RECOMMENDATION: Staff recommends approval of both the final site plan, and the requested critical slope waiver, with the following conditions: 1. Administrative approval from County Engineering staff, 2. Approval of Department of Environmental Quality permit, 3. Submission and administrative approval of Groundwater Assessment paperwork, 4 Approval from Virginia Department of Transportation staff 1 STAFF CONTACTS: Summer Frederick—Senior Planner; Jonathan Sharp- Engineer PLANNING COMMISSION: March 11, 2008 AGENDA TITLE: SDP2007-155 Shadwell Market PROPERTY OWNER: Lloyd Wood, Jr. APPLICANT: McKee Carson APPLICANT'S PROPOSAL: Request for final site plan approval to construct new service station and convenience store with associated gas pumps and parking on 1.180 acres (Attachment A), and approval of a critical slope waiver in conjunction with grading required for proposed development. PLANNING AND ZONING HISTORY: 1. SDP1989-73: Action allowed for the construction of gas pumps as an addition to existing food store. 2. ZMA2002-9: Action allowed rezoning of 0.5 acres from RA Rural Areas to C1 Commercial to allow installation of a stormwater detention/quality facility and a septic drainfield for the commercial use located across US 250 on the same tax map/parcel COMPREHENSIVE PLAN: The Comprehensive Plan designates this property as Rural Area in Rural Area 2. REASON FOR PLANNING COMMISSION REVIEW: The subdivision has been called up by a Planning Commission member, and the applicant has requested a modification to allow disturbance of critical slopes. DISCUSSION: The proposed site development is in the rural area [Attachment B] and is subject to the review requirements contained in Section 18-32.6 of the Zoning Ordinance. The plan has been reviewed by the site review committee and has been found to meet all of the requirements of this section of the ordinance A modification to allow critical slopes disturbance is necessary before the applicant may begin grading for the project. The request for a modification has been reviewed for both the Engineering and Planning aspects of the critical slopes regulations. Section 4.2.3.2 of the Zoning Ordinance restricts earth-disturbing activity on critical slopes, while Section 4.2.5(b) allows the Planning Commission to waive this restriction. The applicant has submitted a request and justification for the waiver(Attachment C),and staff has analyzed this request to address the provisions of the ordinance. Review of the request by Current Development Engineering staff: Section 4.2.5(a) Description of critical slope area and proposed disturbance: The existing critical slope area on the site consists of a steep slope and scrubby vegetation adjacent to the parking area for the existing gas station. The slopes appear to be man-made, and this has been confirmed by the applicant. There is no previously approved site plan showing the construction of the man-made slopes; thus, the critical slopes on site are not exempt. The applicant is proposing a parking area, gas station building, and associated grading within the critical slope areas. Areas Total site 1.1 acres approximately Critical slopes 600 sq ft 1% of site Critical slopes disturbed 600 sq ft 100% of critical slopes Below, each of the concerns of Zoning Ordinance section 18-4.2 is discussed. Compliance with Zoning Ordinance 18-4.2: 2 "movement of soil and rock" Proper slope construction, control of drainage, and vegetative stabilization will prevent any movement of soil. "excessive stormwater runoff' The proposed development has a decrease in impervious area and in turn a reduction of stormwater runoff. "siltation" Inspection and bonding by the County will ensure siltation control during construction. Proper stabilization and maintenance will ensure long term stability. "loss of aesthetic resource" The critical slopes on site appear to be man-made The proposed grading plan appears to be an improvement compared to the grading currently on site. "septic effluent" Disturbance of the proposed critical slopes will not cause septic effluent to travel further. Exemptions to critical slopes waivers for driveways, roads and utilities without reasonable alternative locations: The disturbed critical slopes are not exempt(see explanation above under the description). Based on the above review, Engineering recommends approval to the critical slopes waiver. Review of the request by Current Development Planning staff: Summary of review of modification of Section 4.2: Section 4.2 5 establishes the review process and criteria for granting a waiver of Section 4.2.3 The preceding comments by staff address the provisions of Section 4.2.5(a). Staff has included the provisions of Section 4.2.5(b) here, along with comments. The critical slopes in question appear to be associated with the construction of SR 250, and possibly previous on- site grading. If a site plan clearly depicting the creation of these slopes had been approved by the County, work causing the slope's disturbance would be exempt from Section 18-4.2.3 requirements. The County has no record of such a site plan. Additionally,grading associated with the proposed critical slope disturbance is required for proposed alterations and improvements to the site's ingress/egress,and proposed alterations to SR 250. These proposed alterations would result in safer, more convenient site access than is currently in place. RECOMMENDATION: Based on the above review, and in conjunction with Engineering staff's recommendation, Planning staff recommends approval of both the final site plan, and the requested critical slope waiver, with the following conditions. 5. Administrative approval from County Engineering staff, 6. Approval of Department of Environmental Quality permit, 7. Submission and administrative approval of Groundwater Assessment paperwork, 8. The proposed site plan for Shadwell Market seeks to impact locations of existing critical slopes. These impacts are proposed within areas where existing critical slopes are the result of previous mass grading rather than natural areas where no previous development has occurred. The critical slope areas have been shown on the Existing Condition Sheet of the submitted plan on January 22, 2008. Description of critical slope area and proposed disturbance Of the 1.1 acres that encompass the site,there are approximately 610 sf(0 014 AC) of critical slopes. These critical slopes areas are within the limit of disturbance.The proposed disturbance is fill around the critical slope areas.This will help in stabilizing the existing topography and further improve the erosion problems on-site. In fact,the proposed fill around the critical slope areas will stabilize the topography and improve the erosion problems on-site. "Excessive stormwater runoff' and"siltation" The proposed development has less impervious area compared to the existing condition. This will reduce the total stormwater runoff from the site. "Loss of aesthetic resource" The areas of critical slopes are not currently considered an aesthetic resource.
