HomeMy WebLinkAbout09 11 79 PC MinutesSeptember 11, 1979 The Albemarle County Planning Commission conducted a public hearing on Tuesday, September 11, 1979, 7:30 p.m., Board Room, County Office Building, Charlottes- ville, Virginia. Those members present were Col. William Washington, Chairman; Mrs. Joan Graves; Mr. James Huffman; Mr. Layton McCann; Mr. Kurt Gloeckner; Dr. James Moore; Mr. James Skove; and Mr. Tim Lindstrom, ex-Officio. Members who were absent were Mrs. Norma Diehl, Vice -Chairman and Mr. Charles Vest. Other officials present were Mr. Robert Tucker, Director of Planning; Mr. Ronald Keeler, Assistant Director of Planning; and Mr. Frederick Payne, Deputy County Attorney. Col. Washington called the meeting to order after establishing that a quorum was present. SP-79-51. County of Albemarle requests a Health Clinic on 2.1 acres zoned A-1 Agriculture. The property is described as Tax Map 128, parcel 79B, located on the west side of Rt. 627 approximately � mile south of Rt. 6 in the Esmont area. Mr. Keeler presented the staff report in which he mentioned several neighbors in the area had written letters recommending approval. Mr. Skove established there is no other clinic other than the one on Rose Hill Drive. Mr. Huffman stated he was bothered by the first condition relating to the shared entrance. He mentioned the fact that the other party was a retired employee of the highway department and this party did not own an automobile. He foresaw the shared commercial entrance as an economic burden on this party. Col. Washington established the fact that the other party would not have to share the cost of the installation of the commercial entrance. entrance. Mr. Gloeckner moved for approval with the following conditions: 1. County to bear the costs of the installation and the maintenance of the commercial entrance; 2. Site plan approval to include: a. Virginia Department of Highways and Transportation approval of commercial entrance; b. Screening of facility for adjoining residence to the south; C. Determination of parking requirements by Director of Planning; 3. Special permit to terminate when the clinic is no longer operated by a public agency. Mr. Huffman seconded. There was no discussion and the vote was unanimous for approval. At this time, Mr. Lindstrom asked for and was granted time to pass out to the Commission typewritten pages outlining his concept of the Agriculture/Forestry section of the proposed Zoning Ordinance. SP-79-40. Mr. and Mrs. Shannon Stinson request permission to locate a mobile home on Tax Map 123, Parcel 12A, approximately 4 miles north of Scottsville on Route 795. Mr. Keeler stated the applicant has requested withdrawal. Mr. Gloeckner moved for withdrawal. Mr. McCann seconded the motion. The vote was unanimous for withdrawal. Resolution of Intent: Recommend Amendment of the Subdivision Ordinance to Require Road Frontage Improvements. Mr. Keeler presented the staff report. 'He reported that Mr. Byron Coburn was present to answer any questions. Mr. McCann said he would like to know why the Highway Department recommends road frontage improvements. Mr. Coburn answered the development would pay part of the cost of highway maintenance or improvement due to the increased traffic. system. Mr. Gloeckner asked if there is any way to earmark funds for a cost -sharing Mr. Coburn answered that each year in the budget, funds are set aside that are uncommitted. Col. Washington closed the public hearing. specified. Mr. McCann said he will not support the amendment unless some limitations are Mr. Huffman agreed, saying that without limitations the Commission could be accused of being discriminatory. Mr. Skove moved to recommend the amendment as outlined by staff to the Board. Mrs. Graves seconded. Discussion: Mr. Gloeckner said he could not support the amendment. The vote was 4-3 in support of Mr. Skoves motion, with Messrs. Huffman, McCann and Gloeckner dissenting. CROSS RESIDENTIAL SITE PLAN - Located off the south side of Route 250 West, one mile past Mechum River. Proposal for three rental cottages on ten acres. White Hall District. Mr. Keeler stated the applicant has requested indefinite deferral. Mr. McCann moved for deferral for an indefinite period of time. Mr. Gloeckner seconded the motion. The vote was unanimous for deferral. THROPP FINAL PLAT - Property located on the south side of Route 665 near Free Union. Proposed division of one lot of 2.06 acres leaving an 18-acre residue. White Hall District. Mr. Keeler presented the staff report mentioning that at the last Commission meeting, the applicant had returned and stated the condition was unacceptable as he had intended to locate more than one dwelling on the property. Applicant wishes to sod -farm the property. Mr. Thropp stated he wished to withdraw the application. Col. Washington established with Mr. Thropp that there is no limitation on reapplication. Mr. Gloeckner moved for acceptance of the withdrawal. Dr. Moore seconded the motion. The vote was unanimous for acceptance. SP-79-46. Central Telephone of Virginia has petitioned the Board of Super- visors to locate an unmanned telephone switching unit on 2.571 acres zoned A-1. Property is located on the east side of Route 601, near Free Union. County Tax Map 29, Parcel 44B, White Hall District. Mr. Keeler presented the staff report noting this application is located on the property of Shelter Associates and that the applicant received a variance from the Board of Zoning Appeals that same day to locate their switching unit 3� feet from the right-of-way of 601. Mr. Payne, representing the applicant, said Centel is buying easements for location of the units which are about the size of a Vepco transformer. Col. Washington established the unit would be 28� feet from the centerline 70 of the road. Mr. Payne replied that if it were placed any further into the property, Centel would have to take too much property. Col. Washington closed the public hearing. Mr. McCann moved for approval with staff's recommendations as follows: 1. Written agreement between CENTEL and The Virginia Department of Highways and Transportation that VDH & T will bear no expense for relocation of switching station and appurtenances should such need be occasioned by road improvements. This agreement shall be approved by the County Attorney and VDH & T. 2. Staff approval of site plan to include: Virginia Department of Highways and Transportation approval of entrance; and landscape screening, if necessary. Mr. Gloeckner seconded the motion. There was no discussion and the vote was unanimous for approval. SP-79-49. Central Telephone of Virginia has petitioned the Board of Supervisors to locate an unmanned telephone switching unit on 10 acres zoned A-1. Property is located on the south side of Route 664, just northwest of the intersection of Routes 663 and 664, and just west of Chestnut Grove Baptist Church in Earlysville. County Tax Map 19, Parcel 16B, Rivanna District. Mr. Keeler presented the staff report mentioning the proposed unit will be located in a wooded area to the rear and adjacent to property of the Chestnut Grove Clhurch. There was no public comment and Col. Washington closed the public hearing. Mr. Gloeckner moved for approval with the following conditions: 1. Staff approval of site plan to include Virginia Department of Highways and Transportation approval of entrance and landscape screening, if necessary. 2. Wooded area to remain in natural state. Mr. McCann seconded the motion. There was no discussion and the vote was unanimous for approval. SP-79-55. Central Telephone of Virginia has petitioned the Board of Supervisors to locate an unmanned telephone switching unit on 0.99 acres zoned A-1. Property is located on a gravel road off the south side of Route 641, approx- imately 1/8 mile east of Route 29 North. County Tax Map 21, Parcel 28A, Rivanna Magisterial District. Mr. Keeler presented the staff report noting that a microwave tower is located on the property and residential development in the area is sparse. There was no public comment and Col. Washington closed the public hearing. 7 Mr. Gloeckner moved for approval with the following staff recommendation: 1. Staff approval of site plan to include: Virginia Department of Highways and Transportation approval of entrance; and landscape screening, if necessary. Mr. McCann seconded the motion. There was no discussion and the vote was unanimous for approval. BERKMAR FINAL PLAT - Property described as parcel 12-1 on tax map 61M-U; located on the west side of Berkmar Drive adjacent to Robertson Electric Company. Mr. Keeler presented the staff report noting that water and sewer do not have to be present for plat approval. Joe Wood stated there is good sight distance at the entrance and he foresees no problems. Col. Washington closed the public hearing. Mr. Gloeckner moved for approval subject to staff's recommendations: 1. The plat will be signed when the following conditions have been met: a. The parcel shall be served by public water and sewer; b. Virginia Department of Highways and Transportation approval of entrance location. Mr. McCann seconded the motion. There was no discussion and the vote was unanimous for approval. SP-79-57. Albemarle County Service Authority has petitioned the Board of Supervisors to locate a sewage pump station (wastewater lift station) on 1225 square feet zoned A-1. Property is located in the Albemarle High School Complex. County Tax Map 60, Parcel 78A, Jack Jouett District. Mr. Keeler presented the staff report noting that the plans involve moving the Georgetown Green sewer lift station from their property to the Albemarle High School property. There is some urgency involved inasmuch as the old station discharges into the reservoir when it goes down. Mr. Tommy Thompson, representing the Albemarle County Service Authority, stated the Service Authority will relocate at Georgetown Green's direction. They have secured the right-of-way from the school board and will need a right-of-way from the Georgetown Green homeowner's association. Mr. Brad Stillman, representing the Georgetown Green homeowner's association, stated two thirds of the homeowners' signatures are needed to grant right-of-way to the Service Authority but he feels there is no problem there as the Service Authority's plan seems to be a good one. He asked what would happen to the site of the old lift station. Mr. Brian Smith, representing the Service Authority also, reported the plans for the old site are to salvage what can be salvaged and then cover and re -sod. The equipment that will be needed for this will be a backhoe and flatbed, then tamping machines. The new system will have much less noise and will be virtually fail-safe. He pointed out that mid -November is usually the end of the construction season. Col. Washington closed the public hearing. Mrs. Graves moved for approval with staff's one condition as follows: 1. Staff approval of fencing and landscape buffering. Dr. Moore seconded the motion. There was no discussion and the vote was unanimous for approval. New business: Discussion of the 6-year plan for secondary road improvements. Mr. Dan Roosevelt from the Virginia Department of Highways and Transportation presented his department's plan for improvements. The complete plan is attached to these minutes. The Commission deferred any discussion or action on the Highway Department's plan until some later date. With no further business to discuss, the Commission adjourned. 9 7_3 1980 SIX -YEAR PLAN 1. Hard Surface Roads by Traffic Count. over 2,000 vpd b. Map - Six -Year Plan wM fT Code and Department Policy Requirements Guiding the Development of the,Six-Year Plan 1. Code: Requires allocation of Secondary Improvement Funds to each county for gravel road improvements to hard surface. Percentage is based on miles over 50 vpd compared to state wide miles over 50 vpd. Albemarle percentage is 19.55 %. 2. Policy: That each county will share equally the burden of Federal Aid Funds which amounts to about 45% of Secondary Improvement Allocation. Federal Aid requirements specify types of projects that can be funded. One type of Federal funding is for railroad crossing improvements. To fully qualify for this funding, all qualifying crossings within the state must be programmed in the Six -Year Plan. Albemarle County's share must be funded. 3. Policy: A maximum of 5% of the allocation for Secondary Improvements each year can be designated for plant mix application without designating the location. 4. Policy: A maximum of 2% of the combined Secondary Maintenance and Improve- ment Allocation can be designated for improvement of roads qualifying for ,%WW addition to the State Secondary System. S. Policy: A maximum of 13% of the Secondary Improvement Funds allocated to each county can be designated for unforeseen items. This funding must also incl,ide allocations for such county wide items as new pipe installa- tions, new sign installations, preliminary engineering for projects not budgeted, and seeding and fertilizing of roadsides which are impractical to plan for by location so far in advance. Within the requirements of the Code and Department Policy, the following is the policy and philosophy of the Board and Department for Albemarle County con- cerning road improvements: 1. The Comprehensive Plan for Albemarle County recommends the concentration of population growth in the urban areas around Charlottesville, Crozet and Hollymeade and in the eight villages. Improvement of gravel roads to hard surface is acknowledged to draw development to these roads. Therefore, hard surfacing of gravel roads outside the growth area would seem to con- flict with the goals of the Comprehensive Plan. It is acknowledged, how- ever, that traffic volumes exceeding 50 vpd on gravel roads make proper maintenance of the road, difficult, and some consideration should be given to the needs of people already living along gravel roads. Special consid- eration should be given to those who assist in the improvement of a gravel road through the prior dedication of right of way and easements, funding or other services. This plan recommends funding of hard surface improvements to gravel roads to the minimum amount required by law, based upon the following criteria: 1. First priority should be given to qualifying road along which right of way for improvement has already been donated. 2. Second priority should be given to qualifying roads within the urban and village areas. 3. Third priority should be given to the gravel roads having the highest traffic counts. 2. The Federal Aid funding requirements for railroad grade crossings will be met by funding during the six -year period. 3. The improvement needs of the high volume hard surface roads can be tempo- rarily met by application of a smooth, low maintenance surface. Therefore, the maximum amount available for plant mix application, without route des- ignation, should be allocated each year. 4. $20,000/year has been allocated in the past .for improvement of new additions to the system. This money has seldom been fully utilized. Therefore, the full amount allowed by law and policy will not be allocated, but the allo- cation will remain at $20,000. 5. Although policy allows 13% of the funds available to be used for unforeseen or undesignated improvement, other priorities would seem to take precedence over this. However, some funds for unforeseen items should be set aside. This plan recommends $70,000 be set up for this item. Twenty thousand dollars ($20,000) of this will be used for county wide items such as new signs, new pipe, and seeding and fertilizing roadway banks. The remaining funds will be available for unforeseen items or may be allocated to desig- nated items if no unforeseen needs are encountered. 7-6 CONTINUED 6. The funds remaining should be allocated to major improvements. Past plans have designated these priorities: 1. Route 601 - Mechum River Bridge 2. Route 743 - Hydraulic Road 3. Route 631 - Park Street Bridge 4. Route 631 - Meadow Creek Parkway 5. Route 665 - Bridge over South Fork of Rivanna River Because of increases in estimated costs of all construction and the need for replacement of the bridge on 671 over Moorman's River, it is recommended that the 665 bridge be deferred and that the 671 bridge be substituted. 7. This plan continues the philosophy adopted in 1977. That is, emphasis in improvement funding is given to high volume hard surface and gravel roads. Improvement of low volume hard surface roads will be accomplished through signing and pavement marking. Improvements to low volume gravel roads will be limited to maintenance activities. Improvements to bridges are limited to those falling within roadway improvements or when the condition of the bridge warrants replacement.
