Dear Mr. McCollum
Enclosed please find an application for a Letter of Zoning Compliance in connection with a
proposed multifamily residential project in Stonefield, on Block C2-1. The proposal is for a
residential apartment building containing 112 multi -family dwelling units. Our firm represents
the prospective purchaser of the property. I have attached a draft response letter that
addresses all of the issues that we seek confirmation of, such that I believe it is self-explanatory,
but should you have any questions, please do not hesitate to reach out to me directly. You
provided a similar letter of zoning confirmation, dated October 7, 2020, regarding Block D-1 in
Stonefield. Because most of the land use regulations applicable to this request also apply to
Block D-1, I have attached your previous letter regarding Block D-1 for reference.
I am submitting this application electronically along with the following items

2. Application Fee in the amount of $227.76 (original to be hand -delivered)
3. Copy of the Tax Map as prepared using the County GIS system
4. Proposed form of Letter of Zoning Compliance

1. Approved/Recorded Plat/Plan of the property. Please include a copy of the most recent recorded plat of the property.
2. Sample letter or information needed. Please include the information you are requesting. Letters of Zoning Compliance
may include:
• The applicable Zoning and Overlay Districts of the property
• The permitted uses of the property/whether a specific use is permitted on the property
• Applicable Rezonings/Proffers/Special Use Permits/Conditions/Variances/etc. associated with the property
• Applicable Site Plans
• Applicable Zoning or Building Code Violations. This office does not keep track of fire violations, you can reach the
County of Albemarle —Fire and Rescue at (434) 296-5833
• Other information/forms as requested. (If the letter is for an automobile dealer please include the DMV form)
Letters of Zoning Compliance will be processed within thirty (30) days of receipt of a complete application
Review cannot begin until the application above is complete and all applicable forms and fees are submitted.

In response to your request for a Letter of Zoning Compliance for the above referenced
Property, please be advised of the following:
The Property is zoned Neighborhood Model District per zoning map amendment
ZMA200100007 "Albemarle Place," approved October 22, 2003 with proffers. This
rezoning has been amended several times. The most recent, ZMA201300009, was
approved on November 13, 2013. The applicable Code of Development, Application
Plan, and Proffers associated with the Property were approved alongside these
rezonings. The associated documents including the Code of Development, Proffers, and
Application Plan can be found using the links provided below.
The proposed multifamily residential use is permitted by right under the applicable Code
of Development, Application Plan, and Proffers associated with the Property. The Land
Use Table (Table 1) of the Code of Development establishes the maximum number of
allowable residential units within the designated blocks. [There are 39 remaining
residential units allocated to Blocks A though D. A Special Exception application
(SE202100025) has been submitted to request the transfer of 73 residential units from
Block E to Blocks A through D. The requested Special Exception will be considered by
the Board of Supervisors on September 15, 2021. If approved, SE202100025 will permit
112 new residential units to be built within Block C2-1.] OR [On September 15, 2021, the
Board of Supervisors approved SE202100025, which transferred 73 remaining
residential units from Block E to Blocks A through D. There are now 112 remaining
residential units allocated to Blocks A through D, all of which may be built within Block
C2-I.]
• Section 20A.5.i.5 of the Code of Development provides for a maximum building height of
5 stories within Block C by right. The maximum may be increased by special exception.
[A Special Exception application (SE202100026) has been submitted to request an
increase in the maximum building height to 7 stories for the proposed 112-unit

residential development on Block C2-I. The requested Special Exception will be
considered by the Board of Supervisors on September 15, 2021. If approved,
SE202100026 will permit the proposed 7-story building on Block C2-I.] OR [On
September 15, 2021, the Board of Supervisors approved SE202100026, which permits
the proposed 7-story building on Block C2-I.1
• There are several pending or unsatisfied proffers associated with the Property including
proffers 1(C), 2, 5, 6, 12, and 13. You can view the most recent updated proffers list in
the documents attached below for ZMA201100007 and ZMA201300009.
• There are no building or zoning violations on file associated with the Property.
• Copies of any applicable records maybe obtained via the noted links or from this office
