JANUARY 4, 1971
The Albemarle County Planning Commission met on
January 4, 1971 in the County Court House at 7:30 P.M.,
Charlottesville, Virginia.
Present were: Dr. Avery Catlin, Chairman, David
Carr, Vice -Chairman, Louis Staley, James Parks, Dr. James
Sams, Henry Page and Cecil Maupin. Also attending was
Mr. Lloyd Wood.
Judge Savory Amato was absent.
The Secretary established that a quorum was present.
The minutes of December 14,1970 meeting were approved
as submitted.
At this time the chairman called for the Public
hearings.
A. ZMP-149. Phillip & Mary Beasley Estate. To
rezone 3.49 acres from A-1 Agricultural to
RS-1 Residential. Property is located on Route
29 North across from the Hacienda Motel, and
described as County Tax Map 46, Parcel 14.
Rivanna Magisterial District.
After the conclusion of the presentation by the
staff and applicant the Planning Commission by unanimous
vote, deferred action on ZMP-149 until the meeting of
January 18, 1971 to determine compliance with the
County Lane Use Plan.
B. ZMP-150. H. C. Keller and W. W. Ross. To
rezone 1.36 acres from A-1 Agricultural to B-1
Business. Property is located in the southeast
corner of the intersection of Routes 53 and 795,
and is described as Tax Map 92, Parcel 47B.
Scottsville Magisterial District.
The staff presented their report suggesting denial
of the request. Mr. Sprouse and Mr. H. C. Keller presented
the petition for the rezone. Mrs. Ellen Nash, Attorney
representing certain land owners in the area spoke in
oppostiion. The staff presented three letters in oppo-
sition to the request.

After a discussion Mr. Carr made the following motion
seconded by Dr. Sams, that ZMP-150 be denied as being
incompatible with the area and not in keeping with the
Comprehensive Plan as proposed. The motion was carried
unanimously. Mr. Maupin had motioned for a deferral,
which failed for a lack of a second.
C. Special Permit 89. Mamie Dunbar. To locate
two mobile homes in an A-1 Agricultural zone.
Property is located in Blue Ridge Acres off
Route 690 and described as Tax Map 69A, Lots
50 and 51. Samuel Miller Magisterial District.
The staff presented their report. Mr. & Mrs. Dunbar
were in attendance. A Mrs. Foshed appeared in oppostiion,
stating others in the area were also in opposition but
unable to attend. Dr. Lange appeared in opposition also.
After a discussion Mr. Parks made the following
motion, seconded by Mr. Page that S. P. 89 be denied.
The motion was carried unanimously
D. Special Permit 91. Mittie S. Walton. To
locate a mobile home in an A-1 Agricultural zone. Property
is located on Route 601 at intersection with Route 676
and is described as Tax Map 43, Parcel 34A, containing
16.0 acres. Ivy Magisterial District.
This permit was withdrawn prior to the hearing.
At this time Mr. Rosser Payne was recognized and he
presented a summary of the finalized future Land Use Plan,
stating that a copy of the plan would be available
by January 31, 1971, for distribution. He suggested that
public hearing be set early in the year for possible
action. The zoning ordinance (Revised) will be forth-
coming after the adoption of the Land Use Plan.
E. Special Permit 92. John C. Vermillion. To
locate an Antique and Gift shop in an A-1
Agricultural zone. Property is located off of
Route 20 near Key West Subdivision and described
as Tax Map 62, Parcel 32, containing 12.94 acres.

The staff presented their report and Mr. & Mrs. John
C. Vermillion were present. After a discussion Mr. Maupin
made the following motion, seconded by Mr. Parks that SP-92
be approved subject to :
A. a detailed site plan be submitted to the
Zoning office prior to issuance of a
Zoning Permit. The motion was carried
unanimously.
F. Special Permit 93. David Shifflett. To
locate a mobile home in an A-1 Agricultural
zone. Property is located on Route 795 near
intersection with Route 620 and is described
as Tax Map 103, Parcel 55A, containing 13.0
acres. Scottsville Magisterial District.
The staff presented their report. Mr. Shifflett
was unable to attend. After a discussion Dr. Sams made
the following motion, seconded by Mr. Maupin, that SP-93
be approved subject to Health Department approval for
Septic System and a 100 Foot setback from Route 795. The
motion was carried unanimously.
G. Special Permit 94. Loyal Order of Moose,
Charlottesville Lodge No. 1028 Inc,. To
make an addition to the Moose Lodge. Property
is located on Route 250 east and described as
Tax Map 79A(1), Block B,Lot 27. Rivanna
Magisterial District.
The Staff presented their report after which a
representative of the Moose Lodge presented the petition.
After a general discussion Mr. Parks made the following
motion, seconded by Mr. Page that Sp-94 be approved
subject to State Fire Marshal's review and rer-ommenda
tion and Health Department approval. The motion was
carried unanimously.

H. Special Permit 95. John G. Dunn. To locate
a mobile home in an A-1 Agricultural zone.
Property is located on Route 671 near its intersect-
ion with Route 668 and is described as Tax Map 16
Parcel 49, containing 3.03 acres. White Hall
Magisterial District.
The staff presented their report. Mr. Dunn was
unable to attend. After a discussion Mr. Maupin made the
following motion, seconded by Mr. Page that SP-95, be
approved subject to Health Department approval for a
Septic Field.
I. Use Permit 70-04.Mason B. Herring, Lessee of
Cavalier Gulf Station, wishes to amend the
Albemarle County Zoning Ordinance to permit in
the B-1 Business zone, "storage of inoperative
motor vehicles in connection with service station
and related wrecker services". Applicant has
asked that certain restrictions be placed in
the proposed amendment so that the requested use
can be readily distinquished from an automobile
graveyard or junkyard.
A lengthy discussion was held. Mr. Herring and Mr.
Mike Hayden, attorney presented the petition. After the
discussion it was the opinion of the Commission that a
committee be established to review and recommend a course
of action for report to the Commission on January 18, 1971.
Dr. Catlin, Chairman appointed, himself, Mr. Carr, and Mr.
Staley to serve on the committee. Mr. Lloyd Wood was
asked to serve as a representative of the Board of Supervisors.
At this time consideration was given to the following
site plans submitted for approval.
1. Acme Visible Inc. Deferred for additional informatior
until the January 18, 1971 meeting.
2. Cosmopolitan Realty Corporation. " Burger Chief "
The subject site plan was approved subject to:
A. The elimination of the driveway on Route 29
located at the intersection of Greenbrier Dr.

B. The relocation of the driveway on Greenbrier
Drive in a westerly direction.
C. A provision for an internal driveway through the
shown Pedestrian Island steming from the
facility to Route 29.
D. Review and recommendation of the County
Engineer and Soil Conservation Service as
it relates to storm water drainage.
At this time the chairman appointed Mr. Parks,Mr.-
Page, and Dr. Sams to serve on a committee to review the
"Willoughby Planned Community" as to the need for a
potential School site.
There being no further business the meeting was

January 18, 1971
The Albemarle County Planning Commission met on
January 18, 1971 in the County Court House at 7:30 P.M.
Charlottesville, Virginia.
Present were: Dr. Avery Catlin, Chairman, David
Carr, Vice-chairman, Cecil Maupin, Dr. James Sams, Louis
Staley, Henry Page, Savory Amato, and James Parks. Also
attending was Mr. Lloyd Wood.
The Secretary established that a quorum was present.
The minutes of January 4, 1971 meeting were approved
as submitted.
At this time the chairman called for the Public Hearings:
1. ZMP-151. Charles W. Hurt has petitioned the
Albemarle County Board of Supervisors to rezone
6.0 acres from R-3 Residential to B-1 Business.
Property is located in "Westfield Subdivision"
.with frontage on Commonwealth Drive. Property
is described as County Tax Map 61 Parcel 30.
Charlottesville Magisterial District.
The staff presented their report recommending
approval of the request stating that the request complies
with the proposed Comprehensive Plan. After a discussion
the Commission approved ZMP-151 as requested unanimously.
2. ZMP-149. Phillip and Mary Beasley Estate. To
rezone 3.49 acres from A-1 Agricultural to RS-1
Residential. Property is located on Route 29
North across from the Hacienda Motel, and
described as County Tax Map 46, Parcel 14.
Rivanna Magisterial District.
The staff presented their report recommending approval
having found the request in compliance with the proposed
Comprehensive Plan. After a discussion the Commission
approved the request unanimously.
At this time consideration was given to the following
site plans submitted for approval:
1. Lot 1 and 2 Block D. Westerfield Subidvision
The Commission approved the subject site plan
subject to the following:

1. Compliance with the minumum setback from any
Residential zone of 50 feet.
2. Final review by the County Engineer regarding
Storm Drainage.
3. Elimination of driveway located between the
two office buildings.
4. No certificate of occupancy to be issued until
Greenbrier Road is constructed to meet State
Standards to the North property line.
It was noted at this time that the "Willoughby Planned
Community" had been withdrawn. No official word had been
received by the Planning and Zoning Office however.
At this time the Chairman recongnized Mr. Roger Ford
and Mr. Robert Stroud who presented a proposed development
for low income housing in the Esmont-Porters Area requesting
a consensus from the Commission regarding a proposed
"Restricted Road" with a four lot subdivision. After a
discussion the Commission was of the opinion that a
restricted road with the subdivision as proposed was possible.
At this time the Committe studied the Use Permit of
Mason Herring (Storage of inoperative vehicles) presented
its report. Mr. Herring and Attorney Mike Hayden were i6
attendance. After a discussion the following motion was
adopted by a 6-1-1 vote, that Use Permit 70-04 be denied
and that Mr. Herring be given 30 days from January 21, 1971
to remove all inoperative vehicles.
At this time Mr. George Trembly presented a preliminary
proposal regarding a possible restricted road. It was the
consensus of the Commission that the extension of the
existing easement should be 50 feet and no less.
At this time the site plan of Mr. Peter Hallock was
considered involving a "Retail Nursery Outlet." It was
found that the minimum setback in the west line property
line had not been adhered to. It was ascertained that Mr.
Hallock had to comply or seek a variance from the Board of
Zoning Appeals.

February 1, 1971

February 1, 1971 in the County Court House at 7:30 P.M.
Charlottesville, Virginia
The meeting was called to order and a quorum was estab-
lished by the Chairman.
Present were: Dr. Catlin, Chairman, David Carr, Vice -
Chairman, Cecil Maupin, Dr. Sams, Louis Staley, Judge Amato,
Jim Parks, and Henry Page. Mr. Lloyd Wood, Board member
and Mr. Tom Batchelor were also in attendance.
The approval of the minutes of January 18, 1971,
were deferred until February 15, 1971.
At this time the Chairman called for the Public
Hearings:
1. Sp-96. W. A. Pace, Jr. To locate a Mobile
Home Sales Lot in aB-1 Business Zone on prop-
erty containing .566 acres. This property is
described as County Tax Map 61, Parcel 120R,
Charlottesville Magisterial District and is
located on the south side of Route 631 west of
Route 29.
After the staff report and Commission discussion
a motion was made and seconded and unanimously adopted
to approve Special Permit 96 subject to the Site Plan
as submitted and conditioned upon the following:
a. Approval of a two year permit for the proposed
use with a one year renewal provision there
after by the Zoning Administrator, after determ-
ining that the use is not creating a vehicle
safety hazard.
b. Subject to Health Department approval for sanitary
facilities.
C. Subject to Highway Permit for access onto property
from Route 631.
d. Subject to water service being produced by the
County if central water is desired.

2. Sp-97. Clayton Birckhead. To place a mobile
home on 1.0 acres of land zoned A-1 Agricultural.
This property which is located on Route 729 is
described as County Tax Map 105, Parcel 9B,
Scottsville Magisterial District.
After a staff report and Commission discussion
a motion was made and seconded, which was approved unan-
imously, to approve Special Permit 97 subject to the
following conditions:
a. Health Department approval for a Septic Field
System.
b. A minumum fifty (50) foot setback from the
Right -of -Way of Route 729.
At this time the Chairman called for the staff present-
ation of the site plan of the Charlottesville -Albemarle
Vocational Technical School to be located on 16 acres on
Rio Road and the proposal of the School Board to locate
a school in the North Rivanna Community Cluster as proposed.
Mr. Davis of "Davis and McClinton" architects and
representatives of the School Board Staff were present
and assisted the secretary in presenting the two proposals.
After due consideration of the two proposals the
Planning Commission took the following action unanimously.
1. Site Plan -Vocational Technical School: Approval
subject to a deacceleration lane being provided
for inconnection with the one way entrance onto
the School property.
1. School Site in North Rivanna Area: Approval of
the location of a school in the North Rivanna
Community Cluster having found the general
location of the proposed School to be incompliance
with the proposed County Comprehensive Plan.
At this time the commission considered three referrals
from the County Board of Supervisors with the following
action:
1. Blue Ridge Acres Subdivisions -Possible Zoning
Category to releive pressures of Mobile Homes.
The Chairman appointed Mr. Staley, Chairman and
Mr. Carr to a committee to study the referral and
report back to the Commission at its meeting of
February 15, 1971.

2. County Permit System: Possible fee schedule and
additional enforcing agent. The Chairman appointed
Mr. Parks and Judge Amato to study the referral and
report back to the Commission upon completion.
3. Raising of Fowl: Possible amendment to County
Zoning Ordinance to protect adjacent land owners.
The Chairman appointed Dr. Sams, Mr. Page, and
Mr. Wood to study the referral and report back
on the February 15, 1971 meeting.
At this time the staff presented a subdivision plat
involving a 2.03 acre tract located on an abandoned road
(Old Scottsville Road) for Planning Commission approval,
after a general discussion the Planning Commission unanimously
approved the plat of 2.03 acres., property of F. V. Ford
as prepared by Warren Wade, Surveyor, dated 1/26/71.
The secretary at this time informed the Commission of
the showing of a film entitled "Design with Nature" which is
to take place in 'Campbell Hall" at the University of Virginia
on February 8, 1971.

February 15, 1971
The Albemarle County Planning Commission met on
February 15, 1971 in the County Court House at 7:30 P.M.
Charlottesville, Virginia,
The meeting was called to order and a quorum was
established.
Present were: Dr. Catlin, Chairman, David Carr, Vice -
Chairman, Cecil Maupin, Dr. Sams, Louis Staley, Judge Amato,
Jim Parks, Henry Page, and William Roudabush. Mr. Lloyd
Wood, Board Member and Mr. Tom Batchelor were also in attendance,
At this time the chairman welcomed Mr. William Rouda
bush as the new member from Rivanna District.
The minutes of January 18, 1971 and February 1, 1971
were approved as submitted.
At this time the Chairman called for the Site Plan of
Jefferson Towne Apartments -Phase 111, It was noted that
Mr. David Carr did not participate in the discussion and
vote.
The staff presented the plan. Mr, Morris Foster was
representing the development, The plan called for 42 Apart-
ment Units-, 30--2 bedrooms, and 12--3 bedroom units,
After a lengthy discussion Judge Amato made the following
motion seconded by Mr. Maupin which was approved by a 8-0-1
vote that the Jefferson Towne Apartments Phase 111 Site Plan
(Dated February 1971) be approved subject to the following
conditions:
1. Stablization of undeveloped land on Phase 1 of
Jefferson Towne Apartments with the assistance of
the Soil Conservation Service,
2. One entrance onto project (Phase 111) from Common-
wealth Drive, to be placed directly accross the first
entrance onto Phase 1 Jefferson Towne Apartments.
3. Placement of appropriate recreation equipment subject
to approval of the County Planner,
u.. It was noted the City utilities were being used, said
sewer facilities are presently overloaded at the Meadow Creek
Plant,(400,000 per day overload)

At this time the Chairman called for reports from Committees:
I. Blue Ridge Acres - Possible rezoning.
Mr. Staley presented the report of the committee which recom-
mended that RS-1 Residential be considered for the 105 lots in Blue
Ridge Acres and Parcel 52 A of Map 69, and that a soil survey be
conducted relative to the subdivision. Mr. Staley made the report in
the form of a motion, seconded by Mr. Carr. The motion passed unanimously.
2. The Raising of Fowl under the definition of "Agriculture"in
an A-1 Agriculture Zone.
It was noted that Judge Amato did not participate in the discussion
or vote.
Mr. Henry Page presented the Committee report stating that it was
the committees opinion that the use (Raising of Fowl -Chicken Nursery)
was a bona fide agriculture use and should not be restricted. The use
was on a par with the raising of cattle. Therefore, the Committee
recommended no control other than that which already exist. Said
control being under the Health Department and Highway Department. The
report was made in the form of a motion,seconded by Dr. Sams which was
approved by a 8-0-1 vote.
At this time a discussion was held on the Comprehensive Plan as
it relates to Public awareness and input and Planning Commission work
sessions.

March 1, 1971

The Albemarle County Planning Commission met on March 1, 1971,
in the County Court House at 7:30 P.M., Charlottesville, Virginia.
Present were: Dr. Avery Catlin, Chairman; David Carr, Vice -
Chairman; Henry Page; Cecil Maupin; Judge Savory Amato; Dr. James Sams;
Louis Staley; and James Parks.
Also attending was Lloyd F. Wood, Board representative. Mr. William
Roudabush was absent.
A quorum was established and the minutes of February 15, 1971
meeting were approved with the following amendments. Change the last
sentence in paragraph six (6) to read, "It was noted that Mr. David Carr
did not participate in the discussion and did not vote." A second
amendment is found in Page two (2) under Item 2. The opening paragraph
,*NOW should read "It was noted that Judge Amato did not participate in the
discussion and did not vote."
At this time the Chairman called for the Public Hearings:
I. ZMP-153. Henry Browne. To rezone 25.17 acres from A-1
Agricultural to R-1 Residential. Property is located at the
intersection of Routes 663 and 764 Northwest of the Earlysville
Post Office and is described as County Tax Map 31, Parcel 4
Rivanna Magisterial District.
The staff presented their report, stating that the land use proposal
was in keeping with the "Village Concept" for the Earlysville Area as
proposed by the Planning Consultant under the County's Comprehensive
Plan. He further stated that clarification of two statements under the
Residential objectives by Mr. Rosser Payne as found in the Comprehensive
Plan was in order at this time, since they affected the application.
The clarification was relative to lot size and proper sanitary facilities
and the timing of development.
Mr. Henry Browne presented his petition and elaborated on the possible

his petition. Mr. Eade, adjacent property owner, appeared in opposition,
referring to improper access and control of users of the facility.
After a discussion, Mr. Maupin made the following motion, seconded
by Mr. Page, which was approved by a 6-2 vote that SP-100 be approved
subject to the following condition:
I. Internal roads be improved with a dust proof material and
maintained in a dust proof condition.
2. Subject to Highway permit.
3. Health Department approval for sanitary facilities as proposed.
4. Condition Use Permit for Central water supply.
5. Approval of 75 spaces as shown on the submitted site plan.
4. SP-101. Carl D. Graves. Applicant wishes to place a permanent
mobile home on property containing 2.51 acres. Property is
located on Route 635 and is described as County Tax Map 85,
Parcel 18B, Samuel Miller Magisterial District.
The staff presented their report, after which Mr. Graves presented
his petition. After a general discussion Mr. Maupin made the following
motion, seconded by Mr. Staley, which was approved unanimously, that
SP-101 be approved subject to a 50 foot setback from the right-of-way
of Route 635 and Health Department approval for septic field system.
Mr. Dettor had submitted a letter in opposition.
At this time the Staff presented a request for approval of a
plat involving the revision of lot line on the basis of an alleged
error on the part of the surveyor of the original plat.
It was the concensus of the Commission that the matter be deferred
for additional information and reviewed by the County Attorney.
At this time the staff presented the Preliminary Plat for the
extension of Residential development in "Ednam Forest Subdivision".
After a discussion the Commission approved the preliminary plat subject
to the following condition:
1. Proposed sediment control measures while development is taking
place, with the assistance of the Soil Conservation Service.
2. Street Profiles
3. Adequate drainage easements, reviewed by the County Engineer.

residential development.
Mrs. Marvin Rosenblum appeared to contest the request as it relates
to time of half -acre lots under the R-1 Zone and County action on the
request prior to any adoption of the plan.
After a lengthy discussion Mr. Carr made the following motion,
seconded by Mr. Parks, which was adopted by 8-0 vote that ZMP-153 be
recommended for the RS-1 Residential Zone. The Commission was of the
opinion that until such time a Capital Improvement Program set forth the
extension of Public Utilities, the property within the Earlysville Village
Center should be considered for one (1) acre development to prevent
the potential of inadequate and concentrated septic systems.
2. SP-99. L. C. McAllister, Applicant wishes to place a permanent
mobile home on land containing 80.0 acres. Property is located
on Route 614 near the intersection of Route 674 west of White
Hall, and is described as County Tax Map 26, Parcel 14,
White Hall Magisterial District.
The staff presented their report, after which Mr. McAllister pre-
sented his petition stating that it was his intent to build a permanent
standard dwelling over the next two years and that the mobile home would
be temporary thereto.
A Mr. Bishop appeared in opposition and represented one other land-
owner in the area.
After a discussion Mr. Amato made the following motion, seconded
by Mr. Carr, which was approved subject to Health Department approval for
septic field, 300 feet setback from Mormans River and that the permit be
granted for a period of twelve (12) months, renewal administratively for
an additional twelve (12) months period only.
3. SP-100. Melvin T. & Anne H. Dixon. Applicant wishes to locate
a campground on Route 605 on property containing 270 acres.
Property which is north of Earlysville and is described as
County Tax Map 20, Parcel 5A, Rivanna Magisterial District.
The staff presented their report, after which Mr. Dixon presented

4. Perculation test on all lots
The Commission waived the maximum length of Cul-de-sac for Ednam
Place and Richwood Place. The Commission approved the extension of a
restricted road system with the proposed Ednam Forest Subdivision as
shown on the preliminary plat dated February 10, 1971, as prepared by
R. 0. Snow, Surveyor.
At this time consideration was given to a preliminary site plan for
a warehouse complex on Route 742, Avon Street extended.
The concensus of the Commission was that a more detailed site plan
be submitted showing access onto property, topography, parking area,
loading and unloading area, and a landscape plan.
The Chairman previously had recognized Mr. Rosser Payne, Planning
Consultant, who presented the Comprehensive plan formally and assisted
the Commission in discussing possible work sessions. After the discussion
it was the concensus of the Commission that plans should be made to
provide for work sessions on each Monday through April 1971, at 7:30 P.M.
with other sessions held in afternoon at 3:30 P.M. Mr. Payne is to
assist the Commission in its sessions.
After a discussion on public involvement led by Judge Amato, the
Chairman allotted the membership to different areas of the County to
obtain public feed back to the Commission. The areas and membership
involved are found below:

At this time the Chairman called for items of Old Business. The
_- Chairman recognized Mr. Humphrey who proposed that the Commission consider
an amendment to the County subdivision ordinance to delete all references

made to the City Planning Commission and City Council.
A discussion followed during which time Mr. Tom Conger, City Planner,
voiced his opposition with great exhuberance.
At the termination of the discussion it was the concensus of the
Commission that a meeting with the City Planning Commission to discuss
problems within the three mile area of the City, as it relates to problems
of the development was in order with the two different sets of standards -
the City of Charlottesville and the County of Albemarle subdivision
standards.
A report is to be made to the Commission on March 15, 1971, during
a regular meeting.

PLANNING COMMISSION MINUTES
The Albemarle County Planning Commission met on March 15, 1971, in the
County Court House at 7:30 P.M., Charlottesville, Virginia.
Present were: Dr. Avery Catlin, Chairman; David W. Carr, Vice -Chairman;
Henry Page; Cecil Maupin; Judge Savory Amato; Dr. James Sams; Louis Staley;
James Parks; and William Roudabush. Also attending was Lloyd F. Wood.
A quorum was established and the minutes of March 1, 1971, were approved
as submitted.
At this time the Chairman called for the Public Hearings:
1. SP-95. John G. Dunn. To locate a mobile home in an A-1
Agricultural zone. Property is located on Route 671 near its
intersection with Route 609 and is described as Tax Map 28,
Parcel 23A, containing 6.0 acres. White Hall Magisterial
District.
This is to be heard by the Board of Supervisors on April 15, 1971.
After a discussion by the Commission noting that legal notices had not
been made via Certified Mail, but did contact and receive one letter from
one adjacent property owner which was submitted. An amendment motion was
made by Mr. Maupin, seconded by Mr. Parks.
SP-95 was approved by a unanimous vote subject to a letter being submitted
to the Zoning Office prior to the hearing by the Board of Supervisors, from
Mr. Dunn's brother, stating no opposition, subject to annual review by the
Zoning Administrator, subject to Health Department approval for septic system,
and subject to a 100 foot setback from Route 671.
2. CUP-145. County of Albemarle. A public hearing will be conducted
to consider "Phase III and Phase IV" of the "North Rivanna River
Water Facility" which involves two (2) 700,000 gallon steel storage
tanks with appurtenances, approximately 15,600 lineal feet of water
line. One water line is to be extended from Montvue Subdivision to
a storage facility on Still House Mountain, and a second water line
extending from an existing line located on Route 29, North, westerly
to Piney Mountain to a second storage facility. Plans for the above
items and their exact routings are available for review in the
office of the County Engineer, Room 400, County Office Building,
Charlottesville, Virginia.

The staff introduced Mr. J. Harvey Bailey who presented the petition and
elaborated on the County's proposal. After a discussion Mr. Amato made the
following motion, seconded by Mr. Page that CUP-145 be approved subject to the
following conditions:
1. that the two tanks as proposed not exceed 34 feet in height.
2. that the two tanks be painted with a suitable color to assist in
screening the two facilities from view.
3. that acceptable,suitable size evergreens be planted to supplement
the existing tree cover and to take advantage of existing cover to
to assist in further screening of the two tanks.
The motion was carried by a unanimous vote.
At this time the staff presented a request from Mr. Ray Jones, Executive
Director, Albemarle County Service Authority, for a review of the Authority's
proposal to extend an 18 inch sewer line from the proposed Powell Creek
Sanitary Sewer Plant to serve a new Elementary School site and adjacent rural
areas. After a discussion the commission unanimously approved the resolution

`r that follows: "The proposal of the Albemarle Service Authority as outlined
at the meeting adhere to and is in keeping with the adopted Plan for Regional
Service for Albemarle as- adopted by the Commission on December 15, 1970".
At this time consideration was given to Site Plans and Subdivisions:
1. Site Plan of lot 2B-3 "University Heights" on Route 250 West -
Service Station, dated March 1, 1971, by Huffman, Foster, and Associates.
Approved as submitted subject to final review by the County Engineer
for proper drainage and County Planner and de -acceleration lane on
Route 250.
2. Site Plan of East Coast Oil Company on Route 29 North, dated
March 4, 1971, prepared by Huffman, Foster, and Associates. Ap-
proval subject to:
1. Review for Plans for sewer and water
2. De -acceleration lane along Route 29 with a width of 10 feet
3. Review of provision for storm drainage by County Engineer and
Communication with adjacent owners to the north to obtain

It was noted that Mr. Roudabush and Judge Amato did not participate
in the discussion and did not vote.
4. Site Plan of Stack House, Incorporated, for the location of storage
and office on land owned by Superior Stone and zoned M-2 Manufacturing.
Approval subject to the provision as presented on the site plan
submitted with the application.
Consideration was given at this time to Subdivision Plats:
1. Plat shown lot 1, a subdivision of the Pauline Cole's property,
dated 3/3/71, by Thomas D. Blue, Civil Engineer and Land Surveyor.
Requesting a 50 foot restricted road; approval as submitted with a 50
foot restricted road serving one lot only as shown on the above
mentioned plat.
2. Preliminary Plat of extension of Greenbriar Heights Subdivision.
Preliminary Plat was approved for lots 1 through 26 and lots 67
through 72 on unnamed 56 foot streets. Remaining area of subdivision
was tabled for detail review since it involves the proposed
Meadow Creek road, as found in the County adopted Major Thoroughfare
Plan. Plat prepared by W. S. Roudabush, Jr.
At this time discussion was held on possible Public Hearing dates on the
Proposed Comprehensive Plan. It was the consensus of the Commission that the
following dates be set for Public Hearings in the area noted below.

2. Crozet Area - April 5, 1971, at 7:30 P.M.

At this time the Chairman reported on a meeting of representatives of
the County and City Planning Commission relative to Subdivision Ordinance
conflicts within the three mile limit around the City of Charlottesville.
A Committee was established to investigate further the problem. Those
serving from the County Planning Commission are Dr. Catlin and Mr. Roudabush.
Contact with the State Highway Department is to be through Culpeper.
The Commission also requested that the County Attorney be requested the
legality of the City imposing its Subdivision Ordinance into the three
mile area.

The Albemarle County Planning Commission met on
April 5, 1971, in the County Court House at 7:30 P.M.
Charlottesville, Virginia.
Present were: Dr. Avery Catlin, Chairman, David
Carr, Vice -Chairman, Henry Page, Dr. James Sams, Judge
Amato, James Parks, William Roudabush and Mr. Lloyd
Wood, Board Member. Mr. Cecil Maupin and Mr, Lewis
Staley were conducting a Public Hearing on the Compre-
hensive Plan in Crozet .
A quorum was established and the minutes of March 15, 1971
were approved as submitted.
The Chairman at this time stated that no public
hearing would be ward after 11:00 P.M. If the Agenda
was not completed on this date, the meeting would be
adjourned until April 12, 1971 at 7:30 P.M. in the
County Court Room.
The Chairman called for the Public Hearings:
1. ZMP-154. Walter A. Young, Sr. To rezone 5.189 acres
from A-1 to R-1 . Property is located on
Beagle Gap Road off of Route 691 in Green
wood and is described as County Tax Map 54,
Parcel 41, White Hall Magisterial Dist.
The staff presented their report. Mr. W. A. Young
presented his petition. After a discussion regarding the
inadequacy of access roads and the past zoning history of
the subject land, Mr. W. A. Young requested that his applic
cation be with -drawn without prejudice. This request for
withdrawal was permitted by the Commission without prejudice.
Evelyn Pace, Jack Earle and Ralph Paddock spoke in opposition.
Ronald Morris appeared in favor.
Mr. Marvin Rosenblum was recognized at this time,
who requested that the Commission consider a moratorium
on rezoning cases until completion of all elements of the
Comprehensive Plan.
2. ZMP-155. Clifford G. And Audrey C. Allen. To rezone
50 acres from A-1 to R-1. Property is located on
Route 250 West near Route 676 and is described as
County Tax Map 58, Parcel 6, Samuel Miller Magisterial

Mr. William Roudabush excused himself from the dis-
cussion and from participating in the vote.

of the request, Mr. Louis Martin presented the petition..
A discussion following with primary interest being given
to the whether or not a sufficient central well system
could be obtained to serve the proposed development. It
was the consensus of the Commission that the proper zone
might be RS-1 instead of R-1, but a study was needed to
determine the availability of a sufficient water supply.
Mr. Ray Smith asked for information regarding a
Spring on the property which he had rights to.
Mr. William Colney, resident in Glenaire expounded
on the inadequacy of the existing "Glenaire Water System" and
considered R-1 Zone not compatible as it relates to lot
size or the placement of Septic Systems.
Mr. Martin stated he wishes to develop in keeping
with existing land use. Mr. Allen stated that he did not
intend to develop to the maximum permitted in an R-1 Zone.
After a discussion by the Commission Mr. Amato made
a motion to defer ZMP-155, for a detailed analysis of the
availability of water to serve. Dr. Sams madea motion to
approve RS-1. Dr. Sams subsequently withdrew his motion
and seconded the motion of Judge Amato which passed by a
majority of the members voting.
3. ZMP-156. Cushman Realty and Bldg, Corp. To rezone
95.35 acres from A-1 to R-1. Property is
located on Route 678, 1/2 miles north of Route
250 at Ivy and is described as County Tax
Map 58, Parcel 87, Samuel MIller Magisterial
District.
The staff presented their report, finding the applic-
ation generally in compliance with the Comprehensive Plan
as proposed.
Mr. Fred Landess presented the case for the rezoning.
A discussion by the Commission following during which
concern was shown for regards to serving the proposed
development with a central water supply and the R-1 zone
withits permitted 8,200 Square foot lots with all
utilities available.
A petition was filed by residents of West Leigh stating
that the R-1 Request was notin keeping with existing develop-
ment. They also questioned the water supply asking that it
remain 2 acre development.

Mr. William Colney spoke in opposition because of
the impact on the school. Others in opposition were Henry
Jackson, J. H. Smith, a Mr. Simons, James Saunders, a Mr.
Foster, Jack Hall. They were concerned with water supply and
density. William Workman asked for denial. After a discussion
Mr. Carr made the following motion seconded by Judge Amato
that ZMP-156r be deferred until an analysis as to the
availability of water could be presented for consideration.
The motion was carried unanimously.
4. ZMP-158. Northwest Limited Partnership. To rezone
27 plus acres from R-2 to R-3. Property
is located on Hydraulic Road, 112 miles
west of Route 29 North and is described
as County Tax Map 61, Parcel 45, Charlottesville
Magisterial District.
The staff presented their report suggesting denial and
elaborated on the unadequacy of City Sewer to serve by
virture of some 800 apts units under construction having
already been committed to Meadow Creek Plant which is
already overloaded. When the 800 units are received the
lines east of Route 29 will be overloaded beyound its
peak design flow of 70 MGD (7.4 MGD to be exact)
Mr. William Perkins, Attorney, representing the applicant
presented the petition stating that the City could serve
and there was plenty of capacity left in the City Line and
Plant. Mr. Charles Rotgin also spoke on the petition.
Numerous people appeared in opposition. Justin Logan,
Mr .Scott, DonnaDuchworth, William Murray and John C. Spears.
Mr. Jack Lowe, attorney representing the people in opposition
spoke on the error of zoning the parcel to R-3 and expounded
on why its4Duld remain R-2.
After a discussion Mr. Carr made the following motion,
seconded by Judge Amato, that ZMP 158, be deferred until
a committee of the Commission can fully inspect the property.
The motion was carried.
Dr. Catlin appointed David Carr, Judge Amato and Mr.
William Roudabush, however, the Chairman noted that all
member of the Commission should view the site if possible.
5. SP-106.. Everett Wayne Breeden. To locate a permanent
Mobile Home on property zoned A-1 and located
on Route 676 just north of Route 678 near the
Meriwether Lewis School. This property
which contains 4 acres is described as County
Tax Map 58, Parcel 69C, Samuel Miller Magisterial

The staff presented their report. Mr. Breeden was in
attendance. Mr. David Wood, Attorney representing numerous
property owners in the area spoke in opposition to locating
the mobile home on the property. It was noted that one other
Mobile Home exist on the property. After a discussion Mr.
Parks made the following motion that SP-106 be denied as
being incompatible with the area. The motion was seconded
by Judge Amato and the motion carried by a mojority vote.
The hour now being 11:30 P.M. the Chairman asked for
a motion to adjourn the meeting to April 12, 1971 to continue

and Public Garage on 1.36 acres at the intersection of Routes

Mrs. Nash, Attorney, represented opposition to this request.
Mr. H. C. Ketter and Mr. Sprouse represented the applicants. Persons

After a discussion Mr. Carr made the motion to deny the request as being

Dr. Charles Hurt presented the petition. Mr. Worthington, representing
the Stoney Point Road Citizens Association spoke in opposition alluding to
traffic problems. Aesthetics and over abundance of such facilities presently
existing. Mr. G. R. Pasqual also spoke in opposition.
After a discussion Mr. Amato made the following motion, seconded by

Mr. Maupin that SP-102 be approved suject to the following conditions:
A. That all vehicle travel ways and customer parking area be
graveled and maintained in a condition to prevent dust and mud. V000
B. That a setback be established of 80 feet from the right-of-way
of Route 250 for and display of productions or parking of vehicles.
C. That no flags or pennants be permitted.
D. That a de -acceleration lane be established to minimize potential
areas in collision at this busy intersection of Route 20 and 250.
E. No other access to this property be provided except at the existing
driveway directly across from Route 250.
This permit will be for a period of two years, renewable each
year thereafter.

3. ZMP-159. Ronald R. Morris. To rezone 45.0 acres from A-1
Agricultural to R-1 Residential. Property is located on Park
Road (Route 1204) in Crozet, and is descirbed as County Tax Map

applicant; Mr. Sneed and Mr. Morris also elaborated on the request.
After a discussion relating to facilities that serve the proposed
development, Mr. Roudabush made the following motion, seconded by Dr. Sams,

4. SP-103. Jerome Keys. To locate a private Airport in an A-1
Agricultural Zone located on Route 250, one-third mile west of
the Mechums River Bridge. This property which contains 169.41

After a discussion, Mr. Maupin made the following motion, seconded by

intent to rezone 128.75 acres known as Blue Ridge Acres, from
A-1 Agricultural to RS-1 Residential. Property is located in
the Afton Area with frontage on Route 250 West and Route 796., and
is described as County Tax Map 69A, lots 1 through 105, and Parcel
52 A of Tax Map 69, Samuel Miller Magisterial District.
The staff presented the request after which, Mr. Page made a motion
to approve ZMP-160, seconded by Mr. Carr which was approved by a majority
vote. It was noted that this rezoning did not constitute a precedent
to consider all non -conforming subdivisions for similar rezonings.
8. ZMP-161. Albemarle County Board of Supervisors. By resolution
of intent to rezone 97.43 acres from M-1 Manufacturing to A-1
Agricultural to present the construction of a Community College.
Property is located on Route 742, and abuts I-64 and Lakeside
Subdivision. Property is described as Tax Map 77 E (1)-lB,
Parcel 1B, Charlottesville Magisterial District.
The Staff presented the request. Upon motion by Mr. Carr, seconded
by Mr. Roudabush, ZMP-161 was approved as requested, by a majority vote.
9. CUR-49. Albemarle County Service Authority. To locate a
Sewage Treatment Plant on 15.0 acres of A-1 Agricultural land on
the South Fork of the Rivanna River northeast of the Carrsbrook
Subdivision. This property is described as County Tax Map 46,
Parcel 21, (Portion Thereof), and to locate related sewage lines
from the Albemarle High School Pumping Station on a route taking
it through the Berkeley Community and the Woodbrook, Carrsbrook

Hearing on the Ivy Community Cluster at Murray School.

At this time the Chairman called for the Public Hearings:
1. ZMP-162. Alexander and Mary Jo Rives, Elnora
Brassfield. To rezone 1.0 acres from A-1 to

Mr. Humphrey presented his report stating that the
Village Concept for Cismont would have to be extended to cover
the area of this request and that the RS-1 zoning was
more appropriate in any case, rather than the R-1 Zone,
Mrs. Joan Rives appeared to elaborate on the request,
stating that the one acre tract was to be deeded to a
friend of theirs whom they had known for years. Mr.
Fishburne, attorney representing the applicant stated
that there was fMny division of land in the area of less
than an acre and that the request would be in keeping with
existing character of the area. (ZMP 162presentation
was delayed while the Commission awaited the appearance

on the proposed treatment of effulent. The plant is to
be operated on an extended aeration system utlizing oxygen
to provide aerobic action with a sulfur (Chemical) cycle, r
and is considered a tertiary system. Relating to control
odor Mr. Bailey gave no guarantee of 100% preformation
in the elemination of oder. It depends on the maint-nance
and operation of the Plant as well as what citizens place
into the system. Copper in the system for example would
harm the aerobic activity which would interfere with
proper operation.
After a discussion Mr. Amato made the following motion
seconded by Mr. Maupin that CUP-49 be approved as submitted
subject to suitable screen be provided to screen from view
the Plant facilities as they relate to the adj oing property
to the north of the subject property. The motion carried
unami,ously by those members present.
3. ZMP-163. David J. Wood Jr. To rezone 1.463
acres from R-2 to R-3. Property is located between
Hydraulic Road and Route 29 North on a proposed
extension of Greenbriar Road. Property is described
as Tax Map 61 Parcel 28, Charlottesville Nagisterial
District.
The staff presented their report, relating the request
to the objectives of the Proposed Comprehensive Plan and
existing use in the area. The staff had recommended approval
as requested.
Mr. David Wood attorney and part owner presented the
petition and elaborated on the realtionship of the property
to the school property and that the parcel was involved in
a land swap between the school and Mr. Wood and others.
After a discussion by the Commission Mr. Maupin
made the following motion, seconded by Dr. Sams that
ZMP-163 be approved in keeping with the staff report.
The motion carried by a unanimous vote of those members
present.
4. ZMP-164. David J. Wood Jr. To rezone four parcels
1.942.acres, 1.365 acres, 1.365 acres, and 1.647
acres from R-3 to B-1. Property is located between
Hydraulic Road and Route 29 North of a proposed
extension of Greenbriar Road, Property is described

The staff presented their report on the request relating
to the Commercial objective$�'of th=e"&oposed Comprehensive
Plan and suggesting denial of the request. Mr. David -Wood
presented the petition for rezoning;presented a general,
map of the area, stating that the land was owned by five,
persons jointly, and that the property was bought for a
lot of money. Thought that the County awed him.,so.mething
for putting a road i n , providing for access'"0 the 23
,acre schoolsite and doubling its value. He stated that:.fi'e
had asked -the County to participate in the road but they had
refused. The road would cost 75,000 to: 100,000 doll-ars.
He alluded to Mr. Humphrey.,suggested that he apply for this
rezoning, but backed off >sa ' g. he might of misunder!ft6od.
He spoke on Road network' fose've the area and visualized
their intersection where the -request was located, as a
desirable commercial area and of future benefit to the
County Citizens. He further Stated that there were
ei.irat},t`s to the county involving the road.
Mrs. Rosenblum supported the objectives of the Com-
prehensive Plan as they relate to Commercial Land Use.
Mrs. Martin stated"if you want Citizens to respect
the plan and support it, you must also respect the plan"
The Public Hearing was closed. Mr. Amato suggested
that they forget the disagreement of Mr. Wood and the Planner
and consider the relationship of the four parcels to the
School property and residential area near by. In his
opinion the rezoning would not be compatible with both,
existing and proposed land use and made a motion to deny
the request which was seconded by Mr. Roudabush. Dr. Sams
ask for clarification on the objectives of Commercial
Land Use within the Comprehensive Plan. The staff replied.
The Chairman called for the question. The motion
to deny the request of ZMP-164 was approved by a 5-1 vote.
UP-71-01. Ted T. and Katherine Tucker, have
petitioned the Albemarle County Board of Super-
visors to amend the permitted use section in an
A-1 Zone (Article 2-1) under Authority of Article
11-4 to permit with a Special Permit a "Motor
Sport Park" and related facilities.
At this time Judge Amato excused himself from the
Commission and did not vote on the subject matter. Judge
Amato was in attendance as an interested citizen.

The staff presented their report stating that in
their opinion two zones existing which the Commission could
consider an appropriate for the requested area, the A-1
zone with a Special Permit and the M-2 Zone with a
Special Permit. He stated that the use, with experience under
Court Action had to be placed under a zone within the
ordiance.
Mr. Lewis Chandler, attorney, representing Mr. & Mrs.
Tucker presented the petition stating that the applicants
are working with the youth of the area and had in much a
place where racing could take place off of Public Highways.
There would be safety experts to assist the youth in
providing for proper operation and maintenance of their vehicles.
At this time Mr. Luck was recognized to elaborate further
on the objectives of the "Motor Sport Park" and that it
wasn't a dra strip or race track and that it would be
operated on Sundays and possibly Saturdays.
Mr. Amato representing himself and other adjacent
property owners presented a petition against the location
of such a use in the A-1 Zone, suggesting it should be
placed in a Commercial or Industrial Zone.
Mrs. McFarlin stated that if she wanted all the noise
she would move to the city.
Donna Duckworth stated that there was probably a
need for such a facility but it would be a mistake to open
up all A-1 Zoning at this time.
A gentlemen stated that he objected to increasing traffic
on access road. The whole deal stinks!
Mr. Joe Hearn, resideht of 640 stated you should
hear his neighbors sport car being reved up. Its noisy.
Mr. Tucker stated in rebuttle.
1. He is attempting to fill a need.
2. People were using illegal vehicles on public
highways now.
3. Wouldn't pollute any more than vehicles on Public
Highways.
Mr. Murray spoke against the location of such a
facility in the A-1 Zone. IWO
Mrs. Martin Stated that a good definition was needed
regarding a "Motor Sport Park".
Frank Kelser stated it would tend to establish A-1
Zoning as a Commercial Zone.
Mrs. Rosenblum pointed out the intent of the A-1 Zone
which �s in her opinion did not cover this use.
Mr. George Cason stated that an M-2 Zone was more appropriate.

After a discussion Mr. Roudabush made a motion to
deny the use under the A-1 Category which was seconded by
Dr. Sams. The motion was carried unanimously by those
members participating.
At this time Judge Amato returned to the Commission
to consider the uemirdning agenda.
SUBDIVISIONS:
1. Prelininary Plat-Clearview involving four lots and
a conservation area and restricted road.
Approved subject to the conditions of establishing a
restricted road and for four lots as shown including
the area earmarked for open space and conservation.
Property of Joseph P. Ast and Richard P. Bell contains
67 acres off of Route 676 Parcels A. B. C. D.
2. Final Plat. Property of W. L. Clover in Montvue
Su,6division off of Route 654, dated 12/28/70 by
Machie Engineering and Co. Approval subject to 15
foot easement not being for access to properties and
subject to the 50 foot restricted road be realigned
to afford a better approach to Lots A-1, and A-2 and
A - 3 .
3. Preliminary Plat: 35.46 acres owned by W. E. and J.F.
Bishop showing four lots with access via a 500 foot
restricted road, dated April 1971 by W. S. Roudabush.
Mr. Roudabush excused himself from delikeration and
voting on this matter.
Approved as submitted for restricted road access.
SITE PLAN
A preliminary site plan for Four Seasons Shopping Center
was presented by the staff. It was approved subject to deceleration
lanes being installed with Va. Dept of Highways approval on Route 631
and final utility plans approved by the County Engineer.
OLD BUSINESS:
At this time a discussion was held to clarify the
history of plans submitted by "Greenbriar Heights Subdivision"
extension in views of the fact that the Commission minutes
were not clear on the matter.
It was ascertained that at the meeting of the
Commission held on November 2, 1970 the subdivision plat
showing section three, Block F, Greenbriar Hefights, contain-
ing nine (9) lots were presented for approval by W. S.
Roudabush, Jr. Surveyor. The primary discussion held at

that meeting was related to the improvement of "Chapel
Hill Road", a private restricted road not in the states
secondary system. Mr. Roudabush at the meeting submitted
a Preliminary Master Plan for the Subdivision of additional
land of "Greenbriar Heights" dated October 9, 1970 which
showed lots fronting on the Chapel Hill Road. The minutes
of November 2, 1970 stated that action on Section three,
Block F as mentioned was deferred to ascertain whether or
not, Mr. Forloines should develope a 50 foot R/W Road for
inclusion into the State System if a twenty foot wide strip
was dedicated by those property owners on the north side
of the center line of "Chapel Hill Road". This matter
was brought back to the Commission prior to March 15, 1971
at a regular meeting of the Commission. The minutes do not
relate this second meeting regarding the plan. At
this second meeting the secretary reported that the County
Attorney had informed him thatiftre property owners on
the north side of "Chapel Hill Road" would dedicate the
additional R/W, he could not see why Mr. Forloines could
not developf a road for inclusion into the State System. A
lenghty discussion was held with the following action:
That the Plat of Block F Section be approved provided
that a road acceptable to the State Highway Department was
developed to a point where it would tie into a road already
in the Slate or City System. The Commission considered
that Glenn Drive as shown, on the October 9, 1970 Plat
would meet the condition of approval. They also noted that
if the entire length of Chapel Hill could be developed
for inclusion into the State System, it would be to the
benefit of all concern.
Between this second meeting and the Marchil5, 1971
meeting, numerous meetings between Land onwers on Chapel
Hill Road and Mr. Forloines and his representatives were
held. Mr. Lloyd Wood was also represented at this meeting.
On March 15, 1971 at a regular meeting of the Commission
a new Preliminary Plan for the extension of "Greenbriar
Heights" was submitted for approval as reflected in the
March 15, 1971 meeting. At that meeting it was reported
that an agreement could not be obtained between property
owners on the north side of Chapel Hill Road to met the
condition approval of the Commission relating to Section 3
Block F of Greenbriar Heights. Subsequently the new
Preliminary Plat was approved with lots back onto Chapel
Hill Road.

NEW BUSINESS:
�%W,, A work session was established to consider the comments
and recommendations received during the course of Public
Hearings on the Comprehensive Plan for May 17, 1971 at
7:30 P.M.
At this time the staff submitted to the Commission
copies of the Capital Improvements Program based upon
the needs of the year 2000 Comprehensive Plan.
There being no further business the meeting was
adjourned.

PLANNING COMMISSION MINUTES
May 17, 1971
The Albemarle County Planning Commission met on May 17,
1971 in the Board of Supervisors meeting room, County Office
Building, at 7:30 P.M. in Charlottesville, Virginia.
Present were: Dr. Catlin, Judge Amato, William Rouda-
bush, Cecil Maupin, Dr. Sams, Lewis Staley, Jim Parks,
David Carr, and Henry Page. Mr. Lloyd Wood and Mr. Tom
Batchelor, Jr. were also in attendance. (Board Members)
The Chairman called the meeting to order and a quorum
was established.
The minutes of May 3, 1971 were approved subject to
correction of spelling and wording of some paragraphs.
At this time the Chairman called for the scheduled
items on the agenda.
1. "Lowes" Building and Hardware Company. A site
plan involving the relocation of the above facility
on 250 � between I-64 and Route 20. The Site
Plan was approved as revised with a de -accelerat-
ion lane on Route 250, with individual in and out
drive ways and subject to Health Department approval
for well and septic system, and Highway approval for
drainage.
2. "Hall Bros, Inc." A site plan to relocate an
existing facility in the City to a site on Route
742 to accomodate a "Custom Kitchen Cabinet"
activity. The Site Plan was approved subject
to Highway Dept approval and Health Dept.
approval for well and septic system. It was
noted that common driveways along Route 742
were needed to reduce potential traffic and safety
hazards.
3. Preliminary Site Plan -Albemarle Townhouses. The
staff noted that additional information as
needed on the Site Plan such as; percent of lot
area to gross acreage, building design and offset,
number of parking spaces, acres of open space
inclusive of streets and parking area, visible
play area, flood plain information (Corp. of
Engineers) corner lots to be 40 feet wide and
street names.
The staff noted that the City wishes to impose a 56
foot Right-of-way with a 30 foot Cross-section. The dept.
of Highways states they most likely will not accept roads
into the system. Access is poor.

After a discussion with the applicants, the Chairman
appointed Mr. Parks, and Mr. Roudabush to a committee
to converse with the City Planning Commission and Highway
Department on the matter of Roads and to report back on
June 7, 1971.
4. Preliminary Site Plan-Greenbriar Limited Partner-
ship (Apartments). This site plan involves 138
apts. units on land situated at the intersection
of Route 743 (Hydraulic Road) and Gerogetown Road,
known as the "Peyton Property".
The staff reported and recommended the following
conditions be imposed on any approval.
1. An eighty(80) foot setback for all structures
from the R/W of Route 743 (Hydraulic Road).
2. Close the western most driveway entrance on
Hydraulic Road.
3. Construct a de -acceleration lane on Hydraulic Rd.
in connection with the remaining driveways.
4. Dense screening along Hydraulic Road be established.
5. Allocation of recreation area to a more accessible
area of the project.
6. Receipt of detailed drainage plans on site.
7. Subject to negotiations with the County of Albemarle
for sewer and water service.
The Commission approved the preliminary site plan
subject to the seven (7) conditions as presented by the
staff, unanimously.
At this time the Chairman called for the discussion
on the communication of Mr. Walter Cushman regarding an
amendment to the existing RS-1 Zone to include an approach
to cluster development by reducing the minimum lot size
as found in the RS-1 Zone.
A lengthly discussion followed with participation by
Mr. Cushman. At the end of this discussion a committee was
established to study and report back, on the merits of
clustering in the RS-1 Zone and other residential zones
with density andsite control. The committee members are:
Mr. Staley, Chairman, Mr. Carr, Mr, Page, and Judge
Amato. The motion, to refer to the committee, the request
of Mr. Cushman, by Mr. Page, was seconded by Mr. Roudabush
and was approved by an 8-1-0 vote.

At this time the Chairman asked for a report from
those Commissi".Ors who attended the various public hearings
in connection with the Comphrehensive Plan as' to the
reaction of the general public to the supject plan.
JUDGE AMATO: (EARLYSVILLE ==NORTH ALBEMARLE)
People didn't want to be bounded to the cluster
conclusively as laid out. For example high density
areas would not necessarily have to be located as shown
on the plan maps, etc.
MR. HENRY PAGE: (SOUTHERN ALBEMARLE)
Population influx Number of people thought the plan
would open the door to development and population increase.
Mr. Page was of the opinion that Mr. Payne had answered
and informed the public asto the answers to their concern.
MR. CECIL MAUPIN: (FREE UNION-CROZET)
People were very well satisfied . There was a fear
that the plan would be up held strictly, and no zone would
be granted outside the recommendations of the plan map.
MR. DAVID CARR: (IVY)

People concerned with:—ro. in Ivy, didn't want any
except what exi.,sts. They want to preserve Ivy as a bedroom
community. He sensed that people feel like the picture
drawn is the everlasting situation.
Dr. SAMS: ( SCOTTSVILLE)
Industrial areas on Route 6 should be more approp-
iately located in the "UNIROYAL PLANT AREA". The need
is to maintain the general agricultural environment in the
Scottsville area.
At this point the proposed conservation was discussed
as to how it would become a reality. Mr. Rosser Payne needs
to report further on this implementation of this zone.
MR. ROUDABUSH: (KESWICK-SHADWELL)
People were concerned with retaining agricultural
character. The main concern with two industrial sites,
one on Route 22 and at the I-64 interchange with Route 616.
The people want elimination of the industrial site on
Route 20. Why must growth come? What is to make people
want to live in the clusters? Are we encouraging growth?

Willgrowth support itself? Does the plan automatically
zone the property as shown in the plan? Would defeat of
Bond issue the vast growth? What effect has the plan on
taxes?
JIM PARKS: (CHARLOTTESVILLE AREA)
Route 29 was the major concern of the citizens.
Mr. Parks was concerned with R-3 zone on Route 29 North.
Doesn't think it feasible to locate apartments on high
speed roads. Strip zoning is here to stay
MR. STALEY: ( CROZET)
People wanted name change and location of, after
Village Center removed and placed in Greenwood. Questioned
not showing commercial area north of Railroad in Crozet.
It is shown as one acre development. Four corners at I-64
Interchange. Why is one corner shown for Commercial use.
Most people favor large lots. Is the plan flexible:
At this time the Chairman recognized Mrs Jane Moore
who presented a letter and recommendations rrom the
"Highway Committee" of the "Citizens for Albemarle".
Mrs. Marvin Rosenblum presented a letter and recommen-
dations from the "Master Plan Committee" of the "Citizens
for Albemarle Assoc."
The secretary presented a folder to each Commission
member with the written comments received on the plan at
his office as well as the recommendations from the above
mentioned Committees of the "Citizens for Albemarle".
Mr. Whiteside of southside Albemarle was recognized.
Dr. Sams had reported the wishes of the people correctly.
At this time the Chairman called for the old business.
Mr. Carr and Mr. Roudabush reported on a visit to the City
hearings on revising the Charlottesville -Albemarle thorough-
fare Plan and thought it wise to have a report given to
the County on the implications of the Citys proposal on
the County planning for roads and their improvement.
The Secretary was asked to course a briefing on the action
of Council as to what has been done, as it relates to
the Charlottesville -Albemarle Thoroughfare Plan through
the revision by the city as soon as possible.
The staff presented a status report on an amendment to
the County Code, requested by the Board, relating to
required grading places before any earth is touched.
