Subject: SUB202100070 CARTER MOUNTAIN SUBDIVISION - RURAL SUBDIVISION
The County of Albemarle Planning Division will grant or recommend approval of the plat referenced above once
the following comments have been addressed: [Each comment is preceded by the applicable reference, which is
to the Subdivision/Zoning Ordinances unless otherwise specified.]
1. 114-302 (A)(4), 14-302 (A)(5), and 14-303 (L)] Please include any instrument reference for Carters
Mountain Rd. This comment has been addressed.
2. [14-302(B)] Please clarify the Zoning information in Note 2 to state that the property is zoned "Rural Areas."
This comment has been addressed.
3. [14-309 & 14-310] Soil evaluations & Health director approval of septic systems. Please provide the soils
evaluations for the proposed lots. This information will be reviewed by the Health Department and Health
Director approval is required prior to final plat approval. Please provide the location of the primary and
reserve drainfield on each proposed lot to be submitted to the Health Department for review. This
information was sent to VDH on 6/14/2021. Their review is pending. Comment addressed.
4. [14-308.1] A Tier II Groundwater Assessment has been initiated for this application. Results of the
assessment will be forwarded to the applicant once it is completed. The Tier II Groundwater Assessment
is attached below for your reference.
5. [General Comment] Please revise the numbering of the notes on Sheet 1. Number 5 appears twice on two
separate notes. This comment has been addressed.
6. [14-302(A)] According to the Plat recorded in Deed Book 4016 pages 674-679 this parcel contains five (5)
development rights. In order to create this subdivision each proposed lot will need to be allocated at least
one (1) development right. Since four (4) lots are being created that are all less than 21 acres, four (4)
development rights are being used. There are 5 development rights total. So, the remaining or leftover
development right needs to be allocated to one of these proposed lots, or it can remain as unassigned and
the future property owners can determine where it gets allocated at a future date. This additional
development right could theoretically be used to add an additional dwelling or further divide one of these
proposed parcels in the future. Please update Note 9 on Sheet 1 accordingly. This comment has been
addressed, but please revise for clarification purposes. Proposed wording for Note 10 on the plat is
below:
a. Parcel 1 was assigned 5 Development Rights (DB 4016 PG 678). Lot 4 is hereby assigned
two (2) development rights and may be further divided. Lots 1, 2, and 3 are hereby assigned
one (1) development right each and may not be further divided. Comment addressed.
[14-303(0)1 Please provide a signature panel for the "Agent for the Board of Supervisors." Include a
signature line, date, and a statement that this has been approved for recordation. This comment has been
addressed.
8. [14-302(B)l Albemarle County GIS data suggests that the property is not within the Water Protection
Ordinance Stream Buffer or Flood Plain. Please revise Note 7 on Sheet 1. This comment has been
addressed.
9. [14-302(B)l Albemarle County GIS data indicates that this property is not within an Ag/For District. Please
revise Note 11 on Sheet 1. This comment has been addressed.
10. [14-302(B)l Please add a date of last revision. This comment has been addressed.
11. [14-302(A)l Please revise Note 8 to say that Lots 1 thru 4 of Tax Map/Parcel 10200-00-00-03700 each
contain a building site that complies with Section 4.2.1 of the Albemarle County Zoning Ordinance. These
lots are essentially taking the place of Parcel 1 so there is no need to have that reference in this note, and
there is no residue. Comment addressed
