The Albemarle County Planning Commission held a public hearing on
Tuesday, May 16, 1989, Meeting Room 7, County Office Building,
Charlottesville, Virginia. Those members present were: Mr. David
Bowerman, Chairman; Mr. Keith Rittenhouse, Vice Chairman; Mr. Tom
Jenkins; Mr. Harry Wilkerson; Mr. Tim Michel; and Mr. Peter Stark.
Other officials present were: Ms. Amelia Patterson, Senior Planner;
and Mr. .Tames Bowling, Deputy County Attorney. Absent: Commissioner
Diehl.
The Chairman called the meeting to order at 7:30 p.m. and established
that a quorum was present. The minutes of May 2, 1989 were approved
as submitted.
CONSENT AGENDA
Sugar Hollow A riculturalfForestal District - Planning Commission must
refer applications to Advisory Committee.
Mr. Stark moved, seconded by Mr. Wilkerson, that the Consent Agenda
be approved. The motion passed unanimously.
SP-89-29 Robert & Marilyn Brugh - Request in accordance with Section
22.2.2(8) of the Zoning Ordinance to amend Condition #2 of SP-85-14 as it
relates to the type, location and number of vehicles to be located on
the site. Property, described as Tax Map 61A, Section 3, Parcel 2, is
located on the east side of Rt. 29, approximately 600 feet north of
its intersection with Westfield Road. Charlottesville Magisterial
District.
Ms. Patterson presented the staff report. Staff recommended approval
subject to conditions.
The Chairman invited applicant comment.
Mr. Brugh addressed the Commission. He stressed that there was ample
parking on the site for the proposed use. He also noted that there
were many other uses which could .be located on the site which would
generate much more traffic.
There being no public comment, the matter was placed before the
Commission.
Mr. Wilkerson noted that the request was "straightforward" and moved
that SP-89-29 for Robert & Marilyn Brugh be recommended to the Board
of Supervisors for approval subject to the following conditions:

1. Parking of vehicles in accordance with plan marked "SP-89-29 Robert
D. and :Marilyn C. brugh" signed "A.M. Patterson, May 9, 1989."
2. Not more than twenty-two (22) rental passenger vehicles shall he
located on site.
Mr. Stark secondedthe motion which passed unanimously.
ZMA-89-5 Ann Horner - Request to rezone 2.836 acres from R-2, Residential
to Cl, Commercial. Property, described as Tax Map 56A1, Section 1, Parcel
46A is located on the south side of Jarmans Gap Road at the intersection
with Rt. 1201. White Hall Magisterial District.
The applicant was requesting deferral to June 13, 1989.
Mr. Stark moved, seconded by Mr. Wilkerson, that ZMA-89--5 for Ann Horner
be deferred to June 13, 1989. The motion passed unanimously.
SP-89-27 Joseph Terry - Request in accordance with Section 22.2.2(8) of
the Zoning Ordinance for the issuance of.a special use permit to allow
for motor vehicle rentals on property.zoned C1, Commercial. Property,
described as Tax Map 32, Parcel 38A, is located on the west side of Rt. 29
approximately 300 feet north of its intersection with Rt. 649.. Rivanna
Magisterial District.
The applicant was requesting deferral to May 23, 1989.
YLr. Stark moved, seconded by. Mr. Michel, that SP-89-27 for Joseph Terry
be deferred to May 23, 1989. The motion passed unanimously.
SP-89-28 Richard & Geraldine Muller - Request in accordance with Section
10.2.2.28 of the Zoning Ordinance for the issuance of a special use permit
to allow for the transfer of four development rights. Property, described
as Tax :Map 47, Parcel 16, and 16A, is located on the east side of Rt. 20,
adjacent to the Rt. 649-Rt. 20 intersection. Zoned RA, Rural Areas.
Rivanna Magisterial District..
The applicant was requesting deferral to May 23, 1989.
Mr. Stark moved, seconded by Mr..Wilkerson, that SP-89-28 for Richard &
Geraldine Muller be deferred to May 23, 1989. The motion passed unanimously.
The Riggory Preliminary Subdivision Plat — Proposal to create eleven (11)
lots from an existing 70.6 acre parcel. A private road is
proposed to serve these lots. This request is being reviewed concurrent
with a special permit. Property, described as Tax tiap 47, Parcel 16, is
located on the east side of Rt. 20, adjacent to the Rt. 649-Rt. 20
intersection. Zoned RA, Rural Areas. Rivanna Magisterial District.
The applicant was requesting deferral to May 23, 1989.

Mr. Stark moved, seconded by Mr. Michel, that the Riggory Preliminary Sub-
division Plat be deferred to May 23, 1989. The motion passed unanimously.
Sherwood Commons Preliminary Site Plan - Request for Extension.
Ms. Patterson presented the staff report and explained that the applicant
was requesting an additional one year extension to the preliminary plan.
The applicant cited as justification for the extensiou "delays caused by
the planning and installation of water and sewer 1ine.extensions."
Though staff was in support of an extension, they suppoited a shorter period
than that requested by the applicant "due to previous history on this
plan and the fact that the present process could allow an expedited review
such as consent agenda for resubmittal, if the plan expires."
The applicant was represented by Ms. Marcia Joseph. She explained that
it is taking longer to work out some of the issues because of the
number of parties that are involved in various developments. She
stated three of the original conditions of approval have been completed.
There being no public comment, the matter was placed before the Commission.
Mr. Bowerman noted that it appeared that delays were not the fault of
the applicant.
Mr. Michel stated he had no objection to an extension, but he was uncertain
as to how long the extension should be.
Ms. Patterson stated "I'm not sure there is a material difference
between a 6-month or one-year extension, but we just want to see them
proceed."
Mr. Stark moved that the Sherwood Commons Preliminary Site Plan be granted
a six-month extension and that staff be granted administrative approval
of the final plan.
Mr. Wilkerson seconded the motion.
(Mr. Bowerman noted he had no problem with this request but he did not
know if the Commission would be willing to do it again.)
The previously -stated motion passed unanimously.
Pursuant to Section 2.k344(a)G) of the Code of Virginia, Mr. Stark moved
that the Commission go into Executive Session to discuss personnel matters.
Mr. Michel seconded the motion which passed unanimously.
The Commission went into Executive Session at 8:01 p.m.
