[14-302(A)(10) and 18-10.3.1] In accordance with Section 10.3.1 of the Zoning Ordinance the acreages of the proposed lots will need to be adjusted to conform with the 31-acre rule. The notes on the plat recorded on May 27, 1998 in Deed Book 1712 pages 711-715 suggest that Parcel A (TMP 21A-2A) was assigned two development rights and when used shall not total more than 4 acres. This means that the 5-acre Lot 1 will need to be reduced to 4 acres or less. 3. [14-302(A)(10) and 18-10.3.1] Please include a note regarding the rights of further division of the proposed lots. A subdivision of any parcel less than 21 acres in size requires a development right. There are two possible ways to distribute the development rights. a. Reduce Lot Ito 4 acres and assign it 2 development rights. The required note on the plat would read: Lot 1 is assigned two (2) development rights and may be further divided. Lot 2 may not be further divided. b. Reduce Lot 1 to 2 acres and assign each of the lots a development right. The required note on the plat would read: Lot 1 is assigned one (1) development right and may not be further divided. Lot 2 is assigned one (1) development right and when further divided it shall not consist of more than 2 acres. 4. [14-302(B)(1)] Please include a date of revision. 5. [14-302(B)(10)] Please include the note: "The stream buffer(s) shown hereon shall be managed in accordance with the Albemarle County Water Protection Ordinance." 6. [14-310] Health Director Approval. This Plat requires approval from the Health Director before final approval.
