Ms. McCulley REVIEWED BY:
BACKGROUND:
The Board heard this site plan on appeal by adjoining landowners at its September day
meeting. The Planning Commission had approved the site plan and granted two waivers. The
Board did not grant waiver of sound level limitations of the Zoning Ordinance.
DISCUSSION:
Presumably, the request for reconsideration is related to the sound level limitations. No
new information has been submitted. Staff can provide no new comment on or analysis of the
matter. Dependent on the nature and extent of information which may be submitted at some
future date, it may take staff some time to evaluate. (There may be need to retain a
consultant to advise the Board and staff as to technical issues.)
RECOMMENDATION:
Waiver requests/relief of conditions of approval are processed through a standard procedure
(i.e. - site plan schedule) together with a specific fee. Staff would recommend that this
established procedure be followed in this case. Along with the application and fee, the
applicant should submit all information intended to be presented to the Board to ensure
timely review.
Should the Board choose to deviate from this standard procedure and initiate reconsideration
through its own action, staff would recommend that: (1) Adjoining owners be notified; (2)
The Board take action to set aside the fee.

RE: Boar' s Head Inn Major Site Plan Amendment
Dear Amelia:
This letter is to summarize the meeting we had last Friday,
regarding the referenced site plan and the Board of Supervisors '
action taken on September 1, 1993 . We understand that the Board of
Supervisors reversed condition 1 (b) of the Planning Commission's
decision of July 20, 1993 for SDP-93-019 . Pending a resolution of
this issue, either through a further appeal or by our completion of
the current conditions of the site plan, we propose that the Boar's
Head Inn move forward with events which were already scheduled. As
we discussed, the events were contracted for prior to the
Supervisors' decision. A copy of those scheduled events is
attached to this letter. Enclosed are copies of the contracts for
upcoming tent events.
We also discussed the possibility of requesting the Supervisors '
reconsideration of its decision on SDP-93-019 . Please consider
this our request for such reconsideration and advise us if this may
not occur within say the next sixty days. If we need to formally
advise the Clerk of the Board, please let us know. Once we have
had an opportunity to consult with our planner and our Board. of
Directors, we will let you know our disposition on the site plan
for the new site. We will, of course, continue to seek the support
and cooperation of our neighbors in the meantime.
