The Albemarle County Planning Commission conducted a meeting on
Tuesday, December 4, 1979, 7:30 p.m., Board Room, County Office Building,
Charlottesville, Virginia. Those members present were Col. William R. Washington,
Chairman; Mrs. Norma Diehl, Vice -Chairman; Mr. James Huffman; Mr. Layton McCann;
Mr. Charles Vest; Mr. Kurt Gloeckner; Dr. James Moore; Mr. James Skove; and Mr. Tim
Lindstrom, ex-Officio. Absent was Mrs. Joan Graves. Also present were Mr. Ronald
Keeler, Assistant Director of Planning and Mr. Frederick Payne, Deputy County
Attorney.
After establishing a quorum was present, Col. Washington called the
meeting to order.
SP-79-69. Fruit Growers Coop. has petitioned the Board of Supervisors
for a veterinarian satellite office on 1.570 acres zoned B-1. Property
is located in the northeast quadrant of the intersection of Routes
240 and 810, in Crozet. County Tax Map 56A1, Parcel 01-65; and
County Tax Map 65A2, Parcel 01-27. White Hall Magisterial District.
Mr. Keeler presented the staff report.
Mr. Ben Dick, attorney on behalf of the Fruit Growers Coop., stated that
the property is zoned B-1 and this use is permitted under special permit clause
in that district.
Dr. Nelson Garnett, veterinarian, said that the clinic will be "appointment
only" and this will limit the demand on parking. He said that only two employees
are anticipated.
Mr. Gloeckner established that the facility will be used only for
small animals.
Dr. Garnett said that the hours of operation will be only a few per day,
mostly in the afternoon.
Mr. Roy Patterson, a resident of Crozet, said that the service is needed
in Crozet so that individuals don't have to drive to Waynesboro or Charlottesville
for this service.
There was no additional public comment, and Col. Washington closed the
public hearing.
Col. Washington stated his concern for parking, noting that the Fruit
Growers' corner has grown gradually and persistently over the last two years. He
pointed out that many of the uses there are part time uses, in terms of operational
hours. He urged that the parking spaces be designated, and felt this would provide
some organization to the entire site.
Mrs. Diehl established that the library use is temporary until the Windham
project is completed.
Mr. Keeler advised the Commission that the zoning administrator has determined
that parking for the entire site is needed, and therefore a site plan will have to
be required. He pointed out that parking is currently inadequate with those
uses on the property.

Mr. McCann felt that the use is appropriate for one of the designated
growth areas of the county, and moved approval subject to the following conditions,
noting that if parking cannot be met, the use cannot be located on the property:
1. No treatment of livestock on the premises;
2. No overnight keeping of animals on the premises;
3. Compliance with conditions of VA-79-64;
4. Site plan approval.
Mr. Skove seconded the motion, which carried unanimously, with no
discussion.
ZMA-79-41. Martha B. Bacon has petitioned the Board of Supervisors
to rezone approximately +0.6 acres from R-2 Residential to B-1
Business. Property is on the southeast side of Greenfields Court
in Greenfields Subdivision, east of Route 631. County Tax Map 45,
Parcels 150 and 151. Charlottesville Magisterial District.
Mr. Keeler presented the staff report and read the comments from the
Highway Department.
Mr. Larry McElwain, on behalf of the applicant, said that he wishes
to amend the request for CO Commercial Office zoning. He said that the applicant
wants to become a dealer for log homes, and will construct one on this property.
He felt the model home will improve the appearance of the property, and will
serve in the nature of a professional office. He pointed out that this is a
transitional zone. Mr. McElwain explained the terrain and felt it would be
limited for residential use. A very small amount of traffic will be generated.
Eventually the applicant hopes to have a maintenance agreement on Greenfield
Court.
Mr. Payne pointed out that according to the plat the road has been dedicated
to public use, however has not been taken into the state secondary road system.
Mrs. Crenshaw, an adjoining property owner, felt the road should be considered
in the approval of the rezoning. She said that the Highway Department plans to install
a pipe along the highway, and there will be a resulting water impact on this
property.
There was no additional public comment, and Col. Washington closed the
public hearing.
Mr. Keeler said that with the change in zoning request, the staff would
still find it difficult to recommend against similar zones in this area,
especially those served by Greenfield Court.
Mr. Payne advised the Commission that the request is still properly before
them because the CO designation would be a less intensive use than the original
B-1 designation.
Mr. Gloeckner established that a site plan will be required if the
property is rezoned.

Mr. Keeler pointed out that it is the opinion of the County Attorney
that a maintenance agreement cannot be made part of site plan approval, and
the Commission should be aware of this.
Mr. Gloeckner felt that certain road improvements could be required at
the site plan stage, though, since the road has never been taken into the state
system. Also, the drainage across the property could be solved prior to development
of the property. He moved approval of the Commercial Office designation.
Mr. McCann seconded the motion, stating that he did not feel the land
is appropriate for residential development.
Mr. Skove questioned the sort of road improvements that could be required
at site plan approval.
Mr. Payne advised the Commission that the road could be improved from the
intersection of Route 631 up to the property. Maintenance cannot be assured, though,
since this particular owner has no control over other owners along the roadway.
The motion carried by a vote of 6-2, with Mr. Skove and Mrs. Diehl dissenting.
Col. Washington asked that the staff pay particular attention to the road
situation at the time of site plan review.
ZMA-79-43. South 29 Land Trust has petitioned the Board
of Supervisors to rezone 39.261 acres from A-1 to R-3 and
16.0 acres from A-1 to B-1. Property is located on the
south side of Route 29 and northeast of the I-64 interchange.
County Tax Map 76, Parcel 17B, Jack Jouett Magisterial
District.
Mr. Keeler presented the staff report, noting that the applicant
is requesting that the petition be changed to apply for 55.261 acres of R-3
zoning with a proffer limiting the density to 10 units per gross acre. He read
the comments from the Highway Department. He said that the staff supports the
proposal since it complies with the Comprehensive Plan and the recent actions
on the neighborhood plans.
Mr. Jim Hill said that he feels there will be no transportation problems
in using this for University housing for graduate students and professors, since
this falls within the University bus system. An entrance permit has already been
bbtained from the Highway Department.
There was no public comment and Col. Washington closed the public hearing.
Mr. Skove established that townhouses and garden apartments are planned
for the site.
Mr. McCann felt that this will be an asset to that particular part of the
community.
Mr. Skove said that essentially the Commission has already covered this
rezoning in its review of the Comprehensive Plan amendments.
Mr. Gloeckner moved approval of the rezoning subject to the proffer submitted
by the owner.

discussion.
SP-79-72. Forest Hill Assoc., Inc. has petitioned the Board
of Supervisors to locate a contractor's office on 4.09 acres zoned
B-1. Property is located on the north side of Route 250 East
adjacent to Lowe's. County Tax Map 79, Parcel 4, part thereof.
Rivanna Magisterial District.
Mr. Keeler presented the staff report and read the comments from the
Highway Department.
There were no comments from the applicant or the public, and Col.
Washington closed the public hearing.
Mr. McCann said that the proposed use is appropriate for the area.
Mrs. Diehl moved approval of the special permit subject to the following
conditions:
1. Access restricted to Hunter's Way only;
2. Site plan approval;
3. No outside storage of equipment materials except for parking of trucks.
Mr. Skove seconded the motion, which carried unanimously, with no
discussion.
ZMA-79-45. B and T Properties have petitioned the Board of
Superviosrs to rezone 16.975 acres from A-1 to RS-1. Property
is located on the north side of Route 250 West at Ivy, approximately
600 feet northwest of the C and O Railroad overpass. County Tax
Map 58, Parcel 84, part thereof, Samuel Miller District.
Mr. Keeler presented the staff report, noting that the staff had met
earlier that day with the applicants to discuss the road situation. He said
that the applicant has agreed to reserve the right-of-way for possible realignment
of the road at some other date. He said that there is only a short distance for
adequate site distance at the entrance.

Mr. Dick Gibson, representing the applicants, said that part of the
land will be used for residences for the owners of the property. He said that the
applicants are willing to proffer a reservation for two years for realignment of
Route 678.
Mr. Jack Taggart said that he has lived in Ivy since 1969 and will be
building on this land himself. He felt the request complies with the recommendations
of the Comprehensive Plan and is commensurate with the area and asked the
Commission to approve the request. Wd

Dr. Borchardt, another owner of the property, asked for favorable
consideration of the request.
Mr. Ed Smith said that he has been satisfied with Mr. Gibson's representation
of what will happen with the easement, as explained prior to the meeting.
Col. Washington established that the property has an existing pipestem
lot.
After a brief discussion of the road situation, Col. Washington felt
that approval of the request at this time could be a potential roadblock to future
alignment of Route 678. Mr. Gloeckner reminded the applicant that he would be
faced with comments from the Highway Department at a later date on entrance
requirements, probably suggesting limitation of entrances to Route 250.
Col. Washington said that he feels it would be poor planning to rezone
the property that evening, when there are matters that have not been solved
that conflict with future road improvements. He pointed out that the Comprehensive
Plan recommends realignment of Route 678.
Mrs. Diehl moved action be deferred until December 17, 1979, due to
lack of information on the situation that evening.
Mr. Vest seconded the motion, which carried unanimously, with no
additional discussion.
SP-79-73. Berkmar Assoc. Ltd. has petitioned the Board of Supervisors
for light warehousing on 1.729 acres zoned B-1. Property is located on
Berkmar Drive, adjacent to U-Stor-It. County Tax Map 61, Parcel 121A,
Charlottesville District.
Mr. Keeler presented the staff report, and read the comments from the
Highway Department.
Mr. Sandy Lambert, on behalf of the owner, said that he is cognizant
of the erosion problems in the area and interested in correcting them.
There was no public comment, and Col. Washington closed the public hearing.
Mr. Huffman moved approval of the special permit subject to the following
conditions:
1. Site plan approval by Planning Commission including landscaping/screening plan;
2. All storage shall be enclosed. No outside storage shall be permitted.
Mr. McCann seconded the motion, which carried unanimously, with no
additional discussion.
