The Albemarle County Planning Commission held a public hearing on
Tuesday, January 9, 1990, Meeting Room 7, County Office Building,
Charlottesville, Virginia. Those members present were: Mr. Keith
Rittenhouse, Chairman; Mr. Harry Wilkerson, Vice Chairman; Mr. Tom
Jenkins; Ms. Ellen Andersen; Mr. Tim Michel; and Ms. Babs Huckle.
Other officials present were Mr. Ronald Keeler, Chief of Planning;
Mr. Bill Fritz, Senior Planner; and Mr. George St. John, County Attorney.
Absent: Commissioner Grimm.
The Chairman called the meeting to order at 7: 30 p.m. and established
that a quorum was present.
Indian Hill - Mr. Keeler asked for authorization to approve a private
road IF the applicant can "adequately demonstrate to the Engineering
Department that they qualify for a private road."
Mr. Jenkins moved, seconded by Mr. Wilkerson, that staff be granted
administrative approval of a private road for Indian Hill Final Plat,
IF the Engineering Department determines that a private road is
acceptable. The motion passed unanimously.
Ham R. Myers Waiver Request (SUB-89-218) - The applicant is seeking a
waiver of Section 18-36(f) of the Subdivision Ordinance in order to
allow a lot fronting on a private road to have direct access to Rt.
784. Property, described as Tax Map 47, Parcel 32 is located on the
south side of Rt. 787 near the end of state maintenance in the Rivanna
Magisterial District. Zoned RA, Rural Areas.
Mr. Fritz presented the staff report. Staff recommended approval of
the waiver request. Mr. Keeler noted the following important aspect
of this request: "If you grant the waiver there are not going to be
any more entrances than if you don't grant the waiver. So you're not
looking at a case of an increased number of entrances to the state
road."
The applicant, Mr. Hamilton Myers, was present but offered no additional
comment.
There being no public comment, the matter was placed before the
Commission.
Mr. Wilkerson moved that the Ham R. Myers Waiver Request be granted.
Mr. Michel seconded the motion which passed unanimously.

Forest Lakes Block "0" Preliminary Subdivision Plat (SUB-89-224) - Proposal
to create 16 lots totalling 7.54 acres with an average size of 10,500
square feet. Property, described as 'fax Map 46 Parcels 29 and 29E
(part) is located 500 feet east of the intersection of Cross Timbers
Road and Timberwood Parkway in Forest Lakes development. Zoned R--4
Residential in the Rivanna Magisterial District.
Mr. Fritz presented the staff report. Staff recommended approval subject
to conditions.
There was a brief discussion about the status of Rt. 649. Mr. Wilkerson
asked if there should be a condition requiring the closing of Rt. 649.
Mr. Fritz responded that the road will be closed and that could be
made a condition if the Commission so desired.
Referring to a 25 mph speed standard for road MM, Mr. Rittenhouse asked
if he was correct in his understanding that VDOT would still approve
this preliminary plat based on the existing standards provided it is
submitted before March 31, 1990. fir. Fritz stated that was correct.
Mr. Keeler stressed that the Highway Department rsust have received the
road plans, NOT the County Engineer's Department, by March 31st.
The applicant was represented by Mr. Steve Runkle. He offered no
additional comment.
There being no public comment, the matter was placed before the
Commission.
There was a discussion about whether to add a condition regarding the
closing of Rt. 649. Mr. Runkle pointed out that the road is already
blocked and has been for some time. He added: "We intend to keep it
blocked off." Mr. Keeler added that it had been physically blocked
for some time and staff did not feel an additional condition was necessary.
Mr. Wilkerson moved that Forest Lakes Block "0" Preliminary Subdivision
Plat be approved subject to the following conditions:
1. The final plat will not be signed until the following conditions
have been met:
a. Department of Engineering
calculations;
b. Department of Engineering
and calculations;
c. Department of Engineering
d. Department of Engineering
off -site drainage easement
approval of road and drainage plans and
approval of stormwater detention plans
issuance of an erosion control permit;
approval of all required on -site and
plats.
Mr. Michel seconded the motion which passed unanimously.

Jefferson Pointe Townhomes Preliminary Site Plan - (SDP-89-90) - Proposal
,to construct 25 townhomes on 8.02 acres zoned R-10, Residential with
ZMA-89-15. Property, described as Tax Map 78, Parcel 55A and 55A5 (part)
is located on the north side of U.S. Route 250 in front of Westminster
Canterbury in, -the Rivanna Magisterial District. Proposal is to have
access only over the Westminster Canterbury access road (Pantops.
Mountain Road).
Mr. Fritz presented an amended staff report. Mr. Fritz explained that
because the applicant had "adequately addressed the concerns in the (original)
staff report," staff had changed their original recommendation for denial
to a recommendation for approval subject to conditions.
Ms. Huckle expressed concerns about the tot lots being too close to the
highway. She asked that staff note her concern and see that these play
areas are moved as far away from Rt. 250 as possible. Mr. Fritz noted:
"I see the applicant nodding his head in agreement."
The applicant was represented by Mr. Ron Langman. His comments included
the following: 4
--The applicant plans to do a "superior job" of landscaping along
Rt. 250. (He noted that he had had trouble getting information from VDOT
about the proposed new right-of-way.)
--The plan has been redesigned to pull the houses further -away from
Rt. 250.
--The amount of grading on site has been reduced.
--Green space has been kept in the center of every parking lot.
--Houses will block the view of the parking areas from Rt. 250.
--The sight/sound barrier wall will be of high quality, stained
wood with a hedge planted on each side.
In response to Mr. Rittenhouse's question about maximum elevation, Mr..
Langman stated that moving the units back did not effect the.maximum
elevation limitation of 580 feet.

employed by Mr. Gene Worrell, owner of the property on the southside of
the proposed development. He stated his primary concern was the pre-

There being no further public comment, the ratter was placed before the

Mr. Michel expressed concern about the temporary detention basins for
Phase 1. He asked what was planned for future phases. Mr. Fritz
explained that the applicant would have to satisfy the Runoff Control
Ordinance with each individual phase.
Mr. Rittenhouse reiterated the concerns about the play areas being too
close to Rt. 250 and also about the fence being made as attractive
as possible.
Mr. Wilkerson moved that the Jefferson Pointe Townhomes Preliminary Site
Plan (Phase 1) be approved subject to the following conditions:
1. The final site plan will not be signed until the following conditions
have been met:
a. Department of Engineering approval of drainage plans and
calculations;
b. Department of Engineering approval of paving specifications;
c. Department of Engineering issuance of erosion control permit;
d. Planning Department approval of landscape plan.
Mr. Jenkins seconded the motion which passed unanimously.
Lakeland at Reynovia Final Plat (SUS 89-225) - Proposed to create 33 lots
with an average lot size of 0.4 acres. Proposal is to be served by
internal public roads. Property, is zoned R4, Residential with ZMA
88-11. Property, described as Tax ;Pap 90, Parcel 36 is located on the
west side of Route 742 just south of Mill Creek in the Scottsville
Magisterial District.
Mr. Fritz presented the staff report. Staff recommended approval subject
to conditions.
The applicant was represented by sir. Steve Driver. Referring to condition
No. 2 [Department of Engineering approval of stormwater detention plans
and calcuiations.3, he explained that those plans had been reviewed by the
County Engineer's Office and a contigency for that approval was either
the issuance of an alterations permit for an earth embankment dam or
that none would be required. He explained that an alterations permit
was required and has been sent to the County Engineer to fulfill the
requirement.
The Chairman invited public comment.
Mr. Gary Hollins, representing the Board of Directors of the 2,11il Creek
Homeowners' Association, addressed the Commission. He expressed particular
concern about proposed sites 41 through 46, particularly their
proximity to Mill Creek homes. He was distressed because he explained
he had chosen to live in Mill Creek because of the representation by
the developer that it would be a private, wooded community. He stated
that the proposed cul-de-sac for lots 41-46 in Lake Reynovia would
eliminate Nill Creek's natural privacy. He asked that the cul-de-sac
not be allowed.

Mr. Fritz pointed out that the area about which Mr. Hollins expressed
concern was not a part of Phase 1.
Mr. Hollins expressed concern about buffer areas between all of Reynovia
and Mill Creek's common boundaries.
Mr. Rittenhouse expressed an understanding of Mr. Hollins position; however,
he pointed out that the County "neither disputes nor endorses advertising
by a particular developer --we're not in a position to do that. So what
the developer told you and what you perceive is going to take place, if
they're different things ... it's an issue that the County has no control
over and won't endeavor to have any control over." Mr. Rittenhouse also
noted that the County has not, "traditionally," invoked additional buffering
between such similar uses.
In response to Ms. Huckle's question, Mr. Fritz explained that the Commission
would review the future phases.
Mr. Keeler commented: "This is a proffered zoning. There was a plan
proffered and it's my opinion and Mr. St. John can correct me if I'm
wrong, that the applicant has a right to rely on that plan and I'm
not sure at this time that we can come back and impose buffers and that
sort of thing on a plan that received careful consideration at public
hearings by both the Planning Commission and the Board of Supervisors."
Mr. Hollins asked why he had not received notice of the public hearings
referred to by Mr. Keeler. He did not know of any Mill Creek homeowners
who had received such notice. Staff did not know the answer to this
question.
There being no additional public comment, the matter was placed before
the Commission.
Mr. Michel encouraged the applicant to try to develop similar homeowners'
covenants as those of Mill Creek. Mr. Driver stated he would forward
this suggestion to the applicant. He felt the covenants would be similar
in nature. He noted the only basic difference in the nature of the
subdivision was that Lake Reynovia would have a central recreation
area with a pool and tennis courts.
Mr. Wilkerson moved that the Final Plat for Lakeland at Reynovia be
approved subject to the following conditions:
1. The Final Plat will not be signed until the following conditions
have been met:
a. Planning Staff approval of revised pl
