HomeMy WebLinkAbout10 13 87 PC MinutesM October 13, 1987 The Albemarle County Planning Commission held a public hearing on Tuesday, October 13, 1987, Meeting Room 5-6, County Office Building, Charlottesville, Virginia. Those members present were: Mr. Richard Gould, Vice Chairman; Mr. Harry Wilkerson; Ms. Norma Diehl; Mr. David Bowerman; and Mr. Tim Michel. Other officials present were: Mr. Ronald Keeler, Chief of Planning; Mr. David Benish, Planner; Mr. John Pullen, Planner; Ms. Laura Hill and Ms. Amelia Patterson, Planners, and Mr. George St. John, County Attorney. Absent: Commissioners Cogan and Stark. The Chairman called the meeting to order at 7:30 p.m. and established that a quorum was present. The minutes of September 29 were approved as submitted. SP-87-76 Ricky & Lucille Ayers - Request in accordance with Sections 5.6 and 10.2.2(10) of the Albemarle County Zoning Ordinance to locate a single wide mobile home on property described as Tax Map 103, Parcel 2F. Property, located on the east side of Rt. 795, t 1.4 miles south of its intersection with Rt. 620. Scottsville Magisterial District. Mr. Pullen gave the staff report. The report stated that two special permits had been granted previously for mobile homes on this site, but neither request was pursued. The report also stated that one objection had been filed against the application from an adjacent property owner who was concerned about drainfields from this property draining onto his property. In response to Mr. Gould's question, Mr. Pullen stated the two previous special permits had been approved in 1983 and in April, 1987 and there had been no objections to those applications. In response to Ms. Diehl's question, Mr. Pullen stated Health Department approval had not been granted for the previous requests because neither had been pursued. Mr. Gould asked Mr. Pullen if he was aware of the proposed location of the drainfield and whether or not it would be draining in the same direction as the existing drainfield which is currently seeping onto an adjacent owner's property. Mr. Pullen responded negatively. He added that the property owner who objected resides at the bottom of a hill and drainfields from property located above his property are currently causing a problem. The objecting property owner was concerned about one more drainfield being added which would exacerbate his problem. Ms. Diehl questioned why no sketch depicting the location of the trailer on the site had been submitted. Mr. Pullen confirmed that the applicant intends to reside in the mobile home. The Chairman invited applicant comment. /4 October 13, 1987 Page 2 Mr. Ayers addressed the Commission. He stated he did not feel placing his mobile home on this site would create more drainage onto the objecting owner's property. He stated the drainage problem referred to had been in existence for several years. Mr. Keeler added that there appears to be an existing drainage problem in the area and the exact cause is uncertain, i.e. it is uncertain as to whether the drainage comes from drainfields or the state road. He stated that if it was the Commission's desire he would request that the County Engineer's Office review the problem. There being no public comment, the matter was placed before the Commission. Mr. Gould stated he felt staff's suggested conditions of approval addressed the issue because if Health Department approval could not be obtained for the drainfield, the proposal could not go forward. Mr. Michel agreed and moved that SP-87-76 for Ricky & Lucille Ayers be recommended to the Board of Supervisors for approval subject to the following conditions: 1. Health Department approval prior to moving mobile home onto property; 2. Compliance with Section 5.6.2 of the Zoning Ordinance. Ms. Diehl seconded the motion. She also asked if condition No. 2 included a requirement for a sketch showing the location of the mobile home on the property. Mr. Keeler indicated that Ms. Diehl's concern was covered in condition No. 2. Ms. Diehl stressed that she felt such a sketch should accompany such proposals, for the benefit of the Commission's review. Mr. Bowerman stated he was still uncertain as to whether or not such a sketch was required or whether it was optional. He suggested that staff work with the applicant to insure that such a sketch was available at the time of Board review. The motion for approval passed unanimously. The proposal was to be heard by the Board of Supervisors on October 21, 1987. J. Sobel/L. Martin Preliminary Subdivision Plat - Proposal to create 3 lots on a ±40 acre parcel. The plat proposes future residential use. The average lot size is ±13 acres, with lots ranging from 5.0 to 21.0 acres. The property is located on the west side of State Route 676 in the Ivy area, approximately one mile north of State Route 250. Zoned RA, Rural Areas. Tax Map 57, Parcel 75. Samuel Miller Magisterial District. Mr. Pullen gave the staff report. Staff recommended approval subject to conditions. October 13, 1987 Page 3 on Mr. Pullen confirmed that minimum sight distance can be obtained in both directions. The applicant was represented by Mr.Sobel who offered no additional comment. There being no public comment, the matter was placed before the Commission. Mr. Gould stated he felt the proposal was in order. Mr. Bowerman asked staff what physical constraints existed on the highway which limit the speed to 30 mph, thus requiring only 300 feet of sight distance. Mr. Pullen explained that the road is curvy and winding. Ms. Diehl moved that J. Sobel/L. Martin Preliminary Subdivision Plat be approved subject to the following conditions: 1. The final plat will not be signed until the following conditions have been met: a) County Engineer approval of private road and drainage plans and calculations; b) Virginia Department of Transportation issuance of private street commercial entrance permit; c) Issuance of an erosion control permit, if deemed necessary; d) Planning staff approval of technical notes on the plat; e) County Attorney approval of private road maintenance agreement; f) 25 feet of right-of-way be dedicated from the center line of the State Road 676. 2. The final plat may be administratively approved. Mr. Bowerman seconded the motion which passed unanimously. Peacock Hill Section 6, Final Plat - Proposal to create 24 lots from 20.43 acres (with 33.5 acres of residue) for an average lot size of .85 acre (37,073 square feet). Proposed roads for this phase of develop- ment are to be private roads. The lots are to be served by individual septic fields and a central water system. Property, located northwest of the intersection of I-64 and Rt. 708. Tax Map 73, a portion of Parcel 29. Samuel Miller Magisterial District. Zoned PUD, Planned Unit Development. Ms. Patterson gave the staff report. Staff recommended approval subject to conditions. /.2 October 13, 1987 Page 4 Referring to condition l(c)--Health Department approval of delineation on each lot of approved septic areas, and notation restricting disturbance of these areas --Mr. Gould asked if this had ever been done before. Ms. Patterson replied that there have been similar cases in the past where staff has felt that it should have been done and problems resulted because it was not done. She could recall only one case (South Fork Farms) where septic areas had been required to be delineated on the final plat. Mr. Gould asked how this could be enforced. Ms. Patterson explained that because of the fact that it will appear on the final survey the homeowner and contractor will be more aware of the situation. The Chairman invited applicant comment. The applicant was represented by Mr. Bill Roudabush. He explained that the applicant has been working with staff for some time on the phasing of this development and all of the conditions of approval are a continuing part of the original approval. He stated the the applicant has no objections to the suggested conditions of approval. There being no public comment, the matter was placed before the Commission. Mr. Gould stated the proposal appeared to be in order. Mr. Wilkerson moved that Peacock Hill, Section 6, Final Plat, be app_oved subject to the following conditions: 1. The final plat will not be signed until the following conditions law have been met: a. Peacock Drive to be upgraded in accordance with the Virginia Department of Transportation letter of October 22, 1986; b. Virginia Department of Transportation approval of improvements necessary at the intersection of Turkey Ridge Road and Peacock Drive; which may include sight distance and signage; C. Health Department approval of delineation on each lot of approved septic areas, and notation restricting disturbance of these areas; d. County Attorney approval of homeowner documents; e. Issuance of an erosion control permit; f. Issuance of a runoff control permit, if required; g. County Engineer approval of road and drainage plans and calcu- lations; h. Compliance with conditions of ZMA-85-22 as they relate to this section. 2. The final plat may be administratively approved. Mr. Michel seconded the motion which passed unanimously. R /3 October 13, 1987 Page 5 Raintree, Phase VI Final Plat - Proposal to create 10 lots from 4.07 acres for an average lot size of 13,924 square feet. The property is located off of Old Brook Road adjacent to Phase V of the Raintree Development. Zoned R-2 (cluster development approved for 2.2 dwelling units per acre). Tax Map 61, Parcel 126. Charlottesville Magisterial District. Mr. Benish gave the staff report. Staff recommended approval subject to conditions. The Chairman invited applicant comment. The applicant was represented by Mr. Bill Roudabush who explained that this was an extension of a previously -approved plan and was almost 100% consistent with the preliminary plan. He explained that the stormwater detention area would serve phases 5, 6 and a portion of 7. He also stated that detention measures would probably result in some improved downstream drainage conditions. Mr. Bowerman asked Mr. Roudabush to explain how this phase would relate to the preliminary. He was unclear as to how the cul-de-sac would work. Mr. Benish pointed out that there are fewer lots. Mr. Roudabush explained that lots 45 - 50 have already been plated and will have a temporary turn -around. He stated that the road plans have been designed in such a way as to allow the sections to "plug" into each other as they come in. There being no public comment, the matter was placed before the Commission. Mr. Michel stated the proposal was in order and moved that Raintree, Phase VI, Final Plat be approved subject to the following conditions: 1. The final plat will not be signed until the following conditions are met: a. County Engineer approval of road and drainage plans and calcu- lations; b. County Engineer approval of stormwater detention plans and calculations; C. Issuance of an erosion control permit; d. Virginia Department of Transportation approval of road and drainage plans and calculations; e. Albemarle County Service Authority approval of final water and sewer plans; f. County Attorney approval of homeowners documents; g. Planning staff approval of lot enumeration. Mr. Wilkerson seconded the motion which passed unanimously. October 13, 1987 Page 6 Miscellaneous Mr. Gould advised the Commission that the League of Women Voters has requested t i m e on the October 27 agenda to discuss septic system regulations. The Commission asked staff to study the issue of possibly amending the County Scenic Road regulations to allow existing, residential dwellings to add"attached" additions to their dwellings without requiring a hearing before the Board of Zoning Appeals.
