To Whom it May Concern:
In response to your request for a Letter of Zoning Compliance for the above -referenced
Property, please be advised of the following:
The Property is zoned Planned Unit Development (PUD) (See Zoning Map link). Section
20.3.1 of the Zoning Ordinance allows multi -family development as a by -right use. The
Property is subject to the Airport Impact Area ("AIX) and Steep Slopes Overlay Districts
as described in Section 30 of Chapter 18 of the Albemarle County Code ("Zoning
Ordinance"). The Property was rezoned to a planned development community from
Residential (R-1) on May 8, 1972, before the current Zoning Ordinance adopted in 1980,
and given this Planned Unit Development (PUD) classification in the new zoning map of
December 1980. The PUD zoning has remained on the Property since that time.
Development of the Property has occurred per SDP1988-00113 Final, SDP1989-00045
Minor Amendment, and SDP1997-00123 Minor Amendment and is subject to applicable
use, site plan, and water protection ordinance regulations. The Property is improved with
16 multi -family buildings with 144 units, which includes all required parking. All
applicable building height and setbacks are noted on the site plan.
The adjacent properties are as follows: parcels to the Northwest, West, and South are
zoned PUD, parcels to the East are zoned Residential (R-1), parcels to the Northeast
are zoned Planned Residential Development (PRD), and parcels to the North are zoned
Residential (R-4).
To the best of my knowledge, the Property is currently in compliance with all
applicable requirements of the Zoning Ordinance. A review of our files found (i) no
violations or alleged violations or regulations applicable to the Property, whether
pending, contemplated, or having already occurred, (ii) no fees due or pending with
respect to any matter before the County Zoning Office; and (iii) no pending
application for rezoning of the Property or for a special or conditional use permit or
variance in connection with the Property. Further, no proceeding to challenge the
zoning or other governmental approval or use of the Property is pending or overtly
threatened to the best of my knowledge.
If the Property contained physical development approved with a site plan, then in the
event of casualty, the Property may be rebuilt substantially in the same form upon
satisfaction of all required building permits and site plans, as applicable.
