The County of Albemarle Planning Division will recommend approval of the plat referenced above once the following
comments, and those provided by other Site Review Committee, SRC, members, have been satisfactorily addressed. The
following comments are those that have been identified at this time. Additional comments or conditions may be added or
eliminated based on further review. [Each comment is preceded by the applicable reference to the Albemarle County Code.]
1. [ZMA2004-14, SUB2016- 41] The preserved slopes depicted on Lot 106, Lot 107, Lot 111, and Lot 112 are not
permitted to be disturbed. The preliminary plat did not depict disturbance of these slopes. Provide a note on the final
plat that no grading or disturbance is taking place in these preserved slopes and that each lot has a building site
outside of these areas. Depict the building site for each of these lots. Rev.1: Comment addressed.
2. [14- 302(A)4& 5,14- 311] Revise the lot layout so the existing SWM easement is not located on Lot
101. Rev.1: Comment addressed.
3. [Comment] Verify with County Engineering that the roof drains for each dwelling built on Lots 84- 100 to be
routed to the pond located near the intersection of Sunset Dr. and St. Ives Rd. (Pond #4 on WPO200600066). If
this is the case provide a note to that effect on the cover sheet of the plat. Rev.1: Comment addressed.
4. [Comment] Remove the following note, and merely label and depict the preserved and managed slopes. Rev.1:
Comment addressed.
5. [14- 317] Instrument evidencing maintenance of certain improvements. With the final plat submit an instrument
assuring the perpetual maintenance of the open space areas. County Attorney approval is required prior to final
plat approval. Rev.1: Comment not yet addressed. Please seethe attached template and/or checklist for private
improvement maintenance agreements. Be aware, this instrument or a similar instrument meeting the
requirements of 14-317 will need to be recorded with the plat. Failure to do so will result in a subdivision
violation.
6. [Comment] Prior to final plat approval all SRC reviewers shall approve the plat. All reviewer comments are
attached except ACSA. Once ACSA comments are received we will forward them to you. Rev.1: Comment not fully
addressed. It is unknown whether ACSA has comments on this plat. Comments from ACSAwill be forwarded
upon receipt. Otherwise, there are no outstanding changes requested by other staff or agency reviewers.
7. Rev.1: [ZMA2004-14] Provide information, via an exhibitor other means, to demonstrate where the Briarwood
development is in relation to Proffer #4 of ZMA2004-14, a copy of which is provided below for ease of reference.

Since development of phases associated with this project have not been strictly linear, staff seeks to ensure that
this proffer is being fulfilled since Phase 4 acts as one of the trigger points to evaluate compliance.
'A. The owner shall obtain County approval of recreational facilities to include: one tot lot with Phase 3C
and one tot lot with Phase 113; the dedication of open space with the approval of Phases 4 and 5 for the
passive recreational area which shall include the construction of walking/jogging trails; and, the primary
recreation area south of Camelot shall be built or bonded for its construction prior to final plat approval
of Phase 4. This recreational area shall be built prior to completion of Phase 4 and shall consist of a
baseball/multi-purpose field, two half basketball courts, playgroup equipment and picnic facilities. All
recreation facilities shall be installed by the owner. The walking/jogging trails shall be constructed and
maintained by the owner as a primitive path in accordance with the applicable design and construction
standards in the County's Design Standards Manual:'
In accordance with the provisions of Z.O. 14-229 of the County Code, if the applicant fails to submit a revised plat to address
all of the requirements within six (6) months after the date of this letter, the application shall be deemed to have been
voluntarily withdrawn by the applicant.
