HomeMy WebLinkAbout05 06 80 PC MinutesMay 6, 1980 The Albemarle County Planning Commission conducted a public hearing on Tuesday, May t6, 1980, 7:30 p.m., Board Room, County Office Building, Charlottesville, Virginia. Those members present were Col. William Washington, Chairman; Mrs. Norma Diehl, Vice -Chairman; Mr. Layton McCann; Mr. James Skove; Mr. Charles Vest; Mr. Kurt Gloeckner; Mr. Corwith Davis, Jr.; and Mr. David Bowerman. Other officials present were Mr. Ronald Keeler, Assistant Director of Planning; and Mr. Frederick Payne, Deputy County Attorney. Absent was Mr. Tim Lindstrom, ex-Officio. Col. Washington called the meeting to order after establishing that a quorum was present. Minutes of April 22, 1980, were approved by the Commission as submitted. ZTA-80-02. Marianne Tejeda - temporary events sponsored by local non-profit organizations: Mr. Keeler presented the staff report, noting the letter from Mr. Peter Easter, a resident of the Foxfield neighborhood. Mr. Payne noted the revised wording of Section 2-1-29, as suggested at the previous meeting on the petition. He stated that the peculiar set th of facts seemed to make it permissible to proceed without the applicant, representative. Mr. Whitely opposed the proposed amendment to the ordinance unless there could be restrictions on what could take place. He saidut addressingthat swritttheconcerns it could encompass any kind of plans for property of the neighboring residents. Mr. and Mrs. Phillips said that up until this point they had been happy with the Foxfield operation. If the management changes anytime in the future, they said that many problems could arise. They voiced opp nket approval of any kind of operation. There was no additional public comment, and Col. Washington closed the public hearing. Mrs. Diehl questioned if there have been more races on the Foxfield property than what had been sanctioned by the County. Mr. Payne agreed, stating that the staff did not learn of one event until the Wednesday before the Saturday on which it was to take place. He felt the terms of the special permit should be carefully enforced. Mr. vest suggested the need for a definition of "maj ordinance. or event" in the Mrs. Diehl preferred not to leave some of the events to an administrative approval process. Mr. Gloeckner said that he feels the applicant should have a special permit for each event, especially if the two original permits have been abused. He suggested that a fine after the fact for a zoning violation seemed appropriate in this case. Mr. Payne said that another possibility is to revoke the original special use permit. Mr. Skove felt there were two problems: violating the intent of the ordinance and the problem of notifying adjoining property owners of temporary events. Mr. Davis established that Foxfield is a non-profit organization. Mr. Skove questioned if it is possible to write the amendment in such a fashion that adjoining property owners have time for input. Mr. Payne replied that this could be handled in a similar fashion to mobile homes. SuMr. Keeler suggested that it could be written so that only the Board of pervisors need review the permit. Mrs. Diehl expressed grave concern on giving blanket approval for something that ultimately covers the entire A-1 zone. Mr. Gloeckner moved denial of the zoning text amendment. Mrs. Diehl seconded the motion, which carried unanimously. ZMA-80-08. Marion B. Short has petitioned the Board of Supervisors to rezone 12.63 acres from A-1 to M-1. Property is located on the southeast side of Route 742 ( Avon Street Extended ) and also has frontage on Route 20. County Tax Map 90, Parcel 28, Scottsville District. Mr. Keeler presented the staff report. Mr. Camblos, on behalf of the applicant, noted the slope from Avon Street ✓a .7- is substantial, however, it is not as extreme midway through the property. He said that Wilson Trucking adjoins the property on the city side. Everything in the area is industrial. Mr. Camblos said that the owner of the property was recently admitted to a nursing home, and the children are attempting to provide for their mother in her elderly years through the highest use of this property. He felt the property is suitable for light industrial uses. He noted the Comprehensive Plan recommendation on the property. There was no public comment, and Col. Washington closed the public hearing. Mr. Keeler noted for the record that much of the industrial development in the county is on land that is not suitable for industrial use. Mr. Camblos said that if plowed, the soil would end up on Route 20, but an industrial operation would protect the land so that it would be to his advantage as well as the neighbors' advantage. Mr. Davis said that the slopes are indeed severe, and he did not feel it appropriate for industrial zoning. Furthermore, he pointed out that Route 20 is a scenic highway; however, the slopes are better in that direction. He could not support the petition. Mr. McCann said that he has problems with the 10% slope provision for industrial land, noting that Albemarle County is a hilly county. He noted that the Comprehensive Plan recommends industrial zoning for the property, and the soil erosion and other ordinances would have to be followed in its development. Mrs. Diehl noted that the staff has specifically reviewed the site, and the Comprehensive Plan is not site specific. Mr. Skove pointed out that the staff report addresses possible limited industrial development, however steep slopes cover most of the property. Mr. Camblos said that the land cannot be sold conditionally due to the circumstance that the court must approve the sale, etc. Mr. Gloeckner agreed with Mr. McCann, stating that the Board of Supervisors has expressed its plans for development south of town. Utilities are in that direction and access from Route 20 to the interstate is good. Water and sewer will no doubt serve this property within ten years. Mr. Vest said that he wished it could be determined that the land has slopes of 10 0 or less. Mr. Davis felt that perhaps only two acres are suitable for development on Route 20. Mr. Skove moved denial of the petition. The motion was seconded by Mr. Davis, and carried by a vote of 6-2, with Messrs. Gloeckner and McCann dissenting. ZMA-80-09. Charles W. Hurt has petitioned the Board of Supervisors to rezone 4.48 acres from B-1 to M-1. Property is located on the north side of Route 649 ( Proffit Road ) and has frontage on the southeast side of Route 29 North. County Tax Map 32A, Parcel 2-1B, Rivanna District, AND SP-80-21. Charles W. Hurt has petitioned the Board of Supervisors, under Section 8-1-27(4) of the Zoning Ordinance, for manufacturing of pre -fabricated buildings and materials on 4.48 acres zoned B-1 ( proposed for M-1 zoning ). Property is located on the north side of Route 649 and has frontage on the southeast side of Route 29 North. County Tax Map 32A, Parcel 2-1B, Rivanna District. Mr. Keeler presented the staff report on both applications to the Commission. He read the comments submitted by the Virginia Department of Highways and Transportation. Mr. Peter VandeLinde, contract purchaser of the property, said that a primary use in Hollymead would mean eventual conflict with the neighborhood. He pointed out that Automated Structures on Route 649 is in a residential area. He said that he feels the use would be in harmony with the area. Mrs. Mary Jo Lovelace was opposed to an industrial use so near a residential area. She noted that a lot of industrial land is already in the area, and opposed any more traffic on Route 649. Additionally, she pointed out that this is not recommended by the Comprehensive Plan. Mr. VanderLinde said that other parcels discussed by the staff are inappropriate. He said that the proposed operation is small. He requested that if the Commission does not find this site to be suitable, they give guidance on an appropriate area. He noted at this time the property is defoliated. Mr. McCann questioned where industrial uses will be put in the county - he said that according to the chart for industrial appropriateness, this receives a priority rating of two. Mr. Payne said that the Comprehensive Plan has to be treated as a general guide. Mrs. Deihl said that if this property is rezoned, the owners of the other two parcels will feel forced to apply for industrial zoning. Mr. McCann moved approval of ZMA-80-09. The motion died for lack of a second. Mr. Skove objected to the use of the domino theory on all the parcels, and moaned that ZMA-80-09 be denied. Mr. Davis seconded the motion, which carried by a vote of 7-1, with Mr. McCann dissenting. Mr. Vest then moved denial of SP-80-21. The motion was seconded by Mr. Gloeckner, and carried by a vote of 7-1, with Mr. McCann dissenting. The Planning Commission will conduct a public hearing, pursuant to Section 15.1-456 of the Code of Virginia (1950) as amended to review VEPCO's proposed rebuild of the Bremo transmission line for compliance with the Comprehensive Plan. The Bremo transmission line begins at the Rivanna River below the Woolen Mills and proceeds generally in a southeasterly direction, crossing Route 53 at Nix and continuing in said direction to the Fluvanna County line. Mr. Keeler presented the staff report. Mr. Phil Lucas, representing VEPCO, said that all the rebuild will be steel towers or wooden structures. He discussed the various heights of the towers proposed. He explained the legend for the area of the transmission line and pointed out that the majority of the area is forested and agricultural. There was no public comment. Col.. Washington closed the public hearing. Mr. Lucas said that he has no problem complying with the staff's recommendation regarding screening and vegetation. Mrs. Diehl questioned the approximate height above the water level. Mr. Lucas replied that it is approximately 120 feet. Mr. Davis pointed out the desirability of single shaft poles with upswept arms. .Mr. Lucas said they had been considered, however would be much more visible than the corteen from Monticello. Mrs. Diehl questioned the cost differential between poles and towers. Mr. Lucas said that is between 10 and 15%. Mr. Davis expressed concern with the Pantops area toward the substation. Mr. Gloeckner moved that the Commission recognize this as being substantially in compliance with the Comprehensive Plan, subject to the recommendations of the staff regarding vegetation and screening. Mr. Vest seconded the motion, which carried by a vote of 7-0-1, with Mr. Davis abstaining. ZMA-80-10. Patsy 0. Tiffany has petitioned the Board of Supervisors to rezone 2.0 acres from A-1 to B-1. Property is located off a 50-foot right-of-way north of Route 250, and is west of I-64. County Tax Map 55, Parcel 19, part thereof, Whtie Hall District. Mr. Keeler presented the staff report, and noted the letter from Mr. Bradley Peyton supporting the staff's recommendation for denial of the petition. Mr. Keeler also read the recommendations from the Virginia Department of Highways and Transportation. /.3U Mr. Tiffany said that during the review of the special use permit three Board members had expressed support of a possible rezoning petition. He had no other comments. Mrs. Helen Mileus, representing the Scenic Road Committee of Citizens for Albemarle, reminded the Commission of the County's committment to development of downtown Crozet as a continued business center. Mr. Skove moved denial of the petition. Mrs. Deihl seconded the motion. Mr. McCann said that there are problems here with this land, however, he feels the proper place for businesses is in the interstate quadrants. He said that he would support the motion.
