Acreage: (43.142 acres total) 41.262 acres in Rezone from: NA Albemarle County, 1.88 acres in Fluvanna Special Use Permit for: NA County. TMP: 09400-00-00-02200 By-right use: Rural Area. Location: Union Mills Road (State Route 616) approximately 240 feet south from the intersection of Union Mills Road (State Route 616) and Woods Edge Road (State Route 623) on the Albemarle/ Fluvanna County Boarder. Magisterial District: Scottsville. Proffers/Conditions: No Proposal: Addition of a fourth dwelling on Requested # of Dwelling Units: One (1) the property. additional dwelling. Currently three (3) dwellings exist on the property DA (Development Area): No Comprehensive Plan Designation: RA (Rural Area): Yes Rural Area 4. Character of Property: The property is Use of Surrounding Properties: Scattered developed with three dwellings, a shop, residential uses. accessory structures and agricultural buildings. Factors Favorable: Requiring a full site plan Factors Unfavorable: None. does not forward the purpose of the ordinance or otherwise serve the public interest. RECOMMENDATION: Staff recommends approval. STAFF COMMENT: This is an application for site plan waiver approval. These requests are reviewed in accord with Chapter 18, Section 32.2.2 of the County Code which states: I 322.2 The foregoing notwithstanding,after notice in accordance with section 32_42.5,the commission may waive the drawing Of a site plan in a particular case upon a finding that the requirement of such plan would not forward the purposes of this chapter or otherwise serve the public interest: provided that no such waiver shall be made until the cone icsion has considered the recommendation of the agent. The agent may recommend approval,approval with conditions,or denial of such waives In the case of conditional approval,the agent in his recommendation shall state the relationship of the recommended condition to the provisions of this section_ No condition shall be imposed Which could not be imposed through the application of the regulations of section 32.0. (32_2.2,1980;Amended 5-1-87) The site review committee has reviewed this request and is able to support the request. No conditions are needed and no public comment was received on this application. Based on the recommendations of the site review committee and the limited work required to establish this use the agent recommends approval of this waiver request. ATTACHMENTS: A. Vicinity Map B.
