The Albemarle County Planning Commission conducted a meeting
on Wednesday, June 27, 1979, 2:00 p.m., Board Room, County Office
Building, Charlottesville, Virginia. This meeting was a continuation
of the June 26, 1979,meeting. Those members present were Col. Washington,
Chairman; Mrs. Norma Diehl, Vice -Chairman; Mr. Kurt Gloeckner; Mr.
Layton McCann; Mr. James Huffman; Mr. Charles R. Vest; Mr. James R. Skove;
Dr. James W. Moore; and Mrs. Joan Graves. Other officials present were
Mrs. Idette Kimsey, Planner; and Mr. Ron Keeler, Assistant Director of
Planning. Absent were Mr. Frederick Payne, Deputy County Attorney, and
Mr. Tim Lindstrom, ex-Officio.
Col. Washington called the meeting to order after establishing
that a quorum was present.
FHM PARTNERSHIP/DOCTORS COURT, OFFICE BUILDING #3 SITE PLAN:
located on the east side of Hydraulic Road across from
Albemarle High School: Proposed site plan for a two story
office building with 7,888 square feet, Charlottesville District.
Mrs. Idette Kimsey presented the staff report.
Mr. Gloeckner disqualified himself from the discussion and
vote by leaving the room.
The applicant made no comment.
Col. Washington established that Virginia Department of
Highways and Transportation did not recommend frontage
improvements.
Mr. Skove moved for approval with staff conditions:
1. A building permit will not be issued until the following
conditions have been met:
a. Written Fire Official approval;
b. Approval of Runoff Control;
c. Note on site plan all existing drainage structures.
Mr. Vest seconded the motion, which carried unanimously.
Mr. Gloeckner re-entered the meeting.
BALLARD WOODS FINAL PLAT: Property located west on the south
side of Route 677 near West Leigh Subdivision. Property is
described as Tax Map 59C(3), parcel 8(2) in the Samuel Miller
District.
Mrs. Idette Kimsey presented the staff report.
Morris Foster had the road built and entrance approved by
Virginia Department of Highways and Transportation as a
subdivision road. He feels that he has had a commercial
entrance for ten years. However, during the meantime require-
ments of Virginia Department of Highways and Transportation
and
have changed, and the road ^entrance were never intended to
serve only one lot.

Mr. Ron Keeler noted that the Virginia Department of Highways
and Transportation said road plans were never approved, and
revised plans were never submitted.
Mr. McCann moved for approval with staff conditions:
1. This plat will not be signed until the following conditions
have been met:
a. Note on plat tax map and parcel number.;
b. Note the source of the title on the plat;
c. No responsibility of County for any problems
resulting from Ballard Wood Court until it becomes
part of the State system.
Mr. Skove seconded the motion.
Mr. Payne asked that it be made clear in a statement that
the County is not assuming any liability for drainage,
maintenance, etc., concerning the road.
Mr. Layton McCann included that as part of his motion.
Mr. Skove accepted the amendment.
The vote was 7-0-1 with Dr. Moore abstaining.
VIRGIL BARNETT FINAL PLAT: Property is off south side of
Route 250 on Old Three Chopt Road. Property is described
as Tax Map 80, parcel 56 in the Rivanna District.

Mrs. Idette Kimsey presented the staff report.
Morris Foster stated that the applicant has n�%eplans for
future subdivision. He also tried to explain;road situation,
noting only Mr. Barnett uses the back portion of the road.
Mr. Payne said that it doesn't appear essential that the road
be a through -road to serve any of the properties.
There was no public comment.
Col. Washington closed the public discussion.
Mr. Gloeckner recommended they approve a private entrance
where Barnett's current entrance is and allow no access
from commercial entrances. Then the Planning Commission
could recommend to the Board it vacate a portion (100 feet)
of Three Chopt Road that serves Tract B.
Mr. Gloeckner, then moved approval with staff conditions:
1. This plat will not be signed until the following conditions
have been met:
a. Health Department approval;
b. Correct on plat Charlotte A. Wood to Charlotte A. Lloyd;
c. Virginia Department of Highways and Transportation
commercial entrance approval;
d. Compliance with the Private Road Ordinance, including:
1. County Engineer approval of the road;
2. County Attorney approval of the maintenance agreement.
Mrs. Norma Diehl seconded the motion.
The vote was unanimous.
COSMOPOLITAN SPA SITE PLAN ADDITION: Property located on
Westfield Road west of Route 29 North. Property described as
Tax Map 61-W, parcel lA2 in the Charlottesville District.
Mrs. Idette Kimsey presented the staff report.
This was deferred until later in the meeting because of
absence of applicant or his representative.
ADVENTURE BOUND SITE PLAN: Property is on Route 610, 5 miles
west of Boonesville. Property described as Tax Map 6, parcel
24 and 25B in White Hall District.
Mrs. Idette Kimsey presented the staff report.
Mrs. Norma Diehl questioned if the septic system is adequate.

Gary Duncan said this is a school for learning disabled.
boys, age 10-18, and is licensed by 3 state agencies.

Mr. Skove pointed out that the 15-18 recommendation by the
Highway Department is based on economics, and commercial
entrances are supposed to be based on safety.
(Mrs. Diehl left the meeting).
Mr. Gloe:ckner noted this road does not need improvements
since this is the same use as before.
Mr. Gloeckner moved approval of the site plan with staff
conditions:
1. Certificate of Occupancy will not be issued until the
following conditions are met:
a. Health department approval;
b. Fire Official approval.
Mr. Skove seconded the motion.
The vote was 7-0-1 with Mrs. Graves abstaining.
GORDONSVILLE ELECTRICAL SUBSTATION SITE PLAN: Property
located on Route 646 north of the intersection with Route 231.
Property described as Tax Map 37, parcel 11A in the Rivanna
District.
Mrs. Idette Kimsey presented the staff report.
Mr. Gray said he prefers to do frontage improvements at the
time the road is upgraded.
Mr. Moore established that this is a unmanned station.
Mrs. Graves stated a vicinity sketch should be shown on the
site plan.
Mrs. Graves moved approval with staff recommendations:
1. A building permit will not be issued until the following
conditions have been met:
a. Virginia Department of Highways and Transportation
approval of commercial entrance and frontage improvement.
b. Vicinity sketch.
Mr. Skove seconded the motion, which carried unanimously.
Mr. Keeler pointed out that there is no special permit for
transmission lines.
(Mr. Skove left the meeting.)
OAKENCROFT SUBDIVISION FINAL PLAT: Property is located
on Route 601 about three miles northwest of Charlottesville.
Property is described as Tax Map 59 and 43, Parcel 32 in
Samuel Miller District.
Mrs. Idette Kimsey presented the staff report.
Danny Graff stated there will be no new construction on
the lot; the subdivision is for tax purposes; the entrance
is in excess of commercial requirements; the road is paved
and exceeds private road standards.
Mr. McCann moved for approval with staff recommendations:
1. This plat will not be signed until the following conditions
are met:
a. Health Department approval;
b. Compliance with the Private Road Ordinance, including:
1. County Engineer approval of road;
2. County Attorney approval of maintenance agreement.
Mrs. Joan Graves seconded the motion, which carried unanimously.
WILHOIT FINAL PLAT: Tax Map 61, parcel 183, on the west side
of Rio Road. East just north of Rio Heights.
Mrs. Idette Kimsey presented the staff report.
Mr. Keeler noted condition (a) of the staff conditions.
Virginia Department of Highways laid a new pipe and cut the
ditch along the front of the small parcel. under an entrance permit;
Staff recommends frontage requirements remain on larger parcels.
Mr. Wilhoit stated that the Virginia Department of Highways
and Transportation lowered the ditch for entire length of property.
Mr. Gloeckner moved to suspend rules and reconsider plat.
Mr. Keeler read Virginia Department of Highways and Trans-
portation recommendation of June 7.
Mr. McCann seconded the motion for reconsideration which
carried unanimously.
COSMOPOLITAN SPA:
Mrs. Graves moved for deferral in view of the absence of
applicant.
Mr. Gloeckner seconded the motion, which carried unanimously.
By motion of Mr. Gloeckner, second by Mr. McCann, the
Planning Commission adopted a resolution of intent to
amend the Comprehensive Plan for more detailed land use
plans for the villages, communities, and urban area.
With no further business, the Planning Commission adjourned
at 5:00 p.m.
