The Albemarle County Planning Commission conducted a meeting on Tuesday,
March 11, 1980, 7:30 p.m., Board Room, County Office Building, Charlottesville,
Virginia. Those members present were Mr. Layton McCann; Mr. James Skove;
Mr. Charles Vest; Col. William Washington, Chairman; Mrs. Norma Diehl, Vice -
Chairman; Mr. Kurt Gloeckner; Mr. Corwith Davis, Jr.; and Mr. David Bowerman.
Also present were Mr. Tim Lindstrom, ex-Officio; Mr. Ronald Keeler, Assistant
Director of Planning; and Mr. Frederick Payne, Deputy County Attorney.
Col. Washington called the meeting to order after establishing that
a quorum was present.
Minutes of February 19, 1980, were approved with the following addition
to the Birdwood portion: Col. Washington asked that the minutes
reflect that he had asked if a representative from the University were present,
and that no representative came forward.
Minutes of February 26, 1980, were approved as submitted.
SP-80-08. Albemarle County Service Authority has petitioned the
Board of Supervisors, under Section 4-1-12(5) for a wastewater
lift station on 8,148 square feet zoned R-1. Property is located
on the west side of the cul-de-sac on Old Forge Road. County Tax
Map 60A, Parcels 10-4, 5 (part thereof), Jack Jouett Magisterial
District.
Mr. Gloeckner disqualified himself from the discussion and vote on
SP-80-08 and SP-80-09 by leaving the room.
Mr. Keeler presented the staff report.
Mr. Brian Smith, Engineer for the Albemarle County Service Authority,
was present to answer any Commission and public questions.
Mr. E. W. Pullen, a resident of Montvue, questioned the direction of the
pumping and the inset into the grade.
Mr. Smith explained with the use of the tax map the direction
of the flow. He noted the artist's rendering of the lift station.
( Mrs. Diehl arrived at the meeting. )
Mr. Pullen said that his property will look directly onto the site,
and stated that the water authority has been very responsive to his concerns
and have made a great effort to make the facility as unobtrusive as possible.
He said that he hopes the facility will be engineered in such a fashion that
it will be as quiet as possible. He noted his concern for the septic tanks
and septic fields on the various Montvue lots, and felt it would be important
to accommodate this area, as well, with public sewer. Mr. Pullen felt that future
needs should be addressed, since most of the residences in Montvue are around 15
years old.
There was no additional public comment, and Col. Washington closed the
public hearing.
Col. Washington questioned the sound level of the lift station.
Mr. Smith was unable to respond in terms of a decibel reading. He
pointed out that the station will be somewhat 1:_ke the installation in Hollymead;
only a hum will be heard when the station comes on. He further described the
construction plans for the building.
Mr. Skove questioned if the design of tae station precludes serving
the Montvue section at a later date.
Mr. Smith replied that this station had been planned for three stage
development, and if at a later date it becomes necessary to serve Montvue,
the station can be moved downstream and provide service.
Mr. McCann pointed out that under the Comprehensive Plan amendments,
Montvue is scheduled to move into the rural area, i.e., out of the designated
growth area. He moved approval of the special permit subject to the following
conditions:
1. Staff approval of site plan;
2. Staff approval. of subdivision plat;
3. Maintenance of as many trees as possible dt,ring construction.
Mr. Skove seconded the motion.
Discussion:
Mr. Davis said that at some later date he would like a guide for
appropriate decibel levels on various uses.
The motion carried by a vote of 6-0-1, with Mrs. Diehl abstaining.
SP-80-09. Albemarle County Service Authority has petitioned the
Board of Supervisors, under Section 4-1-12(5) for a wastewater
lift station on 0.9 acres zoned R-1. Property is located on the
north side of Northfield Road in Westmoreland Subdivision near
the intersection of Carrsbrook Drive and Northfields Road. County
Tax Map 62-A(2), Parcel L-11, Charlottesville District.
Mr. Keeler presented the staff report.
Mr. Brian Smith, Engineer for the Albemarle County Service Authority,
was present to answer questions.
Mr. H. I. Taylor of Northfields noted that the lot is not in
Westmoreland Subdivision. He was concerned that this station did not
propose picking up Northfields.
Mr. Smith stated that perhaps the same: kind of arrangement can be
made for future service to Northfields as is planned for Montvue. He felt
it

it could be enlarged and moved at a later date, if necessary.
Mr. Taylor said that he has trouble justifying this cost -wise, since it
will serve such a small area. He noted that he lives next door to the proposed site,
and hopes that the structure proposed for this site will be somewhat like the
artist's rendering on the previous application.
Mr. J. I. Delatre said that his property looks down on the structure
and he is therefore concerned about its appearance.
Mr. Keeler noted for information purposes that these two projects have been
reviewed by the Board of Supervisors and have been included in the Capital
Improvements Program and approved for funding.
Mr. Smith said that the building will have a brick facade but will be
slightly different in appearance from the other structure in Hessian Hills.
The roof line will also.be different. The pumps in this faciltiy will be
underground and smaller that the Hessian Hills station.
There was no additional public comment and Col. Washington closed the
public hearing.
Mr. McCann said that he assumes the staff will review the landscaping.

Mrs. Diehl expressed concern that the station will not serve Northfields.
Mr. Smith pointed out that the Service Authority has received no
complaints from Northfields residents nor have any problems been pointed out
on particular lots.
Mr. McCann said that the Commission could always recommend to the
Board of Supervisors that it consider service to Northfields with this lift
station.
Mr. Skove felt that this would be very expensive, and not be covered
by,the allocation in the Capital Improvements Program.
Mr. Smith said that expansion to include Northfields would necessitate
additional study, and would not be cost effective if it were to serve only 8-10
lots in Northfields.
Mr. Bowerman said that he is a resident of Westmoreland. He advised
the Commission members that Dr. Iachetta has held a couple of meetings with
area residents to address the sewer problems. Mr. Bowerman was aware of scattered
lots with problems in Westmoreland, and noted this is primarily with the smaller
lots. He felt this lift station is urgent to Westmoreland because of the health
hazard and because of the smaller lots.
Col. Washington was reluctant to ask the Board of Supervisors to redirect
this project to include Northfields.
Mr. McCann said that his suggestion was based on the fact that this
is part of the urban growth area and public utilities are necessary.

Mr. Skove said that this station was designed to cover a specific
problem, and he feels it is necessary to proceed with plans to correct that
problem.
Mr. McCann moved approval of the special permit subject to the following
conditions:
1. Staff approval of the site plan;
2. Maintenance of as many trees as possible during construction.
Mr. Davis seconded the motion, which carried unanimously, with no
discussion.

SP-80-10. Foxfield Association:
Upon the motion of Mrs. Diehl, and second by Mr. Vest, the Commission
unanimously voted to defer discussion and reconmendation on this item until April 8,
1980.
ZTA-80-01. Marianne Tejeda:
Upon the motion of Mrs. Diehl, and second by Mr. Vest, the Commission
unanimously voted to defer discussion and recorunendation on this item until
April 8, 1980.
SP-80-11. Charles W. Hurt has petitio:zed the Board of Supervisors
to permit R-3 Residential development on 3.0849 acres zoned B-1.
Property is located on the east side of Commonwealth Drive, approximately
200 feet north of the intersectin of C,Dmmonwealth Drive and Hydraulic
Road. County Tax Map 61W, Parcel 21, Charlottesville District.
Mr. Keeler presented the staff report.
Mr. Tom Sinclair, present on behalf of the applicant, said that, the plans
are to build duplexes on the property. He had no objection to the conditions
of approval.
There was no public comment, and Col. Washington closed the public
hearing.
Mr. Bowerman said that he had been under the impression that the special
permit request always came before the site plan or subdivision plat. He noted
the Commission had reviewed the subdivision plat a few weeks ago.
Mr. Payne responded that this property is unusual in that it is being
developed residentially.
Col. Washington questioned why the owner did not rezone the property.
Mr. Sinclair said that he does not know the answer to that question.
Mr. Lindstrom asked if the possibility could be that the entrance
would be affected.

Mr. Keeler said that Highway Department reviewed this site as a
residential use. A
Col. Washington asked if a site plan follows. Mr. Keeler replied
one would follow only if the property develops commercially.
Mr. McCann moved approval of the petition subject to the following
condition:
1. Property is to be developed in single-family attached units in accordance
with subdivision plat approval of February 20, 1980.
Mrs- Diehl seconded the motion which carried unanimously, with no discussion.
Col. Washington asked that the staff mention this action to the Board
Of Supervisors in its review of the proposed zoning map.
SP-80-12. Claudia Craig has petitioned the Board of Supervisors for
public riding stables on 12.6181 acres zoned A-1. Property is located
on the north side of Route 728 and on the west side of Route 729, approximately
10 miles northeast of Woodbridge. County Tax Map 105, Parcel 8P,
Scottsville District.
Mr. Keeler presented the staff report.
Ms. Craig was present to answer Commission questions. She noted that she
feels the condition addressing a commercial entrance is somewhat expensive.
There was no public comment and Col. Washington closed the public hearing.
Mr. Davis said that since horseshows are permitted by right, he does
not feel condition #5 is appropriate.
Mr. Keeler said that the applicant had represented in his discussion with
her that this would be no problem.
Mr. Payne pointed out that a special use permit sometimes excludes uses
that are permitted by right in the district.
Mr. Davis felt there were excessive conditions on what he contends is an
agricultural use, especially the commercial entrance.
Mr. McCann said he is willing to drop condition #5, however feels Highway Department will nevertheless require a commercial entrance. the
Ms. Craig said that clinics will be held once a month and only eight
students can be accommodated. She expressed no desire to hold horseshows, since
the property is not conducive to shows.
Mrs. Diehl felt because of the nature of the vehicles that would be
entering the property, a commercial entrance is necessary.

Mr. Gloeckner established that the conditions addressing private
roads is necessary because access is over an existing easement.
Mrs. Diehl moved approval of the petition subject to the following
conditions:
1. Site plan approval to include Virginia Department of Highways and Transportation
approval of a commercial entrance; provisions
2. If easement is used for access, compliance with private roads p
including:
a. County Attorney approval of maintenance agreements;
b. County Engineer approval of road specifications;
3. Fences maintained at all times;
4. All riding ring surfaces shall be covered with a material to prevent erosion
( e.g., pine needles, pine bark, etc. );
5. No horseshows shall be permitted.
Mr. Skove seconded the motion.
Discussion: Mr. McCann supported the motion, but stated his disagreement
will all the imposed conditions, since they seem to be more necessary for a larger
operation.
Mr. Davis said that in the future, this should be considered a :farming use,
within a certain scale.
Ms. Craig noted there is a difference in a public and private stable,
however the County of Albemarle does not recognize this
within its operations,existing
zoning laws. She felt a place should be made for small

Mrs. Diehl felt that the Commission should consider Ms. Craig's suggestion
at a later date.
New Business:
Col. Washington briefly discussed the zoning ordinance workshops with
the Planning Commission, noting the attendance at the meetings and some of the
points made by the county citizens.
There was no additional business, and the meeting adjourned at 9:35.
