The Albemarle County Planning Commission held a regular meeting Tuesday, April 3,
1979, 7:30 p.m., Third Floor, County Office Building, Charlottesville, Virginia. Those
members present were Mr. Charles Vest; Mr. Layton McCann; Mr. Jim Skove; Col. William
Washington, Chairman; Mrs. Joan Graves; and Mrs. Norma Diehl, Vice -Chairman. Those
members absent were Mr. Kurt Gloeckner; Mr. James Huffman; Pr. James Moore; and Mr.
Tim Lindstrom, Ex-Officio. Other Officials present were Mr. Ronald Keeler, Assistant
Director of Planning; Mr. Robert Tucker, Director of Planning; Miss Mason Caperton,
Planner; and Mr. Fred Payne, Deputy County Attorney.
Col. Washington established that a quorum was present and called the meeting to
order at 7:30 p.m.
WESTERN ALBEMARLE SHOPPING CENTER SITE PLAN
Miss Caperton presented the applicant's request. Mr. Blankenbaker, the applicant's
representative, and Mr. and Mrs. Benn, the applicant's, were present.
Miss Caperton read the Highway Department's recommendations, into the record as
follows: The western most entrance should be shifted several hundred feet to east
to align center line to center line with the entrance to the Henley -Brownsville Schools.
This alignment would allow for a left turning lane to be established into the shopping
center through the use of existing pavement opposite the existing left turning lane to
the school proper't$. The right turning lane approaching the western entrance should be
200 feet by 12 feet wide with a 200 foot taper. The turning lane as shown between the
two entrances is proper. This will, however require the widening of the fill and the
extension of the pipe which is located in the fill in the swale which is shown as a
stream leading to the sedimentation pond. A drainage easement will be needed across thie
property either to the wet pond or stream. The eastern entrance location appears adequate.
However, minimum sight distance to the east exists. Sight distance should be improved
through the clearing of vegetation on a slope to the immediate east, some minor grading
may be required. A 50 foot right-of-way is noted to serve the residue which is currently
zoned A-1 behind the shopping center property. We would like some idea of the area of
residue as well as its plan potential development." (letter of February 8, 1979)
Miss Caperton read letters into the record from Mr. Jeff McDaniel, Health Department;
Ms. Mary Hunter; and The Albemarle County School Board. (attached)
Mrs. Diehl asked if the Health Department has already approved the septic system.
Miss Caperton noted that she believes it has been scheduled, but the Health Department
has not been out to the site at this time.
Mr. Benn noted that he objects to the School Board's request for a chain link fence
around the shopping center. He noted that it appears they are trying to prevent the High
School students from having access to the center. Mr. Benn noted that easy access would
be much safer than students entering Rt. 250 to get to the shopping center. He also stated
that he believes the shopping center will be an enrichment to the community of Crozet,
rather than a hazard.
Mr. Tucker noted that there will not be an increase in drainage caused by this
development. He noted that the problem is with the culvert pipe on the Henley -Brownsville
side of Rt. 250.
Dr. McClure stated that the School Board wishes to assure that the drainage
system will be preserved. He noted that he had spoken with the County Engineer
and he noted that the system will be preserved.
Mr. Osborne, the applicant's representative, stated that he feels if any problem
should occur it could be relieved by extending the pipe, which runs under Rt. 250,
through the applicant's property.
Mr. Patterson, Citzens for Albemarle, stated that the safety and welfare of the
students should be the primary concern. He noted that the following areas should be
considered:
Types of businesses
Combination of entrances
Covering of drainfields.
Mr. Patterson's comments are attached.
Mr. Armstrong, Principal of Western Albemarle, stated that he has the same concerns
as.Mr. Patterson had just mentioned with the additional concern of bike paths between
the school and the shopping center. He asked the Commission to consider the following
requests:
Each businesses' plans be reviewed by the Planning Commission
Traffic light
Careful study of soil erosion and run-off control
100 foot buffer zone between the school and the shopping center.
Mrs. Johnson noted that the safety prol,lem will be with the children crossing
Rt. 250 from the middle and elementary schools.
Mrs. Williamson stated that since the schools are supported by tax dollars
all taxpayers should be notified of any action taking place adjacent to the schools.
Mr. Benn noted that the types of businesses that are intended are a bank; a doctor's
office; and a grocery. He stated that his proposal complies with the Comprehensive Plan's
objectives for this area. Mr. Benn commented that taking each business before the Planning
Commission would pose an economic problem.
Col. Washington stated that he agrees that there isn't a drainage problem now, but
if the use of the pipe as installed is continued there may be a problem.
Mrs. Graves noted that she feels fences should be placed around the sedimentation
ponds.
Mr. Tucker noted that it would not be inapporpriate to include this as a condition
of approval.
Mr. Skove asked if once this plan is approved would there be any problems with
approving subsequent uses.
Mr. Payne noted that there would be no legal problems.
Mrs. Diehl asked what provisions are being made for left turn traffic.
Miss Caperton noted that the applicants hzwe met with the Highway Department
and have discussed restripping the pavement to provide a left turn lane.
Mrs. Graves commented that she can see problems with traffic trying to cross Rt. 250.

Mr. Keeler noted that the Staff's reason for recommending that the entrance be
relocated was to prevent traffic from zigzagging across to Rt. 250.
Col. Washington noted that he is aware that the Highway Department is reluctant
to put up traffic lights. He asked if this plan could be approved on the condition
that a 3 plus year study be done to see if a traffic light is needed.
Mr. Payne noted that it is his understanding that the Highway Department will see
that a traffic light is put in if they feel it is needed. He stated that he feels the
Commission would need proof that the need for a light is being generated.
Col. Washington noted that a 100 foot buffer is large, He asked if it is unusual.
Mr. Tucker stated that a site can be adequately screened with less than a 100 feet
of buffer. He noted that there is approximately 800 feet between the southern boundary
of this property and Western Albemarle High. Mr. Tucker commented that there is a 50
to 60 foot buffer between this site and the school on the western edge, which is the
side the school is concerned with. He noted that to extend the buffer the applicant
would have to cut back on the number of parking spaces.
Mrs. Diehl noted that if the pedestrian path is deleted the white pine screening
could continue around the western boundary of the property.
Mr. McCann asked the Staff's opinion of the landscape plan.
Mr. Tucker noted that there are some isolated areas.that will require additional
landscaping. He also stated that if the Commission would like to see additional buffering
they will need to speak to this.
Mrs. Diehl asked if Section 17-5-21 of the Zoning Ordinance, gives the Commission
the authority to require a chain link fence around the property.
Mr. Payne noted that it could, but the State Statutes already provide for a
situation of this nature.
Mr. McCann stated that he doesn't feel the developer should bear the cost of a
chain link fence, since he doesn't feel his property needs protecting.
Mr. Payne noted that there is a state statute that states if an adjacent owner
chooses to fence his property, the other owner must bear half the cost of the fencing.
Mrs. Graves spoke to the concerns of the public and then moved for approval.
Mr. McCann seconded the motion.
Mrs. Diehl noted that she would like to see the pedestrian and bike path deleted.
Mr. Blankenbaker noted that this condition was added upon the recommendation of
the Planning Staff.
Mr. Tucker noted that the Staff felt that if the students should go to the shopping
center it would be safer than the students entering the highway for access to the center.
Col. Washington asked if a condition should be placed on this item stating that the
developer and the School Board would share the cost of erecting a chain link fence.
Mr. Payne noted'that this would not be necessary, since a State Statute already

speaks to this.
The conditions of approval are as follows:
1. A building permit will not be issued until these conditions have been met:
a) County Engineer approval of pavement specifications (particularly over the

septic fields) and drainage layout, including drainage of Brownsville School
site;
b) Albemarle County Service Authority approval of water plans;
c) Written Health Department approval of septic facilities with particular care for
those areas under parking lots and plantings and screenings;
d) Fire Official approval of location of hydrants and location and screening of
dumpsters; and handicapped facilities;
e) Minimum area requirements for each commercial use shall be 40,000 square feet;
f) Landscape plan subject to Staff approval, including 30 foot buffer on western
boundary of the site;
g) Virginia Department of Highways and Transportation approval;
h) Run-off Control permit required;
i) Grading permit;
j) Relocate automatic teller to the rear of the bank with driveway access extending
to the residue;
k) Shopping Center shall hook to public sewer when capacity becomes available;
1) Compliance with technical requirements of Article 17 of the Zoning Ordinance;
m) Fences around sedimentation ponds to be approved by Staff;
n) Delete bike and pedestrian path.
Mrs. Graves motion carried unanimously, with no further discussion.
SP-79-02. Thomas A. Lane has petitioned the Board of Supervisors to amend
SP-77-82 (for sales and service of farm machinery) to increase the acreage of the
site from 2.88 acres to 5.0 acres. The property is located on the west side of
Route 29 North near the Wonderbread property. County Tax Map 45, Parcel 94.
Mr. Keeler presented the applicant's request. Mr. Lane, the applicant, was
present and had no comments.
Mr. Keeler, read the Highway Department's comments into the record, as follows:
"Increasing the acreage from 2.88 to 5.0 acres to be used for the sales and service
of farm machinery as examined on Rt. 29, adjacent to "Wonderbread", does not appear
to have great additional impact so far as traffic is concerned. The entrance design
has been discussed previously. The same entrance should work sufficiently well for
the larger property, provided all other parameters are the same."
Mr. McCann moved that the Board be recommended to approve this item subject
to the following:
1. Compliance with conditions of SP-77-82;
2. Site plan amendment required for exa:pnsion of farm implement use into this
parcel if required by Article 17 of the Zoning Ordinance.
Mrs. Diehl seconded the motion, which carried unanimously, with no further
discussion.

SP-79-05. Raymond F. Loba has petitioned the Board of Supervisors for antique
storage (with monthly sales from the warehouse) on 166.490 acres zoned A-1. Property
is located on the northeast side of Route 811, approximately � mile east of the
intersection of Routes 810 and 811. County Tax Map 40, Parcel 46.
Mr. Keeler presented the applicant's request. Mr. Loba, the applicant, was
present.
Mr. Keeler read the Highway Department's comments into the record, as follows:
"Antique storage warehouse on Route 811 near Route 810; since the proposed use would
be primarily a warehouse with sales limited to infrequent transactions, it would appear
that this would not create severe problems. However, access to the property should be
examined to determine if it meets commercial standards."
Col. Washington asked if the entrance to the property is off the gravel road or
Route 811.
Mr. Keeler noted that the entrance is off the gravel road.
Mr. Loba stated that selling antiques is more of hobby, than a commerical use in
his case. He noted that the sales would be advertised in the paper and would be on an
appointment basis only. Mr. Loba also commented that he would probably not operate
during the winter months, but would like the option to do so on a monthly basis.
Mr. McCann noted that since monthly is not clearly defined the approval should note
that the sales will be held for three consecutive days.
Mrs. Diehl asked if the sales would be held outside the building.
Mr. Loba noted that all sales would be held within the building.
Mrs. Graves asked if a site plan is required and if it is does the Commission have
the authority to'waive the site plan.
Mr. Payne stated that if no additional parking is required a site plan will not be
needed. He noted that the Commission can request that the Board of Supervisors grant
Staff approval of the site plan, if required.
Mr. Keeler noted that antique shops have the same parking requirements as
furniture stores. They are 1 space - 400 square feet, at -the most. Mr. Keeler stated
that one space - 100 feet of building floor area is adequate for parking access.
Mrs. Diehl asked if the applicant's representations should be listed as conditions.
Mr. Payne noted that he feels this is spoken to in condition #1.
Mr. McCann moved that this item be recommended for approval to the Board of
Supervisors with the following conditions:
1. Use limited to applicant's representations as stated in (a) and (b) below:
a) No auctions, loudspeakers, or food would be involved; sales would also be
by appointment;
b) No signs. Advertising of sales would be by newspaper advertisement;
2. Virginia Department of Highways and Transportation approval of entrance;
3. Sales to be limited to three (3) consecutive days; one sales period per month;
4. No outdoor storage, display or sales.
Mr. Vest seconded the motion, which carried unanimously, with no further discussion.

SP-79-07. David J. Wood, Jr., and Joseph M. Wood, II, have petitioned the
Board of Supervisors for mini -warehouses on 3.391 acres zoned B-1. Property
is located behind Dart Drug, at the end of Williamsburg Road. County Tax Map 61M,
Parcel 12-1E.
Mr. Keeler presented the applicant's request. Mr. Wood, one of the applicant's,
was present.
Mr. Keeler read the Highway Department comments into the record, as follows:
"Mini -Warehouse, 3.391 acres behind Dart Drug at the end of Williamsburg Road. This
use could generate considerable amount of traffic. We would be opposed to this
traffic using Williamsburg Road. If this property is served from existing entrances
in the Shoppers World Shopping Center, I do not believe it would be objectional."
Mr. Wood stated that he believes he is putting his property to use that is not
objectionable. He noted that there will be no noise, odor, and very little traffic.
He noted that it is his intent to fence the property and there will be no access to
Williamsburg Road.
Mrs. Graves asked if people would most likely use the facilities at 7:00 a.m.
Mr. Wood noted that there will be very little activity at any time of day.
Mrs. Graves noted that she is concerned with the truck traffic upsetting the
dogs at Pampered Pet.
Mr. Keeler noted that he spoke with Mr. Dofflemeyer, who leases the property,
and he noted that he has no problems with the application. He noted that Mr.
Dofflemeyer stated that a metal building is located between his property and the
Wood's property and he will be fencing in the Pampered Pet property in the near
future.
Mrs. Diehl moved that this item be recommended to the Board of Supervisors
for approval, with the following conditions:
1. Site plan approval including Planning Commission approval of the landscape plan;
2. All storage shall be in enclosed buildings;
3. Operating hours from 7:00 a.m. to 10:00 p.m. Operation by appointment shall be
permitted at other hours for emergency situations;
4. No access to Williamsburg Road.
Mrs. Graves seconded the motion, which carried unanimously, with no further
discussion.
Resolution of Intent to amend Article 17 of the Zoning Ordinance to increase the
number of prints submitted from 10 copies to 20 copies.
Resolution of Intent to amend the Subdivision Ordinance to increase the number
of prints submitted from 10 copies to 20 copies.
Mrs. Graves moved to recommend that the Board of Supervisors adopt the above
amendments.
Mrs. Diehl seconded the motion, which carried unanimously, with no further
discussion.

Resolution of Intent to amend Article 17 of the Zoning Ordinance to provide for
the membership of the Area Soil Conservationist on the Site Review Committee.
Mrs. Graves moved that the above item be recommend for adoption to the Board
of Supervisors.
Mr. Vest seconded the motion, which carried unanimously with no further discussion.
Resolution of Intent to amend Chapter 18 of the County Code to provide for the
subdivision plat review by the Site Review Committee.
Mr. McCann moved that the above resolution be withdrawn.
Mr. Vest seconded the motion, which carried unanimously, with no further discussion.
NEW BUSINESS - Cedric`:s/Barney's Site Plan
Mr. Tucker noted, for the Commission's information, that the new owner of this
site wishes to delete the drive-in window and replace this area with an outside dining
area and landscaping.
Capital Improvements Program
Mr. Tucker noted that the Capital Improvements Program will be before the Commission
in the near future. He commented that this will be basically an update of the past three
years program. Mr. Tucker stated that he has been made aware that the Commission would
like more input into this program. He commented that he is aware that the Commission
is concerned with the extension of water and sewer lines, in the County. Mr. Tucker
noted that the capital improvements program will be based a great deal on the proposed
zoning map. He noted that it would probably be immature to include any of these
changes in this year's review.
Col. Washington stated that it has always been his observation that the Commission
has had a very limited time span and none of the individuals with primary input were
present for the discussions.
Mrs. Diehl noted that she feels a work session with the necessary representatives
present would be beneficial.
Mr. Tucker suggested the first week in May as a tentative date for the work session.
Meeting between Commission and Mr. Cheavacci, Health Department
Mr. Tucker noted that he had spoken with Mr. Cheavacci and he stated that he would
be happy to met with the Commission during one of the work sessions on the proposed
Ordinance.
Chris Green Lake
Mr. Tucker noted that a site plan for an addition to the parking area at Chris
Green Lake would be appearing on next week's agenda.

AGR District - Rental Units
Mr. Tucker and the members of the Planning Commission briefly discussed
tenant houses on some of the larger farms in the County that are not occupied by
farm tenants.
There was no further discussion and the meeting adjourned at 10:30 p.m.
