HomeMy WebLinkAbout07 02 1996 PC MinutesM JULY 2, 1996 The Albemarle County Planning Commission held a public hearing on Tuesday, July 2, 1996, Meeting Room 7, County Office Building, Charlottesville, Virginia. Those members present were: Mr. Bruce Dotson, Vice Chair; Mr. David Tice; Mr. Jared Loewenstein; and Mr. William Finley. Other officials present were: Mr. Wayne Cilimberg, Director of Planning and Community Development; Mr. John Shepherd, Planner; Mr. Greg Kamptner, Assistant County Attorney; and Mr. Pete Anderson, UVA Representative. Absent: Commissioners Huckle, Nitchmann and Washington. Mr. Dotson called the meeting to order at 7:00 p.m. and established that a quorum was present. The minutes of the June 11, 1996 meeting were approved (3:0:1) as submitted. Mr. Dotson abstained from the action on the minutes because he had not been present at the June 11th meeting. Mr. Cilimberg summarized actions taken at the June 19th Board of Supervisors meeting. CONSENT AGENDA SDP-96-042 Emergency Communications Center Preliminary Site Plan - Modification of Sections 4.12.6.2 (to allow one-way circulation) and 4.12.6.5c (to allow angled parking). Note: Staff corrected the wording of the condition proposed for this item as follows: "Redesign of the parking spaces such that angled parking shall provide a 9 x 18 foot parking space with an angle to the aisle of 50 degrees or less and the aisle shall be at least 16 feet wide where one-way circulation is used." MOTION: Mr. Finley moved that the Consent Agenda be approved. Mr. Tice seconded the motion. The motion passed unanimously. SUB-96-034 Raintree Phase 9 Preliminary Plat - Proposal to subdivide 1.32 acres into 4 lots averaging 0.33 acres. Property, described as Tax Map 61, Parcel 125E, is located on the West side of Old Brook Road approximately 100 feet North of Ramblewood Place. The property is zoned R-2, Residential in the Rio Magisterial District. Lots shall be served by public water and sewer. This application is accompanied by a request for waiver of Section 4.2 of the Zoning Ordinance to allow for clearing and grading on critical slopes. Mr. Shepherd presented the staff report. Staff recommended approval of the ., subdivision plat, subject to conditions, and approval of the waiver request. 197 In reference to condition No. 2, Mr. Tice asked if staff would require a certain size white pine and would there be any requirement for maintenance of the plantings. Mr. Shepherd said staff had not addressed that issue. Mr. Cilimberg said, in the past, conditions have been placed on site plans which require the replacement of plantings which die. He said the Site Plan Ordinance does address the issue of size of plantings. At Mr. Tice's suggestion, it was decided condition No. 2 would be amended to read: "Plant or bond 15 white pine trees, 4-5 feet in height, along the southwest side of Lot 74 prior to approval of final plat. Any trees that die within 12 months of planting shall be replaced." Staff confirmed the proposal is consistent with the Zoning Ordinance and that the landscaping issue raised by Mr. Tice is not a zoning matter. Regarding the movement of dirt which had occurred "outside the purview of the permit", Mr. Shepherd confirmed that the mound of dirt which is currently grassed over is what was moved previously. The earth movement which took place later "is another matter" and has now been stabilized. Mr. Dotson asked if the applicant had gained any advantage by proceeding with the work and not following all the usual requirements or was this just a oversight. Mr. Shepherd: "That is hard to answer. From the County's perspective, we would prefer that a permit be obtained prior to the work taking place." Mr. Dotson asked: "But the %applicant is not now able to do something that he wasn't able to do before?" Mr. """ Shepherd responded: "I don't believe so. And the way the fill was placed --with sound engineering practices-- is the way it would have been done under a permit. So in that regard, I don't feel there was any advantage in the approach that would lessen the stability of the slope or the engineering of it." He said that fact had been an important factor in staffs being able to support this request. The applicant was represented by Mr. Scott Williams. He said the applicant usually plants 4-6 foot trees for tree buffers. He said the placement of the fill had been an oversight on his part and had not been done to gain any type of advantage. Mr. Shepherd confirmed that 4 developable lots had existed on the site prior to the placement of the fill. Mr. Williams expressed no opposition to the change in the wording to condition No. 2 as proposed by Mr. Tice. earlier. Note: Mr. Jack Kelsey was present to represent the County Engineering Department. He was not asked to answer any Commission questions. There being no public comment, the matter was placed before the Commission. MOTION: Mr. Loewenstein moved, Mr. Tice seconded, that the Raintree Phase 9 Preliminary Plat be approved subject to the following conditions and that a wavier of Section 4.2 be granted to allow for clearing and grading on critical slopes: C�� 1. Albemarle Engineering approval of the following conditions associated with the V40W allowance of construction and grading on critical slopes: CM a. The proposed slopes shall be constructed at a grade of 2:1 or flatter. Developer shall be responsible to survey the as -built slopes and submit written confirmation to the Engineering Department for approval. b. The new fill material shall be benched into the existing compacted fill to promote better soil cohesion between the two layers and slope stability. c. The new fill shall be compacted to 95% dry density compaction in accordance with ASTM D-698 specifications. Test results shall be submitted to the Engineering Department for approval. d. Upon completion of the slope construction: grades shall be immediately surveyed and confirmed; and slopes immediately stabilized in accordance with the Virginia Erosion and Sediment Control Handbook. e. Prior to any grading or earth disturbing activity, a revised Erosion and Sediment Control plan must be approved by the Engineering Department. 2. Plant or bond 15 white pine trees, 4-5 feet in height, along the southwest side of Lot 74 prior to approval of final plat. Any trees that die within 12 months of planting shall be replaced. 3. Final Plat approval subject to Albemarle County Engineering approval of all final plat requirements and the following conditions: a. Albemarle County Engineering approval of grading and drainage plans and calculations. b. Virginia Department of Transportation approval of right-of-way improvements and drainage calculations. c. Albemarle County Engineering approval of stormwater detention plans and calculations. 4. Final Plat approval is subject to Albemarle County Service Authority approval. 5. Final Plat approval subject to approval of Albemarle Inspections Department and the Fire -Rescue Division. The motion passed unanimously.
