7 STAFF PERSON: YOLANDA HIPSKI PLANNING COMMISSION: MAY 12, 1992 , SDP-92-017) BOAR'S HEAD INN SPORTS CLUB MAJOR AMENDMENT Proposal: The applicant is proposing to locate three tennis courts to be enclosed with a "bubble" structure for not more than six months of the year on 9.85 acres zoned HC, Highway Commercial and R-1, Residential (see Attachment A) . Reason for Planning Commission Review: Major amendment to a site plan; modification of 4.2.3 .2 to allow grading activities/building on slopes of 25% or greater. Location: Property, described as Tax Map 59D(2) , Section 1, Parcel 15, is located at the southeast quadrant of Wellington Drive and Berwick Road and behind the existing sports club in the Boar's Head development (see Attachment B) . Architectural Review Board Status: The Design Planner for the Architectural Review Board (ARB) has determined this proposal will not be visible from Route 250W. Therefore, Architectural Review Board review of the site plan is not required. STAFF COMMENT: The Zoning Administrator has reviewed this use for conformance to the Zoning Ordinance and determined this improvement to be allowable under nonconformity provisions (see Attachment C) . The applicant requests a modification of Section 4.2. 3.2 of the Zoning Ordinance to allow earth disturbing activities on 25% or greater slopes (see Attachment D) . The Engineering Department has reviewed this request and supports approval (see Attachment E) . In staff opinion, there should be no detrimental affect on aesthetic resource created by this modification. The slope is not visible from adjacent residential properties. Staff opinion is this preliminary site plan is consistent with the Zoning Ordinance regulations and recommends approval subject to the following conditions: RECOMMENDED CONDITIONS OF APPROVAL: 1. The Planning Department shall not accept submittal of the final site plan for signature until tentative 1 _ t approvals for the following conditions are obtained. The final site plan shall not be signed until the following conditions are met: a. Department of Engineering approval of grading and drainage plans and calculations; b. Department of Engineering approval of ..stoxmwater detention plans and calculations; c. Department of Engineering issuance of an erosion control permit; d. Staff approval of landscape plan. 2. Administrative approval •f final site plan. 3 . A Certificate of Occupancy shall not be issued until the following condition is met: a. Fire Official approval. History: (SDP-047) Boar's Head Inn Site Plan - Proposal to locate a sport club. (SDP-78-023) Boar's Head Inn Site Plan - On August 22, 1978, the Planning Commission approved a proposal to add a 97 hotel/motel room, 2, 500 square feet dining room, and 106 parking spaces. (SDP-85-001) Boar's Head Inn - Gift Shop Addition - On February 12, 1985, the Planning Commission approved a site plan addition to the existing gift shop. Comprehensive Plan Recommendation: Urban Neighborhood 7. This site is located in a designated growth area. School Impact: N/A Environmental Conditions: This site is not within a watersupply watershed area. This site contains areas of critical slope which were the results of previous grading areas. Utilities; Fire Protection: Required fire flow is 1,500 gpm at 20 psi. The ISO required fire flow is 1,850. The Deputy Director of Inspections has consulted with a Battalion Chief 2 r . of the Charlottesville Fire Department who indicated that given the fire load, a fire flow of 1,500 gpm is acceptable. Therefore, the Inspections Department has revised its original fire flow requirement to 1,500 gpm. Stormwater Detention/Runoff Control: On-site pond. Approval subject to Department of Engineering approval of stormwater detention plans and calculations and Engineering Department issuance of an erosion control plan. Transportation: No comment. Because tennis courts and parking currently exist on this site, the non-conforming use has been established on this site prior to the submittal of this site plan. The proposed tennis court does not encroach within the setback lines required in this zone, therefore the non-conforming use can be expanded to include the proposed tennis courts and temporary air structure. Please note that the slopes in question are existing man-made slopes established to facilitate an earlier plan for a different structure. The intent of Section 4.2 of the Albemarle County Zoning Ordinance is that by limiting construction on 257. slopes, the potential deleterious effects of such construction may be circum- vented. The concerns expressed in the ordinance relate to this project as follows: 1) Increased Potential for Soil Erosion and Sedimentation Slopes of up to 2:1 (507.) are standard in construction of this sort. 2:1 slopes are the accepted maximum slope for erosion control measures requiring embankments found in the Virginia Erosion and Sedimentation Control Handbook, latest edition, as well as cut and fill slopes for VDOT roadways. The control of soil erosion and sedimentation is a primary concern for development and the recommended measures are carefully installed and closely inspected for integrity. Pursuant to County policies erosion and sedimentation con- trols will be maintained and bonded until stabilization has been assured as determined by the Albemarle County Department of Engineering. The potential for erosion is obviously greater for steep slopes than if they are graded for someone's yard. In this case, steeper slopes are being replaced by more easily maintained slopes of a lesser grade. • Yolanda Hipski March 31, 1992ATTACHMENT D Page 1 -- —__ Page,2 2) Water Pollution. Because of the urban location and characteristics of, this site, the increased potential for water pollution associated with steep slopes will not be affected by construction on the 25% slopes. 3) Septic Disposal Problems As ;public sewer is utilized, this concern is not applicable for this site. 4) Rapid and/or Large Scale Movement of Soil and Rock. The extent and location of grading indicates that final stabilization at a 3:1 slope should pose no problem with regards to large scale soil' and rock movement. 5: Excessive Stor mwater run-off This area is subject to the requirements of the star mwater detention ordinance and therefore facilities will be upgraded as necessary so there will be no increase in run-off. Grading the slopes will have no effect on the amount of run-off. G? Loss of Aesthetic Resource An open field graded for a future structure is not an aesthetic resource. Section 4.2 of the Albemarle County Zoning Ordinance provides for public protection from the adverse effects of construction on 251 or greater slopes. Construction consistent with sound engineer- ing and design practices on this site will not accentuate nor create the deleterious effects possible by construction on steep- ly sloping lands. The existing man-made slopes will be laid back such that they will easier to maintain. Waiver requests on critical slopes have been supported previously in holding with Section 4.2.5.1 which allows the Commission to grant a waiver provided that "such modification is consistent witP sound engineering and design practice and that the public interest and the intent of this section would be served to at least an equivalent degree by such modification." It is my understanding that ACSA did determine a fireflow of 1,750 gpm at a fire hydrant near the proposed tennis complex. However, this was not the nearest hydrant. (Although it was the closest one which they felt comfortable about testing. ) The required fireflow of 1,850 gpm @ 20 psi is only required at the hydrant within 400' of the proposed tennis enclosure. It is my understanding that the flow found at 'the tested hydrant does not necessarily represent the maximum flow available in that water system. Before a waiver request is considered, it is suggested that the applicant be asked to provide engineering calculations, based on ACSA's findings, showing the maximum water availability at the required hydrant, which is currently nonexistent. 2 . The ISO guidelines, which are used to determine fireflow requirements, are based on the size, and construction materials of a building. The occupant load is not a consideration. It is my feeling that hydrant fireflow requirements are not intended to address life safety as much as they are intended to provide a tool with which firemen can strive to save a building. , 3 . It is understood that the tennis enclosure will be constucted of materials that comply with the building code.
