RE: SUB2021-00102 - HTC Area C Townhomes - Final Subdivision Plat
Below are comments in response to the comment letter dated July 26, 2021. Meridian Planning Group responses are listed in
Black Bold, Shimp Engineering Responses are listed in Blue Bold.
Planning (Andy Reitelbach):
General Comments:
1. The Planner for the Planning Services Division of the Albemarle County Department of Community
Development will recommend approval of the plan referred to above when the following items have been
satisfactorily addressed. (The following comments are those that have been identified at this time.
Additional comments or conditions may be added or eliminated based on further review.)
1. This application consists of two separate plats. A second fee will need to be paid for the second
plat, and an additional application number will be assigned to the second plat.
Comments below are divided among those comments that relate to both plats, those comments that relate
only to the Block III plat, and those comments that relate to only the Block II plat.
Both Plats
2. These plats do not match the final site plan that is currently under review for these same parcels (SDP2020-
00063). The final site plan and the final subdivision plat must be in conformance with one another.
Additional comments may be provided based on the subsequent layout of the site plan, including the need
for additional easements, or the re -subdivision of lots (if the plat is recorded first). Shimp Engineering
Response: Shimp Engineering will be resubmitting the Final Site Plan SDP2020-00063 which will be based
on the attached Final Subdivision Plat. Additionally, we have already submitted the VSMP Plan WP02021-
00041 which is based on the attached Final Subdivision Plat.
3. As attached single-family houses are proposed for this development, a final site plan is required. Shimp
Engineering Response: Shimp Engineering will be resubmitting the Final Site Plan SDP2020-00063 which
will be based on the attached Final Subdivision Plat.
4. Easements proposed to be public need to be labelled as "hereby dedicated to public use." Response: Labels
have been edited.
5. Deeds will be required for easements. Shimp Engineering Response: Deeds are being prepared by the
owner's attorney. We have sent over this latest plat to assist them in deed preparation.
6. HOA documents, such as a declaration of covenants and restrictions, are required, with appropriate
maintenance agreements, identifying the party(ies) responsible for ownership and perpetual maintenance of
private assets or facilities in common ownership, such as the access easements. Shimp Engineering
Response: Deeds are being prepared by the owner's attorney. We have sent over this latest plat to assist
them in deed preparation.
7. Provide the intended ownership of all proposed common areas. Response: Note has been added.
8. Ensure future submittals of the plats have dates of last revision. Response: Last revision date has been
added.
9. Note #12 on each plat needs to be revised. Every proposed parcel must have a building site that complies
with Section 4.2. 1 of the Zoning Ordinance. Response: Note has been edited.
10. Include a note on each plat that the property is not within an ag-forestal district. Response: Note has been
added.
11. The property in each block is not within a water supply watershed. Revise the relevant notes on each plat.
Response: Note has been added.
12. Provide a written note on each plat, or show graphically, the required setbacks for the parcels in each block.
Response: Text has been added to each plat stating these requirements.
13. Provide the following note on each plat: "The streets in this subdivision may not meet the standards for
acceptance into the secondary system of state highways and will not be maintained by the Virginia
Department of Transportation or the County of Albemarle." Response: Note has been added.
Block III Plat
14. On the Block III plat, clarify that Area A is dedicated to the County for public right-of-way. Response: Label
has been edited.
15. The property in Block III is zoned Planned Development -- Mixed Commercial (PDMC), pursuant to ZMA2001-
00020 (not NMD, with ZMA2017-00005). Response: Note has been edited.
16. Identify whether the proposed 30' access easement on the Block III plat is a private street easement or a
private alley easement. Response: Private alley easement has been added to label.
Block II Plat
17. The property in Block II is zoned Planned Development Mixed Commercial (PDMC) (not NMI). Response:
Note has been edited.
18. On the Block II plat, clarify that Area A is dedicated to the County for public right-of-way. Response: Label
has been edited.
19. Lot 40 has no information provided for it. Response: Lot was mislabeled and is not corrected.
20. Private streets have not been approved for this block at this time. Requests for private streets in the
development areas must be submitted to the Community Development Department, with justification, for
staff to analyze and review.
If approved, the labels will need to be changed to "private street right-of-way."
Shimp Engineering Response: Private Street Request was submitted on October 5, 2020 with Final Site
Plan Submittal for SDP2020-00063. This final site plan based on this final plat will be resubmitted shortly.
Identify whether the variable width access easement along Connor Drive on the Block II plat is a private
street easement r a private alley easement or some other type of easement. Response: Private street
easement has been added to label.
21. There is a label for a sanitary sewer easement on Lot 24. However, it does not appear to be identifying or
pointing to anything. Clarify. Response: Label was misplaced and is now corrected.

Albemarle County Engineering Services (John Anderson)
1. 14.302A.8. requires preliminary plats identify the number, approximate dimensions, and area of each
proposed lot, and while this is a final plat, without clear identifying information, future owners or builders
may encroach on proposed storm or ACSA easement/s.
a. Engineering defers to Planning, but:
b. Notes that deck or structure improvements proposed with FSP, SDP202000063, C8, in some cases
graze an easement. If (building site) lots do not appear on the final plat, it is possible construction may
encroach on easements. Shimp Engineering Response: We are coordinating this and will show the
building/boundary/easement locations with the forthcoming Final Site Plan Resubmittal, pending shortly.
If the developer follows the (upcoming, revised) site plan, no encroachment will occur.
2. Please ref. SDP202000063, C8, Lot 10 boundary with TMP32-41K. A sidewalk on TMP32-41K crosses parcel
boundary with Lot 10. If this is the case, Applicant may be required to furnish a sidewalk maintenance
agreement to share maintenance expense between Owner, Lot 10, and Owner, TMP 32-41K. Shimp
Engineering Response: Thank you for bringing this to our attention. The private parking sidewalk for 32-
41K encroaches on Lot 10 & Block III open space. This sidewalk maintenance is solely responsibility of 32-
41K owner, as it only serves that private use. Technically 32-41K owner should seek access/maintenance
easement from the HTC Area C townhomes owner/developer, as this neighbor is encroaching on Block III
property. However, this private matter should be solved outside this subdivision plat. We have alerted the
owner/developer to this issue, and they will handle the matter separately.
3. Please revise Access Easement table to include AE3, AE4. Response: Labels have been added to table.
Albemarle County E911(Elise Kiewra)
This site will require a two (2) new private road names. Per Sec. 7-200-B of the County's Road Naming and Property
Numbering Ordinance (Page 2 of PDF). Shimp Engineering Response: Road Names have been added to the plat.
There are 3 road names for Block II since Road 1 will stub to the adjacent property to the left (southwest) of the
road. See attached image from (upcoming) final site plan resubmittal.
