HomeMy WebLinkAbout06 28 88 PC Minutesn June 28, 1988 The Albemarle County Planning Commission held a public hearing on Tuesday, June 28, 1988, Meeting Room 7, County Office Building, Charlottesville, Virginia.. Those members present were: Mr. David Bowerman, Chairman; Mr. Keith Rittenhouse; Mr. Tom Jenkins; Mr. Harry Wilkerson; Mr. Tim Michel; and Mr. Peter Stark. Other officials present were: Mr. George St. John, County Attorney; Mr. John Horne, Director of Planning and Community Development; Mr. Ronald Keeler, Chief of Planning; Mr. Bill Fritz, Planner; Mr. John Pullen, Planner; Ms. Amelia Patterson, Planner; and Mr. Steve Cresswell, Assistant County Engineer. Absent: Commissioner Diehl. The Chairman called the meeting to order at 7:30 p.m. and established that a quorum was present. The minutes of June 14, 1988 were approved as submitted. CONSENT AGENDA IBM Office Building Amendment Preliminary Plat - Proposal to locate a 5,000 square foot addition to the existing office building, to total 18,400 square feet. The development will be served by 96 parking spaces. Property is located on the south side of Old Ivy Road (Route 754), just east of its intersection with Route 250 West and adjacent to the C & 0 Railroad. Earlysville Professional Center Final Site Plan - Proposal to locate a 5,280 square foot office building served by 30 parking spaces. 0.865 acres (this proposed Lot C-2). Zoned PUD, Planned Unit Development, designated for commercial use. Property, located off the north side of Rt. 743 (Hydraulic Road) on a private road (extension of the existing driveway) serving the Earlysville Forest Commercial area. Tax Map 31B, Parcel C. Rivanna Magisterial District. The Commission had no objections to staff handling these issues administratively. Mr. Stark moved that the Consent Agenda be adopted. Mr. Wilkerson seconded the motion which passed unanimously. The following three applications were reviewed simultaneously. ZMA-88-7 Branchlands, PUD - Request in accordance with Section 20.2 of the Zoning Ordinance to amend application plan and conditions of SP-80-63 and ZMA-80-26 Branchlands PUD. Property, described as Tax Map 61Z, Sections 3, 4, 5, is located on Greenbrier Drive, off Rt. 29N, within the Branchlands PUD. Zoned PUD, Planned Unit Development. Charlottesville Magisterial District. SP-87-09 Branchlands First & Second Land Trusts - Request in accordance with Section 30.3.5.2.2(3) and 30.3.6 of the Zoning Ordinance to allow the issuance of a special use permit to fill in approximately 40,000 cubic 1 VC, June 28, 1988 Page 2 yards of earth into the floodway fringe of Meadowcreek. Property, described as Tax ;lap 61Z, Parcels 4 and 5 is located on the west side of Branchlands Drive approximately 1/4 mile north of the intersection with Greenbrier Drive, in Branchlands Village. Charlottesville Magisterial District. Zoned PUD, Planned Unit Development. SP-88-4 Republic Homes - Request in accordance with Section 30.3.5.2.2 of the Zoning Ordinance to issue a special use permit to allow for filling in the floodway fringe of an unnamed branch of Meadowcreek. Property, described as Tax ?lap 61Z, Parcel 1, is located on the southeast side of Greenbrier Drive adjacent to Brookmill Subdivision. Charlottesville Magisterial District. Keeler gave a summary of all three reports. The report stated: "Staff opinion is that these changes can be accommodated without adversely affecting adjoining properties or occasioning the need to redesign Hillsdale Drive and Branchlands Blvd. With modifications to land uses as recommended by staff traffic would not increase." Changes in the Application Plan included: "Increase in total dwellings; Increase/reallocation of commercial areas; Inclusion of certain improvements from the unified drainage plan; Deletion of Access Road 2; and Changes to pedestrian/bikeway requirements." Staff recommended approval of all three applications subject to conditions, including modifications and deletions of conditions outlined by the applicant for ZMA-88-07. Mr. Keeler noted the following corrections to the staff report: --Page 2, last sentence of fourth paragraph: "With modifications to land uses as recommended by staff trafficwould not increase." ---Page 2, under item "l.": BEEFTH-A--2- MAINTAIN EXISTING A..2 Mr. Keeler noted that the applicants were in agreement with the modifications recommended by staff. ir. Keeler confirmed that the increase from 82 to 106 dwellings was "reflective of the bonus density in the Ordinance." The Chairman invited applicant comment. The applicants were represented by Mr. Ronald Langman, Mr. Houser and Mr. Hill. They offered little comment. There being no public comment, the natter was placed before the Commission. Mr. Bowerman stated he had reviewed the proposal and felt that it "not only keeps the spirit of what we tried to do in 1981 intact, but simplifies the development of that parcel." He stated he agreed with the land use June 28, 1988 Page 3 changes because he felt they were in the interests of the County and also in the interests of both the church and the PUD because of the "lower intensity usage next to them." He also noted that the vehicle trips/day would not increase. He concluded he had no problems with any of the recommended changes. In response to Mr. Michel's question, Mr. Horne stated "channel improvements will be on the unnamed tributary that goes up through the Branchlands area." He confirmed that the City and the County recognize that there are problems on that creek. Mr. Michel noted that a "vague" retention area was shown on the plan. Mr. Horne commented: "It's going to be partially filled and developed as part of Brookmill's future phases. A lot of that vagueness was addressed with the first phase of Brookmill where there was some proposed detention and some channel improvements in the upper reaches of that tributary. I think we have a lot -better idea now than we did then what's truly going to be necessary to handle the stormwater that's there and it's not proposed to be detention or retention down along Meadowcreek itself." Mr. Michel moved that ZMA-88-7 for Branchlands PUD be recommended to the Board of Supervisors for approval subject to the conditions set forth in Attachment 1 of these minutes, and also that SP-87-09 for Branchlands First & Second Land Trusts and SP-88-4 for Republic Homes be recommended to the Board of Supervisors for approval subject to the following conditions: a. County Engineer approval in accordance with requirements of 30.3 FLOOD HAZARD OVERLAY DISTRICT simultaneous with approval of unified drainage plan; b. Approval of appropriate local state and federal agencies; c. All channel improvements within Brookmill (Area D) to be accomplished at time of any filling in the floodplain under SP-88-04 Republic Homes. Mr. Stark seconded the motion which passed unanimously. All three items were to be heard by the Board on July 7, 1988. Albemarle County Fair Preliminary Site Plan - Proposal to locate the County Fair on 50 acres for a temporary event during a year period. Property is located on the north side of Route 692, just west of its intersection with Route 29 South. Zoned RA, Rural Areas with SP-87-109 Albemarle County Fair, Inc. Tax Map 87, Parcel 3. Samuel Miller Magisterial. District. Ms. Patterson gave the staff report. She noted the.following change in suggested condition l(d): "Health Department approval of well and septic system field." Staff recomended approval subject to conditions. Mr. Bowerman asked if the Commission would see the final. Ms. Patterson replied negatively and explained:"The intent here is that this will serve like a site plan waiver." Mr. Keeler added that the condition on the special use permit was "Planning Commission approval of the preliminary site plan." Mr. Bowerman indicated understanding. June 28, 1988 Page 4 The Chairman invited applicant comment. The applicant was represented by.Mr. Jim Crosby. He indicated no problems with staff"s conditions of approval. He offered little additional comment. There being no public comment, the matter was placed before the Commission. Mr. Bowerman noted that Chief Johnstone`s plan met all the concerns about traffic problems. He stated this had been the major concern at the.time of the first approval. Mr. Jenkins moved that the Albemarle County Fair Preliminary Site Plan be approved subject to the following conditions: 1. Final site plan approval shall not be given until the following conditions have been met: a. Department of Engineering approval of grading and drainage plans and calculations; b. Department of Engineering issuance of an erosion control permit; c. Virginia Department of Transportation approval of right-of-way improvements and issuance of a commercial entrance permit; d. Health Department approval of well and septic system. 2. The stream bank shall be fenced prior to the fair opening to the public. 3. Compliance with conditions of SP-87-109 Albemarle County Fair. Mr. 'Kichel seconded the motion which passed unanimously. Clason Land Trust Preliminary Plat - Proposal to create twenty (20) lots from two (2) existing parcels. Ten (10) lots are proposed under 21 acres and ranging from 2.06 to 3.02 acres in size; ten (10) lots are proposed to be a minimum of 21 acres ranging from 21.25 to 23.5 acres. The ten (10) smaller lots and two (2) large lots are to be served by a proposed public road. Property is located on the south side of Route 708 West, just east of the intersection with Route 710 and across from Blandemar. Zoned RA, Rural Areas. Tax Map 87, Parcels 16 and 17. Samuel Miller Magisterial District. (Mr. Michel disqualified himself from hearing this petition.) Mr. Pullen gave the staff report. Staff recommended approval subject to conditions. Mr. Bowerman asked if there were any situations where.an agricultural/forestal district could effect the development of this type of subdivision. Mr. Pullen explained that in terms of a legislative act (e.g. a zoning amendment ox a special permit) the Commission would have more discretion, but this is a by -right subdivision, and the proximity of the ag-forestal district is immaterial. yIr. Horne confirmed this was correct. He added, however, that "if for some reason a particular improvement in any subdivision is immediately adjacent, not just to an agricultural district, but to an active agricultural area, you do have some discretion to require additional buffering or screening if it seems necessary in an individual case." I,e June 28, 1988 Page 5 The Chairman invited applicant comment. The applicant was represented by Mr. Charles Denny. He offered little additional comment. There being no public comment, the matter was placed before the Commission. Mr. Wilkerson moved that the Clason Land Trust Preliminary Plat be approved subject to the following conditions: 1. The final plat shall be reviewed by the Planning Commission. 2. The final plat shall not be signed until the following conditions have been met: a. County Engineer approval of grading and drainage plans and calcu- lations; b. Issuance of an erosion control permit; c. Virginia Department of Transportation approval of road and drainage plans and calculations; to include commercial entrance and a.100-foot long taper lane; d. Health Department approval of soil scientist study; e. County Attorney approval of maintenance agreements between Lots 1 and 10, and 19 and 20; f. Planning staff approval of technical notes on the plat. Mr. Stark seconded the motion which passed unanimously. (Mr. Michel returned to the meeting.) Ranier (Richard Walden) Preliminary Plat - Proposal to create six (6) lots served by a proposed private road. All lots are a minimum of 21 acres, with lot size ranging from 21.3 to 36.5 acres. Property is located on the west side of Route 708 West, across from the intersection with Route 710. Zoned RA, Rural Areas. Tax Map 87, Parcel 13. Samuel Miller Magisterial District. Mr. Fritz gave the staff report. Staff recommended approval subject to conditions. Mr. Fritz added: "This case is a bit unique in that you do have some discretion since private roads are the exception to the rule because of its proximity to the forestal district --to request a private road at this point. It is a discretionary action to permit a private road." He added that staff felt there was no public benefit to be derived from having a public road serving six large lots. He confirmed that the proposal met all the requirements of the Private Road Ordinance. The Chairman invited applicant comment. Mr. Walden addressed the Commission. He stated he also owned the farm to the north and he had no plans to subdivide. There being no public comment,. the matter was placed before the Commission. Mr. Jenkins moved that the Ranier (Richard Walden) Preliminary Plat be approved subject to the following conditions: June 28, 1988 Page 6 1. The Final Plat shall be reviewed by the Planning Commission. 2. The Final Plat will not be signed until the following conditions have been met: a. Health Department approval; b. County Engineer approval of road and drainage plans and calculations to include approval of horizontal and vertical alignment for a possible public road located within the proposed 50' access easement; c. County Engineer issuance of an erosion control permit for roadways, dam and lake; d. County Attorney approval of :maintenance agreement for private roads and dam if necessary; e. Virginia Department of Transportation approval of entrance. Wilkerson seconded the motion which passed unanimously.. Additions to Keswick and Moormans River Agricultural/Forestal Districts -- Planning Commission must refer the two agricultural/forestal district applications to the Advisory Committee for its revieaT.and recommendations. -Mr. Horne presented the applications to the Commission and asked that they refer them to the Advisory Committee. ur. Stark moved that the Keswick and Moormans River Agricultural/Forestal Districts additions be referred to the Advisory Committee. Mr. :Michel seconded the emotion which passed unanimously.
