The Albemarle County Planning Commission held a public hearing on Tuesday,
October 4, 1983, Meeting Room 7, County Office Building, Charlottesville,
Virginia. Those members present were: Ms. Norma Diehl; Mr. David Bowerman,
Chairman; Mr. Richard Cogan; Mr. Jim Skove; and Mr. Allen Kendrick. Other
officials present were: Mr. Ronald Keeler, Chief of Planning; and Ms. Joan
Davenport, Planner.
The Chairman called the meeting to order at 7:30 p.m. and established that
a quorum was present. The minutes of March 27, 1983 and July 7, 1983
were approved as submitted.
Western Albemarle Site Plan - Located on the south side of U.S. Route 250,
adjacent to the east of Western Albemarle High School property and west
of Brownsville; proposal to cloate a 36,715 square foot shopping and
professional center on 7.75 acres for a major grocery store, restaurant,
retail and professional offices. White Hall Magisterial District.
Tax Map 56, Parcel 17) Deferred from September 20, 1983.
Ms. Davenport presented the staff report. Staff recommended approval subject
to conditions.
Mr. Jeff McDaniel, representing the Health Department, stated that though he
would prefer to see the development connect to public water and sewer, it did
meet area and perk requirements for a drainfield .
Mr. Bill Norris, the Watershed Management Official, addressed the Commission.
He noted that with a drainfield as large as this development will require there
is the potential for harm to the watershed. He stated that if the project
is approved with a drainfield, it be required that it connect to public
water and sewer at such time as it becomes available.
Mr. Elrod, the County Engineer, commented on runoff control measures. He
stated that the plan, as proposed would meet the requirements of the Ordinance
but if the pond was made four times larger, it would not only meet the
requirements, it would actually improve two of the three aspects of runoff
control (suspended solids and rate of flow). He stated he would prefer
that the detention pond be a wet pond, as opposed to a dry one. He stated
also that public sewer is presently 250 feet from the property (though
it is not legally available).
The Chairman invited applicant comment.
The applicant was represented by Mr. Mark Osborne. He commented on the
runoff control issue. Mr. Benn, also representing the applicant, addressed
the Commission. He stated the applicant is considering a pond four times
larger and "probably wet." He stated the applicant was willing to work
with the County to try to improve not only two of the aspects of runoff
but also to improve phrosphorus content as well.

Mr. Tolbert, representing the School Board, expressed concern about the
runoff pond creating an "attractive nuisance" for the nearby school
children. He asked that a barrier fence be required around the pond
and the shopping center, though not necessarily around the entire boundary
of the property.
The Chairman invited public comment.
Mr. Roy Patterson, representing the Citizens for Albemarle, addressed
the Commission. He expressed concerns about adequate supply, particularly
in relation to needs for fire protection; method of handling pedestrian
traffic; and development's incompatibility with adjacent school complex.
Col. Washington addressed the Commission. He expressed concern about
the proximity to the school. He pointed out that a development which
requires so many conditions of approval could be a problem. He felt
the entire project should be bonded.
Mr. John Carter expressed support for the proposal. He felt the existing
Crozet merchants could benefit from increased competition and noted that
it is not the County's job to protect a business from competitors.
Mr.Rick Richmond felt the proposal was in opposition to the Comprehensive
Plan because the Plan "excludes promotion of commercial enterprises
in this area."
There being no further public comment, the matter was placed before the
Commission.
There was a very brief discussion about the runoff control measures.
Mr. Cogan stated he was in favor of extending the jurisdictional area to
serve this site. There was a discussion about the procedure which must
be followed to achieve this.
There was continued discussion about the detention basin, and how it
should be sized. Mr. Elrod commented on detention basins, in general, and
also on the purpose of these basins, i.e. to prevent further degradation,
not to improve conditions.
It was decided the following would be added to condition (j): "Site to be
connected to public water and/or sewer should either or both become available."
Mr. Bowerman asked if the Commission could require that the detention basin
be oversized. Mr. Payne replied it was possible only if the applicant were
agreeable.
Mr. Benn responded that there did seem to be adequate area available and
it did not seem to be terribly expensive. He added: "I want to walk
away with improved water quality, not just meeting runoff regulations."

y There was a discussion about the fence. Some Commissioners questioned its
effectiveness, but did not oppose it, particularly since the School Board
had requested it. Mr. Cogan asked that the fence be at least 50 feet
back (as included in the staff recommendation).
Regarding the size of the detention pond, at Mr. Elrod's suggestion, it
was decided condition (f) would read as follows: "County Engineer final
approval of runoff control plan and calculations to provide facilities that
will reduce suspended solids by approximately 90% and particulate
phosphorus by approximately 80%."
Mr. Skove moved that the Western Albemarle Site Plan be approved subject to
the following conditions:
1. A building permit will not be issued until the following conditions
have been met:
a. Planning staff approval of all the site improvements required to
be constructed with each of the proposed three building phases.
Each phase subject to further site review committee comments;
b. Written Health Department approval;
C. Compliance with the Soil Erosion & Sedimentation Control Ordinance;
d. County Engineer approval of final drainage plans and profiles;
e. County Engineer approval of pavement and retaining wall specifications;
f. County Engineer final approval of runoff control plan and calcu-
lations to provide facilities that will reduce suspended solids
by approximately 90% and particulate phosphorus by approximately
80%;
g. County Engineer approval of dam specifications, fencing and related
easements for detention pond;
h. County Attorney approval of maintenance agreement for detention
pond;
i. Virginia Department of Highways & Transportation approval of
commercial entrances and highway improvements as outlined in
September 15, 1983 memo from VirginiaDepartment of Highways and
Transportation;
j. Albemarle County Service Authority approval of water and sewer
plans including appurtenances and easements for possible future
dedication. All appropriate utilities to be dedicated to Albemarle
County Service Authority at no cost to Authority. This site
to be connected to public water and/or sewer should either or
both become available;
k. Fire Official approval of hydrant and dumpster locations, including
firewall screening of dumpsters;
1. Fire Official approval of handicap provisions;
M. Planning staff approval of landscape plan including fence locations
and specifications.
2. A certificate of occupancy will not be issued until the following
conditions have been met by the applicant:
a. Fire Official approval of fireflow including capacity of water
storage tank;
b. Detention pond and enclosure fence to be constructed before
any certificate of occupancy is issued;

C. Construction of fence and associated landscaping around shopping
center, to be complete before any certificate of occupancy for
Phase II;
d. All improvements to be planted, constructed or bonded prior to the
issuance of a certificate of occupancy for that phase.
Mr. Cogan seconded the motion.
Discussion:
Ms. Diehl stated she could not support the motion because of potential health
and bT4fety problems. She felt a development of this size should be served
b Ywaier and sewer. She was also concerned about the increased traffice in
relation to the close proximity to the school complex.
Mr. Skove stated that he agreed with Ms. Diehl's concerns; however, the
property had been zoned for this use and he felt the conditions of approval
more than met the specifications.
The motion for approval passed (4:1) with Ms. Diehl casting the dissenting
vote. (After discussion, it was decided that no recommendation would be made
regarding extending the jurisdictional area at this time.)
SP-83-64 Vincent Yeaton - Request in accordance with Sec. 10.2.2.22 of
the Zoning Ordinance to locate a country store on .537 acre zoned Rural
Areas, County Tax Map 54, Parcel 55, White Hall Magisterial District.
Located on the northern side of Route 690, ±300 feet east of its intersection
with Route 691, across from the post office at the Old Greenwood Country
Store. The applicant was requesting deferral to October 11, 1983.
Ms. Diehl moved, seconded by Mr. Cogan, that SP-83-64 for Vincent Yeaton
be deferred to October 11, 1983. The motion passed unanimously.
WORK SESSION - Private Roads
Mr. Keeler presented the staff report and initiated the discussion. He was
assisted by Mr. Payne and W.Elrod. Mr. Keeler explained the proposed
changes to the private roads provisions.
The Commission decided not to go forward with Section 18-40 at this time.
This was a proposed new provision which would permit restriction of access
to certain public streets.
The Commission also added the following to the proposed wording for
18-36(g) "In case of a subdivision served by an existing easement of fixed
width, which easement cannot be widened by the subvider, after documented
good faith effort by the subdivider to acquire additional right-of-way
width, the Commission may approve (etc.)...."
Staff was directed to proceed with the finalization of the proposed
amendments. No formal action was required of the Commission.

Gibson and Company - Request for plat approval. Previously approved by
Greene County.
Mr. Keeler explained that the majority of the property lies in Greene
County and the access is through Greene County. He noted that two
lots are located in Albemarle and the Commission was being asked
to ratify Greene County's approval.
Mr. Skpge moved that the Commission ratify the approval of Gibson and
Compsny' l"Asloniehl seconded the motion which passed unanimously.
Request for Withdrawal for Hollymead Section IV Subdivision Plat and
ZMA-82-15 J.G. Dawson.
Mr. Skove moved, seconded by Mr. Cogan, that the Hollymead Section IV's
request for withdrawal be accepted. The motion passed unanimously.
Mr. Cogan moved, seconded by Mr. Skove, that ZMA-82-15, J.G. Dawson's
request for withdrawal be accepted. The motion passed unanimously.
It was decided that the Requests for Adoption of Resolutions of Intent for
Section 32.7.2 and 4.13.2. related to Site Plan Review Committee membership,
and Storage of Inoperable Vehicles, would be deferred to the October
11, 1983 meeting.
There being no further business, the meeting adjourned at 10:50 p.m.
