FEBRUARY 6, 1996
The Albemarle County Planning Commission held a public hearing on Tuesday,
February 6, 1996, Meeting Room 7, County Office Building, Charlottesville, Virginia.
Those members present were: Mr. Bill Nitchmann, Chair; Mr. Bruce Dotson, Vice
Chair; Ms. Babs Huckle; Mr. David Tice; and Mr. William Finley. Other officials present
were: Mr. Wayne Cilimberg, Director of Planning and Community Development; Mr.
Ron Keeler, Chief of Planning; Mr. Ron Lilley, Senior Planner; Ms. Cari Fesquet,
Planner; Mr. Pete Anderson, UVA Representative; and Mr. Greg Kamptner, Assistant
County Attorney.
The meeting was called to order at 7:00 p.m. and a quorum was established. The
minutes of January 16, 1996, were unanimously approved as amended.
ZMA-95-24 Forest Lakes Associates (Item #1) - Petition to amend the proffers of
ZMA 94-04 to modify the type of fencing provided. Property, described as Tax Map
46133, Parcel 1 and Tax Map 32, Parcel 29F, is zoned R-10, Residential and is located
at the northern end of Timberwood Parkway in the Rivanna Magisterial District. This
site is recommended for High Density Residential (10.01-34 dwelling units per acre)
and Neighborhood Service in the Community of Hollymead.
Staff requested deferral to February 20, 1996 due to an advertising error.
MOTION: Mr. Dotson moved, Mr. Tice seconded, that ZMA-95-24 be deferred to
February 20, 1996. The motion passed unanimously.
ZMA-94-12 River Heights - Petition to rezone approximately 29 acres from Rural Area
to LI, Light Industrial (proffered). Property, described as a portion of Tax Map 32,
parcels 5 (part of) and 5C (part of) and Tax Map 33, Parcel 14 (part of), is located on
the east side of Route 29 approximately 0.5 miles north of the North Fork Rivanna River
in the Rivanna Magisterial District. This site is recommended for Industrial Service in
the Village of Piney Mountain. DEFERRED FROM JANUARY 9, 1996.
The applicant requested deferral to March 5, 1996 to address transportation issues.
MOTION: Mr. Dotson moved, Ms.Huckle seconded, that ZMA-94-12 for River Heights
be deferred to March 5, 1996. The motion passed unanimously. [NOTE: Later in the
meeting Mr. Cilimberg said the applicant had just informed him of a request that the
deferral be to March 12th. Mr. Dotson and Ms.Huckle agreed to amend the motion and
the item was unanimously deferred to March 12, 1996.]

ZMA-95-19 Mill Creek Industrial Land Trust - Petition to rezone approximately 23.6
acres from LI, Light Industry to PUD, Planned Unit Development. (This land is
proposed to be added to the existing Mill Creek PUD and designated for Industrial and
Commercial use.). Property, described as Tax Map 76M1, Parcels 11, 12, 13, 14, 15,
17, 18, and 20, is located on the north side of the Southern Parkway approximately 500
feet west side of Route 742 (Avon Street) in the Scottsville Magisterial District. This site
is recommended for Industrial Service in Neighborhood 4. DEFERRED FROM
JANUARY 9, 1996.
Mr. Keeler presented the staff report. Staff recommended modification of the floor area
limitation and offered suggested changes to the agreements of ZMA-94-25 to reflect
said modification.
The applicant was represented by Ms. Andrea Craig. She stressed the day care facility
which is planned will meet the needs of the community.
No public comment was offered. The matter was placed before the Commission.
Mr. Dotson said: "Staff has characterized the industrial change as housekeeping, and
the other as a relocation of what was already the concept of day care. So it seems to
me that their recommendation is sound."
Mr. Nitchmann said he thought a day care facility will be an excellent addition to this
neighborhood.
MOTION: Ms. Huckle moved, Mr. Dotson seconded, that ZMA-95-19 for Mill Creek
Industrial Land Trust be recommended to the Board of Supervisors for approval as
presented by staff. The motion passed unanimously.
ZMA-95-22 J. Bruce Barnes, Inc. (Items #44, 45, 46, 47 & 48) - Petition to rezone
approximately 19 acres from C-1, Commercial to HI, Heavy Industry, with proffers.
Property, described as Tax Map 56, Parcel 58 and Tax Map 56A2, the C & O Railway
and is the current location of J. Bruce Barnes Lumber. This site is located in the White
Hall Magisterial District and is presently recommended for Community Service in the
Community of Crozet.
Mr. Lilley presented the staff report. Staff recommended approval subject to
acceptance of the applicant's proffers.
Mr. Lilley reported the Architectural Review Board reviewed this proposal on February
5th and unanimously supported the rezoning.

Ms. Huckle asked if there will be any type of buffer or landscaping between this
property and adjacent residential property. Mr. Lilley explained that the applicant "is
very interested in maintaining" the existing tree line, though that is not addressed
through a proffer. He pointed out that a 100-foot setback must be maintained with any
new structures.
In response to Mr. Finley's question about the proffer, Mr. Lilley confirmed that the
applicant's proffer will limit any future use of the property to those uses which are listed
in the proffer.
The applicant was represented by Mr. Carroll Conley, owner of the Bruce Barnes, Inc.
He gave a brief history and description of the business. He stressed the importance of
this business to the Crozet Community. He was unaware of any opposition to the
proposal.
Ms. Huckle asked Mr. Conley questions about his wood preserving process. Mr.
Conley explained he uses a non -chemical, kiln drying process.
In response to Mr. Finley's question, Mr. Conley said the burning of the sawdust causes
no pollution problems.
Ms. Huckle expressed concern about the possibility the proffer could, in the event the
operation is sold at some future time, allow a chemical wood preserving process. She
asked if "wood preserving operations" could be removed from the proffer as an allowed
use. Mr. Cilimberg said the applicant would have to agree to an amendment to his
proffer as suggested by Ms. Huckle. Mr. Kamptner added: "If the applicant was to
volunteer limiting the wood preserving portion of subsection 16 to non -chemical wood
preserving processes --that could be volunteered." Mr. Conley assured the Commission
he had no plans to ever use a chemical process.
Mr. Kamptner said the applicant could volunteer a second proffer which would clarify
the "wood preserving operations" language in subsection 16 which would make it clear
"for purposes here that wood preserving operations includes non -chemical wood drying
processes."
Mr. Dotson thought it was Ms. Huckle's intent that "wood preserving operations" not
include any type of preservation process except a non -chemical drying process. Ms.
Huckle confirmed the accuracy of Mr. Dotson's statement.
Mr. Cilimberg stressed the applicant would have to agree. Mr. Conley responded: "I've
got no problem with agreeing that we will never do what I call treating or wood
preserving soft woods or pines. That's not our ball game. We would not even know
where to start."

*OW Mr. Cilimberg said if the applicant is agreeable to the intent expressed by Ms. Huckle,
he will need to submit an additional proffer prior to the Board of Supervisors hearing.
Mr Finley said he would have a problem supporting the additional proffer as suggested
without more information. He said: "They may be able to do it with no problem .... but if
they can't do it without any type of problem,... I don't know."
Mr. Nitchmann said he thought the main issue is one of the need to clarify the definition
of "preserve." He thought this could be addressed by staff and the applicant prior to the
Board hearing.
Public comment was invited.
Mr. Tom Loach, a Crozet resident, addressed the Commission and offered his strong
support for the proposal. He praised the applicant and Barnes Lumber's contribution to
the community.
There being no further comment the matter was placed before the Commission.
Ms. Huckle expressed support for the proposal.
Mr. Finley said he had visited the operation and had been very impressed. He said the
business has existed for many years and is a cleaner operation today than it has ever
been.
Mr. Nitchmann agreed.
MOTION: Ms. Huckle moved that ZMA-95-22 for J. Barnes, Inc. be recommended to
the Board of Supervisors for approval, subject to acceptance of the applicant's proffer
and with the expectation that a second proffer addressing the limitations of the wood
preservation process will be offered prior to Board review. Mr. Dotson seconded the
motion.
The motion passed unanimously.
Mitchell Matthews Office Building - Request for critical slope waiver.
(Property located just west of the Rt. 29 Business intersection with Fontaine Avenue,
directly across from entrance to Buckingham Circle.)
Ms. Fesquet gave a brief staff report and described the proposed structure as a 2-level
architect's office with basement parking accommodations for employees. Staff
w,,,, recommended approval of the request to allow encroachment into 25% critical slope

area. The Engineering Department recommended approval of the request. No
construction will occur within the floodplain, with the possible exception of utility
hookups. Mr. Keeler said the applicant had attempted to obtain additional land which
would have eliminated the need to build in critical slope areas. However, VDOT had
not been willing to sell the additional land.
Mr. Tice asked if a stormwater detention plan has been presented. Ms. Fesquet said
stormwater will be addressed by the Engineering Department.
Neither applicant nor public comment was offered. [NOTE: The applicant was not
represented.]
Mr. Dotson said it appeared, given the topography of the site, that it would not be
developable without this waiver. He asked Mr. Anderson if he thought the proposal
seemed reasonable. Mr. Anderson responded: "On the face of the drawings, it seems
sound. I have not seen the site personally."
Mr. Dotson said this seemed like a good infill project and without approval of this
request the site could not be developed. He said: "It seems to me this is the kind of
thing we are going to need to entertain on some difficult sites as we get more into
developing some of those sites that have been put on the back burner. I feel
comfortable with it."
MOTION: Mr. Dotson moved, Mr. Finley seconded, that the request for a critical slope
waiver for the Mitchell Matthews Office Building be approved. The motion passed
unanimously.
There being no further business, the meeting adjourned at 8:00 p.m.
