HomeMy WebLinkAbout12 09 80 PC MinutesN December 9, 1980 The Albemarle County Planning Commission conducted a public hearing on Tuesday, December 9, 1989, 7:30 p.m. Board Room, County Office Building, Charlottesville, Virginia. Those members present were Col. William Washington, Chairman, Mrs. Norma Diehl, Vice-Chariman, Mr. David Bowerman, Mr. Allan Kindrick, Mr. James Skove, Mr. Charles Vest, Mr. Kurt Gloeckner. Other officials present were Mr. Frederick Payne, Deputy County Attorney and Mr. Ronald S. Keeler, Assistant Director of Planning. Absent from the meeting were Mr. Corwith Davis and Mr. Timothy Lindstrom, ex-Officio. Col. Washington called the meeting to order after establishing that a quorum was present. The minutes of October 21, 1980 and December 2, 1980 were approved as submitted. Mr. Gloeckner disqualified himself by leaving the room. General Electric Company Facility Expansion Site Plan - Mr. Keeler advised the Planning Commission that it had acted on this site plan but deferred action on the entrance until the Planning Department and Highway Department could meet to resolve the matter of the entrance on 29N. Mr. Keeler presented the staff report. Col. Washington inquired if the road off to the right is a one-way. Mr. Keeler replied "yes." Gene Maynard, a representative of General Electric, stated that they have met with the Highway Department and all are in agreement with the concept, and that the engineering is completed at the present time. He also established that as far as dedication to the State, the entire section (Road E) will be dedicated and meets the Highway Department standards; the balance will remain property of General Electric. There were no comments from the public. Col. Washington closed the public hearing. Col. Washington asked Mr. Keeler the appropriate action for the Planning Commission to take. Mr. Keeler replied that they should approve the entrance design and concept, as shown on the plan submitted December 3. Mr. Bowerman asked if the Planning Commission had to reference this back to that portion of the plat that was approved at the previous meeting. Col. Washington called for a motion. jJ Mr. Bowerman recommended approval with the staff's recommendation: 1. A building permit will not be issued until the following conditions have been met: a. Compliance with the Stormwater Detention requirements; b. Fire Official approval of hydrant locations and handicapped provisions; C. Virginia Department of Highways & Transportation approval of commercial entrances to Rte 606. Virginia Department of Highways & Transportation approval of entrance to Rte 29N in accordance with conceptual alignment on plan marked "12-2-80 ROAD "E: REVISED; ROAD "T" ADDED" (The Commission approved the conceptual alignment; Virginia Department of Highways & Transportation is to approve details and specifications including turn lane and crossover design). 2. A Certificate of Occupance will not be issued until the following conditions have been met: a. Dedication for public use of 25 feet from the centerline of Rte 606 to be accomplished by separate plat or deed; b. Fire Official approval of fire flow of 2,500 gallons per minute. Mr. Kindrick seconded the motion. Col. Washington asked Mr. Bowerman if he recommended approval of the plat as shown on December 3. Mr. Bowerman replied "yes." The vote was unanimous for approval. Mr. Gloeckner rejoined the meeting. SP-80-68. Frances Roberts has petitioned the Board of Supervisors for an antique store on 0.53 acres zoned A-1. Property is located at the intersection of Routes 231 and 600 at Cismont. Tax Map 65, Parcel 39, Rivanna District. Mr. Keeler presented the staff report. Col. Washington inquired if this was an old building. Mrs. Roberts replied "yes with an apartment in the rear." Col. Washington asked what is the existing acreage. Mr. Keeler replied "over � an acre." Col. Washington expressed concern about the traffic motivation in this area. Col. Washington asked the applicant if she had the land to meet the parking requirements, without having to back out onto the main road. Mrs. Roberts replied "yes." With no comment from the public Col. Washington closed the public hearing. Mrs_. Diehl asked if Mr. Keeler had completed a site check. Mr. Keeler stated that the Highway Department will have to issue a commercial entrance and that they would like to have controlled access to the the property, so that there would be only one or two thirty foot entrances to the property. He also noted there was some problems with sight distance on one portion of the property. Mrs. Diehl asked how should the wording on Condition #4 read. Mr. Keeler suggested that they add "except for 1 dwelling unit which will be occupied by the applicant." Mr. Payne suggested this read "except for 1 dwelling unit which will be occupied by the operator of the shop." Mr. Gloeckner moved for approval subject to the eight conditions as modified by Mr. Payne and Mrs. Diehl: 1. Virginia Department of Highways & Transportation approval of controlled access to the site; 2. Staff approval of parking layout and landscaping; 3. No outdoor display of merchandise; 4. No other use may be made of the property, except for one dwelling unit occupied by the operator of the shop; 5. No auctions; 6. Building Official approval for commercial usage; 7. Fire Official approval including removal, filling, or other safety measure for underground gasoline tank; 8, Sign sizes to comply with Article 18 - Scenic Highways. Mr. Kindrick seconded the motion, which carried unanimously. ZTA-80-04. Fruit Growers Coop. and David Tyler. The applicant had requested an indefinite deferral. Mrs. Diehl made a motion for deferral. Andre H- Argaud has petitioned the Board of Supervisors to amen e A-i AgricuIrura.,one of the Zoning Ordinance to permit "restaurants" by special use permit. Col. Washington stated that he was relucant to act without the applicant present. Mr. Payne stated that legally you could act on this without the applicant being present, because there was sufficient notification. Mr. Keeler presented the staff report. With no comment from the public, Col. Washington closed the public hearing. Mr. Gloeckner stated that if there was a suitable site it should be approached as a rezoning, and he agreed with the staff to deny this application. Mr. Skove pointed out that this could be done as a rezoning with proffers. Mrs. Diehl stated that the point that there is an adjacent growth area with available land is significant. Mr. Gloeckner stated that if there was a sith which was desirable from a restaurant point of view, and applied for a rezoning, where the Commission could hear the viewpoints of the adjacent owners, this would be the proper way to handle this. Col. Washington called for a motion. Mr. Gloeckner moved for denial. Mrs. Diehl seconed the motion, which carried unanimously. Mr. Payne explained to the Planning Commission the liability of property owners on a private road. Spring Valley Farm - Lot 1 - Final Plat - a division of a 2.0634 acres lot eaving a residue acreage of 4.7664 acres. Property, described as Tax Map 77, Parcel 40D, is located west and adjacent to Roadway Express on Broadway Street in the Woolen Mills area. Mr. Keeler presented the staff report. Mr. Gloeckner stated that as a condition of approval to: note deed book reference for adjacent properties, as well as chain of title and deed book reference. Also, approximate distance to the intersection to Franklin Street, to be shown on the plat. Mrs. Diehl inquired if they were planning to develop immediately and hook up to sewer at a later date. In Mr. Keeler stated that he did not know when they would develop, but the condition for Health Department approval does not perclude you from requiring public sewer later on. Mr. Vest asked if you could require as a condition of approval to hook up to public sewer when available. Mr. Keeler replied "yes." Mrs. Diehl inquired if there was a preliminary plat on this. Mr. Keeler replied that there was no preliminary plat. Mr. Skove moved for approval with the following conditions: 1. Virginia Department of Health approval for septic system location; This condition shall not preclude the Planning Commission requirement of public sewer as a part of subsequent site plan approval. 2. Virginia Department of Highways and Transportation approval of commercial entrance site distance. 3. Note deed book reference for adjacent properties as well as chain of title and deed book reference. Also approximate distance to the intersection to Franklin Street, to be shown on the plat.
