HomeMy WebLinkAbout07 19 77 PC MinutesJuly 19, 1977 The Albemarle County Planning Commission conducted a meeting on Tuesday, July 19, 1977, 7:30 p.m., Board Room, County Office Building, Charlottesville, Virginia. Those members in attendance were Mr. David W. Carr, Chairman; Mr. Roy Barksdale; Mr. Kurt Gloeckner; Col. William Washington; Mr. Paul Peatross; Mrs. Joan Graves; and Mrs. Opal David, ex-Offico. Absent were Mr. Peter Easter, Vice -Chairman; Mr. Leslie Jones; and Dr. James Moore. Other officials present were Mr. Ronald Keeler, Assistant Director of Planning; Mr. Carlos Montenegro; and Mr. Frederick W. Payne, Deputy County Attorney. order. Mr. Carr established that a quorum was present and called the meeting to ZMA-77-10. Biscuit Run, Inc. Mr. Payne reminded the Commission that this had been deferred for a period of two weeks in order that the applicant could supply the staff and County Attorney's office with proper documents that he was the contract purchaser at the time of application. Mr. Payne said that according to the information he has received within that two week period that the application is inadequate and that the applicant is not a valid contract purchaser. Thus he advised the Commission that ZMA-77-10 is not properly before them, and recommended the Commission dismiss the request from its agenda. Mr. Carr said that he had consulted with the County Attorney that date and advised the Commission that the information provided by Mr. Payne is accurrate. He recommended to the Commission that the advice of Mr. Payne be followed and that the application be dismissed. Mrs. Breeden stated that the attorneys being mentioned are not her attorneys and asked what recourse she would have in this matter. Mr. Carr noted that the comments of Mr. Payne were unqualified. He told Mrs. Breeden that if the petitioner wishes to make a proper application the County will be happy to hear it. He suggested that she talk to either the County Attorney or the Director of Planning to establish what would make the application proper. Mr. Barksdale stated that he had made the motion two weeks ago to defer for two weeks in order that the applicant provide the County with the proper documents for review prior to this meeting. In view of the fact that this motion had not been fulfilled, he moved that the Commission dismiss ZMA-77-10 as not properly before them. Mr. Peatross seconded the motion, which carried unanimously, with no discussion. ZMA-77-06. Daniel and Lorene Robinson Mr. Keeler reported that the applicant has requested deferral of this matter until the Planning Commission's meeting of August 2, 1977. %7 Mr. Barksdale moved that the Commission accept this request for deferral. Mr. Gloeckner seconded the motion, which carried unanimously, with no discussion. L. W. Ayers Final Plat - located on the east side of Route 743 northeast of Earlysville: Mr. Montenegro reported that the A-1 zoned property is proposed to be divided into two 20 acre lots from a 170+ acre tract. The staff favors the proposed division, noting that the entrance facility at Route 743 should be realigned to form a "T" intersection with Route 743. The staff recommended approval of the plat subject to the following conditions: 1. Written Health Department approval; 2. Virginia Department of Highways and Transportation approval of entrance facilities; 3. Realignment of entrance to form a "T" intersection with Route 743; 4. Note should be added to plat stating: "No further division along this easement without Planning Commission approval." ( Mrs. Graves entered the meeting. ) Mr. Montenegro stated that with the "T" intersection, the sight distance will be adequate. Mr. Barksdale asked if the Ayers own property that will permit this. Mr. Montenegro stated that this will be a minor alteration. Mr. Tom Sinclair, representing the applicant, stated that the easement will go straight with the road, since he had to make an adjustment to the plat. Mr. Peatross said that he is curious about the shape of parcel A. Mr. Sinclair replied that this was requested by the applicant. Mr. Peatross recommended approval subject to the conditions recommended by the staff. Col. Washington seconded the motion, which carried unanimously, with no discussion. Melvin T. Dixon Final Plat - Located on the east side of Route 604, near Greene County: Mr. Montenegro stated that the applicant proposed to divide a 30.88 acre parcel from a 68+ acre tract to be served by a 50 foot right-of-way. The staff recommends approval subject to the following conditions: 1. Written Health Department approval; 2. Note be added stating: "No further division along this easement without Planning Commission approval." 3. Owner's signature must be notarized. __ 7Y- Mr. Montenegro also noted that the Highway Department stated that if the land is further subdivided at a later date, the sight distance would have to be rechecked. Mr. Barksdale moved approval of the plat subject to the three conditions recommended by the staff. Mr. Peatross seconded the motion, which carried unanimously, with no discussion. C. Edward Good Site Plan - located on the south side of Route 631 just east of and adjacent to the Southern railroad tracks: Mr. Montenegro advised the Commission that the property is zoned CO. On December 1, 1976, the Baord of Supervisors approved the rezoning of this property from R-2 to CO. The applicant obtained a variance of the side yard setback requirement on July 12, 1977. This is a proposed three storie office building providing 9,075 square feet of net office area and the required 46 parking spaces. The plan covers approximately 3/4 of a 1.496 acre site. The plan provides for a deceleration lane on Route 631 and for the installation of a fire hydrant on the south side of Route 631. The site will be served by public water and septic facilities. Considering the peculiar shape and the severe topography of the lot, staff feels that the applicant has presented a good plan. Therefore, the staff recommended approval of this plan subject to the following conditions: 1. Written Health Department approval; 2. Virginia Department of Highways and Transportation approval of entrance facilities; 3. Realign dumpster space to be at a 120 degree angle to the backing space; 4. Bumper blocks must be located on all spaces without curbing; 5. Landscape items to be replaced if they should die. Mr. Robert McCleod said that the applicant can meet all the five conditions of approval. Mr. Gloeckner questioned if the Engineering Department had given approval of the drainage plan. Mr. Montenegro replied that they have. Mr. Gloeckner moved approval of the site plan subject to the conditions recommended by the staff. Mr. Barksdale seconded the motion, which carried unanimously, with no discussion. Westfield Office Complex Site Plan - located on the south side of Westfield Road just east of the new Division of Motor Vehicles site: _ Mr. Montenegro stated that the B-1 property is proposed for a two storie office building providing 5,500 square feet net office area and five parking spaces over the required 30. The staff stated that the layout works well, however, more landscaping is recommended along the front and western side of the property. Therefore, the staff recommended the following conditions of approval: 1. All parking spaces that have no curbing are to have anchored bumper blocks; 2. Staff approval of landscape plan including additional plantings on front islands and on western "slope"; 3. Provide an 18" high temporary dirt berm at eastern end of lower parking lot; 4. Provide railroad ties along parking area at southwestern corner of property to divert drainage; 5. Highway Department approval of entrance facilities; 6. Landscape items to be replaced if they should die. Mr. Barksdale questioned the additional landscaping. Mrs. Graves questioned if the eastern end of the property will later be developed with another entrance. Mr. Montenegro stated that it could be limited to one entrance only if developed as one parcel. Mr. Peatross questioned condition #3. Mr. Montenegro stated this will be permanent if the lower end is developed. The purpose of the berm is to channel the water to the drop inlet. Mr. Gloeckner felt that a cross section of the berm should be shown pn the site plan. He also questioned the amount of drainage area. Mr. Sinclair, representing the applicant, stated that it is just on -site drainage, and it will go into a 12" pipe. Mr. Bill Prillaman, also representing the applicant, stated that he is concerned a bout the request for deciduous trees. Mr. Montenegro stated they would look nice at the entrance. Westfield Road is bare and needs trees is the reason for a landscape plan. Mr. Keeler pointed out that this plan does not require screening on the south side. Mr. Montenegro suggested that Mr. Prillaman come to the Planning Department to discuss the landscape plan. Mrs. Graves questioned if there will be some outside lighting. Mr. Montenegro said that it will be directed away from the street. Mr. Peatross moved approval of the site plan subject to conditions 1, 2, 4, 5, and 6 as recommended by the staff, and the following amended condition #3: 3. Provide an 18" high dirt bern at eastern end of lower parking lot to sufficiently channel water to the drop inlet until the lower end of the property is developed. Mr. Gloeckner seconded the motion, which carried unanimously, with no discussion. Pantops-Worrell Office Building Site Plan - located on the south side of Route 250 East opposite the Odyssey Club: Mr. Montenegro reported that the B-1 property is proposed for a one and a half storie office building with approximately 2,400 square feet of office space and 12 parking spaces. The staff feels that this plan is consistent with existing develop- ment near the site. The staff is concerned about the handicapped access; however, due to grade problems no better access seems available. In terms of access to and from the site, the applicant proposes a 20 foot wide road which will connect with an existing 14 foot wide road leading to Route 250 East. Article 17-5-7 of the zoning Ordinance requires that "The pavement of vehicular travel lanes or driveways designed to permit vehicular travel on the site and to and from adjacent property and parking areas shall be not less than twenty (20) feet in width." Therefore, the staff felt that the entire length of roadway from the parking area to Route 250 East should have a 20 foot width of pavement. The applicant has already expressed an interset in obtaining a variance from this requirement. If so, the applicant will have to resubmit a revised site plan noting the new width and variance, if obtained. The staff recommended approval of the site plan subject to the following conditions: 1. Written Health Department approval; 2. County Engineering Department approval of driveway pavement specifications; 3. Access road must have a 20 foot paved width all the way to Route 250 East; 4. Virginia Department of Highways and Transportation approval of entrance facilities at Route 250 East; 5. Landscape items to be replaced if they should die. Mr. Barksdale questioned if the private drive is used strictly for Worrell. Mr. Gloeckner pointed out, in regard to the existing drive, that if the property is further developed, it will be required to have another site plan. Mrs. Graves said that she does not think the Commission can waive a condition of the ordinance. Col. Washington stated that if there is a way to preserve the existing row of trees along the drive, it should be done. Mr. Peatross said that he has heard nothing that states the trees will have to be destroyed. Mr. Carr said that when the property was rezoned, he expected to see the facility expand. Since this is an expansion of only 3600 square feet, it cannot accommodate too many more employees. Therefore, he said that he is inclined to let this expansion proceed with only the 14 foot road, in view of the trees. However, if at a later date it is further expanded, this matter would have to be readdressed. Col. Washington suggested deferring the matter until it can be established h ow much or how little the road can be widened. - Y,t - Mr. Payne advised the Commission that this is one of the limited cases where the Planning Commission and Board of Supervisors can permit a lower geometric design standard for a road. He said that he feels the Commission can grant a variance in this case, and read from Section 17-5-6 of the ordinance which permits this variance. Mr. Gloeckner stated that he favors the 16 foot road all the way through, with gravel on either side. Mr. Peatross said that he still has not heard anything which says the 20 foot road should not be required. Mr. Gloeckner said that he agreed with the Colonel that the matter should be deferred. Mrs. Graves felt that outdoor lighting should be shown on the plan. Col. Washington stated that it seems logical to require a minimum 16 foot road all the way through, and there is also logic not to permit to widths of roadway through the property. Mr. Gloeckner asked if the staff could measure the possible expansion width and recommend a road width in terms of that. Mr. Barksdale moved action be deferred until the next week in order that this could be accomplished. Mr. Gloeckner seconded the motion, which carried unanimously, with no discussion.
