The Albemarle County Planning Commission held a public hearing on Tuesday,
May 29, 1984, Meeting Room 7, County Office Building, Charlottesville,
Virginia. Those members present were: Mr. Richard Cogan, Vice Chairman;
Mr. Harry Wilkerson; Mr. Jim Skove; Ms. Norma Diehl; Mr. Richard Gould.
Other officials present were: Mr. Ronald Keeler, Chief of Planning; Mr.
Keith Mabe, Chief of Community Development; Mr. lied Payne, Deputy County
Attorney; Mr. Jeff Echols, Highway Department; Ms. Pat Cooke, Ex-Officio.
Absent: Commissioners Bowerman: and Michel.
The Chairman called the meeting to order at 7:30 p.m. and established that
a quorum was present.
SP-84-19 Free Union Country School - Request filed in accordance with Section
10.2.2(5) to locate a.private school.on 2 out of 75 acres, zoned Rural Areas,
Tax Map 29, part of Parcel 15C, White Hall District. Located west side of Rt.
601, ±1/4 mile north of its intersection with Rt. 665, across from Shelter
Builders. Deferred from May 8.
Mr. Keeler gave the staff report. He recalled that the request had been
deferred in order to allow the Highway Department time to do an additional
study in relation to required sigit distance. He stated that it had been
determined that the required sight distance should be increased from 250
feet to 300 feet in both directions. He also stated that it was determined
that a sight distance easement on adjoining properties would not be
necessary. Staff recommended approval subject to conditions.
The applicant was represented by Mr. Hargrave who offered no significant
additional comment.
There being no public comment, the matter was placed before the Commission.
The Chairman invitedcjgrromnfir. Echols, representing the Highway Department.
Mr. Echols addressed the Commission and explained how sight distance could
be achieved in both directions. Ms. Diehl asked him about the possibility
of placing a "School" sign on the highway. Mr. Echols stated he would look
into this but questioned how it could be done since the school was not a
county institution.
Mr. Cogan noted that he had visited the site and presented some photographs
of the road alignment. Ue pointed out that the trees and ,shrubbery shown
in the pictures would be cleared.
Ms. Diehl recalled that some neighbors had been concerned about buffering.
Mr. Cogan felt that would not be a problem. He added that staff would
be able to address that issue at site review.
Mr. Hargrave confirmed he did not anticipate any problems in working with
the Highway Department.

Ms. Diehl moved that 5P-84--19 for tree Union Country School be recommended to
the Board .of Supervisors for approval subject to the following conditions:
1. Planning staff approval of site plan in accordance with recommendations
of the Site Plan Review Committee;
2. If licensure is not required by the State Welfare Department, this approval
shall be construed to include waiver of Section 5.1.6(a) of the Zoning.
Ordinance. All other requirements of Section 5.1.6 shall be met:
3. Permit is issued to Free Union Country School; Incorporated, and is
non-transferrable;
4. Enrollment shall be limited in accordance with recommendations of the Site
Plan Review Committee, provided that enrollment shall, in no case, exceed
thirty-five students;
5. Compliance with the Virginia Department of Welfare's Minimum Standards
for Licensed Child Care Centers.
M.r. Gould seconded the motion which passed unanimously..

CAPITAL IMPROVEMENTS PROGRAM 1984-1989 - Public comment and final review.
Mr. Mabe lead the discussion..
(Public comment was accepted but most of it was inaudible.) Much of the
comment dealt with schools and recreation.
There was a brief discussion about the addition of a project under Education,
i.e. a backstop for Stone Robinson School. It was determined this project
would be included as project No. 34.
It was also decided the Brownsville re -roofing and Maintenance Shop re -roofing
projects would be moved to positions 10 and 11.
-Mr. Wilkerson moved that the Capital Improvements Program for 1984-1989 be
recommended to the Board of Supervisors for approval as follows:
1. Broadus Wood Addition and Remodeling
2. Hydraulic Road Improvements
3. Joint Dispatch Center/911
4. Volunteer Fire Department Advance Allocations
5. County fire Engine
6. Joint Security Complex Sprinkler
7. Comprehensive Refurbishments, Phase I

Mr. Skove seconded the motion which passed unanimously.
James R. Hahn Site Plan Phase 1 - Located south side of Route 649 (Airport
Road), west of Route 29 North. Proposal to locate a commercial/office building
containing 2,196 square feet and 31 parking spaces on 1.6 acres. Tax Map 32,
Parcel 48, zoned Commercial Office, Rivanna Magisterial District.
The applicant was requesting deferral.
Mr. Wilkerson moved, seconded by Mr_ Gould, that the James R. Hahn Site Plan
be indefinitely deferred. The motion passed unanimously.
Mr. Keeler went over upcoming agendas.
Four Seasons Detention Basin and Bennington Woods Subdivision Channel Projects -
Status report by County Engineer.
Mr. Elrod discussed the various possibilities and problems which were being
considered for dealing with the lake at Four Seasons. The possibilities included
draining the lake or building a berm.

Mir. Cogan expressed concern about the possible loss of trees which would result
from the erection of a berm.
yl . Johnson, representing the Four Seasons Homeowners' Association, expressed
some concern about water which would flow down driveways and meet the berm
on the "house side."
Mir. Cogan asked Mr. Elrod to be cognizant of these concerns as the project
proceeds.
Regarding the Bennington Woods Channel, Mr. Elrod stated that there were a lot
of different ideas among the homeowners as to what should be done. He stated
he wanted to make sure that the final design was acceptable to everyone.
Mr. Elrod stated that though he felt this was a serious problem, he did not
feel any houses were in danger.
Mr. Cogan suggested that Mr. Elrod continue to try to arrive at a solution
while being aware of the fact that it .may not be possible to please all the
homeowners.
Mr. Gould moved that a Resolution of Intent to ,amend the.Compr.ehensive Plan
with respect to drainage improvements in the Four Seasons and..Bennington Woods
areas be adopted.
Mr. Wilkerson seconded the motion.which passed unanimously.
-Maintaining Planning Commission Minutes - Mir. Keeler explained that there were
three options in dealing with Commission minutes: (1) Not to attempt to transcribe
them since the law does not require that Commission minutes be transcribed.
(2) An additional full-time secretary added to the Planning staff;.; (He noted
that this has not worked in the past. because office secretaries have numerous
other responsibilities);or (3) An additional part -tine recording secretary
position whose sole responsibility would be toattend meetings and maintain
minutes: (This option was -favored by Mr. Tucker and felt to be the most
effective.) Mir. Keeler pointed out that it took about 5 hours to transcribe
one hour of minutes. Ms. Diehl noted that she felt it was beneficial for the
minutes to be transcribed because they are then available for public review.
Mr. Keeler added that he must often refer to past :minutes. Mr. Payne pointed
out that written minutes are often needed for court cases. Mr. Payne added
that minutes which have been approved by the.Commission stand as an accurate
record of the Commission's proceedings. Mr. Keeler pointed out that it would
be very beneficial for the Board to..receive a copy of Commission minutes
prior to their review of an item which has already been acted upon by the
Commission. M1r. Payne agreed that he felt it would be very helpful for the
Board of be aware of Commission deliberations.
It was the unanimous consensus of the Commission that a part-time recording
secretary be hired.
