The Albemarle County eianning Commission held a public hearing on Tuesday,
January 31, 1984, Meeting Room 7, County Office Building, Charlottesville,
Virginia. Those members present were: Mr. Richard Cogan, Vice Chairman;
Mr. Harry Wilkerson; Mr. Tim Michel; Mr. Richard Gould; and Mr. Jim
Skove. Other officials present were: Mr. Ronald Keeler, Chief of Planning;
Ms. MaryJoy Scala, Planner; and Mr. Fred Payne,.Deputy County Attorney.
Absent:Commissioners Bowerman and Diehl and Ms. Pat Cooke, Ex-Officio.
The Chairman called the meeting to order at 7:30 p.m. and established that
a quorum was present.
SP-83-87 Ri_vanna Water and Sewer Authority - Additional information regarding
the Crozet Interceptor.
Mr. Keeler reviewed a memorandum from the Rivanna Water and Sewer Authority
dated January 30, 1984 which was in response to Commission concerns. The
options were discussed briefly. Mr. Cogan asked that a more effective
program be developed for talking with property owners whose property would
be effected.
No action was required of the Commission.
Michael Wholley Preliminary Plat - Located on the north side of Route 637
at the intersection of Route 682. Proposal to create 6 lots ranging in
size from 5.0 to 21 acres served by a private road. County Tax Map 73,
Parcel 17, Samuel Miller District. Deferred from December 20, 1983.
Ms. Scala presented the staff report. Staff recommended approval subject
to the Commission's approval of requested waivers.
The applicant was represented by Mr. Tom Gale. His comments dealt primarily
with the entrance and sight distance issue. Mr. Wholley also commented
very briefly.
The Chairman invited public comment.
Mr. David Booth, the contract purchaser of lots 5 and.6, addressed the
Commission. He urged the Commission to approve a private road because
it would decrease traffic, thereby making the property more appealing.
There being no further public comment, the matter was placed before the
Commission.
Mr. Cogan identified the main issue before the Commission as being the
access to Lot 4. He stated that Lot 3 would enter onto the state road in
any event and since access is already there he felt adding one more dwelling

unit should not create any potential changes or hazard.
�1r. Payne stated he felt this type.of situation was contemplated. He
explained the reason for this ordinance provision as follows: "The idea
is that a private road is advantageous to the developer for a number of
reasons, not the least of which is the cost. ... If you are giving the
developer something, you are going to get something in return. In this
case you are giving him the cheaper front --end costs of the private road
and you are getting in return the lower burden on the public road."
Some hypothetical possibilities were discussed briefly.
Mr. Michel and Mr. Skove stated the7had no'� strong feelings about the
issue. Mr. Michel added that he tended to agree with the applicant.
�1r. Skove moved that the Michael Wholley Preliminary Plat be approved.
subject.to the following conditions and including administrative approval
of the final plat:
1. The final plat will not be signed until the following conditions have
been met:
a. Virginia Department of Highways & Transportation approval of
private street commercial entrance and single private entrance
to.serve lots 3 and 4;
b. County Engineer approval of road and drainage plans and calculations;
c. County Attorney approval of maintenance agreement;
d. dotes on plat: "These six lots have no additional development
rights" and "Only one dwelling per lot."
(It was determined these conditions reflected the granting of a waiver
of Section 18-36(f) and Section 18-34.)
M.r. Michel seconded the motion which passed unanimously.
Jerry Jordon Final Plat - Located on south side of Route 630 and north
of Route 717, near Alberene. Proposal to create 4 parcels ranging in size
from 2.07 to 17.403 acres with private road. County Tax Map 119,
Parcel 51, Scottsville District. Deferred from January 24, 1984.
M.s. Scala presented the staff report.
The applicant, Mr. Jerry Jordon, addressed the Commission. He explained
the reasons for the proposal.
There being no public comment, the matter was placed before the Commission.
Responding to ti1r. Cogan"s question about the application being submitted
before the end.of the year, Mr. Payne stated the new Ordinance applied.

Mr. Skove noted that the plan could be approved by requiring a state
road.
Ms. Scala pointed out that the lines could possibly be adjusted so as to
comply with the present ordinance 5-acre rule, thus making a private
road approvable.
Mr.Cogan noted he had no trouble with allowing lot 3 to enter onto the
public road (requiring a waiver).
Mr. Skove indicated he "could go either way," i.e. requiring a state road
as is, or re -draw the lines making 5-acre lots with a private road.
Ms. Scala suggested the applicant might wish to request deferral.
Mr. Jordan responded affirmatively and requested that the item be
deferred.
Mr. Skove moved that the Jerry Jordan Final Plat be deferred indefinitely.
Mr. Michel seconded the motion which passed unanimously.
Bobby Martin Preliminary Plat - Located on west side of Route 631, just
north of Route 717, near Alberene.. Proposal to create 4 parcels ranging
in size from 2.07 to 17.403 acres with private road. County Tax Map 119,
Parcel 51, Scottsville District.
Ms. Scala presented the staff report.
The applicant was represented by Mr. Tom Gale. He noted that this was
another proposal that was made under the old Ordinance but which now
falls under the new Ordinance. He explained that the property had been
planned with a private road in 1982.
The applicant, Mr. Martin, addressed the Commission. He explained that
he bought the property in 1983 and would never have bought the land and
put in a commercial entrance if he was not going to be able to divide
the property.
There being no public comment the matter was placed before the Commission.
Referring to the existing maintenance agreement between the applicant
and the owner of parcel 4, Mr. Payne cautioned that division of the
property might not be possible using a private road because of the
characteristics of the maintenance agreement.
Both Commissioners Skove and Cogan indicated they could not approve the
proposal as submitted. It was noted that this situation was the same as
in the Jordan Final Plat, i.e. the choices of approval as is with a
state road, or re -draw the lots to make them conform to the five -acre
rule and allow a private road.

Mr. Skove suggested the applicant might wish to ask for deferral.
The applicant confirmed he would prefer that the item be deferred.
Mr. Skove moved that the Bobby Martin Preliminary Plat be indefinitely
deferred.
Mr. Gould seconded the motion which passed unanimously.
Northside Baptist Church Addition Site Plan.- Located on northeast side
of Rio Road, adjacent to Northfields Subdivision. Proposal to add two new
buildings (12,690 square feet total) and parking areas on an existing
church site on 3.33 acres. County Tax Kap 62A1--F--18, Charlottesville
District.
Ms. Scala presented the staff report. Staff identified no major concerns
with the proposal.
The applicant was represented by Mr. Dale Hamilton. He explained the appli-
cant was in agreement with staff's recommended conditions with the
exception of 1(c) requiring a 20' setback from Rt. .631. He explained
that he had met with Mr. Roosevelt of the Highway Department who had
determined that 20 feet would not be needed because of the existence
of solid rock He also objected to the Highway Department's recommendation
that the entrance be upgraded. He felt it was a hardship to ask the
owner to re -grade an entranceway that was already approved in order to
tie into a roadway that might not be built for at least 10 years.
In answer to.Mr. Skove's question, he stated there were no objections to
not placing any improvements in the setback from Rt. 631, though he
restated that he did not think 20' was necessary.
There was a brief discussion about the possibility of decreasing the
20' setback for improvements (condition 1(c)), but since Mr. Hamilton
stated he had no objection, no change was made.
The Chairman invited public comment.
Ms. Joan Graves expressed interest in the status of the septic field.
She asked if it was still in existence and was ever used. Mr. Hamilton
replied that he was not aware of the existence of a septic field.
There being no further public comment, the matter was placed before the
Commission.
There was a brief discussion about screening. Mr. Cogan asked Ms. Scala
to comment on this issue. GIs. Scala explained it was her intent to
visit the site and determine exactly what type of additional screening
will be necessary.
Regarding the use and frequency of use of the Education Building, Mr.
Hamilton explained that it would be used primarily on Sunday mornings
for Sunday School classrooms and would also be used for offices.

It was determined there were no current plans for any type of day -school.
Mr. Michel expressed concern about the intensive use of the site and
asked about the possibility of limiting the use of the Education facility
though he was uncertain how this could be done. There was a brief
discussion about this possibility and Mr. Payne stated he did not
think an additional condition was necessary, particularly the Commission
was uncertain as to exactly how to limit the use.
Referring to an adjacent property owner's concerns about run-off, Mr.
Cogan asked the County Engineer, Mr. Elrod, if that was a problem.
Mr. Elrod responded that the run-off had occurred during construction
of the site.
It was determined condition 1(e) would be, amended to read: "Staff
approval of landscaping and screening."

Mr. Skove moved that the Northside Baptist Church Addition Site Plan
be approved subject to the following conditions:
1. A building permit will not.be issued until the following conditions
have been met:
a. County Engineer approval of stormwater detention plans and com-
putations to control the runoff from all proposed and future
impervious surfaces;
b. Issuance of an erosion control permit;
c. All improvements to be setback 20' from present Rt. 631 right-of-way
to allow for future grading;
d. Fire Officer approval;
e. Staff approval of landscaping and screening.
(Note: The applicant asked that the issue of the entrance be addressed.
Mr. Cogan pointed out that the conditions of approval did not require
any change of the entrance.)
Mr. Gould seconded the motion which passed unanimously.
Pargo's Restaurant and Office Condominium Site - Located on the east side
of Berkmar Drive, ±1/4 mile north of its intersection with Route 29
North. Proposal to locate 6,000 square feet of office space in three
buildings on 31,000 square foot.parcel. County -Tax Map 61U, Parcel
1-7A, Charlottesville District.
Ms. Scala presented the staff.
The applicant was represented by Mr. Mark Osborne. He offered little
comment.
There being no public comment, the matter was placed before the Commission.

There were brief comments about stormwater detention plans, parking
requirements and the square footage of the building.
Mx. Michel moved that the Pargo Restaurant and Office Condominium Site
Plan be approved subject to the following conditions:
1. A building permit will not be issued until the following conditions
have been met:
a. County Engineer approval of stormwater detention and drainage
plans and computations;
b. Erosion control permit;
c. Dedication of drainage easements by recorded plat;
d. Fire Officer approval;
e. Virginia Department of Highways & Transportation approval of
drainage and commercial entrance.
Mr. Skove seconded the motion which passed unanimously.
Berkmar Drive Office Site Plan - Located on the east side of Berkmar Drive,
+1�4 mile north of its intersection with Route 29 North. Proposal to locate
6,000 square feet of office space in three buildings on 31,000 square -foot
parcel. County Tax M-ap 61L, Parcel 1-7A, Charlottesville District.
Ms. Scala presented the staff report.
The applicant was represented by Mr. David Blankenbaker. He offered no
additional comment.
There being no public comment, the matter was placed before the Commission.
The retaining wall was discussed very briefly. Mr. Elrod also explained
the stormwater detention plans. He confirmed he did not expect there to
be a great deal of drainage from this site.
Mr. Skoved moved that the Berkmar Drive Office Site Plan be approved subject
to the following conditions:
1. The building permit will not be issued until.the following conditions
have been met:
a.. Albemarle County Service authority approval of final sewer plans;
b. County Engineer approval of drainage plans and computations;
c. Written approval for grading on adjacent property;
d. County Engineer approval of stormwater detention structure or
off -site contribution;
e. Erosion control permit;
f. Virginia Department of Highways & Transportation approval of
commercial entrance, frontage improvements and drainage;
g. Dedication of additional right-of-way to include drainage items.

Mr. Cogan initiated a discussion about two recent site plans at Boar's
Head. He wanted these to be closely monitored because of two issues:
(1) Decel lane; and (2) Possible traffic light. He noted that
in all the discussions about the decal lane the applicant had never
indicated that an attempt had been made to obtain additional land.
He stated he would be reluctant to oppose the extension of the
decel lane unless the applicant can show there is no possibility of
obtaining additional right-of-way. He also stated he was extremely
comeued about the possibility of a traffic light. He pointed out
the dangerous traffic movements that currently exist in this area.
There being no further business, the meeting adjourned at 10:00 p.m.
