The following were present: Floyd Johnson, Chairman William Moore, Vice -Chairman Cecil Maupin, Member David Carr, Member William Perkins, Member Otis Brown, County Executive Phillip Tate, Secretary The meeting was called to order by the Chairman. Items for consideration were presented and acted upon as follows: 1. By Amos Sweet, Surveyor, for David, Horace, Harry and Phoebe Garth, showing parcel A, B, C, & D, division of 231.931 acres off State Route 658 in Albemarle County, Virginia. Upon motion duly seconded, the plat was approved. 2. By Amos Sweet, Surveyor, for Hunter Garth, 106.413 Acre tract into tracts A and B.. South side of State Route 676 in Albemarle County, Virginia. Upon motion, duly seconded, the plat was approved, subject to addition of the "substandard statement". 3. By William Roudabush, Surveyor, for Phillip Wood, showing Lot B ,, to be combined with Lot A of Parcel 51, Tax Map 103, near Slate Mill, Albemarle County, Virginia. Upon motion, duly seconded, the plat was approved. 4. By William Roudabush, Surveyor, for Ralph Miller, showing a division of a tract of land recorded in Deed Book 318, Page 170, into Parcels 1 and 2, on State Route 614, in Albemarle County, Virginia. Upon motion, duly seconded, the plat was approved. 5. By Warren Wade, Surveyor, for Harry Price, showing plat of a one (1) acre tract on State Route 649 near Proffit, Albemarle County, Virginia. Upon motion, duly seconded, the plat was approved. 6. By 0. R. Randolph, Surveyor, for G. H. Robbins, showing 0.14 Acres to be added to 0.41 Acre Parcel on State Route 649 near Albemarle County Airport, shown in Deed Book 261 - 514, in Albemarle County, Virginia. Upon motion, duly seconded, the plat was approved. 7. By O. R. Randolph, Surveyor, for G. H. Robbins, showing the Robbins Subdivision composed of 4 lots and 501 R.O.W. near Albemarle County Airport on State Route 606 in Albemarle County, Virginia. Upon motion, duly seconded, the plat was approved. 8. By 0. R. Randolph, Surveyor, for Grover Forloines and Son, showing plat of Section 1A of Beechwood Subdivision, Albemarle County, Virginia. Upon motion, duly seconded, the plat was approved subject to provision of a "turn- wwwlw rr Page 2 around" on the proposed .limit of Kerry Lane. 9. By Thomas Blue, Surveyor, for Tom Pritchett, showing plat of an 84.76 Acre portion of the Pritchett property located near Watt's Crossing off State Route 600 in Albemarle County, Virginia. Upon motion, duly seconded, the plat was approved, subject to providing a 50 foot R/W to the north and south of the property. 10. By Thomas Blue, Surveyor, for Eloise Yancey, plat of Section One, Tremont Park, A subdivision on U.S. Route 250, near Brownsville in Albemarle County, Virginia. Upon motion, duly seconded, the plat was approved. 11. By T. W. Sanders, Surveyor, for John Smith, showing division of part of John Smith Estate near Esmontion the Warren Road in Albemarle County, Virginia. Upon motion duly seconded, the plat was approved subject to showing 55 foot building set -back line. 12. By Amos Sweet, Surveyor, for Williston Clover, showing pre- liminary subdivision plat of "Glenvue" off Tarrell Road in Albemarle County, Virginia. It was suggested that a second access be provided to adjacent property from the cul-de-sac area. Upon motion, duly seconded, the preliminary was approved subject to further study. A Preliminary Plat for 11�1idway" was presented by'Mr. Walter Cushman. Said plat was thoroughly discussed. The following letter was presented to the Commission by Mr. Cushman: "Albemarle County Planning Commission Albemarle County Board of Supervisors Court Square Charlottesville, Virginia Gentlemen: We present herewith a plan of subdivision of approximately forty acres of a one hundredtwenty-seven acre tract of land, hereinafter referred to as "Midway", adjacent to and encircled on three sides by what is known as the Farmington community (including the land acquired by Farmington, Inc. in 1963 from Mr. Donald Barnes.) We also present a plat showing the access roads to Midway. For more than thirty-five years this access has been over existing roads through Farmington, as shown on the plat. Prior to the.Barnes tract acquisition by Farmington, Inc. and due to Farmington's objection to the use of existing reads through Farmington for the purpose of 'subdividing Midway, Midway attempted to establish and additional or alternate access by virtue of a right of way dating from 1895• The issue was decided by the Virginia Supreme Court of Appeals, which court, while granting unlimited subdivision rights to the subject tract, confined the right of way Page 3 in issue to a width inconsistent with the needs of vehicles passing in opposite directions. From this ruling, so inconsistent on its face, yet made by so distinguished a body, one can only conclude that it was the court's thinking that, since the roads through Farmington already constituted adequate access, a second major access was unnecessary. However, they did determine that the second access does exist, and has existed since 1895. In April of 1965 the owners of Midway requested Farmington, Inc. to alter this access dating from 1895 in a manner to con- form to modern subdivision standards. (Copy of letter enclosed herewith.) There has been no official reply to this request and the owners of Midway now take the position that they are entitled to the unlimited use of the access through Farmington, at least until such time as Farmington, Inc. provides some satisfactory alternate right of way across the land it acquired from Mr. Barnes more than two years ago. Farmington, Inc. purchased the Barnes land with the purpose of subdividing it. Farmington must present any plan of sub- division to your Commission and the Board'of Supervisors, at which time Farmington must show compliance with the subdivision ordinances, including provisions for access. A study of the right of way dating from 1895 will show that there is no con- ceivable way for Farmington to subdivide their newly acquired land %,,, without crossing or connecting with that right of way. It follows that your Commission and the Board of Supervisors can, at that time, impose whatever conditions you think necessary to insure both Farmington's and Midway's accessibility. Midway's value lies directly in its residential development potential. Its owners seek relief in so far as possible from the stigme of inaccessibility imposed, not only by Farmington's unwillingness to cooperate, but by Farmington being excepted from the very subdivision ordinances that are intended to insure the free flow of traffic from one community to another. If these ordinances were enforced as to Farmington's roads, Midway would have no access problem. However, if your Commission and the Board of Supervisors consider Farmington's.roads to be excepted from the application of your Subdivision Ordinances as It to free flow of traffic, it follows that Midway should be granted whatever exception is.necessary to permit its subdivision. `WW In conclusion, we take this opportunity to state that the owners of Midway have no objection to Farmington using, as its own access, the bridge and Midway roads connecting Farmington's newly acquired land to Brook Road, thence to the highway. A study of the enclosed access plat coupled with a knowledge of the topography and existing alternatives will show why this route is probably the best available, both from a present use and as a planning point of view. The Chairman, Mr. Johnson, stated that the entire matter would be given the consideration of the Executive Committee. Mr. Leon Dure stated that he felt the ultimate solution required that Farmington, Inc. provide access to adjoining properties. Upon motion, duly seconded, the plat was approved. 2. Upon motion duly seconded, the plat was approved. 3. By T. W. Sanders, Surveyor, for Ernest Gentry,..showing 1.04 Ac. total (Lot A = 0.82 Ac., Lot B = 0.22 Ac.) land between Yancey Mill and Afton on Highway 250 and Highway 689 (Old Rte. 250), Albemarle County, Virginia. Upon motion, duly seconded, the plat was approved. Iwo 4. By Thomas D. Blue, Surveyor, for Nathan and Rose Porter, showing 2.0 Ac. portion of Portion property on State Route 795 near Blenheim, in Albemarle County, Virginia. Upon motion duly seconded, the plat was approved. 5. By Thomas Blue, Surveyor, for Leroy Snow,.Preliminar-v subdivision of a tract located on State Route 795 near Blenheim, in Albemarle County, Virginia. The Secretary was instructed to, upon field inspection, recommend a location of a 50 dedication P,U from State Route .795 to the Portion property east of said subdivision. Upon motion,duly seconded, the plat was given preliminary approval subject to aforementioned revision in final plat. Page 5 6. By B. Upon motion, duly seconded, the plat was approved. 7. By B. Aubrey Huffman, Surveyor, for Charles Hurt, showing division of Lot 1 into Lots 1-A and Lot 1-B, Block A, Section One, Westfield Subdivision, Route 29 North, Lot 1-B to become a part of individual land for future development and not intended to be a separate lot in its own entirety. Upon motion, duly seconded, the preliminary platting was given preliminary approval. 11. By Michael and Dent, Attorneys, for interested parties of the Greenbrier Corporation and Woodbrook, Inc., requesting vacation of part of plat of Section II, Woodbrook Subdivision, recorded in the Clerk's office of Circuit Court, of Albemarle County, Virginia in Deed Book 374, Page 113. The Committee requested the Commonwealth's Attorney, Downing Smith, to review the document and present an opinion at the next Executive Committee meeting in January, 1966. 12. By 0. R. Randolph, Surveyor, for William Woodzell, showing division of Lots 16 and 17 into 16A, 16B and 17 on Route 250 East 1.0 mile east of Shadwell, Magruder Lots, Albemarle County, Virginia. Upon motion by William Moore, seconded by David Carr, the plat was disapproved, by a vote of three for disapproval, one for approval. There being no further business, the meeting was adjourned. Page 6 MINUTES: ALBEMARLE COUNTY PLANNING COMMISSION: DECEMBER 20, 1965:. The Albemarle County Planning Commission met on 20 December, 1965, v at 7:30 P.M., in the Board Room of the County Office Building, Charlottesville, Virginia. Present were: William Moore, Vice -Chairman Cecil Maupin, Member David Carr, Member William Perkins, Member Avery Catlin, Member Richard Marks, Member Garrett Kirksey, Advisor: Board of County Supervisors Otis Brown, County Executive Phillip Tate, Secretary Absent were: William Trevillian, Member Floyd Johnson, Chairman The meeting was called to order by the Vice -Chairman. The floor was opened for discussion of future Planning Commission activities. Each member expressed a desire to serve in whatever capacity the Board of Supervisors outlined. Mr. Brown outlined some possible fields of endeavor based on long range County planning. Ideas were advanced in support of a planning ordinance defining the scope of responsibility for the Planning Commission. Upon motion by Mr. Perkins, seconded by Mr. Carr, the Vice -Chairman was instructed to appoint a committee composed of Mr. Kirksey, Mr. Johnson and Mr. Brown to draft a document outlining the scope of responsibility for the Planning Commission as defined by the Board of Supervisors, said committee to present this document to the Board of Supervisors at theearliest possible date. The motion received a unanimous vote of approval. Upon motion by Mr. Moore, seconded by Mr. Carr, the Commission voted unanimous approval of the plat entitled, "Vacation of Part of Plat of Section Two, Woodbrook Subdivision, Recorded in the Clerk's Office of the Circuit Court of Albemarle County, Virginia, in Deed Book 374, Page 113" as presented by the Greenbrier Corporation. Dr. Marks suggested that the commission secure a copy of the film of the proposed County Parkway which was shown at the Governor's Conference on Natural Beauty. This movie would be made available to civic and social 9 organizations of the County and City. The address is, Citizens Committee for the Virginia Outdoors Plan, P. 0. Box 466, Richmond, Virginia. % The Vice -Chairman instructed the Secretary to cancel the Executive Committee meeting scheduled for the 4th of January, 1966. The full Commission will meet on the 10th of January, 1966. There being no further business, the meeting was adjourned.
