Upon unanimous consent of the Commission, the regular
January meeting was rescheduled for 9 January 1967, being the
second Monday.
Dr. Mirks gave the report of the recreation committee,
including a brief history thereof, for the benefit of the students
present.
Mr. Carr gave a brief report of the significance and
activities of the roads and streets committee.
The Commission unanimously directed the Chairman to req-
uest of the County Board of Supervisors authority to engage legal
counsel on an "as needed" basis for the purpose of -advice and
opinion on matters pertaining to the subdivision ordinance and
the interpretation thereof.
There being no further business, the meeting was -adjourned.

The minutes of the previous meeting were approved and
the reading dispensed with on motion by Ir. Carr, seconded by

regarding a div:;Lsion tabled in the November meeting. The Vice -
Chairman informed him that due to conflicting legal opinion on
the matter, the commission would withhold opinion until the
February meeting.

The following recommendations and observations were
received from the Student Planning Commission of Albemarle County:

WHEREAS, there are three well traveled highways
going through Albemarle County, 29 North and South, 250
East and West and Route 20.
WHEREAS, Shennandoa,h National Park suficientiy
fills the need for such wayside facilities on 250 West.
WHERLAS, the other highways are in great need
of wayside facilities.
THL STUDLNT PLANNING GGIVI iISSION RESOLVE that
four wayside areas be established. Specific areas and
the action to be taken with the areas is as follows:
PliOJLCT 1
A plot of level land on Route 29 Ncrth off the
North bound lane. It is in the vicinity lq'orth of section
32* of Albemarle County. There are no obstructions to
the sight of a vehicle pulling into or out of this way-
side area. This is a particularly accessible plot for
both lanes of traffic, and there is a creek in the rear
of the lot. Suggestions for the usage of this plot:
1. One shelter to be guilt with fire place
2. Two picnic tables inside this shelter and
two outside
3. A number of cans to later be determined,
sufficient enough to prevent littering
4. This plot could serve as a stop -ever for
a maximum of two trailers
5. Water foundations should be constructed
PROJECT 11
A plot of level land is on 29 South, off the
North bound lane approximately two miles before the
turnoff to Red 'mill if you are traveling South. It is
located in the vicinity of section 87. There are no
obstructuons to the sight of a vehicle pulling into or
going out of this wayside area. The accessibility is
good and there is no natural water supply on this plot.
Suggestions for the usage of this plot:
1. Two shelters built with a fire place in
each
2. Two picnic tables inside the shelter and
two outside
3. A number of cans to later be determined,
sufficient enough to prevent littering
4. This plot could be served as a stop -over
for a maximum of four trailers.
PROJECT ill
4 plot of level land just below the inter-
section of Route 708 and Route 20. There are no obstruct-
ions to the sight of a vehicle pulling out or going into
this area. The accessibility is good and there is a good
natural water supply. Suggestions for the usage of this

area:
1. Two or three picnic tables
2. Trash cans to be determined later
3. Could accommodate two or three tents for
camping
4. Water foundations to be constructed (natural
water supply)
PROJECT 1V
A plot on 250 East approximately J of a mile
before the Boyd Tavern sign across from a small gas
station if you are traveling East. It is located in the
vicinity of section 79. There are no obstructions to
the sight of a vehicle pulling into or going out of this
wayside area. The accessibility is good and there is no
natural supply. Suggestions for the usage of this plot:
1. One shelter to be built
2. Two picnic tables on the inside and two on
the outside
3. A number of trash cans to later be determin-
ed, sufficient enough to prevent littering
4. This plot of land would make an excellent
picnic area
This commission suggests that the picnic area
on 29 South approximately - mile beyond the crossroad
(turnoff to Keene) going South, be eliminated. It is
highly unsafe and inaccessible due to two high mounds of
ground that block the view of vehicles pulling out of the
area. This picnic area is on section 87.
WE, THE STUDENT PLANNING CORLM;ISSION, feel the
present Planning Commission should bring it before the
Highway Department, that in the plans for Inter -State
64 plans should be made for picnic areas. This would
prevent later projects such as the present one.
* Albemarle County is divided into 139 sections.
The Secretary was instructed to convey to the Students the apprec-
iation of the Commission for a well thought out project.
The commission on motion by IIr. Perkins, seconded by Zr.
Trevillian adopted the following resolution to be presented to the
Albemarle County Board of Supervisors:
he Albemarle County Planning Commission having
receivE:d the recommendations and resolution of the Student
Planning Commission and having been made more aware of the
lack of outdoor picnic facilities in the County of Albemarle,
does hereby strongly recommend that Albemarle County Board
Of Supervisors petition the necessary state department of
Virginia requesting picnic areas and facilities to be

located on the main highways, namely ioutes 29 and 250,
and further offering the accompaning Student Planning
Commission Resolution as a guide in, the relocation and
location of such facilities.
Ligon request of the County Executive, each member was
requested to outline his thoughts as to the immediate and contin-
uing efforts of the proposed county planner. The following is a
condensation of the relevant ideas:
1. Develope a land use map for the county and maintain
same on a current basis.
2. Compile necessary statistics and data as a basis for
the development of a land use ordinance.
3. Compile; evaluate and maintain current figures and
uses as pretain to:
A. School location
B. School population shifts
C. goad development
D. Recreation areas
L. Sanitary land fills
F. Water shed development
G. Population information as concerns:
(1). Shifts (county, city, state, out of state)
(2). Income
(3). Education
(4). Interests
(5). Profession, trade, etc:.
4. Recommendations covering:
A. Subdivision ordinance and changes thereof.
B. Land use ordinance and changes thereof.
C. ielated ordinances.
5. Heview plats and other requests and present
recommendations, etc.
6. Verify accuracy of plat descriptions
7. Liaison between county and highway department and
other governmental units or agencies concerning
matters of planning and statistics
8. Other duties as may be assigned by the Executive
Office and the Planning Commission.
lethods of streamlining Commission proceedures were dis-
cussed. These ideas will be studied in detail at later dates.

The Secretary was instructed to request from the Chamber
of Commerce a list of civic organizations within Albemarle County,
to include chairman or contact and to present said list at next
scheduled meeting.
Upon motion by 1r. Perkins, seconded by Mr. Moore, with
unanimous approval, the Secretary was .instructed to compose a
resolution setting forth policy whereby routine plats could be
approved by the County Executive or his appointed agent to relieve
the Commission from the obliEition of viewing but not that of
certifying. The resolution is as follows:
The Planning Commission iereby adopts as policy
the following procedure. The Planning Commission
authorizes the County Lxecutive or his appointed
agent to view and give verbal approval to routine
plats and business of the Planning Commission. These
routine plats will be submitted to the Commissior, for
signature only, but the Commission reserves the right
to view the plats if so desired.
The foregoing resolution to adopt a new plat viewing
r.r+ procedure was discussed with the Commonwealth's Attorney by the
Secretary. Ar. Smith recommended that the Commission proceed with
whatever internal arrangement necessary to expedite the viewing of

the plats, but suggested that such an arrangement be verbal
policy. Written policy could be precedent setting and legally
in doubt as to advisability.
It was the consensus of the Commission that the County
Executive in arranging consultation and in County meeting with
the planning consultant arrange, if possible, the date to
coincide with the regular meeting of the Planning Commission.
This would be advantageous to the Commission and to the
consultant.
Mr. Batchelor, County Executive, announced to the
Commission that n county planner would join the staff on the
first of Aui,ust, 1967, and that during the summer months plans
were being ,Wade to hire students working under the direction
of the consultant planner to compile statistics and perform
other ground work planning activities.

` Office Building, Charlottesville, Virginia.

Phillip Tate, Secretary; T. M. Batchelor, County Executive.
Absent were: William Trevillians, Member; Cecil Maupin, Member;

The meeting was called to order by the Chairman and a quorum established.
The minutes of the previous two meetings were discussed and an error of omission
was noted, the error to be rectified prior to the next meeting.
The following plats were brought before the Commission for consideration:
A. By B. Aubrey Huffman, Engineer:
(1) For Irene Kaufman, showing division of land off State Route
616 near Keswick. The entrance road of 20 feet is below
subdivision standards. The engineer and/or surveyor was
requested to confer with necessary property owners to secure
a minimum of 30 feet for right of way. No other action was
taken.
(2) For Virginia Resorts, Inc., showing plat of "Whippoorwill
Hollow" near Owensville off State Route 614. This subdivision
contains 55 lots and serves as cross connection between
State Routes 614 and 676. The following committee was
appointed to view the property, in the interest of the
Commission; Messrs. Floyd Johnson, David Carr, Avery
Catlin, William Moore and Phillip Tate. No action was taken.
B. By Woodson and Nash, Attorneys:
(1) For Stanley Woodward, Sarah Woodward, William Stevenson, Lewis
and Ann Matacia; showing vacation of Sunnyfield Subdivision,
off State Route 53, near Ashlawn. Upon motion by Mr. Moore,
seconded by Mr. Catlin, with unanimous approval, petition
was approved and forwarded to Board of Supervisors.
C. By 0. R. Randolph, C. L. S.:
(1) For Bloomfield, Inc., showing transfer of parcel off State
Route 677 to Hunter Perry. On motion by Mr. Catlin, seconded
by Mr. Perkins, with unanimous approval, transfer approved.
The Commission viewed the preliminary of access easement and parcels, of
American Telephone and Telegraph Company of Virginia, on Piney Mountain, off State
Route 606. No action was taken.

Mr. William Moore, Vice -Chairman, presented a statement of expediency
for developing a land use map for the county. He stated that he had made inquiry
to the Department of Taxation, in Richmond, concerning interpretation of the
State Code as pertains to assessment and reassessment of properties in political
subdivisions having zoning and planning ordinances. Mr. Moore read the following
letter from the Department of Taxation, citing the Code of Virginia, Article 2,
Paragraph 58-772.1:

Dear Mr. Moore:
Please find enclosed a photostatic copy of the Code of Virginia
58-772.1 underlined in red for that portion of the paragraph that
deals with your problem.
In making general reassessments, and in aiding Commissioners
of the Revenue in Virginia with interim assessments, this portion
of the Code of Virginia is interpreted by this office to mean
simply that in any county or other political subdivision where
they have a zoning and planning ordinance the land must be appraised
or assessed for its highest and best use only so far as it can be
used as zoned by the classification under which it falls. If the
land is rezoned by the county or political subdivision, then and
then only can it be reassessed or reappraised for another use which
would change its value appreciably.
Example: Farmland or agricultural land so zoned and must be
appraised and assessed as farm or agricultural land. Only after
it is rezoned can it be otherwise evaluated. This holds for all
classifications such as residential, commercial, or industrial.
The classification under your zoning ordinances sets the upper
and lower limits of value that can be placed on the property for
tax purposes and meets the constitutional provision of fair market
value providing it is properly appraised or assessed. By so doing,
the county tends to control any speculative assessments on farmland
or any other classification by a person or persons hoping to get the
land rezoned.

The Commission members were presented with a copy of a document produced
by Simco, Inc., under the direction of Mr. Jack Sims, compiled for the purpose of
aiding Simco in securing FHA backed monies for the development of "Camelot", on
Route 29 North. Mr. Sims stated that this was done as a result of the County not
having at present a land use or County plan, and further stated that State and
Federal agencies are now requiring such plans developed beyond the idea stage.
Discussion followed, centering around the expediency of the development of a
County land use plan. Mr. Sims was commended, by the Commission, on the informative
and creative nature of the paper.
Upon motion by Mr. Moore, seconded by Mr. Catlin, with unanimous approval,
the Commission agreed to request various county organizations to express views on a
county planning program. Mr. Moore and Mr. Johnson agreed to formulate a letter
to be mailed to several county organizations, fulfilling this motion.
Mr. Batchelor, County Executive, requested the Commission to consider the
earliest possible date for submission to the Board of Supervisors, an ordinance
allowing and regulating town houses. A special committee was appointed by the
Chairman to include: Messrs. Catlin, Marks, Johnson, Batchelor and Tate, to meet
on Monday, 13 March, 1967, at 12 noon,to go over the initial draft of the ordinance.
A special Commission meeting was called for Wednesday, 15 March, 7:30 P.M. to
finalize the ordinance for presentation to the Board of Supervisors on 16 March.
Due notice will be sent to each member.

PLANNING COMMISSION TO MAKE A CAREFUL STUDY OF THE RESOURCES,
POSSIBILITIES, AND NEEDS OF THE COUNTY AND TO MAKE PLANS FOR
THE DEVELOPMENT OF THE COUNTY; AND
WHEREAS, THE PREPARATION OF COMPREHENSIVE PLANS FOR
WATER AND SEWER SYSTEMS IS ONE OF THE NEEDS OF THE COUNTY; AND
THE PLANNING COMMISSION DESIRES TO CONTRACT WITH AN ENGINEERING
CONSULTANT FOR THE PREPARATION OF SUCH PLANS; AND
WHEREAS, THE PLANNING COMMISSION DOES NOT HAVE AVAILABLE
FUNDS TO PAY THE ENGINEERING CONSULTANT AND HAS BEEN INFORMED THAT
THE COUNTY BOARD OF SUPERVISORS DOES NOT HAVE SUCH FUNDS BUT MAY
BE ABLE TO OBTAIN A GRANT FROM THE FARMERS HOME ADMINISTRATION.
NOW, THEREFORE, BE IT RESOLVED:
1. THE PLANNING COMMISSION SHALL CAUSE TO BE PREPARED
OFFICIAL COMPREHENSIVE PLANS FOR THE GUIDANCE OF THE FUTURE
DEVELOPMENT OF WATER AND SEWER SYSTEMS IN THE FOLLOWING AREA:
THE COUNTY OF ALBEMARLE EXCLUDING THE CITY OF CHARLOTTESVILLE.
2. THE PLANS SHALL BE BASED UPON PRESENT POPULATION
DISTRIBUTION AND PROJECTED POPULATION GROWTH WITH PROVISIONS FOR
OTHER AREA FUNCTIONS WHICH ARE DEEMED ESSENTIAL FOR THE GROWTH OF
THE COMMUNITY INVOLVED. IT SHALL INCLUDE PROPOSALS FOR FACILITIES
REQUIRED TO MEET NEEDS DURING THE NEXT FIVE BUT NOT MORE THAN TEN
YEARS AS WELL AS THOSE WHICH WILL BE NEEDED TO MEET PROJECTIONS
FOR THE NEXT TWENTY YEARS OR MORE.
3. THE PROPOSAL OF LANGLEY, MCDONALD AND OVERMAN TO
PREPARE THE COMPREHENSIVE WATER AND SEWER PLANS FOR THE SUM OF
SEVEN THOUSAND FIVE HUNDRED DOLLARS ($7500.00) SHALL BE ACCEPTED
SUBJECT TO THE APPROVAL OF THE BOARD OF SUPERVISORS AND THE
AVAILABILITY OF FUNDS,
4. THE BOARD OF SUPERVISORS IS REQUESTED TO TAKE
THE NECESSARY ACTION TO OBTAIN A GRANT FROM THE FARMERS HOME
ADMINISTRATION.
5. THE CHAIRMAN OF THE PLANNING COMMISSION IS HEREBY
AUTHORIZED AND DIRECTED TO EXECUTE THE CONTRACT FOR THE PREPARATION
OF THE PLANS.
THE COMMISSION MEMBERS HAVING BEEN PRESENTED WITH A COPY OF A
DOCUMENT PRODUCED BY SIMCO, INC., UNDER THE DIRECTION OF MR. JACK SIMS, AT
THE MEETING ON MARCH 69 FURTHER DISCUSSED THE INSTRUMENT. THE COMMISSION
EXPRESSED REGRET THAT IT COULD NOT APPROVE THE DOCUMENT AS A PART OF A COUNTY

The Albemarle County Planning Commission met on May 1, 1967, 7:30 p.m., in
the Board Room of the County Office Building, Charlottesville, Virginia.
Present were: Floyd Johnson, Chairman; William Moore, Vice Chairman;
William Perkins, Richard Marks, Cecil Maupin, Avery Catlin, Members; Phillip Tate,
Secretary; Garrett Kirksey, Advisor, County Board of Supervisors; T. M. Batchelor,
County Executive.

Upon motion by Mr. Moore, seconded by Dr. Marks, with unanimous consent,
reading of the minutes of the April 3 meeting was dispensed with and approved as
presented.
The following plats were reviewed by the Commission with action as
indicated:

(a) Showing Section 2, Ednam Forrest. Plat presented at the
regular meeting, November 7, 1966, with action withheld
pending an opinion by the Commonwealth's Attorney.
Mr. Perkins, Member,withdrew from discussion and voting
by reason of possible conflict of interest.
Mr. Downing Smith, Commonwealth's Attorney, had stated
in conference that any new sections proposed by Ednam Forrest
should not be approved as approval would be a violation of
certain requirements of the subdivision ordinance. One condition
for approval of further additions to Ednam Forrest was that
rights of way in Ednam Forrest must be public rights of way.
Mr. Smith presented to the Commission an Attorney General's
opinion dated February 11, 1966, stemming from a request of
the Commonwealth's Attorney for Augusta County. This opinion
is a matter of record.
The Attorney General's opinion states that the act of
recording a plat operates to create a public right of way over
such parts of the plat as set apart for streets and alleys,
regardless of any notes made on the plat. Mr. Smith stated
that in his opinion and based on the Attorney General's opinion,
the rights of way in Ednam Forrest were in effect public, and
further recommended approval of Section 2, Ednam Forrest.
Upon motion by Mr. Moore, seconded by Mr. Catlin, with
unanimous approval, the plat was approved with the statement
that approval was based on this Attorney General's opinion
and the developer accepts the approval under these conditions,
having been so informed.

facilities must be available, the Commission approved the
preliminary with Mr. Catlin expressing a negative vote.

The Commission heard an informative address by Mr. Leynes,of the State
Department of Planning, on the subject of grants and loans by State and Federal
agencies. Mr. Leynes stated that Federal funds for planning are available through
the State agency but that a county must have a full-time planning staff and Albemarle
may run into problems because it cannot assure a zoning plan would be enacted to
implement such a plan.
Mr. Johnson reported to the Commission that a committee working on the
revision of the subdivision ordinance, after two special meetings, is making signifi-
cant headway in revamping the ordinance. A meeting of the committee was set for
12:00 noon, May 3, in the Board Room.
A special meeting of the Commission, for the purpose of reviewing the
subdivision ordinance, will be called by the Chairman.

The Chairman recognized Messrs. Mosher and Wyatt and introduced them to
the Commission members expressing the hope that their summer employment with the
County would be fruitful.
The Chairman of the Recreation Committee, Dr. Marks, reported a renewed
desire to seek new and improved road -side parking areas throughout the main
corridors of the County. Dr. Marks also stressed the Committee's desire to
establish a summer recreation program utilizing school properties, at the earliest
possible date.
The Commission unanimously gave its support to these two projects,

requesting that Dr. Marks proceed through the proper avenues of approach to the
solution of these problems.

Mr. Johnson reported that he had reviewed a number of communications in
response to the Commissions' appeal to interested civic organizations for suggestions
and thoughts on planning. As copies of general interest had been given to other
Commission members these communications were not read, but all have been acknowledged.
The Chairman recognized Mr. Lloyd Wood, candidate for Board of Supervisors,
Charlottesville District, and requested comment. Mr. Wood spoke briefly in favor of
the overall plan for the County. He also stated that the constituency in the
Charlottesville District, as it has made itself known to him, is desirous of planning
and land use, both as private property owners and as interested citizens, for the
planned growth of Albemarle County. Mr. Wood expressed the thought that without
zoning, property owners are being deprived of much needed protection in the area of
land use.
Mr. William Roudabush, Certified Land Surveyor, suggested that Albemarle
County encourage developers to adopt their own restrictions for their properties until
the County has a zoning ordinance that will provide for such restrictions. He also
noted that such a voluntary zoning would enhance property values because developers
need a pattern they can turn to.
The Chairman noted that as the Ordinance Committee was to meet immediately
after adjournment, the Commission was adjourned and went into work session.

In Section 14, Residential Town House Cluster, Six Units per Acre, as
adopted by the Board of Supervisors on June 15, 19670 the Commission, in consensus,
stated the invalidity of Paragraph A-9 until the Subdivision Ordinance, Sections
1-13, is revised.
Bringing to light Mr. Catlin's expressed concern over future traffic problems
stemming from mass development, the Commission entertained a general discussion on
traffic planning. The members each expressed a desire to be more knowledgeable on the
subject and to create an exchange of ideas, problems, solutions and plans on university,
city, county and state planning as pertains to roads, arterial streets and highways.
Mr. William Roudabush, C.L.S., suggested an exchange of known plans between major
contractors andcbvelopers and the various planning units. Mr. David Carr, Chairman
of the Committee on Streets, was requested to ascertain what traffic studies and
recommendations have been made by the related political subdivisions and report to
the Commission at its next regular meeting.

The Chair recognized Mr. Bernard Chamberlain, recognized as spokesman
for a number of residents of western Albemarle County. He presented a petition to
the Albemarle County Planning Commission, as follows:
"There has come to our attention,largely through the press
and heresay, information that the Albemarle County Planning Commission
is considering recommendation under which several areas of Stockton
Creek and several areas of Yellow Mountain Greek would be dammed and
flooded, whether or not the owners of the property wish this to be
done: III'
and we the undersigned land owners of these areas hereby
subscribe our names in protest of any recommendation being made in
this matter without full consultation with the land owners involved."
Attested by fourteen signatories of the above described
areas.

The Chairman assured Mr. Chamberlain and the delegation that any
recommendation and action taken by the Albemarle County Planning Commission would
be preceded by full consultation with the signatories and other involved; further
stating that the above mentioned project is in a very preliminary study stage at
this time.

thorough presentation, the Commission expressed a desire to view
certain drainage and control situations at the site. A committee
composed of Johnson, Moore, Carr, Tate and Townes was appointed

Mr. Trevillian abstaining, contingent upon favorable findings of

As the regularly scheduled Planning Commission meeting would fall on
Labor Day, the Commission re -scheduled the meeting for Wednesday, September 61
1967 at 7:30 p.m.
It was felt by some members of the Commission that the Commission should
take a stand on the current issue regarding the Shenandoah National Park boundary.
Upon motion by Mr. Moore, seconded by Mr. Trevillian, with unanimous consent, the
following statement was approved:
The Albemarle County Planning Commission is in agreement with
programs to maintain natural forests and other areas in natural state,
however, the Commission strenuously opposes any extension of the
boundaries of the Shenandoah National Park.
The Chairman having presided over the committee assigned to review the
subdivision ordinance, reported to the Commission on the committee's progress to
date. The Chairman stated that the form of the ordinance now in possession of
the Commission members was the total revision as produced by the committee,
however, consultation with Mr. Payne, Consultant -Planner, during August 7, 1967,

resulted in a change in language which would allow more control over restricted
✓ streets than the initial proposal envisioned. After general discussion, in which
Messrs. Johnson, Batchelor, and Tate expressed the desirability of such control,
the Chairman presented the ordinance in its revised form for consideration by the
Planning Commission. The Commission members having studied the proposal for the
previous week were well acquainted with the proposed changes and commended the
committee on its efforts. Upon motion by Mr. Carr, seconded by Mr. Trevillian,
and unanimously approved, the Commission accepted the subdivision ordinance as
revised and presented by the committee, and instructed the Secretary to present it
to the Board of Supervisors for their consideration.
Upon recommendation by the Chairman, the Commission expressed the desire
that necessary arrangements be made for a joint dinner meeting between the Albemarle
County Planning Commission and the City Planning Commission to discuss the subdiv:bion
ordinance and other mutual problems. The date was tentatively set for September 5.
The consensus of the Commission was that a public forum regarding the
proposed revisions in the subdivision ordinance be held at an unspecified date
between the August and September meetings. This forum would allow minor problems to
be resolved, thereby easing the task of the Board of Supervisors.

Heights, to the developer and to the City of Charlottesville for information and
consideration.
The Secretary read the communication from the Charlottesville Wilderness
Committee which questioned some of the statements reportedly made by members of
the Commission regarding the National Forest Reserve. It was the Commission's
consensus that Mr. Johnson, Chairman, should answer this communication with the
proper statement.
The Secretary read a communication from the City of Charlottesville
requesting that the Albemarle County Planning Commission endorse the up -dating
of the 1958 Master Plan for the City of Charlottesville which is to be accomplished
by a grant of 701 funds. Upon motion by Mr. Moore, seconded by Mr. Maupin, with
unanimous consent, the following resolution was approved by the Commission:
BE IT RESOLVED by the Planning Commission of
Albemarle County that the updating of the Master Plan of
the City of Charlottesville is hereby approved and endorsed,
and;
BE IT FURTHER RESOLVED that this Commission will
be glad to participate in checkpoint meetings and have the
opportunity to comment on plan proposals and recommendations
resulting from the execution of this project.
The floor was open for discussion of the proposed revisions in the
County Subdivision Ordinance. Mr. William Perkins, Member, firmly stated
his objection to the provision requiring an escrow fund in lieu of State
Standard Construction or Restricted Streets. A discussion followed, centering
on this point. It was stated by the Chairman that this point was the only

matter in the proposed revision that did not have unanimous approval of the Commission.
As the discussion progressed, the Chairman further stated that an obvious impasse
had been reached precluding unanimity on this one point. Upon motion, duly
seconded, with unanimous approval, the Chairman called a special meeting of the
Commission for Wednesday, September 13, at 3:30 p.m.; further requested that the
County Planner Consultant, Mr. Payne, and the members of the Board of Supervisors
be present to resolve this point of conflict and to further serve as an occasion
to apprise the Board of Supervisors of the content and intent of the proposed revisions.
Upon motion, duly seconded, with unanimous consent, the date for the Planning
Commission's public discussion on the proposed Subdivision Ordinance revisions was
set for 7.30 p.m., September 18, in the Board Room.
The Commission was reminded of the joint dinner meeting with the City
Planning Commission to be held September 13, at 6 o'clock p.m. at the Keswick Club
of Virginia.

The Secretary reported the suggested revisions to the proposed

Subdivision Ordinance resulting from the Planning Committee meeting of `
September 28, 1967.
The Committee unanimously proposed that Section 4, Paragraph A,
Sub -paragraph (4), be changed to read as follows:
"An adequate drainage system for natural and storm
water shall be provided for each subdivision by means of
culverts under streets, side, lead or outlet ditches, catch
basins or curb inlets, or any other devices necessary to
provide adequate drainage for such water. All pipe installed
for drainage purposes in connection with the construction of
streets three (3) miles or more from the City Limits of
Charlottesville shall be of a kind as approved by the Virginia
Department of Highways. All pipe installed for drainage pur-
poses under a proposed street within three (3) miles of the
City Limits of Charlottesville shall be reinforced concrete,
except in such cases when special conditions exist, permission
may be granted by the County Planning Commission for the use
of other materials."
After discussion by the Commission and having heard expressions
from the public, the Commission unanimously adopted the proposed change-,
The Committee further recommended that the proposed revision exempting
the division of family -owned lands for members of the family from the subdivision
regulations be deleted from the proposed ordinance revision. The Committee
stated that this provision virtually paralleled the restricted street provision
of the ordinance. After discussion by the Commission and those in attendance,
the Commission unanimously approved the deletion of the "family" provision of
the proposed ordinance revisions.
Dr. Marks, Chairman of the Recreation Committee, presented a comprehensive
report of the possibilites of recreation facilities adjacent to Totier Creek
impoundment. The report was a result of a field trip and meeting attended by
Mr. Johnson, Chairman, Dr. Marks, Mr. Townes and representatives of the State
Department of Planning, held on October 21 1967 at Totier.
Dr. Marks pointed out the need for protection of the shore line of
the impoundment and the need for expedient acquistion of certain area:- for

recreational purposes. These recommendations were presented to the Corrm:issi.on
for consideration. After very detailed explanation. of the recommendations, the
Commission unanimously accepted the report and adopted the following recommendations:
The Albemarle County Planning Commission does hereby
request that the Board of County Supervisors in the acquisition
of property for the Totier Creek impoundment, purchase the
necessary property encompassed by the flood plain elevation in
lieu of flood easement; and, further recommended that the County
purchase three sites adjacent to the impoundment for present
and/or future recreational purposes. These sites are generally
divided as: (1) approximately 25 acres bordered on the north and
east by the impoundment and on the south by State Route 726;
(2) approximately ten acres bordered on the west by the impoundment
and on the south by State Route 726; and (3) approximately five
acres bordered by the impoundment on the east at dead end of
State Route 737.
Upon motion by Mr. Carr, seconded by Nor. Maupin, with unanimous consent,
the aforementioned recommendation was approved.
Mr. Dave Carr, Chairman of the Roads Committee, gave a brief report on
the Charlottesville Major Street Plan, as presented to the Committee composed of
City, County and Chamber of Commerce representatives, pointing out several, minor
suggested improvements as recommended by the Committee. A detailed report will be
presented when the Charlottesville Major Street Plan is formally presented to the
County.
The Chairman made known to the Commission verbal communication by developers
in the interest of "park areas" provision in the Subdivision Ordinance. Upon motion
by Dr. Marks, seconded by Mr. Trevill.ian, with unanimous approval, the idea was
referred to legal counsel to ascertain the Planning Commission's position with
respect to the laws of Virginia on the subject of County parks and recreation
areas.
The Commission unanimously adopted the following statement occasioned by
the resignation of the secretary:
1400- WHEREAS, Phillip L. Tate has served as secretary of the
Commission from November, 1965 to October, 1967,
WHEREAS, in this capacity, his counsel and guidance con-
tributed greatly to the efforts of the Commission during a period
of great change in Albemarle County,

Commission reviewed the plat of B. .Aubrey Huffman showing the
.� proposed town house development of Sherwood Park by Charlottes-
ville Town Houses, Inc. and by unanimous vote decided to give

preliminary approval to the subdivision subject to the
addition by the developer of an excess road and cul-de-sac.
The Chairman requested counsel to review the latest
revision of the proposed zoning ordinance for Albemarle
County with the members present. The proposed ordinance
was duly reviewed page by page and various additions,
deletions and amendments were suggested and incorporated.
It was the consensus of those present that the proposed
zoning ordinance as changed was a sound and workable in-
strument for future planning and development in Albemarle
County and that it represented a good beginning in the field
of comprehensive land use.
By unanimous vote of the members present the Commission
determined to proceed to advertise a public hearing to be
held at 7:30 P.M. on November 28, 1967, in Albemarle County
High School in accordance with Section 15.1-431 of the Code
of Virginia (1950) as amended.
In subsequent discussion the Commission determined that
it would be advisable, proper and in the best interest of the
public to hold such other public discussions of the ordinance
as might be necessary to assist the public in understanding
the philosophy, administration and necessity of land use
planning and control. It was contemplated that at least one
*%*a* - hearing in the Scottsville area and one in the Crozet area

in addition to the advertised hearing at Albemarle High
School would be desirable.
The business of the meeting having been concluded
the Chairman adjourned the meeting at 10:45 P.M. November
8, 1967.

Preliminary plat of Bonnie Loch was presented to the Commission. Mr.
Trevillian excused himself from entering into discussion and/or voting by reason
of possible conflict of interest. Preliminary plat was approved.
Preliminary plat of Sherwood Park was presented. No action was taken.
In discussion of new dump site for the County, Avery Catlin was appointed
to be liason between the Planning Commission and the Board of Supervisors.
In discussion of jurisdictional areas for the Albemarle County Service
Authority, the Commission expressed their desire to help in any way possible to
make astudy of the jurisdictional areas.
