The Albemarle County Planning Commission conducted a meeting on
Wednesday, February 28, 1979, 4:00 p.m., in the County Executive's Conference
Room of the County Office Building, Charlottesville, Virginia. Those members
present were Col. William R. Washington, Chairman; Mrs. Norma Diehl, Vice -Chairman;
Mr. Charles Vest; Dr. James Moore; Mr. Kurt Gloeckner; Mrs. Joan Graves; Mr. James
Skove; and Mr. Layton McCann. Absent were Mr. James Huffman; and Mr. Tim Lindstrom,
ex-Officio. Other officials present were Mr.. Robert Tucker, Jr., Director of
Planning; Mr. Donald Keeler, Assistant Director of Planning; and Mr. Frederick
Payne, Deputy County Attorney.
Col. Washington called the meeting to order after establishing that
a quorum was present.
The first item of discussion was supplementary regulations. The
Commission was asked to decide if it agreed with the staff' reasoning that certain
uses could be by right with special ( supplementary ) regulations rather than by
special use permit; the staff further noted that it was their impression that the
supplementary regulations in the proposed ordinance were to serve that very purpose.
The staff said that if the Commission agrees with its opinion as to the major purposes
of the supplementary regulations, certain guidelines should be followed. Mr. Tucker
noted that these had been discussed with the Commission at the previous work session.
Mr. Tucker stated that for certain uses the conditions could be standardized.
He noted that in previous years mobile homes had been by special permit and had always
been considered by the Planning Commission and Board of Supervisors. When that section
of the ordinance had been amended, unless there was a compliant from an adjoining
property owner , mobile homes have been permitted with a standard set of conditions.
Col. Washington stated that he is inclined to go along with the staff on
this matter.
Mr. Skove noted that the various uses will have to be looked at some time
in the future on a case -by -case basis.
Mr. Tucker agreed that the staff will have to bring back specific
regulations, though the Commission should put some thought into this to be prepared
to discuss this in conjunction with the district regulations.
The Commission then moved to the discussion of the definition section
of the ordinance. Mr. Tucker said that Mr. Payne has worked on these definitions
and they are now ready for Planning Commission discussion. The definitions will
no doubt change somewhat from this handout, after comments from the Commission,
public, and Zoning Administrator have been evaluated.
Occupation.
Mrs. Graves suggesetd excluding "sales" from Agricultural Service
Col. Washington commented that sales is usually the lifeblood of such
an operation.
Mr. Payne advised the Commission that in its consideration of
the definitions, it must decide how inclusionary or exclusionary they must
be; also the Commission must decide if it wishes to define something that is "
not used. If the Commission has concerns about specific areas, the definition should
be made exclusionary.
Mr. Skove noted that he is concerned about the definition of Automobile
Graveyard.
The Commission decided to discuss at a later date, after a re -work
of the wording, Closter Development in terms of net or gross density. It also
decided to discuss Convenience Store in the future.
Mr. Gloeckner suggested that the term "connections" be defined in
regard to Central Sewerage System.
Mr. Payne stated that all the definitions of "dwelling" conform to the
state building code - he feels it to be advisable to have the ordinance and the building
code in agreement.
Mr. Keeler advised the Commission that it would be proper to define
Fast Food Restaurant.
Mr. Gloeckner asked that a definition be provided for Inn.
Mr. Payne advised Dr. Moore that modular homes are treated as
single-family dwellings.
Mr. Gloeckner suggested that Open Space should be reviewed in terms
of permitting septic fields and other utilities in this area. Mr. Payne agreed that
this is a good idea.
Mr. Keeler suggested that the Commission delete "portable dwelling."
Col. Washington noted concern for including "water" in the area of
development for Residential Area ( net ).
Mrs. Graves suggested deleting "professed" from the definition of
Professional Office.
Those definitions to be reconsidered are as follows:
Agricultural Service Occupation
Cluster Development
Convenience Store
Dwelling, Single -Family
Educational Institution
General Store.
Open Space
Dr. Moore asked that the Commission again discuss the meaning of
Single -Family Dwelling in terms of its relation to the definition of Family.
Mr. Tucker suggested that the Commission should look at the area require-
ments of "general store" and "convenience store".

The Commission reached a consensus on the following changes in definitions:
Home Occupation: An occupation conducted for profit in a dwelling unit and/or accessory
structure.
Hog Farm: A place where hogs are kept and raised primarily for sale.
Kennel, Commercial: A place designed or prepared to house, board, breed, handle,
or otherwise keep or care for dogs and/or cats for sale or in return for compensation,
except as an accessory use to a single-family dwelling.
Nonconforming Lot: An otherwise legally platted or otherwise described lot that
does not conform to the minimum area or width requirements of this ordinance for the
district in which it is located either at the effective date of this ordinance or as
a result of subsequent amendments to the ordinance.
Poultry: Domestic fowl normally raised on a farm such as chickens, ducks, geese,
turkeys, peafowl, guinea fowl, pigeon , etc.
Delete the word "professed" from the definition of Professional Office.
The Commission concluded its business at 6:35 and adjourned.
