HomeMy WebLinkAbout09 22 81 PC MinutesSeptember 22, 1982 T:ie Albemarle County Planning Commission conducted a public meeting on Tuesday, September 22, 1982, 7:30 p.m., Third Floor, County Office Building, Charlottesville Virginia. Those members present were Mrs. Norma Diehl, Chairman, Mr. David Bowerman, Vice -Chairman, Mr. Kurt Gloeckner, Mr. Richard Cogan, Mr. James R. Skove, Mr. Allen Kindrick, and Mr. Corwith Davis, Jr.. Other officials present were Mr. Frederick W. Payne, Deputy County Attorney and Ms. Katherine L. Imhoff, Planner. After establishing that a quorum was present, Mrs. Diehl called the meeting to order. Motor Speciality Site Plan - located on the northeast side of Westfield Road between Covey's Radio & TV Service and McCann Delivery Service; proposal to locate an 8,400 square foot building with retail and storage area for Motor Specialty Company, Inc.. Charlottesville District (Tax Map 61W, Parcel 01-C-01). Ms. Imhoff presented the staff report. Mrs. Diehl asked if the applicant had any comments. sir. Tom Sinclair, representing the applicant, stated that they would respond to any questions or concerns the Commission may have. With no comment from the public, Mrs. Diehl stated that this matter was before the Commission. Mrs. Diehl noted that a landscape plan was to -,be submitted prior to Planning Commission review of this site and questioned why this was not complied with. Mr. Sinclair stated that he was not aware that this was to be submitted before Commission review of the site. He stated that they are proposing two staggered rows of pine trees along the left side of the rear boundary line. Pat Jensen stated that when they obtained the variance for this site, it was recommended that landscaping be done to the end of the building. Mrs. Diehl ascertained that the applicant is proposing two staggered rows of white pines on 10' centers. Mrs. Diehl ascertained that the 4,000 square feet will be used for rental purposes. Mr. Skove asked if the 85% conversion figure was used to calculate the number of parking spaces required based on net office space. Ms. Imhoff stated that the Planning Commission should address this as she has no basis for this figure. 15W Mrs. Diehl noted that the County Engineer is willing to approve a temporay prime and double seal surface with 6" of aggregate base, requiring the permanent surface of 1" of bituminous concrete within one year of the certificate of occupancy issuance. She asked if this would deteriorate the base by using it for a year without the final seal. Mr. Sinclair that this is not an unusual condition and would not have any adverse effects on the base. Ms. Imhoff noted that the applicant used the parking requirements for over the counter sales to obtain the amount of parking required. Pat Jensen asked if a surface base is put on the parking lot at this time, would this be adequate. Mrs. Diehl stated that this would have to be reviewed by the County Engineer. 14s. Imhoff stated that it is her understanding that anything in the urban area is required to have prime and double seal. i4rs. Diehl asked if the landscaping proposed by the applicant should be approved by the Commission. Mr. Payne stated that he did not feel that the Board of Zoning Appeals intended to require the Commission to approve this rather than delegate it to the Staff. Mr. Bowerman noted that the highway department commented that the entrance should be extended further back into the property. Ms. Imhoff stated that this is an existing entrance, noting that with the size of the lot and the parking spaces it would be difficult to bring the entrance road further into the site. Mr. Skove moved for approval of this site plan subject to the following conditions: 1. A building permit can be processed when the applicant has met the following conditions: a. Existing and proposed utility easements; b. Note any drop inlets or other appurtenances; c. Note type of curbing; d. County Engineer approval of temporary and permanent pavement specifications; e. County Engineer approval of curbing; f. County Engineer approval of drainage plans; g. Compliance with the Stormwater Detention Ordinance; h. Compliance with the Soil Erosion and Sedimentation Control Ordinance; i. Fire Official approval of hydrant location and handicapped provisions, if necessary; j. Albemarle County Service Authority approval of internal plumbing and sewer construction plans in connection with the Cross Connection Control Program; k. Staff approval of additional landscaping; 1. Note on plan specifications for retaining wall, to be approved by the County Engineer; 9 2. A certificate of occupancy will be issued when the applicant has met the following conditions: a. Bond shall be posted for permanent paving; b. Fire Official approval of fire flow. Mr. Davis seconded the motion, which carried unanimously. Ednam, Sections F & G Final Plat - located off the south side of Route 250 West, within the Ednam Planned Residential Development; proposal to divide five (5) lots in Section F on 1.01+ acres and five (5) lots in Section G on 1.25+ acres intended for single family attached units. Samuel Miller District (Tax Map 60, portion of parcel 28A). Ms. Imhoff presented the staff report. Mrs. Diehl asked if the applicant had any comments. Mr. Sandy Lambert, representing the applicant, stated that they would respond to any questions or concerns the Commission may have. With no comment from the public, Mrs. Diehl stated that this matter was before the Commission. Mrs. Diehl asked if the Morey Creek Interceptor would be ready when the AWT Plant is ready for operation. Mr. Lambert stated that in talking with the County Engineer, the AWT Plant should be ready for operation October 19. He noted that the Morey Creek Interceptor is under construction at this time and should be completed by October. Mr. Bowerman moved for approval of this plat subject to the following conditions: 1. This plat will be signed when the applicant has met the following conditions: a. Fire Official approval of fire flow; b. County Attorney approval of homeowner's association agreement for the maintenance of the private roadways, parking areas, drainage and appurtenant structures, pathways and any other commonly -awned or common - use amenities; c. Compliance with ZMA-80-19. Mr. Gloeckner seconded the motion, which carried unanimously. n Mill Run Final Plat - located on the north side of Route 743, east of the intersection with Route 663 in Earlysville; a proposal to divide 22.535 acres into 15 lots with an average size of 1.502 acres and leaving 3.3 acres residue. White hall District (Tax Map 31, a portion of parcel 40A, Parcels 40, 41C, and 41D) . Ms. Imhoff presented the staff report. Mrs. Diehl asked if the applicant had any comments. Roger Ray, representing the applicant, stated that they would respond to any questions or concerns the Commission may have. With no comment from the public, Mrs. Diehl stated that this matter was before the Commission. Mrs. Diehl ascertained that lot #7 or #12 should have access only onto Mill Run Lane. Mrs. Diehl asked if the applicant plans to build the road to the present specifications. Mr. Ray stated that they would either change the road specifications or designate a lot to access on Mill Run Lane. Mr. Skove ascertained that four (4) lots have been added to this plat. 'As. Imhoff noted that health department approval has been received for this proposal. 'wrr Mr. Gloeckner moved for approval of this plat subject to the following conditions: 1. The plat will be signed when the following conditions have been met: a. Determination of a building site for all lots; b. 'dote drainage easement for northern stream, if necessary; c. Provide a street sign; d. Compliance with the private road provisions, including: 1) County Engineer approval of road plans; 2) County Attorney approval of a maintenance agreement; e. Compliance with the Soil Erosion G Sedimentation Control Ordinance; f. Designate on the plat which lot shall have access only onto Mill Run Lane. Mr. Kindrick seconded the motion, which carried unanimously. IM Hydraulic Road Apartments Site Plan - Requests deferral Lentil October 20, 1981. Mr. Skove moved to accept the request for deferral of this site plan until October 20, 1981. Mr. Gloeckner seconded the motion, which carried unanimously. Hardee's Restaurant Site Plan - To be deferred. Mr. Gloeckner moved to defer this site plan until October 20, 1981. Mr. Kindrick seconded the motion, which carried unanimously. Wilco Gas Station Expansion Site Plan - Requests deferral until October 20, 1981. Mr. Gloeckner moved to accept the request for deferral of this site plan until October 20, 1981. Mr. Skove seconded the motion, which carried unanimously. **We Rio/29 North, Phase III, Site Plan - located at the northwest corner of the intersection of Rio Road (Route 631) and Route 29 North; a proposal to locate a commercial/retail building (total of 10,614 square feet) on a 40,590 square foot site. Charlottesville District (Tax Map 61, parcel 123F). As. Imhoff presented the staff report. Mrs. Diehl asked if the applicant had any comments. Sandy Lambert,representing the applicant, stated that they have no objections to the recommended conditions of approval outlined by the Staff. He stated that they would respond to any questions or concerns the Commission may have. With no comment from the public, Mrs. Diehl stated that this matter was before the Commission. Mrs. Diehl noted her concern regarding the stormwater detention plan and noted that the County Engineer stated that this could present a design problem for this site. Mr. Sinclair stated that he does not agree with the assessment of the County Engineer that this pond is a hazzard. He noted the concern of the County Engineer that runoff could be a problem on the adjacent properties, but stated that he did not feel this would present a problem. He also noted that they do not intend to pond on the highway department's right-of-way. �+► Bob Tucker, Director of Planning, stated that the County Engineer is con- cerned about the reservation, noting that the highway department will not accept any structures within their reservation. Mrs. Diehl ascertained that there was no information submitted from the highway department regarding this reservation. *400 Sandy Lambert stated that this property was subdivided in the past and a reserved right-of-way was indicated which is shown on the plan. Mr. Tucker stated that the plans showing the highway departments reservation have been sent to the Culpeper office for their review. Mr. Skove ascertained that the number of parking spaces is in compliance with the requirements of the Zoning Ordinance. Mrs. Diehl asked if the County Engineer anticipates any problems in meeting the requirements of the Stormwater Detention Ordinance. Ms. Imhoff stated that the County Engineer has stated that there may be some problems in meeting the requirements of the Stormwater Detention Ordinance, but he felt like they could be worked out with the applicant. Mr. Bowerman noted that the plans do not address the runoff from the building area and walkway areas. He asked if there was any comments from the applicant regarding this. Tom Wyant, stated that there are storm drains which run between the two buildings. The roof drainage from the second building is a 12" pipe with two catch basins between the two buildings. He stated that this will take care of approximately 600 of the drainage from this building. Mr. Bowerman ascertained that that cure and gutter will be installed on Rio Road to meet with the requirements of the highway department. Mr. Skove moved for approval of this site plan subject to the following conditions: 1. A building permit can be processed when the applicant has met the following conditions: a. Note existing zoning; b. Note type of curbing for County Engineer approval; c. Provide detail of retaining wall for County Engineer approval; d. Location of hydrant; e. Staff approval of landscape plan; f. County Engineer approval of drainage plans; g. Compliance with the Stormwater Detention requirements; h. Compliance with the Soil Erosion u Sedimentation Control Ordinance; i. Note edge of Virginia Department of Highways & Transportation right-of- way along Rt. 29N in accordance with the 29N Corridor Study and any right-of-way reservation for Virginia Department of Highways and Transportation approval; j. Fire Official approval of hydrant location; k. Albemarle County Service Authority approval of internal plumbing and sewer construction plans in connection with the Cross Connection Control Program; 1. County Attorney approval of cooperative parking agreement; `` m. County Attorney approval of maintenance agreement for stormcvater detention area(s) and appurtenances, if needed; 60 2. A certificate of occupancy will be issued when the following condition has been met: a. Fire Official approval of fire flow. Mr. Kindrick seconded the motion. DISCUSSION: Mr. Davis asked why the Staff is recommending that some dogwood trees be replaced with sugar maples. Ms. Imhoff stated that sugar maples would be in keeping with the landscaping required on adjacent properties. Mrs. Diehl stated that she felt that the drainage plans should be more definitive. VOTE: The above noted motion was unanimously approved. Lester Rice Site Plan - request to delete a condition of approval: 111(e) Note type and height of fencing." Rivanna District. (Tax Map 80, parcel S9C). Ms. Imhoff presented the staff report. Mrs. Diehl asked if the applicant had any comments. John Rice, the applicant, stated that he would respond to any questions or concerns the Commission may have. With no comment from the public, Mrs. Diehl stated that this matter was before the Commission. Mr. Skove ascertained that the applicant has no objection to the type of screening recommended by the Staff. Mrs. Diehl noted that this condition (note type and height of fencing) was added to the conditions of approval because the applicant had stated that he wanted this for protection. She stated that she has no problem with deleting this condition and adding'tcreening of vehicle storage area from 2SOE, subject to Staff approval." Mr. Kindrick moved to delete condition I.e. -"note type and height of fencing" and to include in the conditions of approval: • Note on site plan screening of vehicle storage area from 2SOE, subject to Staff approval." Mr. Skove seconded the motion, which carried unanimously. New Business: Review of citizens' concerns letter. Mr. Tucker stated that a memorandum was received from the .League of Women Voters regarding various concerns they have with the procedures, inter- pretations and enforcement of County ordinances and regulations. (COPY OF MEMOPAC M IS ATTACHED). A copy of the staff's response to these concerns is attached. The Commission reviewed these concerns and the concensus was the same as that of Staff.
