The Albemarle County Planning Commission conducted a meeting on Monday,
June 4, 1979, 4:00 p.m., Board Room, County Office Building, Charlottesville,
Virginia, to continue work on the draft proposal of the zoning ordinance.
Those members present were Col. William R. Washington, Chairman; Mrs. Norma
Diehl, Vice -Chairman; Mr. Layton McCann;Mr. James Skove; Mr. Charles Vest;
Mr. James Huffman; Mr. Kurt Gloeckner; Dr. James Moore; and Mrs. Joan Graves.
Absent was Mr. Tim Lindstrom, ex-Officio. Other officials present were Mr. Robert
Tucker, Director of Planning;.Mr. Ronald Keeler, Assistant Director of Planning;
Mr. Doug Eckel, Senior Planner; and Mr. Fred Payne, Deputy County Attorney.
Col. Washington established that a quorum was present and called the meeting
to order.
Section 5.1 SUPPLEMENTARY REGULATIONS
Mr. Tucker stated that some things had been deleted from the KDA proposal
since it is difficult to standardize regulations or else the use is provided in
another section of the ordinance by special use permit. He said such uses as
go cart and trail bike tracks have been deleted from the ordinance. He said that
these regulations can be used in determining appropriateness of special use permits
when reviewed by the Commission.
After reviewing the provisions the Commission made the following changes
in Section 5.1:
1. Add to the heading in Section 5.1.1 the word "helistop";
2. Change the minimum area requirement for a drive-in theatre in Section 5.9 to
"5 acres."
3. Amend Section 5.1.15 (A) to read as follows: "All storage and operational
areas shall be enclosed by a solid, light -tight, sightly fence not less than
8 feet in height or alternative screening and/or fencing satisfactory to the
Planning Commission."
4. Amend Section 5.1.16 (C) to read as follow: "For non -sound -proofed animal
confinements an external solid fence not less than 6 feet in height shall be
located within 50 feet of the animal confinement and shall be composed of
concrete block, brick, or other material approved by the zoning Administrator."
5. Amend Section 5.1.16 (D) to read as follows: "In all cases, animals shall be
confined in an enclosed building from 10:00 p.m. to 6:00 a.m. Noise measured
at the nearest agricultural or residential property line shall not exceed 40
decibels."
6. Amend the heading of Section 5.1.20 to read as follows: Public Utility
Structures/Uses;
7. Amend Section 5.1.24 so that the setback for temporary sawmills is not limited
during the last three months of operation;
8. Rework Section 5.1.28 to include sale from trucks;
9. Amend Section 5.1.29 to make exemptions for church bazaars, yard sales, bake
sales, but include carnivals, fairs, concerts, circuses, and craft fairs;
10. Include the following provision in Section 5.1.33: C. No such use shall be
established without Fire Official approval.
11. Amend Section 5.1.34(B) so that it is applicable to all zoning districts;
12. Add the following provision as "C" under Section 5.1.34: In any event, cutting
of trees shall be permitted only in accordance with the summary of best forest
management practices published by the Virginia Division of Forestry;
13. Delete "Explosives" from the heading in Section 5.1.31.
Section 3.16 PLANNED UNIT DEVELOPMENT
Mr. Tucker explained the provisions of Section 3.16 and related them to
the current ordinance. He noted that the density would follow the guidelines for
density as recommended by the Comprehensive Plan.
The Commission changed only the acreage provision in Section 3.16.7.1 from
50 acres to a minimum area of 100 acres.
Section 3.15 PLANNED RESIDENTIAL DEVELOPMENT: PRD
Mr. Tucker reviewed the provisions of this section and compared them to
the existing ordinance provisions.
The following changes were made in Section 3.15:
1. Amend the heading in Section 3.15.4 to read "Residential Densities";
2. Rework wording in Section 3.15.3.2 so that intent is clear.
Mr. Tucker determined from the Commission that he should bring the
Lochridge plat to them the following evening for review of the setback line
from the reservoir on one lot. The request was to permit the setback from
the reservoir to be 100 feet, in compliance with the current provisions of the
runoff control ordinance.
Col. Washington said that most provisions of the draft ordinance have received
at least two-thirds support from the Commissioners and he hopes that when the time
for vote is reached, that the ordinance will receive complete support of the Commission.
He asked that individual members not fight certain issues in the ordinance since
there had been agreement by the majority.
Col. Washington then asked that the Commission support the work of the staff
and that the Commission and staff not appear to be at odds with each other. He
said that the Commission members do not always have to agree with the recommendations
of the staff, however it is important to have a mutual respect for each other. He
suggested that the Commission and staff temper their displays so that the public does
not feel one is bickering with the other.
Mr. Huffman suggested it would be appropriate to support the staffs
from other agencies as well.

Mr. Keeler asked for clarification of the Commission's action with
regard to safety on Route 785. The Commission stated that the road was
unsafe for the subdivision requested, and until such time that it could be
improved to handle the existing traffic and traffic generated from the proposed
subdivision, it would not approve the subdivision it had recently considered.
Mr. Keeler asked if this same action would be applicable to other requests
in the area.
The Commission asked that the staff advise any future applicants on Route
785 of its recent action, and let any prospective applicant interpret how
his request would be affected by the denial of the subdivision.
With no further business, the Commission adjourned at 6:50 p.m.
