N%W The Executvie Committee of the County Planr_ing Commission met at 9:30 A.M. with the following members present: Mrs. Liady, Messers. Perkins and Stevens. Approval was given to a Revised Preliminary plan of the Meadows consisting of 111 Lots. Approval was given to a Revised Preliminary plan of "Glenorchy" consisting of 29 Lots. Final approval was given to a portion of "Glenorchy" consisting of 11 Lots. A preliminary plan of a portion of the Woolen Mills property was presented, after due discussion -the following motion was made by Mrs. Liady, seconded by Mr. Stevens: "In as much as the property in possession of Wollen Mills and }ro- perty in seperate ownership does not affect the physical drawbacks of the property, we give preliminary approval granting an exception in the case (subject to approval by one more member of the Commission.) At a meeting of the Executive Committee held on January 13, 19589 Mr. Johnson recommended that the above motion be amended to read as follows: "That lot no. 2 be made an out lot to be dedicated as a turn around, When the conveyances are made and the house be razed, also that considera- tion be given to the possibility of the use of these seven lots as a potential industrial site." M. Johnson, Perkins, 5 with the folloving members present: Mrs. Liady, Messers. and Stevens. A modified Preliminary Plan of a revised Preliminary Plan of the Mead6ws was presented by Mr. Sweet and given Preliminary approval. Final approval was given to Section II of "Glenorchy" consisting of 32 lots. Final Approval was given to a Plat of a portion of the Woolen Mills property consisting of six lots. Smith Commonwealth's Attorney MINUTES OF MARCH 13& 1958 MEETING OF'THE EXECUTIVE COMMITTEE 0=- ALBEMARLE COUNTY PLANNINvO COMMISSION The regular quarterY meeting of the Allemarle County Planning Commission was held at the Thomas efferson Inn March 13, 1958 with the following members present: Mrs. Liady, Messers. Perkins, Wm. Smith, Fray, Maupin, Beck, Stevens, Pence and Commonwealth Attorney Downing Smith, also present were Messers. E. L. Smith and E. N. Garnett, Albemarle County Supervisors. The business was called to order by Wm. Stevens, acting Chairman. Mr. O.R. Randolph appeared, -before the Commission with a plat of Niront Sub- division located just off Barracks Road. After careful study of the layoutthat of the Subdivision a motion was made by Wm. Smith and .?nd by y naLl approval be given to same Stevens abstained from voting. Also appearing before the Commssion were Mr. E.H. Copenhaver and Mac Dent with a plat of a portion of a Subdivision of Mrs. Sallie Smith's property located be- tween Smith Street, St. Clair Ave. and River Road. After due consideration a motion was made by Mr. Beck, second by Mr. Perkins that preliminary approval be given to this Subdivision providing Locust Lane for its full QO feet width extending north from the Subdivision to Locust Ave. be dedicated as a street. Final approval was given to this Subdivision on April 2, 1958. The proposed amendments to the Subdivision Ordinance made by the Albemarle County Board of Supervisors were read by Mr. Pence. After due discussion a motion was made by Mr. Wm. Smith,secord by Mrs. Liady that these amendments be approved as read. On motion made by Mr. Beck and second by Mrs. Liady a 90 day extention vas granted on the preliminary plans of Berkley Subdivision, subject to the same exceptions as noted at time of original preliminary approval. The question as tb the validity of Mrs. Azalea Williams Re -Subdividing a portion of Block C in Buckingham Subdivision was discussed but no action was taken. Stevens, Beck, Johnson, Perkins, Smith and Fray. All members of the Board of Supervisors were present. This meeting was called to discuss the proposed irmanrof the td toarthe oSubdivision Ordinance. Final approval was given to a portion of Azalea Gardens consisting of 7 lots subject to the following changes (1) that a temporary turn around be put at the end of Azalea Drive and Glen Ave., (2) that the wording City of Charlottesville be removed from the lot and be designated as Lot 17. Simms, Jr., Secretary MIr ms OF MAY 6 1958 MEETING OF THE EXECUTVIE COMMITTEE OF THE ALBEMARLE COUNTY PLANNING COMMISSION A joint special meeting of the City a dpCounty Planning Commission was held on May 6, 1958 in the City Hall Coune l Room with the following members present: Mrs. Liady, Messers. Johnson, Perkins, Stevens, and Simms. Also present from the City Planning Commission were Messers. Bowen, Grigg, Rinehart, Scribner, Youell and Dyke. The meeting was called to order by Milton Grigg, Vice -Chairman of the City Planning Commission. The first matter of discussion was the drainage pipe to be used within a 3 mile radius of the City Limits. The following amendment -,,was unanimously adopted by both planing groups and is to be inserted after Section 35-4(B)(2) as an addition to the last sentence and read "except in such cases where special conditions exist permission may be granted by the County Planning Commission for the used of other materials". The second matter discussed was the 30 foot pavement width. After much disc cussion the City Planning Commission unanimously adopted a motion not to change the ordinance which now requires 30 ft. On motion by Mr. Stevens and second by Wm. A. Perkins, Jr., the following resolution was unanimously adopted by the County Planning Commission, RESOLVED: That the Executive Committee of the County Planning lommission recommend the new requirement of 30 ft of crustied stone (Sec. 35-4; '$--1) and submit our d6cision to the Board of Supervisors for final action. Smith Comonwealth's Attorney no MINUTES OF PLANNING COMMISSION MEETING OF JUNE 129 1958 The regular quarterly meeting of the Albemarle County Planning Commission was held at the Thomas Jefferson Inn on this date at 6:00 P.M. with the following members present: Mrs. Liady, Dr. Birdsong, Mr. Fray, Mr. Powell, Mr. Stevens, Mr. William Smith, Mr. McClung, Mr. Maupin, Mr. Johnson, Mr. Beck, Mr. Perkins, Mr. Downing Smith, Commonwealth's Attorney and Mr. M. M. Pence, County Executive. Minutes of the regular meeting of March 13, 1958, and minutes of the Executive Committee meetings of April 1, April 29, and May 6, 1958, were read and approved. Dr. Y1. L. Birdsong brought before the meeting the matter of the sale of lots in the unapproved Subdivision of Sherwood Farms located on Route 29, South. It appeared that plat of this subdivision had been admitted to record in the Circuit Clerk's Office in error and that lots were being sold to individual purchasers. Dr. Birdsong expressed some anxiety as to certain losses that might be sustained by the purchasers in Sherwood Farms Subdivision since such subdivision has not had approval of either the Albemarle County Planning Commission or the Planning Commission of the City of Charlottesville. After considerable discussion, and on motion by Mr. Perkins, seconded by Mr. Beck, the following resolution was unanimously adopted: WHEREAS it has been brought to the attention of the Albe- marle County Planning Commission that a plat of Sherwood Farms Subdivision has been admitted to record in the Clerk's Office of the Circuit Court of Albemarle, which plat was not first approved by the Planning Commissions of the City of Charlottesville and the County of Albemarle, and WHEREAS, sales of lots shown on the plat may be in violation of the Subdivision Statutes and Ordinances, and WHEREAS, dire harm and financial loss may result to citizens of Albemarle from the purchase of lots in the subdivision. NOW, THEREFORE, BE IT RESOLVED that the Commonwealth's At- torney be and is hereby requested to enjoin sales of lots in viola- tion of the Subdivision Statutes and Ordinances within Sherwood Farms Subdivision. (Page 2.) The secretary presented plat for Subdivision known as "Acropolis" '*taw located on Route 250, East, on Pan Tops Mountain and consisting of eight lots. He advised that preliminary approval had been given this subdivision by the Planning Commission of the City of Charlottesville with revision as noted in red on said plat, changing the division line between lots 2 and 3, Block B. After study and on motion by Mrs. Liady, seconded by Dr. Birdsong, preliminary approval was given this subdivision. N-r. William Smith, who was Chairman of the committee from the Planning Commission in the formulation of a Sanitation Ordinance, reported that the matter had been revived by the Board of Supervisors and that at a meeting recently held with certain members of the Board of Supervisors and the Joint Health Department, several minor revisions *ere made. Mr. Smith advised as to the amendments and stated that the Sanitation Ordinance was now being edited for presentation to the Board of Supervisors. On motion by Mr. Stevens, seconded by Mr. Smith, it was unanimously RESOLVED that the Planning Commission reaffirm its recommendation to the Board of Supervisors that the Sanitation Ordinance as amended be given favorable consideration by that body. M. this date in the Board Room with the following members present: Mr. Johnson, Mrs. Liady, Mr. Stevens and Mr. Perkins. Section 3 of the "Meadows" was presented and on motion by Mr. Stevens, seconded by Mr. Perkins, final approval was given to same. A plat of the Re -division of a portion of lots 51 and 165 Locust Grove Extended was also presented and on motion by Mr. Perkins seconded by Mr. Stevens, final approval was given. Mr. Amos Sweet presented a preliminary plan of "Lakeside" sub- division and "Brook Hill" subdivision located on Rt. 20 south, the property of Robert Shoffner. After due consideration on motion by Mr. Stevens, seconded by Mrs. Liady, preliminary approval was given to "Lakeside". As to "Brook Bill" subdivision it was suggested by the Committee, that further study be given to the road plan and the size of lots before any action be taken on same. Simms,�ecretary TO THE BOARD OF COUNTY SUPERVISORS ALBEMARLE COUNTY, VIRGINIA Gentlemen: At a joint meeting with the City Planning Commission held on August 12# 1958, a matter with respect to a change in the definition of a subdivision was considered. It appeared necessary from the point of view of the two Planning Commissions that a change be made in order to include the subdivision of lots in three or more acres which required the establishment of new roads or access easements. The following is action of the County Plan- ning Commission in this regards "on motion, duly made and seconded, it was unani-- mously RESOLVED that the Planning Commission recommend to the Board of County Supervisors of Albemarle County, Virginia, that the definition of a Subdivision be made to read as follows$ sSu di,' ryigipj - The division of a lot, tract or parcel of Is into two or more lots, plats, sites or other division of land for the purpose, whether immediate or future, of sale and of building development. Division of land into lots of three acres or more not involving the establishment of a new street or actress easement shall be exempt from these regal-- tions.* The above is submitted for your favorable consideration. Simms, Jr., Secretary ALBEMARLE COUNTY PLANNING COMMISSION MINUTES OF THE AUGUST 12,, 1958 JOINT MEETING OF THE CHARLOTTESVILIE AND ALBEMARLE COUNTY PLANNING COMMISSIONS A special dinner meeting of Charlottesville and Albemarle County Planning Commissions was held on August 12, 1958, at 6:00 P. M. in the Stonewall Jackson Room of the Monticello Hotel. The following members were present from the City Planning Commission: James E. Bowen, Jr., Milton L. Grigg, Raymond V. Long, Jr., Loran A. Thompson_, C. C. Youell, and Thompson A. Dyke. From the County Planing Cormi_ssion: C. Nelson Beck, Floyd E. Johnson, Mrs. Fred Liady, Cecil Maupin, William A. McClung, Maupin M. Pence, William A. Perkins, Jr., John M. Powell, William Smith, William T. Stevens and Fletcher Simms. Also present were Mayor R. M. Davis, Ted McKown, Allen Bruns and Ray Niblack. The meeting was called to order by Dr. Thompson. The meeting was called by the City Planning Commission to discuss a possible change in the definitior of a Subdivision. After due discussion by both Commissions on a motion made by Mr. Stevens and seconded by Mr. Maupin it was unanimously resloved that the Planning Commission recommend to the Board of County Supervisors of Albemarle County, Virginia, that the definition of a Subidvision be made to read as follows: r "SUBDIVISION" --The division of a lot, tract or parcel of land into two (2) or more lots, plots, sites or other division of land for the purpose, whether immediate or future, of sales and of building development. Division of land irto lots of three (3) acres or more not involving the establishment of a new street or access easement shall be exempt from these regulations. The City Planning Commission on a motion by Mr. Long and seconded by Mr. Youell and unanimously adopted, voted to recommend to the City Council that the above Resolution be adopted. There being no further business the meetirg adjourned. Following the adjournment of this meeting the Albemarle County Planning Commission held a short meeting in Room 304 of the County Ofrice Building with the following members present: Floyd Johnson, Nancy Liady, William Stevens, William A. Simms, Jr., Secretary Chairman MINUTES OF THE SEPTEMBER 3. 1958 MEETING OF THE EXECUTIVE COMMITTEE OF THE ALBEMARLE COUNTY PLANNING COMMISSION The Executive Committee of the Albemarle County Planning Commission met this date with the followirg members present; Mrs. Liady, Messers. Johnson, Stevens and Perkins. Mr. Amos Sweet brought,before the Commission a preliminary plat of "North Wood", on motion by Mr. Perkins seconded by Mrs. Liady preliminary approval was given. This Subdivision has later been named "Northerly". The final plat of "University Heights" was presented on motion by Mr. Perkins, seconded by Mr. Stevens final approval was given. Final approval was given to a Redivision of lots 13 thru 17 Block 75 Belmont, Mr. Perkins abstained from voting. The final plat of Section ? of "Berkeley Community" was presented,on motion by Mr. Stevens seconded by Mr. Perkins final approval was given. A preliminary plan of a Subdivision located at intersection of Park Street and Wilder Drive, to be developed by Mr. Henry Javor was presented on motion by Mr. Perkins, seconded by Mr. Stevens preliminary approval was given. It was suggested that consideration be given by the developer to relocating the lot line between lots 8 and 9 . There being no further business the meeting adjourned. Hu-6-F. Simms, Jr:, Secretary C ha irma n MINUTES OF THE SEPTEMBER 17, 1958 JOINT MEETING OF THE ALBEMARLE COUNTY BOARD OF SUPERVISORS AND ALBEMARLE COUNTY PLANNING COMMISSION The meeting was held this date with the following members present: From the Board of Supervisors--Messers. Thraves, Sutherland, Harris, Williams, Smith, Garnett and County Executive, M. M. Pence. --From the Planning Commission --Mrs. Liedy, Messers. Perkins, Johnson, Biidsong, McClung and Stevens. The meeting was called to order by 14r. Williams, Chairman, who explained that the main purpose of the meeting was to discuss the proposed change ir;'Afinition of a Subdivision as proposed by the County Planning Commission. Members of the Planning Commission were given an opportunity to explain their reasons for recommending the change in the definition. Mr. Perkins stated that due to the development of Subdivision containing lots of three (3) acres or more, such subdivisions would not fall under the jurisdiction of the Subdivision ordinance. It was anticipated that such subdivisions at some future date would create certain problems with regard to roads, drainage, access streets, in realtion with other Sub- divisions, etc. He advised that the Planning Commissior deemed it wise, that such Subdivisions should fall within the regulatory powers of the Planning Commission as set forth in the Subdivision Ordinance. An opportunity was given to the public to speak in this regard. Several people spoke both pro and con. After hearing the discussion it 1r0 was moved by Mr. Harris, seconded by Mr. Southerland, that the Board go into Executive session. After considerable discussion. the Board re- convened into regular session. On motion by Mr. Thraves, seconded by Mr. Harris the following resolution was unanimously adopted; BE IT RESOLVED by the Board of County Supervisors of Albemarle County, Virginia, that the recommendation of the Planning Commission to change the definition of a Subdivision from, "The division of a lot, tract or parcel of land into two or more lots, plots, sites, three (3) acres or less in area, or other division of land for the purpose, whether immediate or future, of sale and of building development. In MINUTES OF THE DECEMBER 180 1958 MEETING OF THE ALBEMARLE COUNTY PLANNING COMMISSION The regular quarterly meeting of the Albemarle County Planning Commission was held at the Thomas Jefferson Inn at 6:00 P. M. this date with the following members present: Messers. Johnson, Stevens, McClung, William C. Smith,CbcilgMaupin, John Powell, Nelson Beck, Dr. Birdsong and Mrs. Liadyy. Also present were Downing L Smith, Commonwealth's Attorney and M. M. Pence, County Executive. The business meeting was called to order by Mr. Johnson, Chairman. Mr. William Smith said he wished to thank the Executive Committee for their diligent services during the past year. The matter regarding the exhibiting of a large scale map at all meetings, showing the approximate location of Subdivisions to be discussed was brought before the Commission, after due discussion of this matter, on motion by Mr. Beck seconded by Mrs. I,iady and unamiously adopted.The secretary was requested to furnish such a map. A matter in regard to recording dissenting votes by name to any motion or Resolution was given considerable discussion on a motion made by Mr. Stevens and seconded by Dr. Birdsong and unamiously adopted, it was Resolved that in the future all dissenting votes be recorded by name. In regard to presenting plans and profiles of all streets and roads along with the final Subdivision plan was given considerable discussion, on a motion by Mr. William Smith and seconded by Mr. Pence it was unam- iously Resolved that in the future the developer of any Subdivision within the three (3) air mile radius of Charlottesville, be requested to present plans and profiles of all streets and roads for approval along with the final plat of the Subdivision. A revised preliminary plan of "Oak Hill" Subdivision was presented, on a motion by Mrs. Liady seconded by Dr. Birdsong, it was unamiously resolved that an exception be granted to the violation of the 700 foot regulation in Cul-de-sacs because of the terrain and preliminary approval be given.
