Those menders present were Col. Washington, Chairman; Mrs. Norma Diehl, Vice -Chairman; Mr. Layton McCann; Mr. Kurt Gloeckner; Dr. James W. Moore; Mr. Tames R. Skove; Mr. James L. Huffman; Jr..; Mr. Charles R. Vest; Firs. Joan Graves. Other officials present were .r. Fred Payne, Deputy County Attorney; Mr. Ron. Keeler, Assistant Director of Planning; Miss Mason Caperton, Planner; Mrs. Idette Kimsey, Planner; Mr. Doug Eckel, Senior Planner; and Mr. aim Lindstrom, ex-Officio. Col. Washington called the meeting to order after establishing that a quorum was present. The Planning Commission reached a consensus that items K-Q on the evening's agenda will be considered by the Commission on *Wednesday, June 27, 1979, 2:00 p.m., Board Room, County Office Building. SP-79--28 Flood R. Shif.flett to locate a mobile home on 8+ acres zoned A-1. Property is located on the south side of Route 649, across the road from the Springfield Subdivision. Count* Tax Map 32, Parcel 29(0)1, Charlottesville Magisterial District. Mr. Douglas Eckel presented the staff report. Mr. Shifflett stated that his health is bad, and approval of the mobile home would ease his financial burden. Col. Washington closed the public hearing. Mrs. Diehl established that Health Department approval is included in 11-14-2. Mr. Skove felt the conditions of approval should include Provision A-6 under Section 11-14-2. Mr. Vest stated he felt this was a hardship case. Mr. Vest moved for approval with staff. recommendations: 1. Compliance with relevant provisions of Section 11-1.4-2 of the Zoning Ordinance, excluding A-6. 2. Virginia Department of Highways and Transportation approval of commercial entrance. Mr. Gloeckner seconded the motion. The vote was 7-1-1 with Mr. Skove dissenting and Mrs. Graves abstaining. d10 ZMA-79-13. Twin Group has petitioned the Board of Supervisors to rezone 16 acres from A-1 to RPN/RS-1. The property is located on the southwest side of Route 654, and abuts Colthurst Farm on the southwest. The property is approximately 2 miles northwest of Barracks Road Shopping Center. County Tax Map 60, Parcel 158 (part thereof). Jack Jouett Magisterial District. Miss Mason Caperton presented the staff report. Miss Caperton also presented a letter from Montvue Citizens Association, and noted Virginia Department of Highways and Transportation comments. Mrs. Graves established that 25% open space is provided. Mrs. Diehl could find no notice posted near the entrance, and thus had difficulty ascertaining exactly which property is involved. Miss Caperton showed Mr. Skove the open space proposed by the applicant. Mr. Fred Payne explained how open spare could be used for septic fields. Max Evans explained the plan, and stated he felt the slopes adequately provided for septic fields and could later provide for fire hydrants. Most of the hardwood trees could be retained. One existing residence will later use private roads. Col. Washington questioned if the septic fields will be necessary in open space. Max Evans stated he prefers that flexibility. Mr. Holden read his letter stating that the density is too great, the plan does not follow the character ofAarea; the open space will not be that usable. He asked that the Planning Commission be guided in their decision by the existing character of the area. Carol Murrad was concerned about this development and the traffic it will put on Barracks Road. Mr. Tom McEachern questioned the deed of development. Max Evans said the property is optioned on approval of the plan by the County. Mr. McEachern questioned if this would be limited to one dwelling per lot. Max Evans replied yes. He pointed out that the Virginia Department of Highways and Transportation determined proposed entrance is safe and density is in accordance with the area. the He noted it is also in kringe of urban area; he felt the density is low -moderate, and thus it does not overextend the capability of the land. One gentleman questioned the size of the smallest lot. Mr. Evans stated there are twelve lots, 40,000 square feet in area. Charlotte Humphris stated she didn't understand the sewer situation and noted problems in Hessian Hills and Old Forge Road area. She felt development should be on the sewer system, which ends at Old Salem Apartments. Mrs. Humphris wanted to make sure that the public does not have to bear the expense of sewer for a private developer; furthermore, she felt this RPN has insufficient open space. She felt this would set a precedent for higher density all the way to Ivy Creek. Objected to higher density pointing out the Comp- rehensive Plan designates this area for something comparable to existing RS-1. There was no further comment from the public. Col. Washington closed the public hearing. Mrs. Diehl thought there would be problems with some of the slope areas, and would like more comprehensive conditions concerning the area of slopes. Mr. Evans stated the Soil Conservation Service said the soil is good, and pointed to area where soil samples were taken. Health Department approval is still required at time of location of each septic field. Miss Caperton stated that a lot -by -lot soil study test will have to be done. Mrs. Graves stated she was concerned with more septic fields within the urban area. They are temporary measure, according to the Health Department. The neighborhood committee did discuss the lot size for the area as one acre. Then she established that 12 units include the one house existing there. Mrs. Diehl questioned the cost of bringing sewer to the property. Mr. Evans said it is prohibitive in cost for only the small portion of the property which could use it. Mr. Keeler noted that the Planning Commission did not bring sewer to Stillfield Subdivision, ordinance says sewer and water will be required only if reasonably available. Mrs. Diehl was having trouble seeing this as a cohesive 127,2 RPN unit - open space is the sata ller buffer and € l-ie gu l leys . Mr. Skcve agreed, noting it does meet technical requirements. Mrs. Diehl stated she felt it looked like a typical sub- division. Mr. Gloeckner established that it would be exempt from the run, -off control ordinance. Mrs. Diehl stated that she would like to review the soil study prior to seeing the final plat. Mr. Layton McCann stated that he didn't particularly want to see the soil study„ as he felt the Health Department would cover the soil situation. He agreed with the Comprehensive Plan and the new ordinance. Mr. McCann felt that the sewer would bring higher density. iie moved to approve with 13 conditions Mrs. Diehl stated she would like a condition #14 to read "Soil study prior to final plat review by Planning Commission." Mr. McCann withdrew his motion, stating that he sees no need for soil study at this time. Mrs. Diehl moved for approval subject to the following conditions: 1. Approval is for a maximum of 12 lots. Location and acreage of land uses shall comply with the approved plan. Open space shall be dedicated in accordance with the number of lots: approved in the final subdivision process; 2. Acreage approved for open space shall not include roads; 3. No grading shall occur until the final subdivision process; 4. Compliance with Soil Erosion Ordinance; 5. Health Department approval of two septic field locations on each lot; 6. County Attorney approval of Homeowner's Agreements prior to final subdivision approval to include the use of open space for septic facilities, and for private road maintenance agreements; 7. Fire Official approval of hydrant locations, prior to final subdivision approval; 8. All. lots shall have access only on the interior road; 9. Coui,ty Engineer approval of road plans prior to sub -- division approval; 10. Virginia Departments of Highway and Transportation approval of commercial entrance and improvements to Route 654 prior to final subdivision approval, according to letter of June 6, 1979; 11. No buildings shall be constructed on slopes of. 25% or greater and appropriate changes made on the plan for building site locations; 12. Only those areas where a structure, utilities, road or other improvement approved in a final plan are to be 17-.3 R located shall be disturbed; all other land shall remain in its natural state; 13. All units shall be served by a public water supply system and approved by appropriate agencies prior to final subdivision approval; 14. Soil study prior to final plat review by the Planning Commission. Mr. Skove seconded the motion, and stated that public sewer would mean higher density. Discussion: Mr. Huffman and Mr. McCann voiced opposition to condition #14. The vote was unanimous. ZMA-79-18. James M. Maupin has petitioned the Board of Supervisors to rezone 73.4 acres from A-1 Agriculture to RPN/RS-1. Property is located on the north side of Route 691 and south of Route 1206, southwest of Crozet. County Tax Map 55, Parcel 65. White Hall Magisterial District. Mr. Max Evans, representing the applicant, explained the. features of the plan, stating the lot size would be 40,000 square feet; there are existing lakes. The plan is to develop in phases. The soil is good in this area and the slopes are gently rolling. Mr. Evans explained there would be no through traffic because it lessens the liveability. Col. Washington stated he felt the traffic would go via Rt. 684 as opposed to Rt. 691. He also noted the blind intersection and narrow road. He felt that the entire project should have one road from Rt. 691 for health and safety reasons. Mr. Gloeckner suggested one access from Rt. 691 with cul-de-sacs and a dam for the lake with private road over it. Col. Washington stated that the green space should truly maintain trees and act as a buffer. Mr. Evans agreed to a condition addressing trees. Col. Washington closed the public hearing, since there was no public comment. Mrs. Diehl was again having problems seeing this proposal as an RPN; she felt this is really three autonomous com- munities. A114 Mr. Gloeckner opposed the jump in density from A-1 to RPN/RS-1. Mrs. Graves stated that she felt the density is too great. Mr. Gloeckner stated that RPN was to provide for clustering, not for a jump in density; he did not say anything about this in review of ZMA-79-13 because of nearness to urban area. Mr. Evans stated it was on the border for growth area for Crozet in the Comprehensive Plan. Col. Washington pointed out that the growth has gone past this area. Mr. Huffman moved for approval with the following staff conditions: 1. Approval is for a maximum of 47 lots. Location and acreages of land uses shall comply with the approved plat. Open space shall be dedicated in accordance with the number of lots approved in the final subdivision process. 2. No grading shall occur until final subdivision process. 3. Compliance with Soil Erosion and Runoff Control Ordinance; 4. County Attorney approval of Homeowners' Agreements prior to final subdivision approval to include the use of open space for septic facilities and for private road maintenance agreements; 5. Health Department approval of two septic field locations on each parcel prior to final subdivision approval; 6. Fire Official approval of hydrant locations; 7. Only those areas where a structure, utilities, road or other improvement in a final plan are to be located shall be disturbed; all other land shall remain in its natural state; 8. All units are to be served by a public water supply system and approved by the appropriate agencies prior to final sub- division approval; 9. Compliance with the private road ordinance prior to final subdivision approval including County Engineer approval of road plans; 10. Virginia Department of Highways and Transportation approval of entrances on Routes 691 and 684, and frontage improvements; prior to final subdivision approval, in accordance with letter of June 6, 1979. Mr. McCann seconded the motion. Discussion: Mrs. Diehl stated the plan does not show an integrated unit. In the past this has been grounds for denial. Mrs. Graves agreed, and noted the application in the Shadwell area. Mr. Gloeckner stated he could not support the request because of the density jump. The vote was 4-0-5 with Mrs. Graves, Mrs. Diehl, Mr. Gloeckner, Dr. Moore, and Col. Washington dissenting. 1*400 Col. Washington stated he could support the plan with a single road. The Planning Commission took a five minute break. Buck Mountain,'Cluster, Section 2 Final Plat. Located east of Route 671, in Buck Mountain Planned Community; proposal for 9 lots of 1+ acre with 10+ acres in open space. White Hall Magisterial District. Mrs. Idette Kimsey presented the staff report. She noted that lot 9B has less than 14,000 square feet and thus may not be able to get two drainfields on lot. Mr. Evans noted that these cluster lots were part of the approved plan. Mr. Evans also noted that the private drives will have a maintenance agreement. Most of the pines have fallen and will be removed. There was no comment from the public, and Col. Washington closed the public discussion. Mrs. Graves established that the drain easement is 15'. Mr. Gloeckner moved for approval with the following staff conditions: 1. This plat will not be signed until the following conditions are met: a. Health Department approval of two septic drainfield sites on each lot; b. Virginia Department of Highways and Transportation approval of cul-de-sac access; C. County Engineer approval of drainage easements; d. Compliance with the private road provisions of the subdivision ordinance. Mrs. Diehl seconded the motion, which carried unanimously, with no discussion. Eugenia Adams Final Plat. Located on east side of Route 677 South of Route 676; proposed division of one 23 acre parcel ice,: leaving 53+ acres residue. Samuel Miller District. Mrs. Idette Kimsey presented the staff report. Danny Graff, representing the applicant, noted that Mrs. Adams C;?.6 was giving this to her son-in-law, and this is therefore a family division. Mr. Gloeckner moved for approval with the following staff conditions: 1. This plat will not be signed until the following conditions have been met: a. Compliance with the private road agreement, including: 1. County Engineer approval of road; 2. County Attorney maintenance agreement approval; b. Waiver of 18-36D as it relates to the residue. Mr. Vest seconded the motion, which carried unanimously, with no discussion. A. P. Williams Final Plat. Located on the north side of Route 618, east of Route 729 near Fluvanna County; proposed division of two parcels of 5 acres each. Scottsville District. Mr. Fred Payne disqualified himself from the discussion by leaving the room. Mrs. Idette Kimsey presented the staff report. Mr. Morris ,Mated the reason the plat is before the Commission is the pipestem and the reverse driveway to the back parcel. Col. Washington established that adequate dedication has been made. There was no public comment, and Col. Washington closed the public discussion. Mr. Vest moved for approval with the following staff conditions: 1. This plat will not be signed until the following conditions are met: a. Owner's signature notarized; b. Health Department approval. Mr. McCann seconded the motion. Discussion: Mrs. Gravies stated she was not sure that the Virginia Department of Highways and Transportation vehicle count is correct. The motion carried unanimously. Mr. Fred Payne returned to the meeting. -J�12 Meriwether Hills Section V - Final Plat. Located on east side of Route 678 adjacent to Leeds Lane in Meriwether Hills; proposed division of six parcels with an average size of 1+ acre. Samuel Miller District. Mrs. Idette Kimsey presented the staff. report. Mr. Gloeckner stated that a vicinity map was needed on the plat. Mr. Forloines did not object to condition 1-A as long as it is within reason. He said he did not intend to upgrade the County's water system. Mr. Keeler stated that the Fire Official does not intend to require anything but a hydrant. Nothing will be required over the existing 4" line. There was no public comment, and Col. Washington closed the public discussion. Mrs. Graves objected to changing condition 1-A. She noted the cost of upgrading the water system for fire protection as proposed by E. E. Thompson. Mrs. Graves stated that she did not want to tie the hands of the Fire Official. Mr. Gloeckner moved for approval with the following staff conditions: 1. This plat will not be signed until the following conditions are met: a. Fire official approval of location of firs: hydrants; b. Health Department approval; c. Grading permit; d. Runoff control permit; e. County Engineer approval of road plans for state secondary roads and drainage easements for all of Leeds Lane _ i.e. from its intersection with Lewis Street to the end of the cul-de-sac; f. Albemarle County Service Authority approval of water line plans; g. All title owners' signatures notarized; h. Upgrade Leeds Lane from Section 11, Meriwether hills to state standards in accordance with proffer con- ditions of ZMA-79-04; i. Note on plat vicinity map. Mr. Vest seconded the motion. The vote was 8-0-1, with Mrs. Graves dissenting. Thurston, Section 1, Final Plat; Located on the east side of Route 810, north of Crozet, plat showing a temporary turn- around. on lot 31 of the Thurston Subdivision. White HaIl District. A Tuft Sales - John Deere Site Plan. Located on east side of Route 29 North, just north of Route 649, proposed site roy farm equipment merchandise, sales, and service. Rivanna District. Mrs. Idett-e KiTrsey presented the staff report. Dr. Moore as that. Route 649 was improved with a turnlane. Mr. Huffman stated that the utilities kept it fion, being a through lane. Mr. Puryear stated that the petiL.:.oner will need access from Route 29. 1"he applicant will have to provide a decel lane on Route 29. The Virginia Department of Highways and Transportation future plans support the proposal here. Mr. Sinclair felt access from Rt. 649 is too far away and could be a hazard when trying to determine where the access to property is when traveling Route 29. Mr. Puryear stated it was critical to the contract purchaser to have access from Route 29. John Deer will not approve the franchise if access from Rt. 649. Mr. Gloeckner stated that the Planning Commission tried to alert the existing owner to the problem, when subdivided the land; and now John Deere is being penalized. Mrs. Graves stated that this plan assumes that all traffic is coming from the south, and that she would not want to sanction u-turns on Route 29. Mr. Keeler stated that he feels this business has a lot of impulse buying. Mr. Skove again reminded Mr. Puryear of the terms of the subdivision plat. Mr. Keeler stated that the Virginia Department of Highways and Transportation said it would not approve access from Rt. 29 for the Ford Site Plan. Mr. Keeler pointed out that the Virginia Department of. Highways and Transportation had only to give access from one state road; in this case there are two state roads. Mr. Puryear stated that the acreage does not have frontage on Route 649. Mr. Gloeckner stated that they were really talking about another subdivision. Mr. Keeler agreed with Mr. Gloeckner. Col. Washington closed the public discussion. Mrs. Graves stated she could support this site plan. Dr. Moore moved for denial, and stated he thought the sub- division plat was fixed so there was no access to Route 29. Mrs. Graves seconded the motion. Mr. Payne stated that the Planning Commission needed to state what will make the site plan acceptable. Dr. Moore stated that the site plan will be acceptable if it has access to Route 649 only. The vote for denial was unanimous. Saddlewood Farm. Located on north side of Route 618, east of Route 729 near Fluvanna County; proposed division of two parcels of 5 acres each. Scottsville District. Mrs. Idette Kimsey presented the staff report. Mr. Gibbs stated he had no objection to conditions. Mr. Gibbs said that the sliver of land extends out into the lake, so the parcel has frontage on the lake. Mr. Gloeckner questioned the spike at back. Mr. Gibbs then questioned the meaning of condition B(2). Mr. Payne explained that new lots can be added to existing maintenance agreement, if it is adequate. Otherwise, plat will be denied on the basis it can't meet the conditions of approval. Mrs. Diehl moved for approval with staff conditions. • 1. This plat will not be signed until the following conditions have been met: a. Health Department approval; b. Compliance with the private road ordinance, including: 1. County Engineer approval of road; 2. Maintenance agreement for all logs served by this easement to be approved by the County Attorney; c. All, title owners' signatures notarized. Mr. Vest seconded the motion, which carried unanimously with no discussion. David Beach/Westfield Road Final Plat, Parcel 5A-2: Located on west side of Westfield Road, south of Commonwealth Drive; plat showing the division of one parcel of 16,633 square feet. Charlottesville District. Mrs. Idette Kimsey presented the staff report. Mr. Beach and Mr. Sinclair were present. Mr. Sinclair said that the lot will be used as a parking lot. Mr. McCann moved for approval with one condition: 1. This plat will not be signed until the following condition is met: a. All. title owners' signatures notarized. Mr. Gloeckner seconded the motion. The vote was 8-0--1, with Mrs. Graves dissenting. David. Beachy(T7estfield Road Final Plat, Parcel 5A-3 through 5A-5. Located on the west side of Westfield Road, south of Common -- wealth Drive; plat showing the division of one parcel into three. Charlottesville, District. Mrs. Idette Kimsey presented the staff report. Mr. Keeler said that condition 1-A is not a firm recommendation of the staff, that it is a recommendation of the Virginia Depart- ment of Highways and Transportation. Mr. Sinclair stated that he felt: this would be detrimental to the property value and could create problems for the owner in the future, for example, a problem of simple maintenance of the joint easement. Mrs. Graves stated that she supported the recommendation of the Virginia Department of Highways and Transportation. 20,1 Mr. Gloeckner agreed with Mr. Sinclair that this is strictly a business street. He was not strongly in favor of shared entrances in this case. Mrs. Graves moved for approval with staff conditions: 1. This plat will not be signed until the following conditions are met: a. All title owners' signatures notarized. b. Lot 5A-4 share an entrance with either lot 5 or 3, in order to cut down curb cuts; Mr. Moore seconded the motion. The vote was 4-0-5 with Mr. Skove, Dr. Moore, Mrs. Graves, and Mrs. Diehl supporting the motion. Mr. Gloeckner moved for approval subject to the following condition: 1. This plat will not be signed until the following condition i s me t; a. All title owners' signatures notarized. Mr. McCann seconded the motion. The vote was 6-0-3 with Dr. Moore, Mrs. Graves and Mr. Skove dissenting. _Auburn Hills, Section Two Final Plat: Located south of Route 732 and east of Route 53; proposal for lots 6-8 and 21-31 can Jumping Branch Lane. Rivanna District. Mrs. Idette Kimsey presented the staff report. Mr. Keeler stated that the road name may have to be changed. Mr. Tom Sinclair, on behalf of the applicant, objected to condition 1 (b) as proposed by the staff. Mr. Keeler stated that this has been covered by a bond since 1976 and the staff would like the road in the state system prior to any new construction. Mr. Gloeckner stated that condition 1(b) was fair in view of the circumstances. Mrs. Graves suggested that Health Department approval be a condition of approval. Mrs. Diehl moved for approval with the following conditions: 5119- 1. Vl�is plat will not be signed until the following conditions are met: a. Engineering Department approval of road plans for acceptance into state secondary road system and drainage easements; b. Prior to signing Auburn Hills Section II, Auburn Drive shall be constructed to state standards and maintenance bond posted; c. Owners' signature notarized; d. A construction bond posted for Jumping Branch Lane; e. Rename Jumping Branch Lane; f. Health Department approval; Mrs. Graver seconded the motion, which carried unanimously. OLD BUSINESS: Col. Washington discussed his meeting with Mr. Fisher, who expressed concern that the Board would receive the Zoning Ordinance at election time. Mr. Fisher, in that meeting, had asked for a schedule of public hearings on neighborhood plans and on zoning ordinance, and had stated that early August was a good time for public hearings on -he zoning ordinance The Planning Commission asked Mr. Keeler to work up a schedule on neighborhood plans for public hearings. The meeting adjourned at 11:40 p.m.
