HomeMy WebLinkAbout1966Page MINUTES ALBEMARLE COUNTY PLANNING COMMISSION: JANUARY 10, 1966: The Albemarle County Planning Commission met on 10 January, 1966, at 7:30 P.M. in the Board Room of the County Office Building, Charlottesville, Virginia. Present were: Floyd Johnson, Chairman William Moore, Vice -Chairman Cecil Maupin, Member David Carr, Member William Perkins, Member Avery Catlin, Member Richard Marks, Member William Trevillian, Member Garrett Kirksey, Advisor, County Board of Supervisors Otis Brown, County Executive Phillip Tate, Secretary The meeting was called to order by the Chairman, Mr. Johnson. Roll call by the Secretary. Mr. Tate indicated all members present and a quorum was established. Upon motion by Mr. Catlin, seconded by Mr. Moore, unanimously approved, the minutes of the 20 December, 1965 meeting were not read. In matters pertaining to the public, the following plats were presented: 1. Preliminary plat of Section One, "Midway", Albemarle County as presented to the Executive Committee on 3 November, 1965. At that time, the Chairman stated that the entire matter would receive consideration of the Commission. Mr. Perkins, Member, asked to be relieved of duty for the duration of the discussion on "Midway" for reasons of possible conflict of interest. Messrs. Cushman owners of Midway presented an account of events and decisions concerning "Midway" and adjoining properties. The following letter was presented: "January ,2 1966 Albemarle County Planning Commission Albemarle County Board of Supervisors Court Square Charlottesville, Virginia �hw Re: Midway Subdivision Application Gentlemen: We wish to present again our request for your favorable consideration of our proposed preliminary plan of subdivision of a portion of Midway, using as access the present Farmington roads and reserving as additional access the right of way as 1„r► described in the final paragraph of Farmington's letter, dated December 14, 1965, in reply to your Board. We believe that our request should be granted, first, because of the provisions of the Albemarle County Subdivision Ordinance which defines a street as a "public or private thoroughfare which affords principal means of access to abutting property," and also provides that "all lots shall abut or have direct and adequate access to ... residential streets as hereinabove defined." Secondly, if your Board has any doubt as to the application of the above provisions of the Ordinance, you are in a position to fully protect the public by virtue of those provisions of the Ordinance requiring subdivision plans to provide adequate access to a public highway as well as to adjoining properties. In this regard, it is well known that Farmington has incurred substantial expense in plan- nig for the residential development of their Barnes tract acquisition. We have in hand one such plan which speaks for itself as to Farmington's intent and concern for neighboring properties, as well as the County Subdivision Ordinance. We submit that the Durette Road, leading from Midway via Flordon to Route 250, is a key access road for future residents of that area. If extended north across Ivy Creek to Barracks Road it would constitute far better access to the public highways than the present meandering Farmington roads. A great step forward could be accomplished now by a simple revision of the course of the Durette Road around and below Mr. Barnes' residence. In this respect, we believed we had reached an agreement with Farmington's representatives, whereupon we forwarded our letter of confirmation, dated April 2, 1965. We remain ready to abide by the contents of that letter. In the meantime, we seek the right to proceed with the development of our land. Respectfully submitted, Signed: Walter M. Cushman" After a general discussion, the Commission concluded that it should not rule on certain aspects of this matter without certain clarification of Subdivision Ordinance terms. It was therefore motioned by Mr. Moore that the Secretary request the Commonwealth's Attorney, Donning Smith to present a legal opinion as to interpretation of the following Subdivision Ordinance excerpt: Section 1. Paragraph C. Street. A public or private thoroughfare which affords principal means of access to abutting property. (more particularly to define "private", thoroughfare", "abutting property") The motion was seconded by Mr. Catlin with unanimous approval. Mr. Water Cushman presented the following statement for Commission consideration in possible contact with adjoining property owners: Page 9 SUGGESTED LETTER TO FARMINGTON FROM THE PLANNING COMMISSION *400- The so-called Durette right of way serving the Cushman property to which you refer in the final paragraph of your letter of December 14, 1965 is one of our major concerns in planning for the development of that area between Route 250 and Barracks Road. It is the Commission's opinion that the interest of the community can best be served by insuring not only the preservation of this outlet to Route 250, but by requiring its widening to fifty feet whenever a request is presented for subdividing land bordering this road. By so doing, we believe the Durette Road may be utilized at some future date to ease the flow of traffic which otherwise would be forced to use Farmington's railroad crossing as the only means to and from the highway and Charlottesville. The topography of this right of way is another important reason for preserving and improving it, especially when you consider the difficulties of the terrain separating Farmington's present roads from the area to the west. While we do not need to know your detailed plans for development, we do believe that you, the Cushman, and Mr. Dure should present an agreed upon plan, both as to course (if there are to be any changes) and width of the Durette right of way where it passes through or enters your properties. Enclosed herewith is a copy of a letter dated January 5, 1966 from Walter Cushman to the Planning Commission. In regard to the second paragraph of this letter, there seem to be some questions as to the meaning of the Subdivision Ordinance, one being what constitutes a "Private thoroughfare ." Another question is what is meant by "abutting property." We would appreciate hearing your attorney's viewpoint as to these provisions of the Ordinance. We will also appreciate any information you can give us regarding the main access road or roads which you expect to use in connection with the future develop- ment of your property. 2. By William W. Aubrey Huffman, Surveyor, for Thomas Goodman, showing division of Lot 3, Block C, Section 2 in "Oakhill" divided into Lots 3A and 3B, approved by the Commission on 10-6-64, request to be reapproved and redated. Upon motion by Mr. Catlin, seconded by Mr. Moore, plats 2 through 8 were approved by unanimous vote. Mr. Moore presented a summary of the report entitled "Recommendations for Wildlife Management and Habitat Development at Beaver Creek Watershed Project - Albemarle County, Virginia". Those appointed to and serving on the committee were: W. W. Waddell, III C. A. Green Louis Brandt W. B. Trevillian, Jr. The committee met with the local Izaak Walton League's committee on conservation for the Beaver Creek Dam at the home of Carl E. Barnett at Chestnut Ridge, May 19, 1965. The report was unanimously endorsed by the entire Izaak Walton League. The summary presented was as follows: A. It is recommended that the water level of the lake be altered in the following manner by the engineer in charge. 1. Raise the level two feet above normal level during the fall and winter months and lowered two feet by no later than July 1 until September 30. 2. Raise the level one foot above normal level during the fall and winter months and lowered two feet or one foot below normal from July 1 to September 30. B. The reasons for this drawX down of two feet from July to October are to facilitate the establishments of wildlife, feeding areas of waterfowl, and upland game. Water Celery, Millet, and other feed grains grow extremely well in the mud flats left by the drawn down of the lake. C. Wood duck boxes and other nesting structures such as platforms (Small mounds) for nesting geese be established in appropriate locations. D. Principles of sound game management must be encouraged! 1. It is recommended that five or perhaps six duck blinds be constructed at proper locations. a. Each blind is to accommodate three people at the most, but preferably, two hunters. (left to the boards discretion) Page 11 b., To facilitate the greater number of man hours of recreation, two separate groups of hunters should be permitted to use the blinds. The first from sunrise to eleven a.m. The second from one p.m. to sunset. c. The permits for hunting could be issued by the sheriffs office. d. Nominal charges for hunting privileges to defray costs should be collected when the permit is issued. The amount of charge shall be determined by the r Board of Supervisors. e. Each permit holder will be required to check in and out of the lake facility with the office in charge. f. Hunting privileges be permitted three days per week at the most, and preferably, two days - Wednesday and Saturday. g. Building of blinds, sowing of feed patch seeds, and construction of nesting facilities is to be accomplished by local youth organizations under the supervision of their leaders. E. This lake, being situated in the Eastern Flyway, will be visited during their annual migration by ducks and geese. The majority of these birds will stop only briefly to be on their way. Human nature and some hunters being what they are, will present a serious problem during hunting season. Such hunt- ing will be conducted with or without permission on neighboring properties or by poaching on the lake premises. It is in the interest of not only sound game management, but public safety that limited amounts of regulated hunting be allowed, F. Due to the massive reclaiming of wetlands by industry and other interests, the native habitate for these waterf1wl are being destroyed to the extent that they can be no longer used for nesting. After discussion of the several ideas advanced in the report Mr. Carr entered a motion that the Commission, regarding Paragraph A, Subparagraphsl and 2, ascertain the aesthetic effects as to shoreline mud flats of a two -foot drawn - down, discuss the proposal with the Service Authority as to practicability, and request an opinion from Mr. Martin, Division of Fisheries, Department of Inland Game and Fisheries, as to effects on fish life in the lake, said results to be reported at the next meeting. The motion was seconded by Mr. Catlin and un- animously passed. A motion to grant the Izaak Walton League permission to establish nesting areas and observation blinds on platforms if so desired was made by Mr. Kirksey. Upon second by Mr. Marks, the motion was passed unanimously. The Commission instructed the Secretary to draft a letter of appreciation to this committee. .r•► The Chairman instructed the Secretary to cancel the Executive Committee meeting scheduled for the 1st of February, 1966. The full Commission will meet on the 14th of February, 1966. Page 12 The special com&i.ttee composed of Mr. Brown, Mr. Kirksey and Mr. Johnson appointed 20 December, 1965, to draft a document outlining the scope of responsibility for the Planning Commission, presented said document in rough draft form. After a general discussion, several changes were suggested as to wording. The special committee reported that it would meet to formalize the document before presentation to the County Board of Supervisors. The motion picture entitled "Time to Begin" was shown. The Commission expressed its recommendationand desire that the film be obtained for any civic or educational group so requesting. There being no further business, the meeting was adjourned. MINUTES: ALBEMARLE COUNTY PLANNING COMMISSION: FEBRUARY 141966: The Albemarle County Planning Commission met on 14 February, 1966, at 7:30 P.M. in the Board Room of the County Office Building, Charlottesville, Virginia. Present were: Floyd Johnson, Chairman; William Moore, Vice -Chairman; Cecil Maupin, Member; David Carr, Member; William Perkins, Member; Phillip Tate, Secretary. vowd Absent were: Avery Catlin, Member; Richard Marks, Member; William Trevillian, Member; Garrett Kirksey, Advisor, County Board of Supervisors; Otis Brown, County Executive. The meeting was called to order by the Chairman, Mr, Johnson. Roll call by the Secretary indicated five members present, three members absent and a quorum was established. Upon motion by Mr. Perkins, seconded by Mr. Maupin, unanimously approved, the minutes of the 10 January, 1966 meeting were not read. In matters pertaining to the public, the following plats were presented: 1. Preliminary plat of "Deerwood" subdivision owned by Burton & Woodzell on State Route 649 near Albemarle -Charlottesville Airport by 0. R. Randolph, Surveyor. Upon motion by Mr. Carr, seconded by Mr. Perkins, with unanimous approval, the preliminary was approved contingent upon the developer establishing an access R/W in the vicinity of Lot 12, Block 7 at an exact location compatible with terrain. 2. By 0. R. Randolph, Surveyor, for David A. Smith, showing plat of 13.0 acre tract and 20' R/W, 4.0 miles southeast of Afton, Albemarle County, Page 13 Virginia. Upon motion, duly seconded, the plat was approved. 3. Mr. Walter Cushman, representing owners of "Midway" appeared at his own request. Mr. Perkins, member, asked to be relieved of duty for the duration of the discussion on "Midway" for reasons of possible conflict of interest. The Secretary read a letter addressed to Mr. Downing Smith, dated February 11, 1966, from Mr. Walter Cushman, citing several ideas pertaining to the Midway -Farmington situation. Mr. Smith stated that he was in the initial stage of discussion with the legal council of Farm- ington, Inc. and would render his opinion called for at the 10 January, 1966 meeting at the next regular meeting. The Commission agreed to defer discussion on the problem on this basis, allowing three weeks for further investigation and discussion. 4. By William S. Roudabush, Jr., Surveyor, for W. T. Birckhead, showing 2. acre lot as a portion of a 10. acre tract, State Route 616 near Boyd's Tavern, Albemarle County, Virginia. Upon motion by Mr. Perkins, seconded by Mr. Maupin, the plat was approved by unanimous vote. 5. By Thomas D. Blue, Surveyor, for Earl H. Vaughan showing a subdivision of a portion of "Deep Acres" into seven (7) lots and two (2) parcels. Upon motion by i Mr. Perkins, seconded by Mr. Maupin, with unanimous consent, the plat was approved contingent upon the developer providing a 50' R/W to parcels A and B, or providing a statement prohibiting re -division of parcels A and B unless 30' R/W is widened to the required 50' R/W. 6. By Thomas Blue, Surveyor, for Leroy Snow, showing division of a tract located on State Route 795 near Blenheim, Albemarle County, Virginia. Upon proper motion, duly seconded, the plat was approved. 7. By James E. Dorsey, Surveyor, for W. W. Eppard, showing conveyance of Parcel "C" from Lot "A" to Lot "B" in vicinity of St. George Avenue, Crozet, Virginia. Upon motion duly seconded the plat was approved. g. Mr. D. G. Heyne and Dr. M. C. Wilhelm, acting in the interest of residents of Montvue Subdivision on State Route 654 presented a sketch of Montvue showing sur- rounding properties. It was requested that consideration be given to a plan to close a dedicated R/W on the northern boundary of Montvue into the Dan Robinson property and the acceptance of the County or private parties of a widening of a rri✓ 20' private drive to 50' at no expense to the County or said private parties leading from State Route 654 to the Dan Robinson property. While each commission member expressed personal approval of the idea, the Chairman instructed the Secretary to confer with the Commonwealth's Attorney as to possible legal objections. Mr. Heyne Page 14 and Dr. Wilhelm were requested to confer with the owner and/or developers of the Dan Robinson property for concurrence in the plan. All parties were requested to present their finding at the next meeting. At the request of the chairman, the amending of Article 6-1 of the Bylaws was postponed until the next meeting by reason of the absence of three members. The Commission concurred.. The Secretary was instructed to call the next meeting for the first week in March. At the request of the Commission, the Secretary was asked to arrange for a possible amendment to Article 6-4 of the Bylaws in readiness for the next meeting. The Secretary presented the study "Planned Proj-ections for the Charlottesville Area Transportation Study." A resume of the report will be sent to the members at the earliest date. There being no further business, the meeting was adjourned. Huffman, Engineer, for "Birdwood Corporation" preliminary sketch of proposed development of Birdwood Estate on U. S. Route 250 adjacent to -1400 Bellair, and Ednam Forest. Interested parties were present to present various views on the proposed subdivision. The consensus of opinion indicated a desire for a more aesthetic design compatible with adjacent areas. Lack of recreation and public areas was noted as well as overall undesirability of the scheme. Upon motion by Mr. Perkins, seconded by Mr. Carr with unanimous consent, the Chairman ordered deferred judgment and appointed a committee composed of Messrs. Johnson, Moore,Carr, Catlin, Brown and Tate to be available for consultation with the developers and/or planners of "Birdwood", and to further study the area. The Secretary presented the "Planning Projections for the Charlottesvville Area Transportation Study" as prepared by Wilbur, Smith and Associates assisted by the Virginia Department of Highways. 1985 projections indicate a Charlottesville area population of 75,000 persons. The study is to be used by the V.D.H. to plan arterial and periphery streets. The commission requested the County Executive to contact Wilbur, Smith and Associates expressing general approval of the material contained therein. The provisions of Article 8-1 having been carried out and upon motion by Mr. Perkins, seconded by Mr. Carr, with unanimous approval, Article 6 of the By-laws was amended to read as follows: 6-1. "Regular meetings of the Commission shall be held monthly on the first Monday at 7:30 P.M." 6-4. 11 A majority of the membership of the commission shall constitute a quorum. The number of votes necessary to transact business shall be a majority of a recognized quorum. Voting...... minutes." The County Executive Otis Brown presented a report on various proposed County and Service Authority projects. Upon motion by Mr. Carr, seconded by Mr. Catlin, with unanimous approval, the Planning Commission requested the County Board of Supervisors to cause a County dater and Sewerage Study to be made of the County showing existing and proposed facilities. After general discussion, upon motion by Mr. Carr, seconded by Mr. Catlin, with unanimous approval, the Commission requested the County Board of Supervisors to provide $10,000.00 in the 1966-67 Budget for the purpose of creating the position of County Planner, and providing an operating budget, to assist the Planning Commission in the various studies and reports deemed necessary to adchieve and maintain an overall County plan. There being no further business, the meeting was adjourned. Page 17 MINUTES: ALBEMARLE COUNTY PLANNING COMMISSION: APRIL 4, 1966: 4%we The Albemarle County Planning Commission met on 4 April 1966 at 7:30 P.M. in the Board Room of the County Office Building, Charlottesville, Virginia. Present were: Messrs. Floyd Johnson, Chairman; William Moore, Vice - Chairman; David Carr, Member; William Perkins, Member; A,,Tery Catlin, Member; Richard Marks, Member; Cecil Maupin, Member; William Trevillian, Member; Garrett Kirksey, Advisor, County Board of Supervisors; Otis Brown, County Executive, and Phillip Tate, Secretary. The meeting was called to order by the Chairman. Roll call by the Secretary indicated all members present and a quorum was established. A motion to dispense with the reading of the minutes was made by Mr. Carr, seconded by Mr. Moore and unamiousl.y approved. As pertaining to unfinished business, the Chairman recognized the legal council for Farmington, Inc., Mr. J. H. Michael, Jr. Mr. William Perkins, Member, excused himself from entering into any discussion and/or voting concerning Farmington, Inc., by reason of possible conflict of interest. Mr. Michael reiterated the Farmington, Inc., stand on allowing adjacent property owners the use of Farmington, roads. This statement consisted of three main points: 1. Farmington roads are private in that no state or county monies were used for construction: 2. Farmington roads are private in that they are privately maintained: 3. Farmington roads are not to be used by developers of adjacent properties. Other points having been previously stated in correspondence were restated.. A brief discussion followed. The following resolution was made by Mr. Catlin, seconded by Mr. Maupin and unanimously approved, Mr. Perkins abstaining: The preliminary plat of "Midway", Section I, is hereby approved contingent upon the developer establishing a proper legal access in accordance with the subdivision ordinance. The Secretary, at his request, was instructed to decline acceptance of plats which do not comply with the subdivision ordinance, specifictllythose which have not been preceeded by a preliminary submission and those which do not have a general location sketch.
