HomeMy WebLinkAbout06 01 82 PC MinutesJUNE 1, 1982 The Albemarle County Planning Commission held a public hearing on Tuesday, June 1, 1982, Meeting Room 7, County Office Building, Charlottesville, Virginia. Those members present were: Ms. Norma Diehl, Chairman; Mr. Richard Cogan; Mr. David Bowerman; Mr. Allen Kendrick; Mr. Tim Michel; and Mr. Jim Skove. Other officials present were: Ms. Kat Imhoff; Mr. Ron Keeler; Ms. Ellen Nash, Ex-Officio; and Mr. Fred Payne, Deputy County Attorney. Absent: Commissioner Michel. The Chairman called the meeting to order at 7:30 p.m. and established that a quorum was present. Trinity Presbyterian Church Revised Site Plan - Located on the south side of old Route 29S, west of Route 29/250 Bypass; a proposal to revise an approved site plan for the church in order to locate 80 additional parking spaces as well as to revise the grading, storm drainage and landscape plans. Samuel Miller Magisterial District. (Tax Map 76, a portion of Parcel 17). Deferred from May 25, 1982. Ms. Imhoff presented the staff report. Because necessary approvals had not been received by the revision deadline, staff was recommending deferral to June 22» 1982. Mr. Ira Cortez, Fire Official, explained that the Building Department (?) had concerns about the sire of the building. Mr. Trevellians, County Engineering Department, expressed no concerns about the stormwater detention plans. The applicant offered no additional comment. There being no public comment, the matter was placed before the Commission. The Commission agreed with staff's recommendation for deferral. Mr. Cogan moved, seconded by Mr. Bowerman, that the Trinity Presbyterian Church Revised Site Plan be deferred to June 22nd. The motion passed unanimously. Olde Oak Court Condominiums Final Plat - Located on the east ' side. �Hydraulic Road, north of Georgetown Road, across �- from Albemarle High School: to divide a 33,915 square foot site for 6 condominium units with 20,265 square feet in common area. Charlottesville Magisterial District. - Tax Map 61, parcel 36A. Deferred from May 25. Ms. Imhoff presented the staff report. Staff recommended _..�4-_+ +" �"nH/+inn, ��~�r- 6-1-82 2 The applicant was represented by Mr. Michael Horn. He stated that all conditions of approval had been met. 'There being no public comment, the matter was placed before the Commission. Mr. Bowerman moved, seconded by Mr. Kendrick, that the Olde Oak Court Condominiums Final Plat be approved subject to the following conditions: 1. The plat can be signed when the following conditions have been met: a. Note all porches, stoops, patios, etc. and other limited common areas on the plat; b. Make references to the legal documents on the plat. (For example: "This plat is to be accompanied by the condominium regime documents and building plans for each structure); C. County Attorney approval of condominium regime documents to include maintenance of parking area, roadway, landscaping, stormwater drainage and appurtenant structures. 2. Plans of each structure shall be recorded along with this plat and the legal documents, as set forth in Sec. 55- 79.58 of the Virginia Code (1980 Cummulative Statement). The motion passed unanimously. SP-82-30 Rappahannock Electric Coop - Request, in accordance with section 27.2.2.8 of the Zoning Ordinance, for special use permit to replace expired SP-79-78, same conditions to apply, to locate an electric utility substation on 1.875 acres zoned LI Light Industry. County Tax Map 21, part of Parcel 12, Rivanna Magisterial District. Located at intersection of Routes 763 and 606, on the southern side of Route 606, approximately 500 feet west of intersection with Route 29 North. Mr. Keeler presented the staff report. The report concluded: "Staff recommends favorably on the operation of the proposed substation at 34.5 kv; however, staff would recommend that conversion of the substation to 115 kv be treated as new business, since conversion would be dependent *WW on other projects which have not been reviewed." The applicant was represented by Mr. Barry Leonard. He described the history of the proposal. Referring to Mr. Keeler's statement that there would be a 115 kv line "going out and coming in, he stated there were no plans "to go out from the substation, but only to come in." 2..Z b5 6-1-82 3 There being no public comment, the matter was placed before the Commission. The Commission expressed no concerns. Mr. Davis moved, seconded by Mr. Skove, that SP-82-30 for Rappahannock Electric Coop be recommended to the Board of Supervisors for approval subject to the following conditions: 1. Approval of this petition shall not be deemed to be an endorsement of any subsequent projects of REC, VEPCO or any other agency or person related to the usage of this substation. County review of any subsequent project will be treated as new business without reference to this approval, and such project may be approved or denied based on its merits; 2. Approval of this petition shall not be deemed to be endorsement of VEPCO's proposed Remington-Hollymead transmission line project. The County has made no formal review of the proposed project and therefore has no official position on the proposal; 3. The existing temporary substation and appurtenances shall be removed and the site restored within thirty (30) days of the permanent substation becoming operational; 4. Site plan approval to include: a. Sufficient berm on northern and southern and eastern property lines with evergreen trees (4'-6' in height) on 15-foot centers on top of the berm in order to screen the substation structures; b. Trespass fencing around substation structures; C. Virginia Department of Highways and Transportation approval of a commercial entrance. 5. Grading permit; 6. Access limited to Rt. 606. No access shall be permitted from Rt. 29 North; 7, Structures shall not exceed 40 feet in height. w"W The motion passed unanimously. ZMA-82-7 First Rio Road Land Trust WITH PROFFER (WWW Electronics) - Request to rezone 0.3 acre from CO Commercial Office to LI Light Industry with proffer to limit use to 6-1-82 4 current use. County Tax Map 45, Parcel 163, Charlottesville Magisterial District. Located at intersection of Route 631 (Rio Road West) and Greenfield Court. Mr. Keeler presented the staff report. Staff recommended approval subject to the acceptance of the applicant's proffer. The applicant was represented by Mr. Leroy Hamlett, attorney. He described the history of the property. He offered examples of the the product produced by the company (circuit boards). There being no public comment, the matter was placed before the Commission. It was determined the property was served by a private sewer system. Mr. Davis moved, seconded by Mr. Skove, that ZMA-82-7 for ".. First Rio Road Land Trust (WWW Electronics) be recommended to the Board of Supervisors for approval subject to acceptance of the applicant's proffer. The motion passed unanimously. ZTA-82-9 - Resolution of Intent to amend Section 3.0 of the Zoning Ordinance to provide a definition of "borrow area" and to include "soil" as a natural resource extraction activity. and ZTA-82-10 - Resolution of Intent to amend RA and NR District regulations, Sections 30.4.2.2 and 10.2.1 to provide for "borrow area." Mr. Keeler presented the staff report. He was assisted by Mr. Payne who explained the amendments by giving examples. Mr. Payne suggested the following addition to Section 10.2.1: "...10,000 square feet or an aggregate volume of 20,000 cubic feet,...." There being no public comment, the matter was placed before the Commission. Staff answered Commission questions about the effect of the proposed amendments. No concerns were expressed, nor were any changes to the nrnnnsed amendments recommended. 2.7-7 6-1-82 5 Mr. Davis moved, seconded by Mr. Kendrick, that ZMA-82-9 and ZTA-82-10 related to "Borrow Area" be recommended to the Board of Supervisors as presented by staff (See files for final language.) The motion passed unanimously. Request for Waiver of Site Plan Requirement - Calico House (ZMA-82-2 Bruce and Polly Hogshead) Mr. Keeler presented the staff report. Staff recommended acceptance of a sketch plan in lieu of a site development plan, subject to conditions. The applicant* Mr. Hogshead, stated that the applicant was prepared to meet staff's recommended conditions of approval. He stated a bond had been submitted. There being no public comment, the matter was placed before the Commission. Mr. Davis moved, seconded by Mr. Cogan, that the Request for waiver of the site plan requirement be approved subject to the following conditions: 1. Commercial activity of the Calico House shall not commence until the following improvements have been completed or bonded for completion: a. Installation of entrance facilities in accordance with VDH&T requirements; b. Development of parking area and access road in accordance with County Engineer's approval. The motion passed unanimously. SP-82-31 J. Lewis Butler - Request, in accordance with section 10.2.2 of the Zoning Ordinance, for special use permit to locate a public garage (repair shop for body and fender work/no engine repairs) on .82 acre zoned RA Rural Areas. County Taw Map 130, Parcel 42C, Scottsville Magisterial District. Located on western side of Route 726, approximately 1.25 miles south of intersection with Route 6. It was determined the applicant was not present. The Chairman invited public comment. Mr. and Mrs. Sherman, neighboring property owners (across the road), expressed opposition to the request. Mr. Sherman 6-1-82 M. described the neighborhood as "quiet and small in the middle of an agricultural area." He felt the proposed body shop would be out of character with the surrounding area and would be a threat to public safety. Mr. Davis moved, seconded by Mr. Cogan, that SP-82-31 for J. Lewis Butler be deferred to June 8th due to the lack of applicant representation. The motion passed unanimously. JUNE 8 MEETING TIME - The June 8th meeting time was set for 7:30 at which time a work session on the Comp Plan would take place.
