The Albemarle County Planning Commission held a regular meeting, Tuesday, April
17, 1979; 7:30 p.m., Third Floor, County Office Building, Charlottesville, Virginia.
Those members present were Col. Washington, Chairman; Mr. Layton McCann; Mr. James
Huffman; Mrs. Norma Diehl, Vice -Chairman; Mrs. Joan Graves; and Mr. James Skove. Those
members absent were Mr. Charles Vest; Mr. Kurt Gloeckner; and Mr. Tim Lindstrom, Ex-
Officio. Other Officials present were Miss Mason Caperton, Planner; Mr. Ronald Keeler,
Assistant Director of Planning; and Mr. Fred Payne, Deputy County Attorney.
Col. Washington established that a quorum was present and called the meeting to
order at 7:30 p.m.
The minutes of March 20, 1979 and April 9, 1979 were approved as corrected.
CHURCH OF GOD/RIO ROAD SITE PLAN
Miss Caperton presented the applicant's request. Mr. Lambert, the applicant's
representative, was present.
Mrs. Graves asked where the nearest -sewer line is located.
Mr. Keeler noted that the nearest line is at the Vocational Technical Center, but
it is a City sewer line. He noted that the Service Authority has no interest in serving
this site.
Col. Washington noted that the bank behind parking spaces 28-34 is rather steep.
Mr. Lambert agreed,�that the bank is steep and he feels this is probably one of the
areas the Staff would want to see landscaped.
Mr. Echols, A. B. Torrance Company, stated that they are adjoining property owners
and have no objections to the proposed church.
Mrs. Graves noted that she is concerned with two churches being located across the
road from each other. She stated that this will probably cause traffic problems and
she would like to know if the Highway Department had considered this in their comments.
Mr. Huffman stated that the churches would not generate any more traffic than
there is on a weekday on Rio Road.
Mr. Skove moved for approval with the following conditions:
1. A building permit will not be issued until the following conditions have been met:
a) Written Health Department approval;
b) Virginia Department of Highways and Transportation approval of temporary entrance;
c) Fire Official approval including hydrant location and handicapped facilities;
d) Albemarle County Service Authority approval of water plans;
e) Compliance with Soil Erosion and Sedimentation Control Ordinance and Stormwater
Detention requirements;
f) County Engineer approval of pavement specifications;

g) Compliance with the technical requirements of Article 17 of the Zoning Ordinance;
h) Landscape plan subject to Staff approval.
Mrs. Diehl seconded the motion, which carried unanimously, with no further
discussion.
ROBERT FRYE PRELIMINARY PLAT
Miss Caperton noted that the applicant has requested deferral until May 15, 1979
Mr. McCann moved for deferral.
Mrs. Graves seconded the motion, which carried unanimously, with no further
discussion.
SHIPP FINAL PLAT
Miss Caperton noted that the applicant has requested deferral until May 15, 1979.
Mrs. Diehl moved for deferral.
Mrs. Graves seconded the motion, which carried unanimously, with no further
discussion.
MARY HASENSTAB FINAL PLAT - located on Route 631, 4 miles south of Charlottesville
and I-64; proposed division of lots 5A and 6A into two lots of 2+ acres each.
. Miss Caperton presented the applicant's request. Mr. Breeden, the applicant, and
Mr. Gregg, his representative, were present for the meeting.
Mr. Breeden, noted that he could not understand why Health Department and Highway
Department approval are being required, when the lot line is only being shifted.
Miss Caperton noted that these are the recommendations of the Site Review Committee
members and are included in the conditions of approval.
Mr. Keeler noted that it is to the applicant's advantage to have Health Department
approval. He noted that it will assure that the applicant does not sell his septic
system. Mr. Keeler stated that if the applicant is sure of the location of the system,
he couldn't see any problem with deleting the condition, but the applicant should be
assured that he at least has an alternative site for a septic system.
Mr. McCann stated that he questions the wisdom of the Highway Department's
recommendations on this item. He noted that he is familiar with the road and can not
see where the recommended improvements would help the road.
Mrs. Graves moved for approval with the conditions as stated by Staff.
Col. Washington stated that he agrees with Mr. McCann. He noted that the
rdaidences are existing and the 25 foot dedication has been made.
Mrs. Diehl asked the width of the road.

Miss Caperton noted that she is not aware of the width of the road.
Mr. Skove noted that he agrees that no additional use is being placed on the road.
Mr. McCann made a substitue motion for approval with the following conditions:
1. The plat will not be signed until the following conditions have been met:
a) Written Health Department approval;
b) Change of name of Elizabeth Breeden in title of plat;
c) Compliance with private road ordinance for the access easement;
d) All titled owners must sign the plat.
Mrs. Diehl seconded the motion, which carried unanimously, with no further discussion.
MIRAN FOREST FINAL PLAT located off Route 692 and 694, southeast of Batesville;
proposal for ten lots with an average size of 5 acres leaving 361 acres residue.
(SECTION I)
Miss Caperton presented the applicant's request. Mr. Albert, the applicant, was
present. Also, a representative was present from Mr. Shumate's office.
Miss Caperton noted that the only change between the final and the preliminary plat
is that the 50 foot easement has been changed to a 30 foot easement.
Mr. Keeler noted that 30 feet is all that is required by the Subdivision Ordinance.
He suggested that the applicant might like to allow a slope easement, in case the terrain
in the area would change the roadway.
Mrs. Graves asked why lot 11 is so far from the first phase of development.
Mr. Albert noted that on the preliminary plat the total number of lots were shown.
He noted that one of owners had selected lot 11 as a home site and it was included so
that he can build his house.
Mr. Skove asked if the Highway Department is recommending just improving the
frontage of lot 23.
Miss Caperton noted that this is their intent.
Mrs. Graves asked if this differed from Advance Mills (including residue in the
frontage improvements).
Mr. Keeler noted that it differs in that the residue, in this case, is over 400 acres.
Mr. Huffman noted that since the road deadends, he can not see widening the road
to that point.
Mr. McCann stated that he thought on the preliminary plat the Highway Department
only recommended a commercial entrance. He asked if the frontage improvements being
recommended are part of the Highway Department's blanket requirments.
Miss Caperton noted that they are.
Mr. McCann moved for approval with the following conditions:
1. The plat will not be signed until the following conditions have been met:
a) Compliance with the private road ordinance, including:
1) County Engineer approval of the road plans and drainge easements;
2) County Attorney approval of maintenance agreements;
b) Virginia Department of Highways and Transportation approval of commercial entrance:

c) Compliance with the run-off control and soil erosion ordinances;
d) Remainder of Heartwood Road should be completed prior to any further subdivision
approvals to reduce the traffic on Route 694;
e) Remainder of road frontage should be dedicated prior to further subdivision
approvals;
f) Note tax map and parcel number on cover sheet.
Mr. Huffman seconded the motion.
Mrs. Graves stated that she can not support the motion, because if frontage
improvements are not required on lot 23 the Commission may not be able to get further
improvements in the future.
Mr. McCann's motion carried by a vote of 5-1. Mrs. Graves dissented. There was
no further discussion.
LINDSAY PRELIMINARY PLAT - located on Route 615 west of Route 639; proposed for 28
lots with an average size of 2.0 acres.
Miss Caperton presented the applicant's request. Mr. Whitlock, the applicant, and
Mr. Graff, his representative, were present.
Mr. Whitlock noted that this property was originally platted in 1967. He stated
that lots on the western and southeastern side have been sold. He stated that he would
like the Commission to approve this plat without a commercial entrance and frontage
improvements. He also stated that if this approval becomes a financial burden he.will
have to leave the property as is.
Mr. McCann stated that he feels a commerical entrance should be required, because -
a safe entrance is important, but he noted that he could not support frontage improvements
until they are in the Subdivision Ordinance.
Mr. Skove stated that he feels this subdivision will have a significant impact on
the roads and he would like to see a commerical entrance and frontage improvements included
as conditions of approval.
Mrs. Graves moved for approval with the following conditions:
1. The following conditions will be recommended for final plat approval:
a) Virginia Department of Highways and Transportation approval of entrance locations,
both commercial and private, turn lanes, and frontage improvements;
b) Compliance with private road ordinance, including:
1) County Engineer approval of private road plans;
2) Maintenance agreements to be approved by the County Attorney;
c) Grading permit;
d) County Engineer approval of drainage easements (on final plat);
e) Written Health Department approval.
Mr. Skove seconded the motion, which carried with a vote of 5-1. Mr. McCann
dissented. There was no further discussion.
RIVANNA HILLS PRELIMINARY PLAT - located on Route 605 approximately one mile
west of the intersection of Route 605 and 743, north of Advance Mills; proposal for
12 lots with an average size of 3.5 acres.
Miss Caperton presented the applicant's request. Mr. Dixon, the applicant, was
present.
Mrs. Diehl noted that lot 11 appears to be as steep as lot 12 and it appears with
the setback there isn't much room for a building site.
Miss Caperton noted that she had not done a slope analysis, but the lots will have
to have suitable building sites.
Dr. Moore entered the meeting.
Mr. Dixon stated that he is opposed to widening the road. He noted that 50-60 trees
are located within the right-of-way, which serves as a very effective screen between
the highway and the subdivision. He noted that he would be required to improve 500 feet
of roadway on a 2' mile road. Mr. Dixon stated that he could not see where these
improvements would have much affect on the road.
Mrs. Diehl asked if the Commission hadn't seen several subdivisions in this area.
Miss Caperton noted that they had. She stated that Advance Mills and North
Fork Farms are in this vicinity.
Mr. Skove noted that he feels the impact on the roads justifies the frontage
improvements.
Mrs. Diehl commented that she would like to see a slope analysis at the time of
the final plat.
Mrs. Diehl moved for approval with the following conditions:
1. The following conditions will be recommended for final plat approval:
a) Compliance with private road ordinance, including:
1) County Engineer approval of road plans and drainage easements;
2) Maintenance agreement to be approved by the County Attorney;
b) Virginia Department of Highways and Transportation approval of entrance and
frontage improvements;
c) Compliance with Soil Erosion Ordinance;
d) Change building setback for lot 3, must be 75 feet from the right-of-way;
e) Written Health Department approval.
Mr. Skove seconded the motion, which carried with a vote of 5-1-1. Mr. Huffman
dissented and Dr. Moore abstained. There was no further discussion.
PANTOPS FINAL PLAT - LOTS A & B - located on Route 250 East, east of Free Bridge,
proposal for two lots with an average size of 40,000 square feet.
Miss Caperton presented the applicant's request. Mr. Sinclair, the applicant's
representative, was present.
Mr. Sinclair noted that one of the proposed lots represents a sale in the near future.
Dr. Moore noted that 250 Bypass and Rt. 250 are mislabelled on the vicinity map.
Mr. McCann moved for approval with the following conditions:
1. The plat will not be signed until the following conditions have been met:
a) Written Health Department approval and assurance that septic systems are on

their respective parcels;
b) Show an easement where actual access road is;
c) Virginia Department of Highways and Transportation approval of commercial
entrance, if required;
d) Compliance with the private road ordinance, including a maintenance agreement.
Mr. Huffman seconded the motion, which carried unanimously, with no further
discussion.
CAMELLIA GARDENS FINAL PLAT - located on the west side of Route 656 (Georgetown
Road), south of Inglewood Drive; proposal for 13 lots for duplexes, and one existing
dwelling.
Miss Caperton presented the applicant's request. Mr. Sinclair, the applicant's
representative, was present.
Dr. Moore asked if Georgetown Road is still scheduled to be widened.
Mr. Keeler noted that it is his understanding that the design money, to widenedf
Georgetown Road has been designated to improve existing lanes and for a sidewalk.
Mr. Sinclair noted that at Site Review it was recommended that 26 feet be dedicated
from the centerline. He noted that in order to do this 6 additional feet of right-of-
way would have to dedicated, which would move the setback on lot 7L so far back that
there would not be an adequate building site.
Mr. Keeler noted that the Subdivision Ordinance allows the Commission to require
25 feet of dedication from the centerline.
Mr. Sinclair stated that the Highway Department has no authority to require any
additional right-of-way on 7L since the turn lane is not on this frontage.
Mr. Skove noted that he would like to assure that when Georgetown Road is improved
it will be done as easily as possible.
Mr. Payne noted that one solution might be to shift all the lot lines one foot
around the cul-de-sac.
Col. Washington stated that if all the Commission can require is 25 feet of dedication
then it appears that this is all that can be done.
Mr. McCann commented that he world be inclined to require 25 feet of dedication,at
this time, and let the Highway Department work out the additional dedication when needed.
Mr. McCann moved for approval with the following conditions:
1. The plat will not be signed until the following conditions are met:
a) Fire Official approval of hydrant location;
b) Virginia Department of Highways and Transportation approval;
c) Show dedication of 25 feet from the centerline;
d) Change the name of Grace Lane;
e) Vacate"Camellia Gardens" name on approved site plan; (provide three revised
copies);
f) Albemarle County Service Authority approval of water and sewer plans;
g) County Engineer and Virginia Department of Highways and Transportation
approval of road plans;
h) Compliance with Soil Erosion Ordinance;
i) County Engineer approval of drainage easements;

j) Compliance with Runoff Control Ordinance;
k) Joint entrances on interior roads subject to approval of Virginia Department of
Highways and Transportation;
1) Note that existing dwelling should be connected to public water and sewer:
Mr. Payne noted that lots 7R & 7L will probably combine to form lot 7. He noted
that he feels it would be beneficial to have Staff approve these changes so the owner
can implement his approval.
Mr. McCann amended his motion to include the following: "Staff approval of lot
7L and/or 7R to accomodate the conditions of approval."
Mrs. Graves seconded the motion, which carried unanimously, with no further discussion.
AMMCO TRANSMISSION SITE PLAN located approximately 2 mile north of Route 854 on
the northbound lane of Route 29 North; proposal for the site of the Ammco Transmission
Repair Service.
Miss Caperton presented the applicant's request. Mr. Healy, the applicant, and
Mr. Sinclair, his representative, were present.
Mrs. Graves asked if public sewer is availble in this area.
Dr. Moore noted that it is not.
Col. Washington asked what the minimum lot size is with public utilities.
Mr. Keeler noted that the minimum lot size is 40,000 square feet with one utility.
He also stated that this a lot of record, and is a nonconforming lot.
Mr. Sinclair stated that his client objects to the curb and gutter on a economical
basis.
Mrs. Graves asked what happens to oil and transmission fluid that has been used.
Mr. Healy noted that it is stored in a holding tank within the building.
Mr. Wright, an adjcent owner, asked the size of the building.
Mrs. Diehl noted that it is 4,000 square feet.
Mr. Wright stated that it appears this building will obstruct the appearance of the
Real Estate III building. He noted that he is also curious as to the use of the parking
area.
Mr. Healy stated that the parking area is for cars in need of repairs and cars
that have had the work completed and are waiting to be picked up. Mr. Healy noted that
the building will be stucco, with the office and waiting area in the front of the building
and the garage in the rear.
Mrs. Graves asked if the curbing is deleted, what will be used to delineate the
parking area.
Mr. Keeler noted that bumper blocks or striping would be adequate.
Mr. McCann moved for approval with the following conditions:

1. A building permit will not be issued until the following conditions have been met:
a) Written Health Department approval;
b) Albemarle County Service Authority approval of water plans;
c) Virginia Department of Highways and Transportation approval with the approp-
riate changes made on the site plan, if needed;
d) County Engineer approval of drainage facilities such that water will not run
across adjacent properties;
e) Grading permit;
f) Note building height on plan;
g) Note that the Planning Commission is not approving the sign or its location at
this time.
Mr. Huffman seconded the motion.
Dr. Moore stated that he could not support the motion because he feels that
a transmission repair service is too intensive a use even for a business zone.
Mr. McCann's motion carried with a vote of 4-2. Dr. Moore and Mrs. Graves
dissented. There was no further discussion.
RUTLEDGE FARM PRELIMINARY PLAT
Miss Caperton noted that the applicant has requested deferral until May 22, 1979.
Mr. Skove moved for deferral.
Mrs. Diehl seconded the motion, which carried unanimously, with no further

CHRISTIAN AID MISSION SITE PLAN AMENDMENT - located on Route 250 West at Route 677;
amendment to initial site plan for the Christian Mission - Church Annex and Church Office
Building.
Miss Caperton presented the applicant's request. Mr. Landes and Mr. Findley,
the applicants, were present.
Mrs. Graves asked what were the conditions of approval were on the original site
plan.
Miss Caperton read the conditions as follows:
1. If smaller parking lot is retained, it should be moved back 50 feet from right-of-way,
and landscaping should be spelled out as to height and type, to be approved by Staff;
2. No persons to reside on site in the business zone except night watchman;
3. Letter to Virginia Department of Highways and Board of Supervisors regarding the
Commission's position on the decel lane.
(Conditions of approval from April 27, 1976)
Mrs. Graves asked if the parking is in compliance with the previous site plan.
Miss Caperton stated that this site plan amendment will make the site plan comply
with what is on -site now.
Mr. Findley stated that the parking lot existed at the time of the original
site plan. He noted that the parking was approved with,screening between the Highway
and the parking lot, which has been completed. He stated that the sign and the driveway

have been in the same location for several years. He noted that other businesses
along Rt. 250 have the same situation and he does not feel it is fair to single them
out to move the driveway and sign from the Highway Department's right-of-way.
Mr. McCann stated that he feels the Highway Department should deal with this
problem and not the Planning Commission.'
Mr. Findley stated that if they are required to remove the loop, it will destroy
some of the landscaping, which is already established.
Mr. McCann moved for approval with the following conditions:
1. A certificate of occupancy will not be issued until the following conditions are met:
a) Fire Official approval of two handicapped parking spaces and curb cuts and ramp
to the main building;
b) Virginia Department of Highways and Transportation approval of the entrance on
Route 677;
c) County Engineer review for Run-off Control permit.
Mr. Skove seconded the motion, which carried with a vote of 6-1. Mrs. Graves
dissented. There was no further discussion.
OLD BUSINESS - A. W. Dawson Final Plat
Miss Caperton noted that the applicant has requested withdrawal.
Mr. McCann moved for withdrawal.
Mrs. Deihl seconded the motion, which carried unanimously, with no further
discussion.
NEW BUSINESS - Liberty Land Ltd. - RPN
Mr. Keeler noted that the revised plans for this item were due in the Planning
Office on April 11, 1979 and were not received until April 17. He noted that he
doubts if the Staff can prepare a Staff Report for this item until Thursday or Friday.
He asked that the Commission give him some idea as to whether they will act on this
item or not.
There was no consensus from the Commission
Executive Session
Mrs. Diehl moved that the Commission go into Executive Session to discuss potential
litigation.
Dr. Moore seconded the motion, which carried unanimously.
The Commission adjourned executive session at 10:55 and called regular meeting to
order.

NEW BUSINESS - Resolution of Intent
Mrs. Graves moved that the Commission adopt a resolution of intent to amend
Chapter 18 of the County Code and Article 17 of the Zoning Ordinance to require
frontage improvements.
Dr. Moore seconded the motion, which carried unanimously, with no further
discussion.
There was no further discussion and the meeting adjourned at 11:02 p.m.
