HomeMy WebLinkAbout07 07 87 PC MinutesJuly 7, 1987 The Albemarle County Planning Commission held a public hearing on Tuesday, July 7, 1987, Meeting Room 7, County Office Building, Charlottesville, Virginia. Those members present were: Mr. Richard Cogan, Chairman; Mr. Richard Gould, Vice Chairman; Mr. Harry Wilkerson; Mr. David Bowerman; Ms. Norma Diehl; Mr. Tim Michel; and Mr. Peter Stark. Other officials present were: Mr. Ronald Keeler, Chief of Planning; Mr. David Benish, Planner; and Mr. Fred Payne, Deputy County Attorney. The Chairman called the meeting to order at 7:30 p.m. and established that a quorum was present. The minutes of June 16, 1987 were approved as submitted. Crutchfield Corporation (Office Space) Preliminary Site Plan - A proposal to construct 20,000 square feet of office space. The office is to be provided as an additional story above an existing (one-story) warehouse building. The total area of the site is 13.25 acres. Zoned LI, Light Industrial. The site is located off of Rt. 606, approximately one-half mile north of the airport entrance. Tax Map 32, Parcel 9C. Rivanna Magisterial District. Mr. Benish gave the staff report. He confirmed that Health Department approval had been received for septic drainfield locations "for the *ft"Kr`' size of building proposed." Noting the LI zoning for the property, Ms. Diehl expressed concern about the possibility of some of the office space being used for some type of industrial use in the future which might require a special permit for septic discharge. Mr. Benish explained that a change in use would have to be cleared through the Zoning Department and at that time a determination would be made as to whether or not the proposed use complied with the existing use for this facility and this site plan. He stated a zoning clearance would be required both if the property were sold or if the current applicant proposed a change in use. Mr. Keeler pointed out that the applicant had already proffered out any discharge of industrial waste to the drainfield, so "he would have to request a change in zoning in addition to a special use permit." The applicant was present but offered no additional comment. There being no public comment, the matter was placed before the Commission. Mr. Michel stated he agreed with Ms. Diehl's concern about the future use of the drainfields. He stated he was nervous about approving the drainfields without a statement limiting them to office or non- industrial uses. July 7, 1987 Page 2 Ms. Diehl suggested that, at least, a note should be placed on the plat. Mr. Keeler suggested that the same wording that is in the proffer could be used. It was determined this would be addressed by staff at the time of the final plat. Mr. Gould moved that the Crutchfield Corporation Preliminary Site Plan be approved subject to the following conditions and with the understanding that staff is to incorporate a note on the final plat addressing the issue of restrictions on drainfield discharge: 1. A building permit will not be issued until the following conditions have been met: a. County Engineering approval of grading and drainage plans and computations; b. Issuance of an erosion control permit; c. Planning staff approval of landscape plan; d. Albemarle County Service Authority final approval. 2. A certificate of occupancy will not be issued until the following condition is met: a. Fire Officer final approval of site plan. Mr. Wilkerson seconded the motion which passed unanimously. *40410 ZMA-87-06 Crutchfield Corporation - Crutchfield Corporation petitions the Board of Supervisors to rezone 21.235 acres from RA, Rural Areas to LI, Light Industrial. Property, described as Tax Map 32, Parcels 9D, 9E, and 17D is located east and adjacent to Crutchfield Corporation off Rt. 606 in the Rivanna Magisterial District. Mr. Keeler gave the staff report. Staff recommended approval of the request and stated that "LI zoning would be consistent with the intent to limit uses in the area to those compatible to the airport operation" and "the request is consistent with the Land Use recommendations of the Charlottesville -Albemarle Airport master plan." In addition to the staff report, Mr. Keeler pointed out that though public sewer is not currently available to this property, it very likely may become available in the near future, though it is uncertain whether or not there will be additional capacity available at the plant. The applicant was present but offered no additional comment. There being no public comment, the matter was placed before the Commission. Mr. Cogan noted that there was some concern about rezoning to Light Industrial without the preserve of public sewer. July 7, 1987 Page 3 Mr. Bowerman pointed out that any site plan for the property would require Commission approval and could be dealt with on a case -by -case basis. Mr. Michel moved that ZMA-87-06 for Crutchfield Corporation be recommended to the Board of Supervisors for approval. Mr. Bowerman seconded the motion which passed unanimously. The matter was to be heard by the Board on July 15, 1987. SP-86-79 Phil & Mary Sheridan - Phil & Mary Sheridan petition the the Board of Supervisors to issue a special use permit for a golf course Section 10.2.2.4) on 174.7 acres of land zoned RA, Rural Areas. The golf course would be an additional amenity added to the Montfair Campground (SP-76-86). The property is located on the north side of Rt. 673, approximately 1/4 mile west of its intersection with Rt. 810. Tax Map 26, Parcel 33A and 33B. White Hall Magisterial District. Mr. Benish gave the staff report. A major concern of the proposal was that of runoff and erosion control during the construction phase of development. Staff recommended that no more than three holes be constructed at any period of time and that further clearing and grading would be allowed only after the constructed holes have been stabilized to the satisfaction of the County Engineer. The staff report concluded: *6000, "Staff is of the opinion that the existing character and use of the site will not be substantially changed. The impact to adjacent properties would not be substantial provided that adequate facilities are established to contain runoff on site and appropriate setbacks and buffers are established. Therefore, unless the Planning Com- mission and Board of Supervisors determine that the additional traffic generation from the golf course would be in excess of the safe capacity of the public roadway system, staff would recommend approval of this request." nn Ms. Diehl asked if the soils report had included an on -site inspection. Mr. Benish responded that the soil scientist had not visited the site, but county staff members had and staff felt that the soil scientist's remarks were consistent with staff findings. Though the plan had been revised to minimize construction on slopes of 25% or greater, Ms. Diehl asked how much construction on such slopes was still planned. Mr. Benish was unable to give a definitive answer. He noted, however, that most of the grading for the tees, greens and fairways were not on areas of 25% slope, but rather trees and "surrounding areas" were in the areas of 25% slope. Mr. Benish approximated that of the 40-45 acres total for the "holes," no more than 5-10 acres were on slopes of 25%. He stressed that this was very difficult to estimate accurately. 1-1770 July 7, 1987 Page 4 It was determined water for maintenance of the course would be obtained from lakes and from two water tanks (one 22,000 gallon and one 10,000 gallon) which currently serve the campground. The Chairman invited applicant comment. Mr. Phil Sheridan addressed the Commission. He indicated he had no objections to the suggested conditions of approval. He expressed appreciation to staff for their assistance throughout the approval process. Mr. Sheridan acknowledged he was aware of proposed limitations on grading and stabilization requirements. There being no public comment, the matter was placed before the Commission. Mr. Michel commented that the proposal was much improved over the original proposal and moved that SP-86-79 for Phil and Mary Sheridan be recommended to the Board of Supervisors for approval subject to the following conditions: 1. Submittal of a site plan for approval by the Planning Commission. The site plan review shall include County Engineer approval of site grading and drainage calculations. 2. Development of golf course to be in general accordance with preliminary plan entitled Montfair, submitted May 27, 1987. Greens and tees shall be located a minimum of 100 feet from perennial or intermittent stream or pond. 3. The amount of grading to occur on site shall be limited to three (3) holes at any one time. Further grading will not be permitted until constructed holes are stabilized to the satisfaction of the County Engineer. [NOTE: This condition was amended later in the meeting. The following sentence was added between the first and second sentences: Such limitation may also include stabilization measures over the winter months.] Mr. Bowerman seconded the motion. DISCUSSION: Mr. Bowerman suggested it might be more practical to divide construction into two phases rather than three since irrigation would be available from the beginning and this might allow the project to be completed in one season. However, after brief discussion, it was decided staff's suggested phasing would remain, particularly in view of the fact that the applicant will be constructing the golf course himself and staff's recommendations were based on what they felt "he could do." Ms. Diehl stated she could not support the motion for approval for the following reasons: --Topography does not lend itself to this type of proposal; --Great erosion potential; --Heavy use of fertilizers will be necessary to insure that ground cover is stable and this will cause a lot of nutrient runoff. --Golf course is incompatible with campground with young children in close proximity. --Increased traffic generation. July 7, 1987 Page 5 Mr. Wilkerson addressed Ms. Diehl's concern about the close proximity of the driving range to the trail where campers would be walking by explaining that the range was far enough away (1,000 feet) so that a ball could not possibly be hit onto the trail. There was a brief discussion about the trip generation figure (300 vtpd). Mr. Benish stated that figure represented the expected traffic just from the golf course, and did not take into consideration what percentage of those 300 trips were campers already at the campground or general public. He stated that it was difficult to predict exactly and it was possible the figure could be slightly less or slightly more. Mr. Stark indicated he understood Ms. Diehl's concerns, but he pointed out that this type of topography adds to the attractiveness of the golf course and the course will be a nice addition to that section of the county. Ms. Diehl pointed out that she would not be so concerned about erosion if the property were not located within the watershed. Mr. Wilkerson expressed concern about the potential length of the construction process and the increased possibility of erosion problems because of the lengthy time frame. Mr. Michel stated he felt staff's condition No. 3 was an attempt to address this issue. Mr. Benish confirmed that this issue could be addressed further with the site plan. He added, "This is our best attempt at trying to address the concerns with this particular use on this site, but it's a gross attempt until we get into further engineering detail. We can address those issues at a site plan review much better. It's possible an amendment to these conditions may be necessary." Mr. Benish pointed out that the proposal will be subject to all sedimentation and erosion control ordinances and runoff control ordinances so the applicant will be required to "bond for those improvements and maintain them while he is constructing the site." Mr. Cogan stated there was probably more control over a project such as this than there would be with an agricultural activity that could be done by right. In an attempt to address the concerns of the Commission, Mr. Keeler suggested the following change in condition No. 3: "The amount of grading to occur on site shall be limited by the Planning Commission at time of site plan approval. Such limitation may also include stabilization measures over the winter months. Further grading will not be permitted until these areas are stabilized to the reasonable satisfaction of the County Engineer." Mr. Keeler pointed out that it was staff's intent to come up with reasonable phasing for the project, but not to "drag the process out." Mr. Michel stated he would be agreeable to the addition of Mr. Keeler's suggestion that stabilization measures be taken over the winter months but not to the rest of Mr. Keeler's suggested amendment of condition No. 3. July 7, 1987 Page 6 Mr. Cogan pointed out that condition No. 3 could be changed if the site plan calls for it to be changed. However, Mr. Keeler stated, "I'm not sure you could make it any more liberal if it's a condition on the special use permit." Mr. Payne confirmed that it could not be made more liberal. Mr. Michel amended his previous motion for approval by the amendment of condition of No. 3 as follows: 3. The amount of grading to occur on site shall be limited to three (3) holes at any one time. Such limitation may also include stabilization measures over the winter months. Further grading will not be permitted until constructed holes are stabilized to the satisfaction of the County Engineer. Mr. Bowerman, who had seconded the motion for approval, agreed to this amendment to condition No. 3. The previously stated motion for approval passed, 6:1, with Commissioner Diehl casting the dissenting vote. The matter was to be heard by the Board on July 15, 1987. Colonnade Associates/Albemarle Bank & Trust Site Plan - Request for Administrative approval of site plan. Mr. Keeler explained that when the Commission had approved a special use permit r.. for a drive-in window a couple of months previous, it had inadvertantly failed to formally act on the applicant's request for administrative approval of the site plan though the issue had been discussed. He stated it was a straight -forward plan and requested staff be granted administrative approval of the site plan. Mr. Stark moved that staff be granted administrative approval of the site plan for Colonnade Associates/Albemarle Bank & Trust. Mr. Wilkerson seconded the motion which passed unanimously. Administrative Approval of Site Plans - Mr. Keeler reported that hereafter he will require his staff to include as a condition of approval on preliminary site plans a condition which states "Staff approval of final site plan" on those plans which staff feels will allow administrative approval.
