HomeMy WebLinkAbout09 27 79 PC MinutesSeptember 27, 1979 The Albemarle County Planning Commission conducted a meeting on Thursday, September 27, 1979, 2:00 p.m., Board Room, County Office Building, Charlottesville, Virginia, to consider items which had not been considered on the September 25, 1979, meeting. Those members present were Col. William R. Washington, Chairman; Mrs. Norma Diehl, Vice -Chairman; Mr. Layton McCann; Mr. James Skove; and Mr. Charles Vest. Absent were Dr. James Moore; Mr. James Huffman; Mr. Kurt Gloeckner; and Mrs. Joan Graves. Also absent was Mr. Tim Lindstrom, ex-Officio. Other officials present were Miss Mason Caperton, Planner; and Mr. Frederick Payne, Deputy County Attorney. Col. Washington called the meeting to order after establishing that a quorum was present. North Pines Final Plat - located on west side of Route 606, on north side of the Rivanna River: Miss Caperton presented the staff report, noting the letter from the Quayles. Mr. Bob McKee, on behalf of the applicant, said that if sewer becomes available at a later date, and if ZMA-79-31 is approved, the applicant would like a density credit for lots 119-123 making these one acre lots. He said that he realized that this would necessitate a rezoning, however wanted the Commission to understand that this is under consideration. There was no public comment on the plat, and Col. Washington closed the public discussion. Mr. Payne questioned if this property is subject to the reorganization of SV Associates that is currently before the Western District of Virginia, Bankruptcy Division. He felt that the applicant's signature on the plat is incorrect and this should be handled through a condition on the plat, in view of the number of dedications on the plat. He wanted to make certain that the county is properly protected. Mrs. Diehl established that it is proper for the Commission to act on the plat that date if that is addressed in the conditions of approval. Mr. Skove moved approval of the plat subject to the following conditions: 1. The plat will be signed when the following conditions have been met: a. Albemarle County Service Authority approval of water plans; b. An additional 30-foot access to Route 606 for emergency vehicles shall be shown on the plat; c. Compliance with the private road provisions, including: 1. County Engineer approval of road plans and drainage easements; 2. County Attorney approval of maintenance agreements; d. County Engineer and Virginia Department of Highways and Transportation approval of road plans and drainage easements for State standard roads; e. Compliance with the Soil Erosion Ordinance; f. Written Health Department approval; g. Virginia Department of Highways and Transportation approval of commercial entrance and emergency access on Route 606; and improvements to Route 606 /49 from'lot 123 north to the limit of the General Electric upgrading project placing the shoulder catch point at 15 feet from the existing centerline and the ditch at 18 feet; h. Staff approval of revised plat should the school site be required by the Board of Supervisors for ZMA-79-32 ( Briarwood RPN ); i. Correct signature panel; j. Applicant to provide evidence to the reasonable satisfaction of the County Attorney of approval of plat by the U. S. District Court for the Western District of Virginia, Bankruptcy Division. Mr. McCann seconded the motion, which carried unanimously, with no discussion. Carlton Luck Final Plat - located off Keene Landfill Road, off Route 704 about 2.5 miles south of Keene: Miss Caperton presented the staff report. There were no comments from the applicant, or members of the public. Col. Washington thus closed the public discussion. Mr. Vest moved approval of the platsubject to the following conditions: 1. The plat will be signed when the following conditions are met: a. Provide technical information as required by the Subdivision Ordinance; b. Compliance with the private road provisions including: 1. County Engineer approval of road specifications; 2. County Attorney approval of maintenance agreements; C. Applicant to provide certification to the reasonable satisfaction of the County Attorney of existing legal access serving the property from Route 704 over the road shown on the plat; c. Written Health Department approval. Mrs. Diehl seconded the motion, which carried unanimously, with no discussion. Church of the Incarnation Site Plan - located off east side of Route 29 North at Branchlands: Miss Caperton presented the staff report. Representing the applicant, Dan deBettencourt, explained and showed plans for the final road. He noted the problems in securing public water, and preferred to use the lake as a source for a dry hydrant for fire protection. Then the church could tie into the developers'line at a later date, when the PUD is more firmed up. There was no public comment and Col. Washington closed the public discussion. Miss Caperton explained that Mr. deBettencourt has explained his position to the Fire Marshal, who still prefers public water for the church. Mr. deBettencourt said to bring public water to the property at this time would cost in excess of $40,000. // 3 Mr. Skove noted that the provision in the ordinance is that public water will be required when it is reasonably available; in his opinion $40,000 was too costly. Mr. McCann agreed, noting that there is really no increase in the use of the property. He preferred the applicant's suggestion of a dry hydrant to be served by the lake. Col. Washington felt that the applicant is in the position of recovering his cost of the waterline installation and agreed with the staff proposal. Mrs. Diehl moved approval of the site plan subject to the following conditions: 1. A buidling permit will not be issued until the following conditions have been met: a. Compliance with conditions C. 1-3 of SP-79-31; b. County Engineer approval of pavement specifications and drainage facilities; c. Fire Official approval of hydrant locations; d. Show on plan general intersection and alignment of approved collector road as shown on approved "plan 3 amended" under SP-78-31 (Board of Supervisors approval, August 7, 1978 ); 2. A Certificate of Occupancy will not be issued until the following conditions have been met: a. Compliance with condition number 3 of SP-78-31 within the area shown on the site plan dated 9/19/79 NMC. Mr. Vest seconded this motion. Mr. Layton said that he could not support the motion since he does not feel there is an increased use in the property to demand public water hookup. The motion carried by a vote of 3-2, with Messrs. McCann and Skove dissenting. Crozet Baptist Church Site Plan Addition - located on the north and south side of St. George Avenue, west of Route 810: Miss Caperton presented the staff report, and read the letter from Mr. Gates, an adjoining property owner. Mr. Laramore, architect for the applicant, said there is no trouble complying with the recommended conditions. Mr. Gates pointed out that St. George Avenue is a very narrow street, and sometimes he has trouble entering or leaving his property because of the traffic from the church. Also he noted that cars are often parked in front of his driveway. The minister of Crozet Baptist said that this is an expansion for the planned growth during the coming 25-year period. Since there was no further public comment, Col. Washington closed the public discussion. Mrs. Diehl suggested that "no parking" signs along at least one side of the street might be appropriate. Col. Washington established that the runoff control ordinance will address any detention basins that are needed. Mr. McCann moved approval of the site plan subject to the following conditions: 1. A building permit will not be issued until the following conditions have been met: a. Written Health Department approval; b. Compliance with the Runoff Control Ordinance and Soil Erosion and Sedimentation Control Ordinance; C. County Engineer approval of pavement specifications; d. Fire Official approval of handicapped and fire facilities; e. Virginia Department of Highways and Transportation approval of commercial entrances; f. Staff approval of landscaping; g. Mark new parking spaces with railroad ties, etc. Mr. Vest seconded the motion, which carried unanimously. Col. Washington said that the Virginia Department of Highways and Transportation should study the traffic on St. George Avenue that is generated in large part by the church and funeral home. Mrs. Diehl moved that the Commission recommend that the Highway Department review St. George Avenue, especially with regard to parking in front of public institutions. Mr. Vest seconded the motion, which carried unanimously. Robert L. Beverly Final Plat - located off the west side of Route 630, on Appleberry Mountain: Miss Caperton presented the staff report. There were no comments from Mr. Beverly. Mr. David Blankenbaker noted for the record that the division is for a relative of Mr. Beverly. Mrs. Diehl moved approval of the plat subject to the following conditions: 1. The plat will be signed when the following conditions have been met: a. Complaince with the private road requirements including: 1. County Engineer approval of the road; 2. County Attorney approval of a maintenance agreement. Mr. Skove seconded the motion. Discussion: Col. Washington expressed some concern about the "old road" shown on the plat. Mr. Blankenbaker said that is shown more for information purposes for the surveyor than anything; the old road is not part of any existing right-of-way. The motion carried unanimously. /l oz' Evernghim Blake Final Plat - located off the north side of Route 614, east of Owensville: Miss Caperton presented the staff report. Mr. David Blankenbaker showed pictures which pointed out that the entrance essentially complies with the commercial entrance requirements at this point. There was no public comment, and Col. Washington closed the public discussion. Mr. McCann moved approval of the plat subject to the following conditions: 1. The plat will be signed when the following conditions have been met: a. Written Health Department approval; b. Virginia Department of Highways and Transportation approval of a commercial entrance; C. Note: "No further division along this easement without Planning Commission approval;" d. Note the flood plain delineation; building setback lines; e. Compliance with the private road provisions, including: 1. County Engineer approval of the road; 2. County Attorney approval of maintenance agreements. Mr. Vest seconded the motion, which carried unanimously, with no discussion. Coleman Estate Final Plat - located south of Route 631 and southwest of Route 708 near the Mt. Olivet Church: Miss Caperton presented the staff report, noting that Health Department approval has been received. Mr. Magruder Dent said that he requests no commercial entrance be required at this time since no dwellings are on the property and none are planned for the immediate future. He said that it would simply be too expensive to build the commercial entrance, when no use is planned and this is simply being divided to settle an estate. There was no public comment and Col. Washington closed the public discussion. Col. Washington established that the easements shown on the property are pre-existing. Mr. McCann felt that the concern of Mr. Dent over the commercial entrance should be addressed. Mr. Payne said that it would be possible for the Commission to delete the requirement, yet the Highway Department could still require what they felt was necessary. Mr. McCann moved approval of the platsubject to the following conditions: 1. The plat will be signed when the following conditions have been met: a. Legal access to Parcel A, to be approved by the County Attorney; b. Waiver of the private road requirements except for the following provisions: 1. Note on the plat: "only one dwelling per parcel without Planning Commission approval;" 2. Maintenance agreement to be approved by the County Attorney. Mr. Skove seconded the motion. Discussion: Col. Washington said that the commercial entrance could be required at the time of request for building permits. Mr. Skove did not feel that was necessary in view of the size of the parcels. The motion carried unanimously. Grymes/Thomas Jefferson Memorial Foundation Final Plat - located on the northeast side of Route 53, east of Route 20: Miss Caperton presented the staff report. Mr. Lincoln, on behalf of the applicant, said that there are no problems complying with the recommended staff conditions. There was no public comment and Col. Washington closed the public discussion. Mr. Vest moved approval of the plat subject to the following conditions: 1. The plat will not be signed until the following conditions have been met: a. Written Health Department approval; b. Compliance with the private road provisions including: 1. County Engineer approval of the road specifications; 2. County Attorney approval of a maintenance agreement. Mr. McCann seconded the motion, which carried unanimously, with no discussion. Redbud Preliminary Plat - located off the west side of Route 20 North on Redbud Creek: Miss Caperton presented the staff report. Mr. David Blankenbaker said that at the time a final plat is submitted, the road will be shown as a private road. Dr. Carlo Columbini said that the houses will be well screened. He presented pictures of the types of units that will be built. He presented a soil scientist report, and said that a complete report will be accomplished on each lot if the preliminary is approved. b-;- Mr. George Worthington, an adjoining property owner, saw approval of the preliminary plat as an intrusion on the agricultural area. He said that lots will join his hay field. He said that he would not mind one unit per five acres, as recommended by the Comprehensive Plan. Dr. Columbini said that he wants to cooperate with his neighbors, but pointed out that the remainder of the neighbors do not oppose his request. f arms. Col. Washington questioned if the property has a common boundary with other Dr. Columbini said that it does. Mrs. Diehl questioned if the complete soil scientist report would be available to the Commission prior to final plat review. Miss Caperton replied only if that were made a condition of approval. Mrs. Diehl moved approval of the plat subject to the following conditions: 1. The following conditions will be recommended for final plat approval; a. County Engineer and Virginia Department of Highways and Transportation approval of road plans; b. Virginia Department of Highways and Transportation approval of commercial entrance including a left turn lane on Route 20; C. Compliance with the Soil Erosion and Sedimentation Control Ordinance; d. Health Department approval; e. Waiver of double frontage of lot 13 required; f. Change Scottsville to "Rivanna" district; g. Soil Scientist report to be submitted prior to final plat review by the Planning Commission. Mr. Skove seconded the motion, noting that he understands the concerns of Mr. Worthington, however the preliminary meets the requirements of the subdivison ordinance. Discussion: Col. Washington noted that it is logical that no water will be found at the top of the ridge line, and thus a lot of earth disturbing activity will take place simply because of the well drilling. Dr. Columbini said that the geologist he has employed seems to think there will be no problem with the water. The motion to approve the preliminary plat carried unanimously. Wynridge, Phase 2, Final Plat - located on the south side of Westfield Road Extended adjacent to Phase I of Wynridge: Miss Caperton presented the staff report. Mr. Jim Hill said that he does not feel that this is the time to dedicate along the frontage, since the road plans at this time are not firm. Miss Caperton acknowledged that the Virginia Department of Highways is rkipg on a new set of plans. No alignment at this time has been established since the Highway Department does not have the necessary land. //fl Mr. Payne felt that this dedication on the plat in question would tie in the alignment. It is possible, however, to have a conditional dedication. Mr. McCann felt that a reservation might be more in order since there is no known alignment. Mr. Hill pointed out that this plat downzones the property at the owner's own volition. Mr. Skove said that he is afraid that if the land is not dedicated now, it will not be possible to secure it at a later date. Col. Washington said that he understands Mr. Hill's concerns, but also there is the fact that the Comprehensive Plan should be followed. He feels the county has an obligation to see that that road takes place. Mr. McCann moved approval of the plat subject to the following conditions: 1. The plat will be signed when the following conditions have been met: a. Albemarle County Service Authority approval of water and sewer plans; b. Note residue acreage for parcel labeled "Minor Land Trust"; and waiver of frontage requirements; C. Compliance with Soil Erosion and Sedimentation Control Ordinance and Stormwater Detention requirements; d. Fire Official approval of location of hydrants; e. Sidewalks shall be constructed on one side of Wynridge Circle and both sides of Westfield Road; f. Virginia Department of Highways and Transportation approval of commercial entrances and turnaround on Westfield Road, if required; g. County Engineer and Virginia Department of Highways and Transportation approval of road plans for Wynridge Circle and Westfield Road; h. Dedication of half the needed right-of-way for Greenbrier Drive along lots 58-64 and a waiver of double frontage for these lots. Mrs. Diehl seconded the motion, which carried unanimously, with no discussion. Rutledge Farm Preliminary Plat - located on the west side of Route 743, south of Bedford Hills Subdivision: Miss Caperton presented the staff report. Mr. Bishop, owner of the property, said that he is willing to comply with the conditions recommended by the staff. There was no public comment and Col. Washington closed the public discussion. Mr. McCann said that this is one plat that is an obvious result of many of the regulations of the county, since it is really not done as attractively as it was originally presented. Mrs. Diehl suggested that at the time of final plat submittal a better use of the land in the rear be presented without so many long, narrow lots. Mr. McCann moved approval subject to the staff conditions: ho 1. The following conditions will be recommended for final approval: a. Any connection to the Bedford Hills central well system or any new central water supply system will require approval by all appropriate agencies; b. Compliance with the Soil Erosion and Runoff Control Ordinances; C. Fire Official approval of dry hydrants; d. Written Health Department approval; e. Dedication of 25 feet from the centerline of Route 743 must be shown on the frontage of Parcel 49D(1) on Tax Map 45; f. Any easements needed for water lines or septic systems across lots 1B or 2 serving Parcel 49E on Tax Map 45 shall be shown on the final plat; g. Compliance with the private road provisions, including: 1. County Engineer approval of the road plans; 2. Maintenance agreement to be approved by the County Attorney. h. Virginia Department of Highways and Transportation approval of the commercial entrance including clearing or vegetation, regrading of Route 743, and a left turn lane as recommended in their letter of September 7, 1979; i. Waiver of double frontage on lots 4 and 9-17; j. Note on plat: "All lots to enter onto new private roads." Mr. Skove seconded the motion. Col. Washington suggested that a soil scientist report before final plat review might be in order since the property is in the watershed. Mr. McCann said that is required anyway and he sees no need for it before the Commission reviews the final plat. It might cause an unnecessary delay to the applicant. Mrs. Diehl said that she feels it is needed because of the shape of the lots. She said that since Mr. McCann was not willing to include that in the motion, she could not support it. The motion carried by a vote of 3-2, with Mrs. Diehl and Col. Washington dissenting. Col. Washington said that he prefers to be consistent in the requirement of the soil scientist report. Upon motion by Mr. McCann, and second by Mr. Vest, the Commission adopted resolution of intent to amend the Comprehensive Plan to include Camelot as a community. The vote was unanimous. New Business: Col. Washington asked that the staff in the future set the agendas so that no more items are scheduled for one meeting than can be reasonably handled by 11:00 p.m. With no further business, the meeting journed at 4:50 p.m. Ro rt W.
