The Albemarle County Planning Commission held a public
hearing on Tuesday, August 6, 1991, Meeting Room 7, County
Office Building, Charlottesville, Virginia. Those members
present were: Mr. Keith Rittenhouse, Chairman; Mr. Harry
Wilkerson, Vice Chairman; Mr. Phil Grimm; Ms. Ellen
Andersen; Mr. Walter Johnson; and Ms. Babs Huckle. Other
officials present were: Mr. Rich Tarbell, Planner; Mr. Bill
Fritz, Senior Planner; and Mr. Jim Bowling, Deputy County
Attorney. Absent: Commissioner Jenkins.
The Chairman called the meeting to order at 7:00 p.m. and
established that a quorum was present. The minutes of July
23, 1991 were approved as submitted.
ZTA-91-04 Schuyler Enterprises - Petition to amend Section
3.0 to include a definition for truck terminal, and to amend
Section 5.1.33 to provide supplemental regulations for truck
terminal and to include Section 10.2.2(44) which would
provide for truck terminal by special use in the Rural
Areas. Deferred from July 16th Commission Meeting.
The applicant was requesting deferral to August 27th.
Mr. Wilkerson moved, seconded by Mr. Grimm, that the item be
deferred to August 27th. The motion passed unanimously.
SP-PI-21 Schuyler Enterprises - Petition to locate a truck
terminal [use is proposed by ZTA-91-041 on 25 acres zoned
RA, Rural Areas. Property, described as Tax Map 126, part
of Parcel 31A (31F) is located on the south side of the
intersection of Rt. 800 and Rt. 602 in the Scottsville
Magisterial District. This site is not located within a
designated growth area (Rural Area IV). Deferred from July
16th Commission meeting.
The applicant was requesting deferral to August 27th.
Ms. Andersen moved, seconded by Mr. Wilkerson, that the item
be deferred to August 27. The motion passed unanimously.
SUB-91 QQ2 Rosemont Section1. Lots A. S. and C Preliminary
Plat - Proposal to create one additional lot from two
existing parcels totalling 9.8 acres. The lots are proposed
to be served by a private road. Property, described as tax
Map 74, Parcels 49 and 50, is located on the west side of
Rosemont Drive across from Tearose Lane. Zoned RA, Rural
Areas in the Samuel Miller Magisterial district. This site
is not located within a designated growth area.
Mr. Tarbell presented the staff report. Staff recommended
approval subject to conditions,

In response to Mr_ Rittenhouse's question, Mr. Tarbell
confirmed that an easement divided Lot 17 in half. He
explained that because it is an easement dividing the
property, not a dedicated right-of-way, the lot will remain
a contiguous piece of property and will not become (by
Ordinance definition) two separate lots. He stated that the
property owner would have no trouble accessing both portions
of the lot in question. (He compared the situation to
having a driveway in the middle of a yard.) Mr. Rittenhouse
expressed concern about the safety aspect of crossing this
easement. He asked Mr. Tarbell: "Will you want to see a
designated access point when you look at the final plat?"
Mr. Tarbell responded: "I don't think so. ... We will try
to run the easement in a location where there may be an
existing driveway or where it can run with existing
topography so that it doesn't take as much grading." He
added that the purchaser of this lot will see that the
easement exists.
The applicant was represented by Mr. Michael Boggs. He
explained the property had been purchased "to protect our
investment in Rosemont and that of adjoining landowners."
He explained that all adjoining lots have been sold. He
explained that three lots are now proposed instead of four
and minimum lot size is 3 acres rather than 2. He stated a
private road will reduce grading and save more trees.
There being no public comment, the matter was placed before
the Commission.
Mr. Wilkerson moved that Rosemont Section 1, Lots A, B, and
C Preliminary Plat be approved subject to the following
conditions:
1. The final plat shall not be submitted for signature nor
shall it be signed until the following conditions are met:
a. Department of Engineering approval of grading
and drainage plans and calculations;
b. Department of Engineering approval of road and
drainage plans and calculations;
c. Department of Engineering issuance of erosion
control permit;
d. Department of Engineering issuance of a runoff
control permit, if required;
e. Virginia Department of Transportation approval
of right-of-way improvements to include a commercial
entrance;
f. Staff approval of a private road maintenance
agreement;
g. Staff approval. of a road name.

2. Administrative approval of the final plat.
Ms. Huckl�(seconded the motion which passed unanimously.
Referring to ZTA 91-04, Mr. Johnson felt that a definition
for "contractor's office and storage yard" should be
included and this was a good time to make this change. Mr
Fritz indicated that staff would consider this suggestion.
There being no further business, the meeting adjourned at
7 15.
