The Albemarle County Planning Commission held a meeting Monday, March 12, 1979,
4:00 p.m., Third Floor, County Office Building, Charlottesville, Virginia. Those
members present were Mr. Jim Skove; Col. William Washington, Chairman; Mr. Charles
Vest; Mr. Layton McCann; Mr. James Huffman; Mrs. Norma Diehl, Vice-Cha'I.rman; and
Mrs. Joan Graves. Those members absent were Dr. James Moore; Mr. Kurt Gloeckner; and
Mr. Tim Lindstrom, Ex-Officio. Other Officials present were Mr. Robert Tucker,
Director of Planning; Mr. Ronald Keeler, Assistant Director of Planning; and Mr. Fred
Payne, Deputy County Attorney.
Col. Washington established that a quorum was present and called the meeting to
order at 4:00 p.m.
REVIEW OF DEFINITIONS
Mr. Tucker noted that temporary events fairs, carnivals, by non-profit organizations
should be added to the list of definitions.
There were no were no additional comments from the Commission.
Mr. Tucker noted changes that have been made in the Commission's scheduled review
of the Proposed Zoning Ordinance.
RURAL RESIDENTIAL
Col. Washington asked if any provisions have been made for an over and under
situation,( #2 under Section 3.11.3.1) as in relationship to side by side.
Mr. Tucker stated that he believes the last sentence of #2 should take care of
that. ("Other two-family dwellings shall be permitted provided density is maintained.")
Mr. Skove asked if temporary woodyards, such as those used for pulpwood would be
provided for under V .
Mr. Tucker noted that he believes this use would require a special permit.
Mrs. Graves stated that she does not believe "Home Occupation Class B" should be
included as a use by right.
Mr. Tucker noted that because the definitions are so specific the Staff agreed that
there would be no problems with including this as a use by right.
Col. Washington asked how a commercial entrance could be required if "Home Occupation
Class B" is allowed by right.
Mr. Tucker stated that a commerical entrance could be made a supplementary
regulation. He noted that this would allow the Highway Department to require a commercial
when an entrance permit is issued.

Mr. Skove asked if the County has had problems with Home Occupation.
Mr. Tucker noted that there haven't been any complaints or problems, that he
is aware of.
Col. Washington stated that if an accessory building is too close to the
property line there could be problems with individuals complying with the supplementary
regulations.
Mrs. Diehl asked if a site plan is required for Home Occupation's needing an accessory
structure.
Mr. Tucker stated that if it meets the requirements of the site plan ordinance a
site plan will be needed.
Mrs. Graves stated that she feels individuals will want to see more restrictions
when a use is changed from a use by special permit to a use by right.
Mrs. Diehl stated that she doesn't feel too many restrictions are being added, when
setbacks are being added to the supplementary regulations.
Mr. McCann suggested that setbacks apply to new dwellings; not existing dwellings.
Col. Washington stated that he feels since a special permit is required for "Home
Occupation Class B" this is some of the reasons why there have been no problems.
Mr. Keeler noted that public garages should be deleted from the Rural Residential
District. He noted that craft, and antique .shops have been deleted, as well as
professional and executive offices. Mr. Keeler commented that no provisions have
been made for boat marines.
Mr. Huffman stated that he would like to see boat marinas included.
VILLAGE RESIDENTIAL
Mr. Keeler noted that general stores and professional offices have been deleted
from this district. He noted that these items would be covered under commercial in
the village.
Mr. McCallum questioned the position of a farm located within a village.
Mr. Payne noted that it would be considered a nonconforming use.
Col. Washington noted that an accessory use could include many different things.
(#8 under Section 3.10.3.1)
Mr. Payne noted that an accessory use is a use that is incidential to the dwelling.
Col. Washington stated that he believes agricultural uses should be included in
Village Residential.
Mr. Payne suggested that agricultural uses could be permitted by right, with a
minimum area for livestock or poultry.
Mr. McCann stated that it appears the County is trying to impose city regu-
lations on a rural area.
Mr. Keeler commented that the Commission might would like to require a 100 foot
setback.

Mrs. Graves suggested that a 2 acre minimum lot size should be required.
RESIDENTIAL, R-1
Mr. Keeler stated that this district is similar to the current RS-1 zone. He noted
that duplexes are allowed under this district, but not in RS-1. He also noted that
#11 (Tourist lodgings) was added to the current ordinance during the Bicentennial and
has remained because there hasn't been any problems with it.
RESIDENTIAL. R-2
Mr. Keeler noted that this district allows for 2 units per acre and with bonuses
3 units. He noted that the consultants had suggested triplexes and quadraplexes, but
Staff felt they would be unnecessary.
RESIDENTIAL, R-4
Mr. Keeler noted that in this district provisions have been made for triplexes and
quadraplexes.
There was no further discussion and the meeting adjourned at 6:00 p.m.
