The Albemarle County Planning Commission conducted a meeting on
Monday, May 21, 1979, 4:00 p.m., Board Room, County Office Building, Charlottesville,
Virginia, to continue work on the proposed zoning text. Those members present
were Col. William R. Washington, Chairman; Mrs. Norma A. Diehl, Vice -Chairman;
Mr. James Skove; Mrs. Joan Graves; Mr. James Huffman; and Mr. Kurt Gloeckner.
Absent were Dr. James W. Moore; Mr. Charles Vest; Mr. Layton McCann; and Mr. Tim
Lindstrom, ex-Officio. Other officials present were Mr. Robert Tucker, Director
of Planning; Mr. Ronald Keeler, Assistant Director of Planning; Mr. Doug Eckel,
Senior Planner; and Mr. Frederick Payne, Deputy County Attorney.
Col. Washington called the meeting to order after establishing that
a quorum was present.
Mr. Tucker presented the concepts of the Natural Resource Extraction
Overlay District to the Commission, particularly noting the requirements for
fencincT in Section 6.8.8.
Mr. Skove pointed out that the representatives of Martin Marietta and
Luck Quarries had been concerned about the loading operation, -equesting that
the hours of operation be until midnight as opposed to 7:00 p.m.
Mr. Tucker noted the letter from Mr. S. L. Williamson requesting that
this change be made.
Mr. Skove said that he feels the hours proposed by Mr. Williamson
are reasonable as long as the blasting operation is not included in that
time frame.
The Commission agreed, by a vote of 4-1, that the hours of operation listed
in 6.8.11 be changed to read as follows: "Operations involving power equip -,.ant
of an industrial type shall be limited to the hours of 7:00 a.m. to midnight except
in cases of a public emergency as determined by the Director of Emergency Services
for the County. Blasting operations shall be restricted to Monday through Friday between
8:00 a.m. and 5:00 p.m."
The only other change made by the Commission was in Section 6.8.15 (1)•----
to be changed to read as follows: "No blasting shall be permitted except in
conjunction with a permit for a stone quarrying operation."
Mr. Tucker then presented the letters of concern about specific
pieces of property and pointed out the areas on the map ( see attached sheets ).
( Mr. Gloeckner arrived at the meeting during this presentation. )
The Commission decided to listen to these comments but consider them
at such time that the area in which the property is located is being reviewed,
in order to have a more complete idea of the area's zoning.

The Commission decided to announce in the local newspaper that
it would be holding work sessions on the proposed map and would receive comments
from individual landowners at these meetings, to be announced at a later date.
Mr. Tucker agreed that it would be better to notify the public at
the time of publication of the generalized map of those dates of the Commission
work sessions.
Col. Washington suggested that at the public hearing the staff present
a comparison between the KDA proposal and the work of the Commission.
Mr. Huffman asked that the economic impact of the zoning ordinance be
addressed at some Commission date prior to the public hearing.
Mr. Tucker reminded the Commission that property in the county can develop
in so many different ways it will be difficult to describe the economic impact.
However, he said that at some future work session he would ask Mr. Bradshaw of the
Real Estate Department to be present to discuss the tax base.
The Commission briefly discussed the request for a preliminary conference
with the Commission on a proposed RPN in the Route 29 North area. It said that
such a discussion would set a bad precedent, and it would be appropriate for the
staff to work with the property owner under the confines of what is permitted
under the zoning ordinance.
With no further business, the Commission adjourned at 6:00 p.m.
