HomeMy WebLinkAbout08 21 79 PC Minutes1 August 21, 1979 M The Albemarle County Planning Commission conducted a public hearing on Tuesday, August 21, 1979, 7:30 p.m., Board Room, County Office Building, Charlottesville, Virginia. Those members present were Col. William Washington, Chairman; Mrs. Norma Diehl, Vice - Chairman; Mr. Kurt Gloeckner; Mrs. Joan Graves; Dr. James Moore; Mr. James Skove; Mr. James Huffman; Mr. Layton McCann; and Mr. Frederick Payne, Deputy County Attorney. Other officials present were Mr. Doug Eckel, Planner; Miss Mason Caperton, Planner and Mrs. Idette Kimsey, Planner. Commission member who was absent was Mr. Charles Vest. Mr. Tim Lindstrom, ex-Officio was also absent. Col. Washington called the meeting to order after establishing that a quorum was present. Minutes of July 17, 1979 were approved by the chairman as submitted. COMMONWEALTH TOWNHOUSES SITE PLAN: Tax Map 61W, parcel B-3. Located on the north side of Commonwealth Drive, west of Westfield Road. Miss Caperton presented the staff report. (Mrs. Graves entered the meeting.) Mr. Jim Hill, representing the applicant, stated he had no comment to make. Col. Washington closed the public hearing. Mr. Gloeckner moved for approval subject to conditions set forth by staff: 1. A building permit will not be issued until the following conditions have been met: a. Virginia Department of Highways and Transportation approval of commercial entrance; b. County Engineer approval of curbing, drainage facilities, and pavement specifications; c. Compliance with the Stormwater Detention requirements; d. Fire Official approval of handicapped provisions, dumpster screening, and additional fire hydrant; e. Albemarle County Service Authority approval of water and sewer plans; f. Additional landscaping to be approved by Staff; g. Technical requirements as required by Article 17 of the Zoning Ordinance; h. Deletion of 2 parking spaces on each side of the entrance to allow for easier access into the site; and replace with some additional landscaping. l �L Mr. McCann seconded and the motion was carried unanimously. BALLARD MEADOWS SITE PLAN: On the east side of Route 677 north of 250 West. Property is described as Tax Map 59, parcel 28 in the Samuel Miller District. (Deferred from July 17, 1979) Mrs. Kimsey presented the staff report noting Mr. Edgerton stated he has an agreement with Mr. Frank Kessler to share the cost of road improvements. Mrs. Diehl asked if any conditions had changed from the time of the original presentation on July 17, 1979. Mrs. Kimsey replied that Health Department approval has now been granted. Mrs. Graves asked if the previous problems had been solved. Mrs. Kimsey replied that there is now a new entrance design locating the entrance closer to the units. Mr. Skove asked if the units could be sold separately. Mr. Payne replied that the units could be sold only as condominiums. Col. Washington closed the public hearing. Dr. Moore asked if dedication of the road of the entire 155 acre parcel would deny use to the owner. Mr. Payne answered yes, potentially, as the Highway Department could refuse fencing and so forth to the owner. Col. Washington said he felt dedication would be reasonable for 550 feet from the center of the entrance. Mr. Gloeckner stated he could support dedication of 450 feet to the south plus whatever that distance is from the center of the entrance to what the applicant has already dedicated. Mr. Payne said if the Commission required additional dedication, it should be in the form of a condition. Mr. Gloeckner moved for approval with staff recommendations: 1. A building permit will not be issued until the following conditions are met: a. Virginia Department of Highways and Transportation frontage improvement and commercial entrance approval; b. County approval of central drainfield; c. Runoff control permit, if needed; d. Dedicate from the center of the proposed entrance to the south along Rt. 677 a 25-foot strip with a distance of 450 feet for the purpose of improving the road to State requirements and retain the portion to the north that is already dedicated; e. Note on site plan that this is not a subdivision plat. 2. A certificate of occupancy will not be issued until the following conditions are met: a. Fire Official approval; b. Albemarle County Service Authority approval if water becomes available. Mr. McCann seconded the motion. Discussion: Mrs. Graves stated she felt a note or condition should be added saying this plat is not a subdivision. Mr. Payne said that he didn't think it would hurt. Mr. Gloeckner accepted Mrs. Graves condition that the note be added. Mr. Huffman seconded Mrs. Graves motion. The vote was unanimous for approval with the reworded Coddition D and new Condition E. SP-79-40. Mr. and Mrs. Shannon Stinson to locate a mobile home on 5.15 acres zoned A-1. Property is located on the southwest side of Route 795, approximately 4 miles north of Scottsville. Tax Map 123, parcel 12A. The Planning Commission deferred until September 11, 1979, any discussion or action on this application due to lack of representation on the part of the applicants. SP-79-42. Thomas and Marie Moon to locate a mobile home on 13.96 acres zoned A-1. Property is located on the east side of Route 20 approximately 4 mile southwest of Stony Point. Tax Map 48, parcel 21, Rivanna District. The Planning Commission deferred until September 11, 1979 any discussion or action on this application due to lack of rep- resentation on the part of the applicants. GREENTREE FINAL PLAT - LOTS lA AND 1B: Property described as Tax Map 60A, parcel 08-09; located on the west side of Georgetown Road, south of Ingleside Drive. Miss Caperton presented the staff report. Mr. Tom Sinclair, representing the applicant, stated he had no comments. Col. Washington closed the public hearing. Mr. Huffman moved for approval with staff's recommendations: 1. The plat will not be signed until the following conditions are met: a. Compliance with the private road requirements for 25 foot access: 1. County Engineer approval; 2. Maintenance agreement to be approved by the County Attorney; b. Lots 1A and 1B shall have access off of Greentree Park on 25-foot access easement; c. Additional right-of-way dedication to provide for the approved 52-foot right-of-way on Georgetown Road; d. Compliance with the Runoff Control Ordinance; e. Change the right-of-way notation on Georgetown Road to 45 feet. Mrs. Graves seconded the motion. There was no discussion. The vote was unanimous for approval with staff's recommendations. SWEENEY FINAL PLAT: Property described as Tax Map 94, part of parcel 17. Miss Caperton presented the staff report. The Commission discussed the reason for part of the property on one side of the road and the other on the other side. Miss Caperton explained that this was created when Westvaco recorded its right-of- way in July of 1975. She explained that the larger portion would be used for a residence, and the small part would be used for a garden; however, approval of the plat would give the applicant the necessary 2 acres to meet the density requirement. Mrs. Diehl established that the Health Department had approved the lot. Mr. Payne stated that the Commission could require the applicant to provide proof of access to the .63 acre parcel. Mr. Skove questioned the possibility of the applicant seeking a variance from the Board of Zoning Appeals on the required lot size. 1--?n Mr. Payne explained that a lot must meet the requirements of the zoning ordinance before it can be considered for subdivision. Mr. McCann felt that since the parcel falls within Nix Village, and the County is condidering higher densities for the villages, this lot would be perfectly in order. That way the applicant could use the larger portion for his home and the smaller could be used for a garden or some other use. In addition, the 1.55 acres would meet the proposed lot requirements. Col. Washington said that he was reluctant to approve a lot, one part of which might not have access. Mr. Skove moved approval of the plat subject to the conditions recommended by the staff. Miss Caperton questioned if this included proof of access to the .63 acre portion. Mr. Skove replied that this was not included in the motion. Mr. Skove moved for approval subject to staff;s conditions. Mr. Gloeckner seconded the motion, which carried unanimously. Col. Washington noted that it was with definite reluctance that he had supported the motion. Mr. Gloeckner disqualified himself from the discussion and vote by leaving the room. SCOTTSVILLE ELEMENTARY SCHOOL SITE PLAN ADDITION: Property described as Tax Map 130, parcel 25P, located on Rt. 20 South, north of Scottsville. Miss Caperton presented the staff report. Mr. Lawson Drinkard, on behalf of the applicant, stated his firm would be happy to work with staff on the conditions: 1. A building permit will not be issued until the following conditions have been met: a. Fire Official approval of handicapped facilities and location and screening of the dumpster; b. Virginia Department of Highways and Transportation approval of entrance and left turn lane; c. County Engineer approval of road specifications, drainage facilities and curbing; d. Compliance with the Runoff Control Ordinance; e. Provide for overflow parking (perhaps within the playground area); f. Provide a list of the landscaping materials for staff approval. „w 2. A certificate of occupancy will not be issued until the following conditions have been met: a. Central water supply system to be approved by the 1,2/ appropriate agencies; b. Staff approval of playground facilities. Mrs. Diehl commented that all cars will have to go through the school bus loading and unloading zone to get to the parking lot. Mr. Drinkard replied that it would cost another eight thousand dollars to construct a loop for the cars and that the cars and busses would be there at different times. Mrs. Diehl replied she still felt it was not a safe situation. Col. Washington closed the public hearing. Mrs. Graves stated she agreed with Mrs. Diehl but couldn't see how the situation could be improved. Mr. McCann moved for approval with staff's recommendations. Mr. Skove seconded. The vote was 5-0-1 with Mrs. Diehl dissenting. Mr. Gloeckner re-entered the meeting. ROBERT V. CLARK FINAL PLAT: Property described as Tax Map 87, part of parcel 35C; located on the east side of Rt. 29 South (NBL), at Red Hill. Miss Caperton presented the staff report. Mr. Morris Foster, on behalf of the applicant, stated he felt a turn lane should be subject to the Highway Department's approval of a commercial entrance. Col. Washington asked for and received the information that Lots 1 and 2 had both been sold. Mrs. Graves established Lot 4 had double frontage which she felt should be waived. Mr. Huffman pointed out the plat should read Lots 3 through 7 instead of Lots 4 through 7. Col. Washington closed the public hearing. Mrs. Diehl moved for approval subject to the following recommendations: 1. The plat will not be signed until the following conditions have been met: a. Virginia Department of Highways and Transportation approval of the commercial entrance; „ b. Compliance with the private road requirements, including: 1. County Engineer approval of the road specifications; 2.. Count tttorney approval of a maintenance agreement; C. Written Ha th Department approval; d. Provide a topographic map; e. Waiver of double frontage granted for lot 4; f. Change title to read lots 3-7. Dr. Moore seconded the motion. The vote was unanimous for approval. W. P. BALLARD FINAL PLAT: Property described as Tax Map 41, part of parcel 65A; located on the north side of Rt. 675, south of Rt. 614, east of White Hall. Miss Caperton presented the staff report. Mr. Morris Foster, representing the applicant, had no comment. Col. Washington asked if there was an adequate area for a septic system. Miss Caperton replied that the Health Department had given their approval. Col. Washington closed the public hearing. Mrs. Diehl moved for approval with staff's recommendations: 1. The palt will not be signed until the following conditions have been met: a. Written Health Department approval; b. Compliance with the private road requirements; 1. County Engineer approval of the road; 2. County Attorney approval of maintenance agreement. Mr. Gloeckner seconded the motion. The vote was unanimous for approval. Mr. Gloeckner disqualified himself from the discussion and vote by leaving the room. CHRISTIAN MISSION SITE PLAN: Property described as Tax Map 59, parcel 23G; located on the north side of Rt. 250 West, east of the intersection of Rts. 250 and 677. Miss Caperton presented the staff report. Mr. R. V. Finley, the applicant, expressed disagreement with several of the staff's recommendations. He pointed out the fact that the site will eventually have public water but that at the present the site is serviced by a separate well. He also stated the site plan will not generate any more cars as his guests will be 0?3 from out of the country and will not arrive in cars. He said he would like the parking spaces reduced from 58 to 34. Col. Washington closed the public hearing. At this time, the Commission discussed several of the staff recommendations with Miss Caperton and Mr. Finley. Mrs. Diehl moved for approval with staff's recommendations: 1. A building permit will not be issued for the guest house until the following conditions have been met: a. Written Health Department approval; b. Note building information for the guest house on the plan, i.e. square footage, number of floors, number of rooms, etc.; c. Compliance with the Runoff Control Ordinance; d. No buildings shall be constructed on slopes greater than 25%; e. Albemarle County Service Authority and Fire Official approval of plans to connect to public water; f. Virginia Department of Highways and Transportation approval of entrance location on Rt. 677; 2. A Certificate of Occupancy will not be issued until the following conditions have been met: a. Fire Official approval; 3. Water diversion and seeding specifications for the athletic field to be approved by the County Engineer; 4. Virginia Department of Highways and Transportation approval of a commercial entrance for the intersection of Old Rt. 250 and Rt. 677, if required; 5. Maintenance agreement for Old Rt. 250 between landowners using the road, to be approved by the County Attorney. Mr. Skove seconded the motion. Discussion: Mr. McCann reported he could not support the motion. Col. Washington stated his concern as to whether there was reasonable fire protection. Mrs. Diehl replied she would be willing to amend the motion to read 2 a. Fire Official approval. Mr. Skove found this acceptable. The vote was 6-0-1 with Mr. McCann dissenting, for approval with the two amended conditions. 19 51 Mr. Gloeckner re-entered the meeting. LEWIS HILL RPN FINAL PLAT: Property described as Tax Map 58, parcels 81 and 81V, located on the east side of Rt. 678, ,,✓ north of Ivy. Miss Caperton presented the staff report. Mr. Roger Ray, on behalf of the applicant, stated they wished to name the private road Holkam Drive Extended. Miss Caperton replied the Post Office would like one name. Col. Washington closed the public hearing. Mr. Skove moved for approval with staff's recommendations: 1. The plats will not be signed until the following conditions have been met in each phase: a. Staff approval of the naming of the private road. b. Approval is for 60 lots in 2 phases; lots 1-20 and 39-60 and 37.01 acres in dedicated open space are to be included in Phase I; lots 21-38 and 15.86 acres of dedicated open space are to be included in Phase II; c. Compliance with the Soil Erosion and Runoff Control Ordinances; d. County Attorney approval of Homeowner's Agreements to include the use of open space for septic fields, if necessary, and for private road maintenance agreements; e. Health Department approval of two septic field locations on each lot; no septic field shall be sited on any slopes of 25/ or greater; f. Fire Official approval of hydrant locations; g. Abandonment of old road serving lot 25 as approved by the Board of Supervisors in the action letter dated June 22, 1979; h. Only those areas where a structure, utilities, road or other approved feature are to be located shall be disturbed; all other land shall remain in its natural state; i. Albemarle County Service Authority approval of water plans; j. County Engineer approval of private road plans and drainage easements including the portion of Phase I; k. County Engineer and Virginia Department of Highways and Transportation approval of road plans and drainage easements. Mr. Gloeckner seconded the motion. There was no discussion and the vote was unanimous for approval. M JOHN GIB13S PRELIMINARY PLAT: The applicant is requesting that the Planning Commission reconsider their action of February 27, 1979 (and the Board of Supervisors' subsequent action on March 21, 1979) to require frontage improvements on Rt. 618 as recommended by the Virginia Department of Highways and Transportation. The applicant is proposing to put a note on the preliminary and final plats stating that no building permits will be issued until the necessary work has been completed. Mr. McCann moved not to reconsider the applicant's request. Mrs. Graves seconded the motion. The vote was 7-0-1 with Mr. Gloeckner dissenting. WOODLAND NORTH RENTAL SITE PLAN - On the north side of Rio Road East, east of Rt. 29 North. Proposal for 675 apartment units on 52 acres with a density of 17.3 units per acre.
