The Albemarle County Planning Commission held a public
hearing on August 27, 1991, Meeting Room 7, County Office
Building, Charlottesville, Virginia. Those members present
were: Mr. Keith Rittenhouse, Chairman; Mr. Marry Wilkerson.
Vice Chairman; Mr. Tom Jenkins; Mr. Phil Grimm; Ms. Ellen
Andersen; Mr. Walter Johnson; and Ms. Babs Huckle. Other
officials present were: Mr. Wayne Cilimberg, Director of
Planning and Community Development; Mr. David Benish, Chief
of Community Development; and Mr. Ken Baker, Senior Planner.
Absent: County Attorney.
The Chairman called the meeting to order at 7:00 p.m. and
established that a quorum was present. The minutes of
August 6, 1991 were approved as submitted.
ZTA-91-04- Petition to amend Section
3.0 to change the definition of public garage. Deferred
from the August 6, 1991 Commission meeting. Additional
deferral to September 10, 1991 due to advertising
requirements.

iP91-21_ Schuyler Ent!.xori,�ses - Petition to locate a public
garage (this request is being processed concurrently with
ZTA-91-04) on 25 acres zoned RA, Rural Areas. Property,
described as Tax Map 126, part of Parcel 31A (31F) is
located on the south side of the intersection of Rt. 800 and
Rt. 602 in the Scottsville Magisterial District. This site
is not located within a designated growth area. Deferred
from the August 6, 1991 Commission meeting. Additional
deferral to September 10, 1991 due to advertising
requirements.
Both these items were unanimously deferred to September 10,
1991.
CPA-Qy,-02—B1ue_Ridge Neighborhood "Area B" Study - Proposal
to amend the Albemarle County Comprehensive Plan to include
the recommendations of the Blue Ridge Neighborhood "Area B"
Study.
Mr. Cilimberg introduced the topic. Mr. Baker briefly
reviewed the study and the proposed changes to the
Comprehensive Plan.
Ms. Huckle expressed concern about there being too many
entrances onto 1-64_

Mr. Rittenhouse noted the following concerns about the
proposed text changes (pages 170-171 of the Comprehensive
Plan):
--Rewrite the following sentence so that it reads
better: "The Albemarle County Service Authority
jurisdictional area shall remain, but only provide
additional water and sewer services to development is
consistent with the Master Land Utilization Plan."
--Change the word "expansion" to "relocation" in the
following sentence: "`Phis Land Use Map amendment would not
be effective until the Forestry Department undertakes its
glocation in this location."
The following members of the public addressed the
Commission.
Mr. Dan Jordan, representing Monticello -- He
expressed "enthusiastic" support for the study.
Mr. Craig Van de Castle -- He expressed concern about
how this study would ultimately effect the cross country
track at Piedmont Virginia Community College and the
possibility that the track will be lost. He also expressed
concern about the loss of the park -like setting because
there are few such areas left in the county. He asked that
the item be deferred so that further study could be given to
the preservation of the track.
Ms. Peggy Newcomb -- She expressed concern about
endangered wildflowers which will lost if the cross country
track is eliminated. She mentioned particularly goldenrod,
orchids and milkweed.
There being no further comment, the matter was placed before
the Commission.
Mr. Rittenhouse noted that his support of the study was
influenced by Monticello,s endorsement.
Regarding the issue of the cross-country track, Mr.
Rittenhouse noted that the track was on multiple parcels,
with both public and private ownership. He pointed out that
PVCC had chosen not to make an issue of the cross-country
track. Mr. Baker added that PVCC's updated Master Plan will
impact portions of the track, but states that the college
will do all that is possible to minimize the effects on the
track. Mr. Cilimberg suggested that persons interested in
the preservation of the track should meet with individual
landowners over which the course runs and with PVCC to
address their concerns. Mr. Johnson also pointed out that
those interested could present their concerns to the Board
of Supervisors.

Mr. Johnson moved that CPA-91-02 (Blue Ridge Neighborhood
"Area B" Study) be recommended to the Board of Supervisors
for approval as presented in staff's report dated August 27
1991.
Mr. Wilkerson seconded the motion which passed unanimously.
Status of the Comprehensive Plan - Mr. Benish called the
Commission's attention to the draft report which had just
been delivered to the Commission. He very briefly explained
the report and the process staff followed in its
compilation. He stated a work session would be held on
September 18. The Commission did not discuss the report at
this time.
Subdivision Plat Extension Requests - Mr. Cilimberg
explained a memorandum dated August 19, 1991 regarding
subdivision plat extension or reapproval requests. The
recommendation from staff for processing such requests was
as follows:
"The Director of Planning will continue to review
preliminary plat extension requests administratively and
base decisions on circumstances related to unusual delay
beyond the control of the applicant rather than other
factors such as economic hardship and the like. Appeals of
the Director's decisions are available through the Board of
Supervisors. ... When 18 months is expiring, the applicant
will be required to resubmit the final plat on (or before) a
submittal deadline with the appropriate application, fee and
number of copies of the plat. The plat will be considered
as new business with complete review by the Site Review
Committee under ordinance regulations in effect at the time
of resubmittal. Once revisions are received in accordance
with the Site Review Committee recommendations, the plat
will be placed on the Commission's regular agenda for
action." Mr. Cilimberg noted that if no "changes of
consequence in the Ordinance" have occurred since the
original submittal, then the plats may be placed on the
Consent Agenda.
1t was noted that no changes in the Ordinance would be
required.
Mr. Johnson expressed his support for the recommendations of
staff. He asked if the same policy could be applicable to
site plans. Mr. Cilimberg responded affirmatively.

Mr. Jenkins moved that the Commission endorse the policy
statement regarding subdivision plat and site plan extension
requests as presented by staff.
Mr. Wilkerson seconded the motion which passed unanimously.
MISCELLANEOUS
Ms. Huckle was appointed to serve on a committee which will
address the implementation of the Water Resources Protection
Areas Ordinance.
Meals. Tax Referendum - In response to a request from the
Board of Supervisors the Commission expressed their support
for a Meals Tax Referendum being placed on the November
ballot.
Mr. Johnson moved, seconded by Ms. Andersen, to adopt a
resolution in support of the County's Meals Tax Referendum,
the resolution being based on the following: (1) The
Commission is in a position of review and recommendation for
the Capital Improvements Program; (2) The Meals Tax
Referendum is intended to fund Capital Improvements
Projects; and (3) The Commission endorses the placement
the Meals Tax Referendum on the November ballot.
The motion passed unanimously.
The Commission directed staff to develop this resolution and
foward it to the Board of Supervisors.
There being no further business, the meeting adjourned at
8:20 p.m.
