The Albemarle County Planning Commission held a public hearing on Tuesday,
April 10, 1984, Meeting Room 5-6, County Office Building, Charlottesville,
Virginia. Those members present were: Mr. David Bowerman, Chairman; Mr. Richard
Cogan, Vice Chairman; Mr. Tim Michel; Mr. James Skove; Mr. Richard Gould; Mr.
Harry Wilkerson; and Ms. Norma Diehl. Other officials present were: Mr.
Ronald Keeler, Chief of Planning; Mr. Keith Mabe, Chief of Community Devel-
opment; Ms. Joan Davenport, Planner; Mr. Maynard Elrod, County Engineer; and
Mr. Fred Payne, Deputy County Attorney. Absent: Ms. Pat Cooke, Ex-Officio.
The Chairman called the meeting to order at 7:30 p.m. and established that a
quorum was present.
Isotemp Research Building Site Plan - Located on northern side of Boardway
Road (Route 1115); proposal to locate a one-story building for production/
processing, containing 6,000 square feet and 25 parking spaces on .57 acre.
(Tax Map 77, Parcel 40D, part, zoned Ll Light Industry, Scottsville
District)
The applicant was requesting indefinite deferral.
Mr. Skove moved, seconded by Ms. Diehl, that the Isotemp Research Building
Site Plan be indefinitely deferred. The motion passed unanimously.
Garden Court Townhouses Final Plat - Located on the south side of Route 743,
adjacent to Townwood Subdivision. Proposal to create 51 townhouse lots and
common open areas, served by a private road on 4.084 acres. Tax Map 61,
Parcel 13, zoned R-10 Residential, Charlottesville District.
Ms. Davenport gave the staff report. Staff recommended approval subject
to conditions.
Mr. Gould requested a clarification of the bonus application. He asked
if land required to be designated to the Highway Department was still to
be included in the total acreage. Mr. Keeler explained that bonus provisions
are applied "to the lot as it exists at the time of approval --it's applied
to the gross residential area of the lot." He further explained
that the gross density would be 11.9 units/acre and the net density will
be greater than the gross density wherever there exists dedication of right-
of-way.
The Chairman invited applicant comment.
The applicant was represented by Mr. Tom Lincoln. He offered no significant
additional comment.
There being no public comment, the matter was placed before the Commission.

In response to Mr. Skove's question regarding runoff problems, �1r. Elrod
stated that problems which had occurred during construction had been
resolved when the architect changed some of the drainage. designs.
Mr. Skove moved that the Garden Court Townhouses Final Plat be approved subject
to the following conditions:
1. Prior to the signing of any plat, the applicant must obtain the following:
a. Virginia Department of Highways & Transportation approval of
completion of improvements to Rt. 743;
b. Fire Official approval of fireflow, hydrant, dumpster, and handicap
provisions for that phase;
c. Albemarle County Service Authority approval of utility easement plat.
.Easement plat to be recorded concurrently with all phase plats;
d. County Engineer approval of private road provisions, including
bonding;
e. County Engineer approval of on -site stormwater detention facilities
and/or contribution to off -site improvements; including any.necessary
bonding;
f. County Attorney approval of homeowner's maintenance agreement;
g. Staff approval of landscape and recreation plan
i) Bond for all landscaping in common open area, prior to signing
any plat;
ii) Bond for landscaping on individual lots for only the phase being
approved;
iii) The recreation area to be bonded or built when thirty (30)
units or greater are cumulatively approved.
h. County Engineer approval of site improvements necessary for particular
phase of development, including any additional bonds.
Mr. :Michel seconded the motion which passed (6:0:1) with Ms. Diehl abstaining.
ZMA-84-9 First Federal Savings and Loan Association and American Federal
Savings and Loan Association and Four Seasons Condominium Site Plan - Request
to amend Four Seasons PUD, County Tax Map 61X(1), Parcels 4, 4A; County Tax
Map 61X(2), Parcels 4B, 4C, 4D, Charlottesville District. Proposal to locate
96 condominium units on 11.94 acres with average density of 8.04 dwelling
units per acre, zoned Planned Unit Development. Located east of Four Seasons
Drive and north of Foodlake Drive in Four Seasons PUD.
The applicant was requesting deferral to May 1, 1984.
Mr. Michel moved, seconded by Ms. Diehl, that ZMA-84-9 be deferred to May 1,
1984. The motion passed unanimously.
CPA-84-2 - Amendment of "Map 25: Albemarle County Service Authority Project
Areas 1982-2002" of the Comprehensive Plan to bring this map into compliance.
(Planning Commission adopted Resolution of Intent on February 7, 1984.)
Mr. Mabe presented the staff report. The report concluded: Nith the changes
required to bring the service authority project areas into compliance with the

growth areas, staff recommends that Map 25 be amended to reflect this."
There being no public comment, the matter was placed before the Commission.
After a very brief discussion, Mr. Skove moved that CPA-84-2 to amend Map 25:
Albemarle County Service Authority Project Areas 1982-2002" be recommended
to the Board of Supervisors for adoption.
Mr. Cogan seconded the motion which passed unanimously.
CPA-84-3 - Amendment of Comprehensive Plan to include urban drainage
improvements plan. (Board of Supervisors adopted Resolution of Intent on
February 8, 1984.)
(Because there were several residents of the Four Seasons development
present who were interested in this issue, Mr. Bowerman explained the
procedure and stressed that the item before the Commission dealt only with
the detention basin.)
Mr. Mabe presented the staff report.
The Chairman invited comment from Mr. Maynard Elrod, the County Engineer.
Mr. Elrod commented primarily on the project which was of most interest
to the majority of the public present at the meeting, i.e. the Berkeley
Storm Sewer, Phases I and II. He explained that the problem this project
was intended to solve was a channel (as you approach Old Dominion Drive)
which has eroded very deeply. He also made brief comments about the Old
Forge Storm Sewer project, the Woodbrook Channel, and the Berkmar Detention
Basin. He stressed that this hearing was simply to identify the projects
with the intent being that they would someday be funded and implemented.
He stressed that no final designs had been prepared but once the projects
had been funded in the CIP the first step would be to hire consultants.
He made additional comments about the Berkeley project and stated he did
not anticipate that it would cause any noticeable additional runoff.
Mr. Bowerman noted that four of the five Priority II projects dealt with
the Berkeley/Four Seasons area.
The Chairman invited public comment.
Mr. Gregory Johnson, President of the Four Seasons Townhouse Association, read
a lengthy statement which expressed opposition to project 4.21 (Four
Seasons Detention Basin), which included draining the Four Seasons 'Lake.
His statement cited as the primary reason the feeling among Four Seasons'
residents that the lake is a valuable aesthetic amenity, and that it should
be kept as an emergency water supply. (A large number of those members of
the public attending the meeting expressed their support for Mr. Johnson's
comments by applauding.) He concluded by stating that he had met recently
with Mr. Elrod who had "given some assurancd'that the intent, at this point,
by his office, is not to eliminate the lake as is stated in 4.21 of the
Urban Drainage Report. He stated the main objective he hoped to accomplish
"tonight" was to have that proposal reworded "to modify the lake to create
a detention basin."

Ms. Margaret Acock presented a petition containing 275 signatures of Four
Seasons residents. The petition was in opposition to the draining of the
lake.
Mr. Keeler read a letter from the League of Women Voters which made comments
about drainage issues. The League "supported, in general, the report's
third alternative for funding," i.e. general fund appropriations to the CIP
budget.
Ms. Peggy Van Yahres, representing the Charlottesville/Albemarle Board of
the Piedmont Environmental Council, addressed the Commission and expressed
support for most of the concepts in the Urban Drainage Report, in particular,
the concept of regional stormwater detention facilities.
Mr. Tim leher, property ownereffected by project 4.26, Bennington Channel,
expressed concern about this project because it would result in the loss of
the use of most of his backyard. He questioned the proposed size and
suggested changes.
Mr. Ron Manella, tennis pro at Four Seasons, expressed concern about draining
the lake. He explained that the clay courts get water from the lake which
is essential to their maintenance. (The public applauded Mr. Manella's
comments.)
Ms. Ann Cronen suggested that the creek be put underground.
The following residents of Four Seasons expressed their opposition to
draining the lake: Mr. Bob Marl; Mr. Tim Bobbitt; Mr. Walpole; Ms.
Fritzie Williams, Ms. McClintock; Mr. Richard Good; Mr. Gary Rogers; Mr.
Steve West; and Mr. Robert Zack.
GIs. Diane Neher also expressed concern about the Bennington Channel project.
There being no further public comment, the matter was placed before the
Commission.
There followed a discussion.about the possibility of lowering the level of
the lake and its effectiveness in relieving downstream flooding, including
the side effects of such m approach, i.e. steep slopes, decreased water
quality, detriment to animal life, particularly fish, etc.
Mr. Bowerman asked Mr. Elrod: "Do you think that a solution could be worked
out that would be effective from the County's point of view, from your
point of view, for stormwater management, and also provide the residents of
Four Seasons with the amenity that they have become used to?" Mr. Elrod
replied: "The only difference being that the lake wouldn't be as large."
Mr. Elrod confirmed that it was envisioned that the proposed lake would
be about 1/3 as large as.the existing lake.
Mr. Cogan stated he would consider this (i.e. adjusting the lake at Four;.
Seasons to relieve downstream problems) only as a last resort. He did not
think it was "equitable to put the burden of other development onto something
that is already in existence."

Discussion followed which included the issue of cost of the Four Seasons
project and the differences in requirements for different level storms.
Mr. Bowerman pointed out that the issue before the Commission was an
amendment to the Comprehensive Plan, but that the comments received
relating to individual projects would be taken into consideration in
dealing with those projects.
Mr. Elrod indicated he was receptive to a modification of the Four Seasons
Lake rather than draining it.
Mr. Michel indicated he was in favor of that approach.
Mr. Bowerman stated he did not see a consensus that the lake should be
drained.
Mr. Mabe pointed out that the amendment under consideration had the projects
as stated by Mr. Elrod in terms of the lake and the Bennington Channel, etc.
Therefore, in adopting the amendment the Commission would be adopting
projects as in the original Urban Drainage Report. He asked Mr. Payne to
comment as to the accuracy of this assessment.
Mr. Payne stated he felt it would be unwise for the Commission to take
action without having a clear consensus of what was actually being adopted.
He advised the Commission to arrive at a clear consensus of the changes
that should be made to the plan in the event Mr. Elrod determines it is
necessary to change the wording of Mr. Mabe's report. However, Mr. Elrod
pointed out that if we wait until we have firm answers about any of
these projects no progress will ever be made. He felt it was necessary
to adopt some kind of plan even if it has to be changed later. Mr.
Payne stated he was referring more to the feasibility of the concept and
"defining what concept you want to go with."
Mr. Michel suggested that the Commission adopt the plan with the exception
of the two controversial projects (4.21/Four Seasons Detention Basin and
4.26/Bennington Channel) which staff should be authorized to study further.
Mr. Cogan agreed with this suggestion.
Mr. Cogan moved that CPA-84-3 to amend the Comprehensive Plan to include
the urban drainage improvements plan, with the exception that a recommendation
for projects 4.21 and 4.26 is withheld pending further study by the County
Engineer, be recommended to the Board of Supervisors for approval.
Mr. Michel seconded the motion which passed unanimously.
William E. Schuiling (Brown Olds/Honda) - Request for site plan waiver -
Property described as Tax Map 61, Parcel 120L, owned by Patrick and Thyrza
McCauley. Adjacent to rear property line of Brown Oldsmobile and Honda.
Mr. Keeler presented the staff report which stated that staff felt the
expansion could be approved administratively subject to conditions.
- Mr. Bill -Edwards was present to represent the applicant. He offered no
significant additional comment.

The Chairman invited public.comment.
Ms. Joan Graves expressed a lack of understanding of the sewer issue. (Mr. Keeler
responded to Ms. Graves question.)
There being no further public comment, the matter was placed before the
Commission.
Mr. Bowerman stated he had no problem with the request.
Mr. *Michel moved that the William E. Schuiling (Brown Olds/Honda) request for
a site plan waiver be approved.and that staff be granted administrative
approval of the expansion subject to the following conditions:
1. Staff approval of site plan showing: a) proposed storage area, b) no
access to private easement and c) landscaping in accordance with 21.6 of the
Zoning Ordinance.
2. County Engineer approval of stormwater drainage facilities and grading
permit to include appropriate corrective measures to existing storage area.
3. Fire Official approval of fire lanes and additional hydrant, if required.
4. Zoning Administrator approval of customer parking.
3. Albemarle County Service Authority approval of .sewer connection. Sewer
hook-up may be bonded for not more than six months.
6. County Engineer approval of paving specifications.
Hr'. Gould seconded the motion which passed unanimously.
Miscellaneous
'there followed a brief discussion of additional work session dates for the
CIP and a discussion of work projects and tentative work program.
Mr. Mabe led the discussion.
There was a brief discussion on whether or not to consider a study of a stream-
lining process. It was the consensus of the Commission that a study should be
undertaken.
There was a brief discussion about the Crozet Inteceptor and whether or
nor "extemporaneous" connections would be allowed.
There being no further business, the meeting adjourned at 11:00 p.m.
