HomeMy WebLinkAbout12 21 82 PC MinutesDecember 21, 1982 The Albemarle County Planning Commission conducted a public meeting on Tuesday, December 21, 1982, 7:30 p.m., Meeting Room 5/6, Second Floor, County Office Building, 401 McIntire Road, Charlottesville, Virginia. Those members present were Mrs. Norma Diehl, Chairman, Mr. David Bowerman, Vice -Chairman, Mr. Allen Kindrick, Mr. Richard Cogan, Mr. James R. Skove and Mr. Corwith Davis, Jr.. Other officials present were Mr. Frederick W. Payne, Deputy County Attorney, Ms. Mason Caperton, Senior Planner and Ms. Katherine L. Imhoff, Planner. Absent from the meeting was Mr. Tim Michel and Ms. Ellen V. Nash, ex-Officio. After establishing that a quorum was present, Mrs. Diehl called the meeting to order. The minutes of April 6, 1982 and May 25, 1982 were approved as submitted. River Heights Final Plat - located on the west side of Route 29 North (southbound lane), south of the South Fork of the Rivanna River and north of Route 659; proposal to divide 74+ acres into 4 lots (ranging in size from 4.08 acres to 15.16 acres) and having 43+ acres in residue. Charlottesville Magisterial District. (TM 45, Parcels 68D(1), 68D(2) and 68D(3)). DEFERRED FROM NOVEMBER 16, 1982. Ms. Imhoff presented the staff report. Mrs. Diehl asked if the applicant had any comment. Mr. Wendell Wood, the applicant, stated that it was his understanding that two entrances were approved from Rt. 29 when the rezoning for this parcel was approved. Ms. Imhoff noted that the traffic distribution plans would have to be approved by the Highway Department. Mr. Wood stated that they were asked by the Highway Department to prepare a traffic analysis plan based upon the maximum use of this road. He stated that he felt access was being denied based upon this traffic analysis plan. He also noted that Parcel B has 800' of road frontage and pointed out that they did not anticipate that access to Rt. 29 would be denied. He noted that this entire parcel is under one ownership and stated that if it were owned by two or more different owners; each owner would be given direct access from Rt. 29. He noted that adequate sight distance is available and reiterated that they are asking for three entrances, one to Parcel C, one to Parcel B, and one to Parcel D. Mr. Wood noted that if direct access were denied to Parcel B (access to Rt. 29) this would effect the development capabilities of this parcel. M with no comment from the public, Mrs. Diehl stated that this matter was before the Commission. Mrs. Diehl noted that from a planning viewpoint, the Commission must plan for the maximum development allowed for the area. Mr. Cogan noted other instances where access to a major highway has been denied. He noted that if direct access from Parcel D could be provided for and approved by the Highway Department, he would not be opposed to this. Mr. Davis asked if a maintenance agreement would be necessary between Parcel D and Hilton Heights Road. Ms. Imhoff noted that the roads will eventually be taken into the State system as they serve the residue as well. She pointed out that Parcel C has direct access onto Rt. 29 as well as internal access. Mr. Davis stated that he felt the maintenance agreement (for the 50' access easement) should be required. Mr. Davis questioned the need for internal access to Parcels C and D. Mr. Roosevelt showed on the plan the location of the proposed entrances and the traffic configuration created by this property. He explained that internal access to Parcel C and D would allow for a better traffic flow both in a north and south direction. Ms. Imhoff pointed out that conditions g and h outlined in the staff report adequately address the entrancec. (CONDITION G: Note on the plat that Parcel D may have one access onto Route 29 North designed and designated as an exit only; CONDITION H: Note on the plat that Parcel C shall have only one entrance onto Route 29 North which is to be located a minimum of 500' from the crossover.) Mrs. Diehl noted that the Highway Department and the County Engineer recommends that the access onto Rt. 29 be designated as an exit only. Mr. Trevillian stated that the Commission should consider the traffic flow from Carrsbrook noting that the turn lane would have to be lowered which in turn would allow Parcel D to have an entrance and exit to Rt. 29. Mr. Roosevelt stated that the option to lower- the road and build a crossover at Carrsbrook would tie in with the 29 North Corridor Study. He noted that as part of the reconstruction of Rt. 29, the study calls for the road to be six lanes wide with a crossover at Carrsbrook. Mr. Roosevelt also noted that the Corridor Study was based on the premise that this was the maximum design in this corridor without purchasing additional right-of-way. 9 Ms. Imhoff noted that the Commission may want to consider adding the following condition: • The applicant is put on notice that the Planning Commission is enforcing the Highway Department's recommendation not to approve construction of intermediate entrances directly to Parcels C or D on Hilton Heights road (as shown on traffic distribution Plan B submitted by the applicant." Mr. Bowerman moved for approval of this final plat subject to the following conditions: 1. The plat can be signed when the following conditions have been met: a. Note the individual and total acreages for the joining of parcels 68D(2) and 69D(3) with parcel 68D(1); b. Note on the plat all easements to conform to the Department of Highways and Transportation's comments dated December 14, 1982, to Mr. Robert Tucker; C. Provision of a street sign; d. Virginia Department of Highways & Transportation and County Engineer approval of the road plans for Hilton Heights Road and any other prospective roadways for acceptance into the State highway system; e. Albemarle County Service Authority approval of provisions for water and sewer; f. Compliance with the private road provisions including: 1) County Attorney approval of a maintenance agreement for the 50, access easement; 2) County Engineer approval of road plans; g. Note on the plat that Parcel D may have one access onto Route 29 North designed and designated as an exit only; h. Note on the plat that Parcel C shall have only one entrance onto 29 North which is to be located a minimum of 500' from the crossover; i. Virginia Department of Highways & Transportation approval of all proposed commercial entrances; j. Change note on plat to read "No further division or redivision without Planning Commission approval." 2. The applicant is put on notice that the Planning Commission has granted no approval of access onto Route 659 (SPCA Road) at this time. 3. The applicant is put on notice that the Planning Commission supports the Virginia Department of Highways & Transportation's recommendation not to approve con- struction of intermediate entrances directly to Parcels C and D on Hilton Heights Road (as shown on traffic distribution Plan B submitted by the applicant). 4. The Planning Commission did grant a waiver of Section 18-29 of the Subdivision Ordinance. This section of the ordinance pertains to the creation of peculiarly shaped lots and waiver of this section permitted the creation of Parcel B. Mr. Davis seconded the motion, which carried unanimously. M University of Virginia Sponsors Hall Dining and Housing Addition Preliminary Site Plan - located off the north side of Massie Road at the University's north campus; proposal to locate a 5,900 square foot addition to the dining area and 24 residential units at a conference center for executive programs. Jack Jouett Magisterial District. (TM 76A). Ms. Caperton presented the staff report. Mrs. Diehl asked if the applicant had any comment. Mr. Steve Barnes, representing the University, stated that he would respond to questions or concerns the Commission may have. Mrs. Diehl ascertained that no grading has been done on this site. Mrs. Diehl thanked Mr. Barnes for attending, the meeting and giving the Commission the opportunity to respond to this proposal. Running Deer, Albino Lane, Final Plat - located off south side of Route 250 East, east of Running Deer Drive and Route 808; proposal to divide 25.199 acres into 10 lots with an average lot sixe of 2.5 acres. Rivanna Magisterial District. (TM 94, parcel 12). Ms. Imhoff presented the staff report. Mrs. Diehl asked if the applicant had any comment. Mr. A. F. Edwards, representing the applicant, stated that he has no problems with the recommended conditions of approval as outlined by staff and further stated that he would respond to any questions or concerns the Commission may have. With no comment from the public, Mrs. Diehl stated that this matter was before the Commission. Mr. Kindrick asked if there are plans for an alternate septic field. Ms. Imhoff pointed out that this septic field was approved by the Health Department in 1975. She also noted that this plat itself is grandfathered because its based on an approved preliminary plat. Ms. Imhoff noted that the Soil Conservation Service has stated that there are no problems relating to soils in this area. Mrs. Diehl stated that a condition could be added to read: • Health Department approval for each lot (written). 19 Mr. Cogan moved for approval of this final plat subject to the following conditions: 1. The plat can be signed when the following conditions have been met: a. Owner's notarized signature; b. Provide metes and bounds to locate all drainage easements; C. Written Health Department approval for lots 2-6, 25 and 26; d. County Engineer approval of final road plans for Albino Lane including inverts and slopes of culverts; e. Compliance with the Soil Erosion and Sedimentation Control Ordinance; f. Provision of a street sign; g. Virginia Department of Highways & Transportation approval of commercial entrance, if necessary; h. Change the note on the plat concerning abandonment of the temporary cul-de-sac to include the information outlined by Section 18-55(1) of the Subdivision Ordinance. Mr. Kindrick seconded the motion, which carried unanimously. Sam Jurlando Final Plat - located off the south side of Route 747, northeast of its intersection with Route 600; proposal to redivide two existing parcels into three parcels. Rivanna District. (TM 33, parcels 42 and 42B). Ms. Caperton presented the staff report. Mrs. Diehl asked if the applicant had any comments. Mr. A. F. Edwards, representing the applicant, stated that the $40.00 fee required for this final plat has been paid. He stated that the applicant is willing to submit the necessary plans for the County Engineer's review of the private road. Mrs. Diehl ascertained that the road specifications for the private road were not submitted for County Engineer's review, as the applicant would like to use the existing road. With no comment from the public, Mrs. Diehl stated that this matter was before the Commission. Mr. Bowerman asked if the applicant choose not to submit road plans for County Engineer approval prior to this plat being reviewed by the Commission. Mr. Edwards reiterated that road plans for the private road were not submitted as the applicant wishes to use the existing road. Ms. Caperton pointed out that staff had requested a review for the adequacy of this existing road to serve one additional lot, noting that this was not received. Mr. Skove pointed out that condition l.b. of the staff report address this concern. (Condition lb. Compliance with the private road provisions, including (1) County FJ Engineer approval of the road specifications for the private road serving a total of four parcels; (2) County Attorney approval of a maintenance agreement. Mr. Skove moved for approval of this final plat subject to the following conditions: 1. The plat will be signed when the following conditions have been met by the applicant: a. Fee of $40.00 due; b. Compliance with the private road provisions, including: 1. County Engineer approval of the road specifications for the private road serving a total of four parcels; 2. County Attorney approval of a maintenance agreement; c. Virginia Department of Highways & Transportation approval of the private street commercial entrance; d. All current owners of the current tax map parcels must sign the plat. Mr. Kindrick seconded the motion, which carried unanimously. Minor Townhouses, Phase II, Final Plat - located off the northeast end of Westfield Road (extended), adjacent to the first phase of Minor Hill, north of Commonwealth Drive; proposal to divide 35 lots for townhouse units in compliance withthe approved site plan. Charlottesville Magisterial District. (TM 61W2, part of parcel 45). REQUESTS DEFERRAL UNTIL JANUARY 18, 1983. Mr. Davis moved to accept the applicant's request for deferral to January 18, 1983. Mr. Bowerman seconded the motion,which carried unanimously. Sherwood Farms, Tracts 1-5 Final Plat - located off the south side of Route 29 South, off the south side of Mountain View Drive and Overlook Drive in the Sherwood Farms subdivision; proposal to divide 74.083 acres into five tracts ranging in size from 7.179 acres to 19.207 acres. Samuel Miller Magisterial District. (TM 76N, parcel 8). Mrs. Diehl noted that although she has no financial interest in this proposal, she is an adjacent property owner, therefore she disqualifies herself by leaving the room. Ms. Imhoff presented the staff report. Mr. Bowerman asked if the applicant had any comment. Mr. Morris Foster, representing the applicant, stated that on site soil tests were done for this parcel and that a soil scientist report was submitted to the Health Department. With regard to the cul-de-sac radius, Mr. Foster stated that Mr. Trevillian, Viso Engineer, has requested this cul-de-sac be increased to 50' and the pavement to 40' (as per Section 18-36h of the subdivision Ordinance.) He noted that this lane serves four lots, therefore it should be subject to County Engineer approval. He noted that he has no objection to increasing the radius of the cul-de-sac if a one lane, circular design with gravel is approved versus an eighty foot radius of gravel. Ms. Imhoff noted that the Commission would have to waive Section 18-37(h) of the Subdivision Ordinance or leave the dimensions of the cul-de-sac and right-of-way to the discretion of the County Engineer.
