October 24, 1978
The Albemarle County Planning Commission held their regular meeting October 24, 1978,
7:30 p.m., Third Floor, County Office Building, Charlottesville, Virginia. Those members
in attendence were Mr. James Huffman; Col. William Washington, Vice -Chairman; Mrs. Joan
Graves; Mr. Charles Vest; Mrs. Norma Diehl; and Mr. Tim.Lindstrom, Ex-Officio. Those
members absent were Mr. Kurt Gloeckner; Dr. James Moore; Mr. Layton McCann; and Mr. Peter
Easter, Chairman. Other Officials present were Mr. Ronald Keeler, Assistant Director of
Planning; Miss Mason Caperton, Planner; Mr. Donald Gaston, Senior Planner; and Mr. Fred
Payne, Deputy County Attorney.
Col. Washington established that a quorum was present and called the meeting to order
at 7:30 p.m.
The minutes of October 10, 1978 were approved as corrected.
Charlottesville -Albemarle Airport Site Plan - located southwest of the intersection
of Routes 649 and 606 at the Airport; proposed additional parking facility.
Miss Caperton presented the applicant's request.
Col. Washington asked if the grading permit includes storm run-off.
Mr. Sinclair, the applicant's representative, stated that the storm run-off is in-
cluded in the grading permit, which has been approved.
Mr. Coburn, Highway Department, noted that the entrance on Route 606 will fall within
Highway Department standards. He noted that although this entrance falls within the Depart-
ment's standards the Department would prefer the entrance be located 500 feetfrom
the intersection of Routes 606 and 649. He also noted that Route 649 is included in their
6 year road plan and that both Routes 606 and 649 will be channelized for 500 feet and at
that time the road will only be good for right turns in and out.
Mike Boggs, the applicant, noted that it is important to keep the air carried traffic
and small aircraft separated. He stated that he doesn't feel the entrance will cause any
problem. He also stated that the traffic using the entrance on Route 606 will be at a
minimun.
Mrs. Graves asked what the situation will be on Rt. 606 when the Industrial Park is
developed.
Mr. Boggs noted that this situation will change over time.
Mr. Sinclair noted that in five to six years when the Highway Department changE the
road the Airport Master Plan will be updated.
Mr. Coburn commented that with the stop signs and turns at this particular intersection
the entrance at this location will be one more decision that a driver will have to make
He commented that if the Commission wishes to approve the 'proposed entrance as is, that it
is up to state standards
Mrs. Graves asked if the problem was with the entrance now, or 5 years from now.
Mr. Coburn stated that the potential for a problem is there from the moment the
entrance is opened.
Mrs. Diehl stated that she thinks maybe there are other ways to channel the traffic
so there isn't any entrance on Route 606.
Col. Washington asked if the entrance is left as it is now can the Highway Department
accomplish anything toward having it relocated.
Mr. Coburn stated that once the entrance :is approved by the Commission there is nothinc_
the Highway Department can do since the entrance is up to standards.
Mrs. Graves moved for approval of the site plan with the deletion of an entrance on
Route 606 and the following conditions:
1. Virginia Department of Highways and Transportation approval of entrance (proposed
entrance was not approved);
2. Fire Official approval of the location of fire hydrant; show existing hydrant on plan;
3. Staff approval of landscape plan;
4. County Engineering Department approval of pavement specifications and curbing;
5. Grading permit;
6. Technical requirements as required in Article 17 of the Zoning Ordinance;
7. Signs must comply with regulations setforth in the Zoning Ordinance;
8. Show required handicapped parking spaces in short term lot.
Mrs. Diehl seconded the motion, which carried unanimously, with no further discussion.
Scottsville Fire Department Site Plan - located between Routes 6 and 737, north of
Route 20 in Scottsville; proposed location of the Scottsville Fire Department.
Miss Caperton presented the applicant's request.
Mr. Shumaker, the applicant, commented that the Fire Department is willing to co-
operate with the County.
Mrs. Graves asked about a hydrant when public water is available.
Mr. Keeler noted that it will be difficult to require the Fire Department to have a
hydrant since there are no plans for public water in that area.
Mr. Huffman moved for approval of the site plan with the following conditions:
1. Highway Department and County Engineering Department approval of direction of drainage
flow;
2. Grading permit;
3. Change width of aisle to read "24 feet" in parking lot;
4. Change adjacent zoning of the Payne property to read R-1;
5. Note that the Payne driveway is to be abandoned when the new entrance is constructed;
6. Staff approval of landscaping; recommend more ornamental trees and shrubs inside curbs
around parking area;
7. Highway Department approval of entrance;
8. Dumpster screen must be non-combustible.
Mrs. Graves seconded the motion, which carried unanimous
ly with no further discussion.

Mrs. Diehl asked if Mr. Cortez's letter recommending that a fire hydrant be installed
by the joint efforts of the Fire Department, Scottsville Shopping Center and W. F. Paulett's
could be referred to the Board of Supervisors.
Mr. Keeler noted that the staff can be directed to see that this letter is presented
for their review.
There was no further discussion.
Bearing Technology, Inc. Site Plan - deferred from October 17, 1978.
Mr. Gaston presented the applicant's request.
Mr. Lewis represented the applicant and had no comments.
Mrs. Graves moved for approval of the site plan with the following conditions:
1. Comply with soil erosion ordinance;
2. Delete optional driveway.
Mrs. Diehl seconded the motion, which carried unanimously with no further discussion.
Sunny Hill Motel Final Plat - located on Route 29 North, north of Charlottesville;
proposed division of the parcel into 2 lots, approximately 1 acre each.
Miss Caperton presented the applicant's request.
Mr. Birckhead, the current owner of the property, commented that the conditions
placed on this plat would ruin Mr. Edwards (contract purchaser's) property.
Mr. Edwards asked if parcel B would have to be served by public water.
Miss Caperton informed him that it would.
Mr. Edwards asked what would effect will this have on parcel A.
Mr. Keeler noted that parcel B:will have to be combined to Mr. Edwards property

Mr. Edwards asked how did he go about doing that.
Mr. Keeler noted that a note will have to be on the plat noting this combination.
Mrs. Graves stated that if this _plat had gone before the Site Review Committee some
feedback would have been gotten from the Highway Department before this evening. She
suggested that this plat be deferred.
Mr. Edwards stated that he is concerned with an easement across parcel A to get to
parcel B and the back lots. He stated that this will affect the planned use for the pro-
perty. He noted that he intends to have a front show line for his used car lot. He
noted that it seems reasonable to have a commerical entrance into parcel A and leave the
joint entrance to parcel B.
Ms. Holowinsky, the applicant's representative, noted that she had not received any
comments from the Highway Department until Monday morning.
Col. Washington commented that the note on plat "Deed Book 320 - 20 foot easement",
doesn't indicate how long the easement has been there.
Mr. Birckhead noted that the easement has been in this location for 20 years.
Mrs. Diehl moved for deferral of the plat. Mr. Vest seconded the motion.
Col. Washington asked for a date for deferral.
Mr. Keeler suggested either October 31 or November 14th.
Col. Washington stated that it will be heared October 31st and be heared at the
beginning of the meeting.
The motion for deferral carried unanimously, with no further discussion.
Nunn/Treakle Preliminary Plat - located off the Old CCC road, northwest of Route 630
near Alberene; proposed 4 acre division leaving approximately 22 acres residue.
Miss Caperton presented the applicant's request.
Mr. Lindstrom asked what is the status of an Old CCC road.
Mr. Treakle, the applicant's representative, noted that this road has some development
on the right hand side. He commented that the road. was cut during the thirties and used as
a fire trail. He stated that a plat that was recorded in 1972 dedicated the road to
public use. He noted that the subdivision proposed will not change the actual usage
of the road. He stated that the recorded plat has about 40 to 50 parcels. He informed
-the Commission that he has clients who would like to take a dwelling that has fallen into
disrepair and make substantial improvements.
Mr. Keeler noted that with 40 to 50 parcels on the road, that the road will have to
come upt to state standards, if the Planning Commission requires compliance with the private
road provisions.
Mr. Treakle asked the Commission members that if they chose to approve the preliminary
plat he would like for them also to authorize the staff to give administrative approval on
the final plat.
Mr. Payne noted that the Commission has the power to require upgrading the current
road or to have any dwelling on the residue enter on a State Road.
Mr. Huffman stated that this road cannot handle the dwellings already using it. He
noted that he could agree to approving this subdivision.since the dwelling is already
located on the road, but feels that any dwelling on the residue should enter on a State
Road.
Col. Washington stated that he feels another condition should be added to the plat
to guarantee that the technical data is supplied on the plat.
Mrs. Graves commented that for this reason the final plat should come back to the
Commission for final approval.
Mr. Keelerstated that the staff does not sign final plats unless the technical
requirements have been met.
Mrs. Diehl asked that technical data be furnished on the final plat before Planning
Commission review.
Mr. Vest moved for approval with the following conditions:
1. Note on plat: "Not more than one dwelling on 4 acre parcel without Planning Commission
approval;"
2. wavier granted of private road requirements;
3. Note on plat: "Residue shall not have access to the CCC road without Planning Commissior.
approval;"
4. Health Department approval of septic facilities on 4 acre parcels;
5. The Planning Commission will not review the final plat unless all technical requirements
are included.
Mr. Huffman seconded the motion, which carried by a vote of 3-1-1. Mrs. Graves
dissented and Mrs. Diehl abstained.
There was no further discussion.
Herold Final Plat - located about 1 mile south of Route 631 and I-64 on an Old County
road; proposed two acre lot subdivision leaving 16 acres residue.
Miss Caperton presented the applicant's request.
Col. Washington asked what type of road and pavement did the Old County road have.
Mr. Gregg, the applicant's representative, stated that it is an old road which is
barely passable. He noted that the applicant wishes to upgrade the road enough to use
as private driveway.
Col. Washington asked what does platted easement mean (condition #2).
Mr. Keeler stated that he is not sure why the County Engineer wishes to see a platted
easement unless he wants to verify that the easement actually exists.
Mr. Payne noted that he has seen few things harder to trace than an Old County road.
He noted that he would like to see a reference on the plat as to where the road can be
traced. He also commented that if this is an Old County road or an abandoned public road
this could cause this parcel to be land locked.
Mr. Gregg stated that the only thing he can do is go back and research this matter
further. He noted that the road shown on the County Tax Map as some type of easement.
Mrs. Graves asked Mr. Payne if he feels this item should be deferred.
Col. Washington noted that he would be reluctant to act on this matter.
Mr. Gregg stated that they could act on the plat subject to the old road being used
for -access.
Mrs. Graves moved for approval of the plat subject to the following conditions:
1. Written Health Department approval;
2. Written approval of the driveway from the County Engineer;
3. Highway Department approval of the entrance on Route 631;
4. Show distance to corner of residue (tie lines);
5. Don't need to dedicate 25 feet from centerline;
6. Note on plat: "No further division of residue without Planning Commission approval;"

7. Verify access to the property to the satisfaction of the County Attorney.
Mr. Vest seconded the motion which was carried unanimously, with no further
discussion.
Woodburn Farm Final Plat - located off Route 649 at the Jefferson Village subdivision;
proposed two lot subdivision, 40,008 square feet and 69,158 square feet.
Miss Caperton presented the applicant's request.
Mr. Gregg, the applicant's representative,, stated that he had no comments except
that the building permit has been issued and the house built.
Mr. Lindstrom stated that he doesn't think; this can happen anymore.
Miss Caperton stated that it was her understanding that a building permit can be
issued on the first dwelling on a parcel if there is a note on plat that reads: "No
further division without Planning Commission approval."
Mrs. Diehl moved for approval of plat with. the following conditions:
1. Note the source of title;
2. Note the material of permanent reference monuments.
Mr. Vest seconded the motion, which carried unanimously, with no further discussion.
Mark Logan Final Plat - located west of Route 622 on the Hardware River near Fluvanna
County; proposed division of 7 acres leaving 173 acres residue.
Miss Caperton presented the applicant's request.
Mrs. Graves asked if the Planning Commission can require Highway Department approval
of the entrance in Fluvanna County.
Mr. Payne noted that Albemarle's Planning Commission has no jurisdiction in Fluvanna.
He noted that the Highway Department is not restricted by County lines. He noted that
the Planning Commission can require the Highway Department look at this entrance.
Mr. Treakle, the applicant's represented, rioted that he has a maintenance agreement
for the road that has not been taken to Mr. Payne for approval.
Mrs. Graves asked if the seven acres of the parcel are on both sides of the easement.
Mr. Treakle noted that the easement goes through the center of the 7 acre parcel and
the purpose of this proposal is to provide for access to lower portion of proprty.
Miss Caperton stated that the staff recommends that this easement run along the
property line instead of through the property.
Mr. Treakle noted that an easement is already located through the center of the
property and is convenient.
Miss Caperton stated that she was not aware a road was there since it was not on the
previous plan.
Mr. Keeler stated that he doesn't think there will be a problem since the road
actually exists.
Mr. Vest moved for approval of the plat with the following conditions:
1. Fee due of $40.00;
2. Waiver of scale granted;
3. Note on plat: "No further division on 50 foot right-of-way without Planning Commission
approval;"
4. County Engineering Department written approval of entrance road;
5. Compliance with private road requirements; including the 50 foot right-of-way if serving
parcels to the south;
6. Note floodplain limits on plat;
7. Note the centerline of the proposed right-of-way;
8. Highway Department approval of entrance.
Mr. Huffman seconded the motion, which carried unanimously with no further discussion.
Harold B. Johnson Final Plat - located off Route 676 near Decca; proposed 4 lot
subdivision, lots ranging from 5 to 10 acres.
Miss Caperton informed the Commission that the applicant had called requesting
deferral until November 21, 1978.
Mr. Vest moved for deferral until the requested date. Mr. Huffman seconded the motion,
which carried unanimously with no further discussion.
Bob Bressan Catering Service Site Plan - located off South Pantops Drive, south of
Route 250 East; proposed to locate a catering service in an existing building.
Miss Caperton presented the applicant's request.
Mr. Bressan, the applicant, commented that he would like clarification of condition
#1.
Mr. Keeler noted that the fire hydrant can be bonded. He commented that it is not
usually the practice to bond items that deal with public health, safety and welfare, but
water is not currently available#
Col. Washington stated that he is not familiar with bonding fire hydrants.
Mr. Payne stated that public water is in the foreseeable future and it is legal to
bond items on a site plan that are conditions of approval.
Mrs. Graves moved for approval of the site plan with the following conditions:
1. Fire Official approval of the placement of the required fire hydrant when the new
water line across Free Bridge is installed. The hydrant shall be within 400 feet of
the structure with 1,000 gpm at 20 psi;
2. Landscape plan to be approved by staff; recommend several 6' to 8' white pines or other
evergreens on east and west sides of the parking lot and a planting area with azaleas
and red maples.
Mrs. Diehl seconded the motion, which carried unanimously with no further comments.

Middle Branch Farm, Phase II, Final Plat - located between Routes 696 and 710 north-
west of North Garden; proposed seven lot subdivision, ranging from 5 to 51 acres.
Miss Caperton presented the applicant's request.
Mr. Sinclair represented the applicant. He had no comments.
Mrs. Diehl moved for approval of the plat with the following conditions:
1. Grading permit for private road; adequacy of proposed bridge to be checked under
grading permit (detail of bridge on preliminary plat);
2. Virginia Department of Highways and Transportation approval of commerical entrance;
3. Health Department approval;
4. Compliance with private road requirements including road constructed to appropriate
standard and maintenance agreement;
5. Highway Department and County Engineering Department approval of access to Lot 2.
Mr. Vest seconded the motion, which carried unanimously, with no further discussion.
Clark's Store Site Plan - located on Route 6, near Schuyler; proposed location of a
one-story general store.
Miss Caperton presented the applicant's request.
Mr. Lum represented the applicant.
Mrs. Graves asked if curbing is on the plan.
Miss Caperton noted that the curbing is not on the plan, but the entrance is.
Mr. Clark, the applicant, noted that his store is already built. He stated that
he has been struggling to get his business open and if matters are delayed much longer
he will go broke.
Mr. Huffman asked Mr. Clark if he had any problems with the conditions of approval.
Mr. Clark noted that he would like for his loading dock to remain where it is, since
it allows for a tractor and trailer to back in and be completely off the road.
Miss Caperton asked Mr. Clark if he would :be agreeable to moving the handicap
parking to the eastern side of the building.
Mr. Clark stated that he would be agreeable to that.
Mrs. Graves moved for approval of the site plan with the following conditions:
1. Compliance with conditions imposed by the Board of Zoning Appeals (VA-78-30) and
Board of Supervisors (SP-78-33);
2. Landscape plan to be approved by staff; recommend white pines along frontage west of
the entrance; shurbs and trees along side of building; and planting island in front of
gas pumps (low shurbs, not to interfere with sight distance);
3. Highway Department and County Engineering Department approval of curbing to restrict
access;
4. Parking in front of gas pumps to be moved to the south, (leaving a 12 foot aisle
between gas pumps and parking) and having access to these spaces to allow for 24
foot aisle (paved area may have to be extended);
5. Relocate handicap parking to the eastern side of the building;

7. Highway Department approval of the commerical entrance, (permit required).
Mr. Vest seconded the motion, which carried unanimously, with no further discussion.
Old Business - Woodbrook Shopping Center Site Plan (Amendement)
Miss Caperton noted that the applicant is requiring a shift in the parking spaces.
Mr. Vest moved for approval of the amended site plan with the following conditions:
1. None of the existing trees along the eastern border of the property shall be distrubed
(Planning Commission 'approved condition, June 27, 1978).
Mr. Huffman seconded the motion, which carried unanimously, with no further discussion.
Old Business - Summit Road Final Plat
Miss Caperton noted that the portion of Summit Road which was to extend to Georgetown
Road was abandoned by the Board of Supervisors on August 9, 1978.
Mrs. Graves moved for approval. Mr. Huffman seconded the motion, which carried
unanimously, with no further discusssion.
There was no further discussion and the meeting adjourned at 10:10 p.m.
