Edwards, CLA McKee Carson 301 East High Street Charlottesville, VA 22902 RE: White Gables Parking Modification Request SDP-2003-34 White Gables Phase One Final Site Plan Dear Mr. Edwards: You have requested a modification of section 4.12.4 (a) which provides that the number of parking spaces in a parking area may not exceed the number of spaces required by this section by more than twenty (20) percent. A copy of the request is enclosed. The White Gables final site plan for Phase One, dated April 28, 2003, shows Pavilion I and Pavilion III. Each of these buildings contains 10 dwelling units and 21 parking spaces. The plan also shows 28 spaces arranged along the road. We understand that 20 of the 21 spaces provided within the structures are assigned to particular tenants. Taken together, Pavilions I and III require 40 assigned tenant spaces and 5 guest spaces for a total of 45 spaces. The plan shows a total of 70 spaces in this phase. Section 4.12.4 (a) limits the maximum number of spaces to 54. The modification of this section is approved for the additional 16 spaces to be built in Phase 1. We agree that it is reasonable to build the 28 spaces in this phase as part of the construction of the road. This approval is also based on the understanding that the number of parking spaces that are provided at the completion of this project will not exceed the number of required spaces by more than twenty percent. Your request to modify section 4.12.6 to allow assigned parking within the buildings without requiring the provision of guest parking is not approved. In light of the approval of excess parking in Phase one, this request is not seen as necessary. Please contact me if you have questions or require further information. The plans dated April 28,2003 show a total of forty-two(42) tenant spaces with an additional twenty-eight(28) spaces reserved for guest parking.These numbers represent(at the time of final build-out) the gross total for the project.In your initial comments dated,May 19,2003,comment 8 states,"The ordinance now requires that the number of parking spaces that are provided may not exceed the number of spaces that are required by this section by more than twenty(20)percent.The parking shown on the entire site meets this standard.However,in Phase 1, 40 spaces are required and 70 spaces are provided a difference of 75%.” In an effort to complete as much of the project as possible in the first phase,thereby causing minimal disturbance in future phases,we have proposed to construct the entire underground infrastructure,most of the landscaping, and the pavilions,only the proposed guest parking will need to be incorporated into Phase 1,because it is an integral part of the,driveway and stormwater management facility.The additional parking required for each pavilion will be made available as each pavilion is built, thereby reducing the overall parking ratio as the project gets closer to final build-out. Therefore,we respectfully request a modification be granted to the White Gables project that will allow the plans to be implemented as shown in the plans (Phase 1)submitted on April 28,2003 for Phase 1.In addition,we also request that the parking shown inside Pavilions I and III be considered assigned parking without enforcing the guest parking(1 guest per 4 units)condition at this time.Should this not be acceptable,we would he willing to delay assigning these spaces until such time Phase 2 is complete;however,we would insist that although the spaces themselves are not assigned,each space would be available only to the tenants in each of the pavilions in which they reside.
