The Albemarle County Planning Commission held a public hearing on Tuesday,
January 23, 1996, Meeting Room 7, County Office Building, Charlottesville, Virginia.
Those members present were: Mr. Bill Nitchmann, Chair; Mr. Bruce Dotson, Vice
Chair; Ms. Babs Huckle; Mr. David Tice; and Mr. William Finley. Other officials
present were: Ms. MaryJoy Scala, Senior Planner; Mr. Wayne Cilimberg, Director of
Planning and Community Development; Ms. Claudia Paine, Senior Planner; and Mr.
Greg Kamptner, Assistant County Attorney.
The meeting was called to order at 7:00 p.m. and a quorum was established. The
minutes of December 19, 1995, were unanimously approved as amended.

Review of the Ivy Creek Agricultural/Forestal District - Consisting of 522.86 acres,
located on both sides of Rt. 676, East of Rt. 660, West of Rt. 743, and also a portion
located at the end of Rt. 657.
Ms. Paine presented the staff report. Both staff and the Advisory Committee
recommended continuation of the District for a period of seven years.
Mr. Dotson noted that there are a number of small parcels in this District. He asked
staff to comment on the effect which belonging to an agricultural/forestal district has
on small parcels. Ms. Paine said the small parcels join in the commitment to preserve
the rural and ag/forestal areas. More specifically, State condemnation is more difficult
for parcels which are in an ag/forestal district.
Mr. Dotson asked if the five -acre parcel would have further division rights if it were
not in an a-f district. Ms. Scala replied: "When it is in an a-f district, if it has division
rights, it can possibly be divided, but only for a family division. You give up the right
to use your small lots while in the a-f district for non -family divisions."
Mr. Finley noted that there are only 6 dwellings in the district, but a lot of parcels. He
asked if those parcels can still be developed. Ms. Scala replied: They could still
build on an existing parcel and they could sell, for instance, one of the five -acre
parcels to anyone and they could build on it. It's just that you cannot subdivide the
smaller parcels for non -family members. But if you wanted to sell the entire parcel as
it exists, for a house site, you could do that."
No public comment was offered. The matter was placed before the Commission.

MOTION: Ms. Huckle moved that the Commission recommend the approval of the re-
establishment of the Ivy Creek Agricultural/Forestal District for a period of 7 years.
Mr. Dotson seconded the motion. The motion passed unanimously.
Historic Architectural Survey of Albemarle County Virginia
Ms. Scala presented final report findings of a survey of twelve Albemarle County
villages: Advance Mills, Batesville, Covesville, Crozet, Crossroads/North Garden, Free
Union, Greenwood, Ivy, Milton, Proffit, White Hall, and Yancey Mills. Staffs report
included a slide presentation of many historic resources within the villages. A copy of
the extensive report was distributed to Commissioners. No action was required of the
Commission.
Committee Memberships
Mr. Dotson expressed a desire to continue on the CATS and Fiscal Impact
committees.
**W Ms. Huckle agreed to continue participation on the RATS and Bypass committees.
Mr. Nitchmann said he would replace Mr. Blue on those committees on which the
Chairman has traditionally served. Mr. Nitchmann said he would also serve on the
Fiscal Impact Committee.
Appointment to the following committees will be made after a full Commission has
been appointed: Mountaintop Protection, Historic Preservation and CIP Technical.
Miscellaneous
Ms. Huckle said Mr. Cilimberg has agreed to report, at some future time, on
information gathered related to groundwater availability on rural lots. Mr. Cilimberg
said the presentation would probably be tied in with the next segment of the Comp
Plan review.
